Publication of the amendment of the payment order and so on to institutions for vocational training and so on.

(Flexible classroom for 28 students at the high school graduates)

§ 1

Notice no. 638 of 3. July 2003 on subsidy payments and so on to institutions for vocational training, etc., as last amended by Notice No 1137 of 5. December 2011, the following changes are made :

Law Order no. 861 of 5. July 2010, as amended by Section 4 of Law No 469 of 29. May 2012, in accordance with section 10, on the guidelines on training and occupation, as well as the duty to education, employment, etc., cf. Law Order no. 671 of 21. June 2010, "

2. The following section 16 is inserted :

" Chapter 2 a

Account and deviation of the grant of a grant of a maximum average class quota of 28.0 students at each class step at the high school full-time training

Statement and reporting of the class votenor

§ 16 a. The institution shall dissolve the average class quota, cf. Section 15 (b) (b) 1 and 2, in the law of the institutions for vocational training and section 39 a (1), 1, in the law of education and training for the higher the commercial sector (hhx) and the higher technical degree ("htx") on each class step of each of the high school full-time training provided by the institution. If the institution has several tender points, the class quota shall be discharged to all the tender parts of the public. Where a section of an institution is covered by the Annex 2 of the notice and the institution of the department is using the derogation option under section 16 d, the class quota shall be separately collected for the department.

Paragraph 2. High school full-time training comprises :

1) The three-year education for the higher the trade sector (hhx), including pre-IB.

2) The three-year training for the higher technical degree (htx), including pre-IB.

Paragraph 3. The institution shall discernise the average class votient by the total number of students taken at the individual high school full-time training, cf. paragraph 1, dividers by the number of classes on the class step of training. For the purposes of this notice, the group of students involved in the classes in class in Danish A shall be defined, unless the institution has organised the class formation in such a way as to ensure that participation in the Danish A has not been legally, for the purpose of : class formation, cf. § 16 c, 2. Act. Elives that, apart from the group forming part of the class, participate in the class ' s class, shall be included in the calculation of the average class quota, cf. However, § 16 f.

Paragraph 4. For the following classes, the institution shall carry out an independent statement of the average class votient on each class step of each class step of each of the high school full-time training provided by the institution :

1) Classes created for students who need a special individual organization due to disability, disease, elitesport, musical basal course or similar, cf. § 40, paragraph. 2, section 41, paragraph. 2, and section 46 of the law on education for the higher the commercial sector (hhx) and higher technical exams (htx).

2) Classes created for a special target group as part of an attempt, cf. Section 45 (3). 1, in the law of education and training, to the higher commercial sector (hhx) and higher technical degree (htx).

§ 16 b. The institution of the institution shall be the statement of class quotas in accordance with section 16 (a) (1). 1-4, at the same time as the initial report of the institution, must take place at first class steps to be used for the calculation of state subsidies, cf. the guidelines for the counting days, the counting periods and reports in the IEU instruction.

§ 16 c. The institution ' s statement of class quotas shall be approved by the institution's management board and attested by the institution ' s manager and auditor in accordance with the rules in the notification of auditing and subsidy-checking, and so on for business-oriented institutions, Education and reporting to the Ministry of Children and Education. The report shall indicate that the institution has used the class formation organisation, where participation in the Danish A is not a true subject, cf. § 16 a (3) (a) THREE, TWO. Act.

Deviations on the basis of the start of training for the start of the training

§ 16 d. An institution covered by the notice referred to in Annex 2 may derogate from section 15 b (s). 1 and 2, in the law of the institutions for vocational training and section 39 a (1), 1, in the law of higher-degree commercial training (hhx) and higher technical degree (Hhx), for the sake of a student in the local area, which is engaged in the first class step, if the student will receive a transport time of more than 5 minutes to the nearest alternative ; the tender place of the training which the student wants to take into consideration. An institution which has a department covered by the Annex 2 of the notice shall be in a similar manner as after 1. Act. derogate from section 15 b (s). 1 and 2, in the law of the institutions for vocational training and section 39 a (1), 1, in the law of education for the greater commercial sector (hhx) and the higher technical degree (htx) for the department concerned, cf. § 16 a (3) (a) ONE, THREE. Act.

Paragraph 2. The transport time is to be carried out as the time of transport between the home of the student (people's home address) and the training ground with public transport equipment,

or similar systems. The nearest alternative tender place must be an institution subject to the law on the institutions of general education or general adult education, etc., or the law of institutions for vocational training.

