Publication of payment for the control of food, feed and live animals and so on. 1)

Chapter 1

Area

§ 1. The compost shall comprise the payment of a levy for the financing of the control and provision of checks and assistance for export, including inspection, authorisation, registration, approval, notification, certification and examination in relation to food, feed ; live animals and establishments, equipment and products, including non-food products, and not animal products.

§ 2. Payment in the following areas shall not be covered by the notice :

1) Payment for control, etc., in accordance with the notice of the international carriage of perishable foodstuffs.

2) Payment for the application setting maximum residue levels for pesticide residues in plant and animal products.

Chapter 2

Checks in slaughterhouses with fixed-manning

§ 3. Undertakings which, in accordance with food law, are authorised for slaughter, which are not covered by Section 22, shall pay for the checks carried out by the Food Authority under this chapter.

§ 4. The payment referred to in section 3 shall be calculated on the basis of established direct and joint control costs.

Paragraph 2. Direct control costs on each business include wages and so on to the inspection staff and the costs of laboratory testing and administrative expenditure in connection with the control execution of the control at the individual company.

Paragraph 3. The salary part shall be calculated on the basis of the recorded hourly usage multiplied by a standard hourly rate for the relevant personnel category. The standard hourly rate will be recalculated according to each quarter, based on the total cost of the total payroll costs of all of the section 3 involved in the quarterly basis. Furthermore, in the payroll part, wages are included in sickness which are not covered by paragraph 1. 4.

Paragraph 4. The following joint costs shall be distributed between undertakings in relation to their direct control costs :

1) Costs associated with administration of the control.

2) Expenditure resulting from the payment of on-call pay or the waiting money to be made redundant by senior auditors.

3) The cost of and related to the participation of the on-board inspection staff, including training for inspection staff for supervisors who are employed for the purpose of training.

4) Costs of and related cooperation representatives, representatives of trustees and of the security representatives in courses and meetings necessary for the operations of the functions concerned and the costs of inspection staff, which are granted freedom of pay to other professional activities.

5) Costs associated with the remuneration of the control staff on maternity leave or parental leave.

6) Costs associated with the remuneration of inspection staff who are on sick leave and where the employer is entitled to reimbursement after the sickness benefits section of Section 54 (4). 1.

7) Expenditure associated with the driving between slaughterhouses with fixed staffing, including wages and so on to the inspection staff during the run.

8) Administrative contributions to the Agency for Health and Safety Management and the compensation provided for in the case of work accidents.

9) Other expenditure as : Move Allowance, AER contribution, AES contribution, Flexjob pool contributions, and non-all-prehenATP contributions.

10) Expenditure associated with the Food Management Action to improve the working environment at slaughterhouses with fixed staffing.

11) Expenditure related to the work of the Food Management Agency for the conversion and advice of the staff of the staff, as well as expenses related to and associated with the participation of the control staff in management development activities and basic courses for the staff of the Food Management Board.

§ 6. Control on live animals and certain products, etc.

§ 7. § 14. § 18. § 19. 20. § 24. Where, in the case of a business covered by this Chapter, additional checks are carried out (follow-up checks), including tighter checks, after compliance with the law on food, of the ecological law or by law on animals of animals, of : Whereas, pursuant to the laws, regulations or Community rules laid down in the territory of the Community, the following charges shall be paid for the additional costs associated with the monitoring of the costs :

1) For the checks carried out, the rates referred to in section 20 are paid.

2) To perform additional checks on an opening, a ban or a penalty shall be paid on the basis of the following item : 1 shall be a fee of 1 934 kr. to cover the additional processing costs associated with it. Paragraph 2. Payment shall be levior in accordance with the rules laid down in Article 28 of the Regulation (EC) No 2. (2) 882/2004) or undertakings responsible for non-compliance, provided that such establishments or those undertakings are situated in Denmark. Otherwise, the payment of the owner or holder of the products in question shall be charged at the time of the extraction of the additional checks.

Chapter 5

Import control and IUU checking

§ 29. for the control of imports of live animals and products of animal origin, etc., food, including certain non-food products covered by import restrictions, as well as materials and articles intended for contact with food, from countries or areas that are not Members of the European Union (third countries) shall be paid, cf. however, paragraph 1 Five-seven, a basic fee of 346 kr., 50 5 kroner. per initiated 15 minutes.

Paragraph 5. No charge shall be paid in relation to imports from the following countries : Norway, Switzerland, Liechtenstein, Andorra and San Marino as well as for fish and fish products and bivalve molluscs, echinoders, tunicates and marine snails, and also the Faroes and Iceland.

