Publication of the amendment of the Executive Order for Nature and Environmental Projects
§ 1
Notice no. 930 of 16. July 2010 on subsidies for nature and environmental projects are amended as follows :
1. All in the notice, 'Food business' is replaced by the 'Natural Business Authority' and 'Food Erenuces' to : 'The Natural Business'.
2. After Section 3 is inserted in Chapter 2 :
" § 3a. For the purposes of a programme group, this notice shall mean a group consisting of a region and one or more of the municipalities of the region in question, which has drawn up a regional programme, cf. paragraph 2, and for which group of the Natural Business Authority has set out a special indicative EU co-financing framework within which participants of the programme group can grant national public cofinancing to projects sought for grants under this announcement.
Paragraph 2. For the purposes of a regional programme, the publication of a programme drawn up by a programme group and which forms the basis for a decision on whether or not one or more of the participants in the programme group will grant national public cofinancing to : projects under one or more of the following notices issued in accordance with the rural area :
1) Compilation of grants for network activities and subsidies for the promotion of food derived from an EU-quality system.
2) Publication of subsidies for nature and environmental projects.
3) Announceance on subsidies for the development and demonstration of primary agricultural use and processing in the food sector.
4) Publication of grants to projects relating to the creation of new jobs in rural areas.
5) Publication of grants to attractive living conditions in rural areas. `
3. The headline to section 4 is deleted.
4. § 4 revoked.
5. As heading to § 5 inserted :

6. Section 5 (5). 2, ITREAS :

8. The following paragraph 8 is added as new :
" Chapter 3a
Specific concerning projects covered by special envelope for co-financing from regions and municipalities
§ 8a. In 2012 and 2013, the National Security Agency will launch an indicative framework for EU funds for projects for which national public cofinancing is provided by the programme group. The Benefit Agency shall publish each calendar year the indicative framework for EU funds for each programme group on the Board of Direction. The publication shall be published no later than one month before the first draft application.
Paragraph 2. By way of derogation from Section 6, paragraph ONE, ONE. a period shall apply for commitments to grants under one of the provisions of paragraph 1. 1 covered special indicative frameworks for EU funds shall be sent to the Natural Acquisitions Agency, through the programme group providing national public cofinancing. The application must be submitted in a special application form which is available through the Home page of the Natural Acquilite.
Paragraph 3. By way of derogation from Section 6, paragraph Applications for grants under the provisions of paragraph 2 shall be 2 and 3. 1 covered special indicative frameworks for EU funds have been received in the Natural Acquisitions Management Board no later than 1. May, 1. July or 1. -October. However, in 2013, the application for a commitment to grant must be received in the Natural Acquisitional Management Board no later than 1. March, 1. May, 1. July, or 1. September. In cases where the application deadline falls on a Saturday, Sunday, Monday or a holiday, the application deadline shall expire on the second weekday (Saturday not counting) that follows thereafter. The application may not be submitted after the 1. September, 2013.
Paragraph 4. The Program Group shall forward all received applications to the Natural Acquire Management Board prior to the next application period, cf. paragraph 3. The Program Group will select one of the participants in the group to preclaim the submission of applications for the Natural Business Authority and shall inform the Office of the Natural Business Authority on the choice. The programme group shall at the same time inform each application in which national public co-financing is provided and with what amounts.
§ 8b. By way of derogation from Article 8, the Natural Acquisition Management Board shall decide whether grants or refused for this provision in cases covered by Section 8a.
Paragraph 2. Notwithstanding paragraph 7, paragraph 7. 1, the Benefit of Natural Acquities shall give priority to the applications covered by Article 8a on the basis of an assessment of the project ' s purpose and an assessment of the overall cost of the project. If the rejected framework does not allow for the application of all applications, they shall be given a commitment to the highest priority.
Paragraph 3. Notwithstanding paragraph 7, paragraph 7. 2, may the Office of Natural Acquidite take a decision on subparagraphs or partially rejected for applications covered by § 8a, if the Benefit of the Natural Acquidite Board,
1) the effect of the project to be insufficient to meet the purpose of the scheme is not adequately covered by the project ;
2) that the effect of the project submitted is not sufficiently in relation to the overall cost of the project, or
3) that the estimated expenditure is not reasonable. ` ;
9. The following paragraphs 24 and before Chapter 6 are inserted :
" § 24a. It is a condition of assurance of grants, that
1) the applicant ' s application shall state whether projects are covered by a contract covered by the EU procurement rules or the rules of the contract law ; and
2) tille shaver if the project is covered by a contract covered by the EU procurement rules or the rules of procedure, holds documents that document that the EU procurement rules or the rules of the contract have been complied with, available for at least five years from ; the date of final payment. `
10. I § 25, paragraph. 1, no. 3, section 25, paragraph. 2, section 27, paragraph. 1, no. 6, section 27, paragraph. 3, section 28 (3). 1, no. 6, section 28 (4). 3, section 29, paragraph. 1, no. 6, and section 29 (3). 2 and 3, the following shall be added after ' salary to ` : ' tilashshavers `.
11. I § 27, paragraph. 1, no. 6, section 27, paragraph. 3, section 29, paragraph. 1, no. 6, and section 29 (3). 2, the words ' including pay for the own work of the Saver shall be deleted ; '.
12. § 25, paragraph. 2, no. Paragraph 1, section 27, paragraph. 3, no. Paragraph 1, section 28 (1). 3, no. Paragraph 1, section 29, paragraph. 2, no. 1, ITREAS :
" 1) the costs may be documented by invoice or equivalent documentation and these costs are not normally funded by public institutions, public undertakings or local authorities, "
13. The following section 33 and before Chapter 9 is inserted :
" § 33a. The National Services Agency may reduce the total value of the eligible cost of a project if the Management Board considers that the EU procurement rules or the rules of the tender have not been complied with. The subsidy will be set up, based on an assessment of the nature and causation of the infringement, and on the basis of an assessment of the financial loss to the European Agricultural Fund for Rural Development (EAFUL), which is considered to be associated with it. ` ;
14. I § 37 inserted after paragraph 1. 1 as new paragraph :
" Stop. 2. Notwithstanding paragraph 1 1 may maintain the defendant, even though the condition is in section 24a, nr. The Agency shall not be satisfied if the FDA considers that the failure to comply with the condition is not essential. ` ;
Paragraph 2 is then referred to in paragraph 2. 3.
15. Chapter 13 revoked.
§ 2
Paragraph 1. The announcement shall enter into force on 1. April 2012.