Waiving during the training process

§ 16 e. An institution may, in the course of training, derogate from section 15 b (s). 1 and 2, in the law of the institutions for vocational training and section 39 a (1), 1, in the law of education for the higher the commercial sector (hhx) and higher technical examination (htx), for the inclusion of a student who satisfies one of the following conditions :

1) The student is moving in his high school education to the part, and the student will receive a transport time of more than 5 minutes to the nearest alternative tender place of the training that the student wants to take up. The transport time is to be carried out as the time of transport between the home of the student (people's home address) and the training ground with public transport equipment,

or similar systems. The nearest alternative tender place must be an institution subject to the law on the institutions of general education or general adult education, etc., or the law of institutions for vocational training.

2) The student is moving during his high school education to the national part and the student has a particular study of its studies, where in the area of the relocation alone it is the institution that is providing a similar subject.

3) The student is temporarily admitted to the institution as part of an exchange abroad, and special reasons speak for the student to go to the institution, for example that he is domiciled at a student who is already going to the institution.

4) The student returns to the institution after having been on foreign exchange abroad for a minimum of six months and has applied for leave from the institution during the exchange period.

5) According to the initiation notice, the student has concluded a prior agreement with the institution of the institution on leave from up to one year of training.

6) The student must go to class step on education, and the institution assesses that it will significantly improve the pupils ' ability to carry through training, possibly in conjunction with a special effort towards the student, that it is happening at the institution.

7) The student shall be admitted to the institution after being expelled from another institution in the middle of a school year due to breaches of the studies and the rules of law and the student meets the condition in paragraph 1. However, 1, however, that the institution of the student is expelled from the possibility of a non-forming part of the alternative tender sites.

Deviation by Special Deviation

§ 16 f. An institution may derogate from section 15 b (s). 1 and 2, in the law of the institutions for vocational training and section 39 a (1), 1, in the law of education for the higher commercial sector (hhx) and higher technical examination (htx), for a student not part of a class covered by section 16 (a) (1). 4, no. 1 if the student is in need of a specific individual organisation due to disability, disease, elitesport, musical basal course or similar, cf. § 40, paragraph. 2, section 41, paragraph. 2, and section 46 of the law on education for higher commercial samen (hhx) and higher technical degree (htx), but participate in a class instruction, cf. § 16 a (3) (a) 3.

Conditions for deviation

§ 16 g. It is a condition of derogation after section 16 d 16 f that the institution's board of directors determines and implements a plan for the addition of additional learning resources in relation to the deviation of an average class quota of 28.0 so that the training aid per year is 28.0. student is the same, regardless of class size.

Documentation and reporting in the application of a derogation from the possibility

§ 16 h. An institution that uses a derogation from the section 16 d-16 shall send a statement to the Ministry of Children and Education. The statement shall contain :

1) A description of the deviation and deviation of deviations and the consequences of deviations from the deviation from the average rate of appeal at 28.0.

2) Documentation of compliance with the conditions for the use of the deviation or derogations in question. The documentation must be certified by the manager and auditor of the institution.

3) The institution ' s assessment of the extent to which the extent of the institution ' s derogations in accordance with section 16 d-16 should lead to the creation of new classes and the time for the formation of any new classes. The assessment shall take place on the basis of :

a) the extent of the derogation,

b) the number of classes in the class step of the training,

c) the amount of time remaining on that class step ;

d) the anticipation of the institution to reduce the overcoming of the class quota and the time-scale for this, due to the institution ' s documented experience of lifts and movements ;

(e) other matters which the institution attaches to the assessment of the fact that the overshoot of the class votenement should lead to the creation of new classes.

4) A plan for the addition of additional canvas resources, cf. § 16 g.

Paragraph 2. An institution which has applied the derogation from Article 16 d shall also prepare a reasoned presentation of the conditions resulting from the need for the derogation and a description of the conditions resulting from the imposition of the pupils not referred to ; to another institution.

§ 16 i. The institution ' s statement after paragraph 16 h (i) (h) 1 and 2 shall be reported to the Ministry of Children and Education in the immediate extension of the institution ' s decision to apply the derogation from the option of section 16 d-16 f, cf. however, paragraph 1 2.

Paragraph 2. The institution ' s statement after paragraph 16 h (i) (h) 1 and 2, for deviations in accordance with section 16 d, at the same time as the initial reporting of the institution, the activity for the calculation of the state subsidies, cf. § 16 b. "

3. Appendix 2 the text of Annex 1 shall be replaced by this notice.

§ 2

The announcement shall enter into force on 1. July 2012 and shall not have the effects of classes established for the teaching of students commenting on the 1. August, 2012, or later.