Paragraph 6. For the import control of fresh fish and fishery products which are directly from the sea from cold and factory vessels, and shall be paid no matter where paragraph is taken. 1 a basic fee of 346 kr; for which DKK 699 kr. per started class.

Paragraph 7. However, for the control of live animals and products of animal origin and other products of animal origin in New Zealand, they shall be paid no more than paragraph 1. 1 the following charges.

Paragraph 2. In the case of tighter checks, it shall be paid for the period of time after paragraph 29 (3). 1 and, where appropriate, laboratory examinations referred to in Chapter 8.

§ 32. The costs of handling and possible storage of products and the housing and storage of live animals in the control of the Food Authority shall be inapplicable to the Food Authority.

§ 33. For the purpose of financing of the IUU control in respect of the import of fish and fishery products from third countries and in the case of the re-export of such items, DKK 296 kr. per catch state test, cf. however, paragraph 1 2-3.

Paragraph 2. However, for imports of fish and fishery products from low-risk countries, however, only 184 kr. per the catch-state test.

Paragraph 3. Paragraph 1-2 shall not apply to imports at direct landing.

Paragraph 4. A low-risk country means a flag State whose catches are subjected to checks and verification by a lower frequency than the standard and whose products are physically controlled by a lower frequency than standard on the basis of the national or of ; The EU established risk assessment.

Paragraph 5. The following countries are considered to be a low-risk country : Norway.

Chapter 6

Verification of certain substances and residues in live animals and certain animal products

§ 34. To cover the costs of verifying certain substances and residues in slaughter and meat and fish, milk and eggs, carried out in accordance with the notice of certain contaminants in foodstuffs and the application of the animal-owners of the animal ; medicinal products for animals, as well as official controls and the self-determination of food business operators, shall be subject to the following charges :

1) Entities in which the slaughter of livestock or farmed game is carried out or where the slaughter of animals takes place, 14.35 kr. per Meat.

2) Aquaculture, where fish are produced, $22.98 is paid. per tonnes of net oproduced fish. Net production means the weight of the fragged fish deducted from the weight of the fish to the fish. Animal by-products are not included in the net production.

3) Entities receiving milk from livestock directly from milk producers for use as a food supply of food shall pay 0,18 kr. per A thousand in unprocessed raw milk.

4) Gluas and chicken coats from which eggs are sold directly to human consumption shall pay EUR 10.37 kr. per tonnes of eggs produced or packed in the establishment.

$35. The establishments referred to in Article 34 shall report to the Food Service Management Board no later than one month after a quarter of the end of the production of the product in the previous quarter. However, for the marketing of fish-producing farms, only 1 January of the year for the previous year shall be reported annually. On the basis of the notification, a charge of charges shall be collected by a charge. The deposit shall be made within 30 days of the submission of the collection.

Paragraph 2. Tax amount that amounts to less than 25 kr. is not required.

Chapter 7

Notification and approval etc. in the matter of food

Paragraph 5. Companies which, in accordance with Regulation (EC) No, of the European Parliament and of the Council, The 258/97 on novel foods and novel food ingredients shall apply for the approval of novel foods and food ingredients, pay a fee for the actual costs incurred by the processing of the case, calculated on the basis of applied, Case processing time. Chapter 8

Laboratory examinations, etc.

§ 38. The charges referred to in Annex 3 shall be paid for laboratory examinations carried out by the Food Management Laboratory laboratories when these studies are not an indentation in ordinary checks after sections 20 to 23 or 29.

§ 39. For the control of protein content in skins for exports, they are paying the enlisted undertakings in accordance with Annex 3.

§ 40. For quality control with deliveries of canned goods under the World Food Programme (World Food Programme), the analyses carried out in accordance with Annex 3.

Chapter 9

The control of feed and feed business, etc.

§ 41. Feedingstuffs which, in accordance with the publication of feed and feed business, are subject to registration or approval, shall pay the fees and charges referred to in this chapter to cover the costs incurred by the Food Management Board ; administration and control, etc., in accordance with the law of animal feed, notification of feed and feed business operators and the European Union regulations on matters covered by that law.

Paragraph 2. Accredited control bodies that carry out auditing of the quality system for the feed business must pay the rates referred to in Section 53 to cover the cost of the Food Management expenditure on ongoing supervision, instruction and supervision, etc., in accordance with the notification of feed and feed business and the Regulation (EC) No 882/2004 of the European Parliament and of the Council of 29. April 2004 on official control for the verification of compliance with feed and food law and animal health and animal welfare rules.

Application fee

§ 42. For the application for registration or approval pursuant to section 14 of the notice of feed and feed business, feed establishments, other than those engaged exclusively in primary production, shall pay a fee of $518 kr.

Annual Tax

§ 43. Feedingstuffs, other than companies which have activities alone as set out in paragraph 1. 2 or paragraph 1. 3, shall pay a yearly fee of 2.074 kr. per unit, cf. Section 14, paragraph 14. 5, in the notice of feed and feed business. However, for feed establishments whose income for the sale or handling of feedingstuffs in the preceding calendar year does not exceed 50 000, the amount shall be reduced to 202 kr.

Paragraph 2. Feedingstuffs that transport feed alone must be taken by the animal feed. unit pay an annual tax of 1.556 kr. However, for undertakings whose income from handling feedingstuffs in the preceding calendar year does not exceed 50 000, the amount shall be reduced to 202 kr.

Paragraph 3. Feedingstuffs which use premixtures or feed additives in pure form shall have to be used by the animal (s) per year. CVR no. or CPR no. pay an annual charge of $1,556 kr.

Paragraph 4. Where the unit of a feed business is in accordance with paragraph 1. One-point-three, pay another annual charges for the same unit, paid for the first charge of the most expensive category.

§ 44. Feedingstuffs which are registered or approved only part of the year may not require the refund or reduction of the annual tax.

Volume tax, etc.

Production

§ 45. Feedingstuffs which produce premixtures shall pay a quantity tax of DKK 903. per full 100 tonnes of dry matter for the feed materials included in the feed produced. However, in the case of feedingstuffs exported to third countries, the amount shall be reduced to 398 kr.

Paragraph 2. Feedingstuffs which produce compound feedingstuffs, except for compound feedingstuffs, shall pay a quantity of DKK 93.50. per full 100 tonnes of dry matter for the feed materials included in the feed produced. However, in the case of feedingstuffs exported to third countries, the amount shall be reduced to 398 kr.

Paragraph 3. Feedingstuffs which produce compound feedingstuffs must pay a quantity of DKK 451 kr. per full 100 tonnes of dry matter for the feed materials included in the feed produced. However, in the case of feedingstuffs exported to third countries, the amount shall be reduced to DKK 298 kr.

Paragraph 4. In the case of feedingstuffs, this notice shall mean products as defined in Regulation (EC) No 2 of the European Parliament and of the Council. 767/2009 of 13. July 2009 on the marketing and use of animal feed, amendment of Regulation (EC) No 2 of the European Parliament and of the Council. 1831/2003 and repeal Council Directive 79 /373/EEC, Commission Directive 80 /511/EEC, Council Directive 82 /4 7 1 / EEC, 83 /228/EEC, 93 /74/EEC, 93 /1113/EC and 96 /25/EC and Commission Decision 2004 /217/EC, excluding cereals from barley, wheat, oats, rye and triticale and processed products thereof.

§ 46. Feedingstuffs producing food additives must pay a quantity of tax of 13.8 kr. per full 100 kilograms : for the additives in feed additives. However, in the case of feedingstuffs exported to third countries, the amount shall be reduced to 8.96 kr.

Trade and Export

§ 47. Feedingstuffs which sell feed materials to end-user in this country or to other EU countries must pay a quantity tax of DKK 93.50. per Full 100 tons of dry matter for the feed materials sold. In the case of feed materials exported to third countries, a quantity tax of 398 kr is payable. per Full 100 tons of dry stuff.

Paragraph 2. Feedingstuffs which either import or from another EU country feed on feed must pay a quantity tax of DKK 903. per full 100 tonnes of dry matter for feed materials included in the imported or imported feed.

Paragraph 3. Feedingstuffs which, for use on their own farm, either import, or from another EU country, import feed materials, compound feedingstuffs or premixtures, shall pay a quantity tax of DKK 93.50. per full 100 tonnes of dry matter for the feed materials concerned.

Paragraph 4. Feedingstuffs, including those engaged in primary production, either importing or from another EU country, use feed, or by means of sale or by use on their own holdings, pay a quantity tax of 13.8 kr. per full 100 kilograms, dry matter of feed additives in clean form and the feed additives included in the imported or imported feed.

§ 48. The exception of the fee shall be feed materials or feed additives which have previously released the FDA in the case of turnover within the EU.

Paragraph 2. Feedinges inextricably released a fee to the Food Authority on export shall be subject to the reintroduction into Denmark for a fee equal to the difference between the price of feed sold to non-EU and feed materials sold within the Community ; EU.

Reporting

§ 49. Feedingstuffs must, at the request of the Food Authority and by a deadline set by the Management Board, provide to the Management Board the information on the company ' s import, trade, production and sale at the latest completed calendar year necessary for : the calculation of the quantity tax and the determination of the annual charge. The Management Board may request additional information and documentation.

Paragraph 2. Report pursuant to paragraph 1. 1 shall be digitally in accordance with the detailed instructions of the Food Management Board.

Paragraph 3. In the case of an undertaking to notify the Management Board the necessary information within the time limit laid down, the Management Board shall determine the basis for the quantity fees estimated.

Paragraph 4. The FDA controls the reported information.

New Companies

$50. For the first time, for feed establishments approved or registered for the first time, the annual volume charges shall be calculated for the period from the entry or registration of the registration and to the end of the calendar year in question on the basis of the establishment ' s premises ; information on expected import, trade and sales in the period concerned.

Paragraph 2. In the company's second registration year, the quantity fees shall be calculated to cover the control over this calendar year on the basis of the company's information on expected imports, trade and sales throughout the calendar year.

Paragraph 3. From the company ' s third registration year, the quantity charges shall be calculated in the current calendar year on the basis of the company ' s information concerning actual imports, trade and sales in the immediate preceding year.

The levying of a levy and cessation of activities, etc.

§ 51. The annual volume charges shall be levion of the person who is the owner of the establishment at the time of collection.

Paragraph 2. Feedingstuffs, resulting from cessation of notification of their approval or registration in the course of the calendar year, shall be reimbursed to quantities corresponding to that part of the calendar year, where the company no longer has any activity, if : the termination or expected termination of feed establishments shall be received by the Food and Food Authority at the latest by 31. December, in the year in question.

Paragraph 3. The company transfer during the calendar year does not cause a refund to be reimbursed.

Reduction quantity tax

§ 52. Feedingstuffs, which have been assessed by the Food Authority, to comply with the requirements of Regulation (EC) No 2 of the European Parliament and of the Council. 183/2005 of 12. In January 2005 on requirements for feed hygiene, a reduction of 5% shall be achieved. the quantity of animal feed on feed materials or additives.

Paragraph 2. The amount of the quantity of the quantity shall be calculated by the feed materials included in the feed. In cases where the calculated fee amounts to such a large amount of money in relation to the feed materials or feed additives, the feed business is in the context of the annual report in accordance with the annual report. § 53. § 54. Food business establishments which have also been approved or registered as feed establishments in accordance with the notice of feed and feed business, because they sell by-products for use as feed, pay for checks in accordance with Chapter 4.

Third-party auditing payment

§ 55. Accredited inspection bodies which, in accordance with Chapter 10 of the notice of feed and feed business, apply the Food Authority for approval to carry out the management of the steering control (s) of the quality assurance system of the feed undertaking, pay the hourly rates specified in section 53 for the time spent by the Food Management Committee in connection with the examination of the application.

§ 56. Feedingstuffs must pay the time-needed hours for the time spent by the Food Management Agency for the management visits of the Management Board to ensure that inspection visits are carried out.

Exceptions and wastes

§ 57. Where, in a business or holding subject, the following checks are carried out (the following checks are carried out) after notification of non-compliance with the law on feedingstuffs, on the law of food, of the ecological law, of the notices issued under the terms of the law on animal nutrition, the tariff rules referred to in section 53 shall be paid for the said laws or rules of the European Union.

§ 58. Payment after this chapter decreens by claims and payment shall be made within 30 days of the date of the invoice.

Chapter 10

Checks carried out by special units of the Food Management Agency and in particular the control of food supplements

$59. Enterprises approved for the export of meat and meat products to the United States shall pay the costs of the operation of the auditory unit.

Paragraph 2. The cost of the audits shall be distributed among the companies involved in the consumption of the time used at the time of the individual company and is to be collected quarterly.

§ 60. Undertakings, as provided for in Chapters 2 and sections 20 and 24 pay for ordinary checks, pay in accordance with. Section 45 (3). 8-9, in the case of food for partial financing of the travel team in the Food Management Travel Team, in the field of investigation and accounting auditing an annual tax of 570 kr. Paragraph 2. Paragraph 1 shall not apply to establishments covered by Section 21 (Retail Company).

Paragraph 3. § 61. Chapter 11

Assistance in connection with exports

§ 62. § 63. Chapter 12

The check carried out by the National Business Authority

§ 64. For the control of fish and fishery products from vessels, including factory vessels, Iceland, Norway or the Faroe Islands, for consumption, processing, or further shipment, 19.7 DKK 19.7. per tonnes for fish and fish products which are directly from the sea from a vessel when it comes to quantities up to 50 tonnes and 9,88 kr. per tons of crowds over here. § 65. Chapter 13

Pensation

§ 68. In compliance with EU rules for the financing of veterinary examinations, the Food Authority may, in particular cases, reduce, in particular cases, the payment of control fees.

Chapter 14

Entry into force and so on.

§ 69. The announcement shall enter into force on 1. January 2013.
