Annex 1 The full text of the Ordinance amending the Ordinance on the grant payment, etc. for institutions for vocational training, etc.

(Flexible class ceiling of 28 pupils at the secondary school full-time education) section 1

In executive order No. 638 of 3. July 2003 concerning the grant payment, etc. to institutions of vocational education and training, etc., as last amended by Decree No. 1137 of 5. December 2011, shall be amended as follows: 1. In the introductory part, the words ' pursuant to section 5, paragraph 4, article 15, paragraph 4, section 18, paragraph 4, article 19, paragraphs 1, 3 and 4, section 25, paragraph 2, article 27, paragraph 2, and section 31 (2) and (4) of the law on institutions of vocational training, in accordance with article 3. lovbekendtgørelse nr. 954 of 28. November 2003 – as regards article 25, paragraph 2, after negotiation with the Minister of finance – pursuant to section 19, paragraph 6, and paragraph 19 (c) of the Act on vocational training, in accordance with article 3. lovbekendtgørelse nr. 870 of 23. October 2002, as amended by section 4 of Act No. 1080 by 17. December 2002 and section 3 of Act No. 1083 by 17. December 2002, pursuant to section 27 (3) of law No. 446 of 10. June 2003 on labour market training, pursuant to section 16 (a) of the Act on agricultural education, see. lovbekendtgørelse nr. 871 of 23. October 2002, as amended by section 5 of law No. 1083 by 17. December 2002, pursuant to section 14 (a) of the law on the vocational secondary education to higher commercial examination and higher technical examination, see. lovbekendtgørelse nr. 834 of 8. October 2003.0 ' to: ' under section 5, paragraph 8, article 15, paragraph 4, article 15 b, paragraph 3, article 18, paragraph 4, article 19, paragraphs 1, 3 and 4, section 25 (2), section 27 and section 31 (2) and (4) of the law on institutions of vocational training, in accordance with article 3. lovbekendtgørelse nr. 878 of 8. August 2011, as amended by section 5 of law No. 271 of 27. March 2012, § 6 of the law No. 418 of 12. may 2012, § 2 of the law No. 469 of 29. may 2012 and § 2 of the law No. 514 of 4. June 2012 – as regards article 25, paragraph 2, after negotiation with the Minister of finance – pursuant to section 19, paragraph 9 and 11, and § 19 c of the law on vocational education and training, see. lovbekendtgørelse nr. 171 of 2. March 2011, as amended by section 2 of Act No. 1368 of 28. December 2011, law No. 210 of 5. March 2012 and section 7 of the Act No. 418 of 12. may 2012., pursuant to § 27, paragraph 3, of the law on labour market training, etc., see. lovbekendtgørelse nr. 381 of 26. March 2010, as amended by section 22 of Act No. 639 of 14. June 2010, § 2 of the law No. 277 of 5. April 2011 and § 2 of the law No. 573 of 7. June 2011, under section 39, paragraph 6, and paragraph 39 (a), paragraph 2, of the law on education to the higher commercial examination (hhx) and the higher technical examination (htx), see. lovbekendtgørelse nr. 861 of 5. July 2010, as amended by section 4 of Act No. 469 of 29. may 2012, under section 10 (g) of the Act on guidance on training and professions, as well as a duty to education, employment, etc., see. lovbekendtgørelse nr. 671 by 21. June 2010.0 ' 2. Under section 16 shall be added:

Statement and the derogation of the reimbursement requirement of a maximum average class grade point average at 28.0 pupils at each grade levels at secondary full-time education

Inventory and reporting of section 16 (a). the institution showdown class sizes average class grade point average, see. section 15 (b), paragraphs 1 and 2, of the law on institutions for vocational training and section 39 (a), paragraph 1, of the law on education to the higher commercial examination (hhx) and the higher technical examination (htx) on each of the grade levels at each of the post-secondary education institution full-time provider. If a branch of an institution covered by the Executive order on Annex 2, and the institution of the Department applies the derogation option under section 16 d, class sizes are stated separately for the Department.

(2). Secondary full-time courses include: 1) the three-year training for the higher commercial examination (hhx), including pre-IB.

2) the three-year training to higher technical examination (htx), including pre-IB.

(3). The institution encounter the average class grade point average know that the total number of recorded pupils on the individual secondary full-time education without prejudice. (1), shall be divided by the number of classes on the class step on training. A class for the purposes of this Ordinance by the Group of students, who together take part in the teaching of the elective Danish (A) unless the institution has organized class formation in such a way that the participation in the profession of Danish (A) is not true for class formation, see. § 16 (c), 2. point students beyond the group that make up a class, participate in class teaching, is included in the measure of the average class grade point average, see. However, section 16 (f).

(4). For the following classes make the institution an independent estimation of the average class grade point average on each of the grade levels at each of the post-secondary education institution full-time provider: 1) Classes that are created for students who need a special individual organisation on the grounds of disability, disease, exercise, elite musical basic course or similar, see. section 40 (2), section 41, paragraph 2, and section 46 of the law on education to the higher commercial examination (hhx) and the higher technical examination (htx).

2) Classes that are created for a particular audience as part of trials, see. section 45, paragraph 1, of the law on education to the higher commercial examination (hhx) and the higher technical examination (htx).

section 16 (b). The institution's statement of class rates pursuant to section 16 (a), paragraphs 1 to 4 shall be carried out simultaneously with the institution's first transmission of activity on first grade levels to use for calculating the State grants, see. guidelines for counting days, counting periods and alerts in the IEU-script.

§ 16 (c). The institution's statement of approval of the institution's Board of Directors and quotients class certified by the institution's Director and Auditor in accordance with the rules laid down in the Ordinance on audit and reimbursement controls, etc. by institutions for vocational training and reported to the Ministry of children and education. It must be indicated in the notification, if the institution has applied an organisation of class formation, where participation in the profession of Danish (A) is not true, see. section 16 (a), (3), 2. PT.

Derogation justified in conditions of educational gradient's start



§ 16 d. an institution covered by the Executive order on Annex 2, may derogate from paragraph 15 (b), paragraphs 1 and 2, of the law on institutions for vocational training and section 39 (a), paragraph 1, of the law on education to the higher commercial examination (hhx) and the higher technical examination (htx) for the sake of a student in the local area who are admitted to the first grade levels, if the student will get a travel time of more than 5 district to the nearest alternative tender place of that training which the student would recording on. An institution that has a place of business which is covered by the Executive order on Annex 2, in a similar fashion as after 1. paragraph derogate from section 15 (b), paragraphs 1 and 2, of the law on institutions for vocational training and section 39 (a), paragraph 1, of the law on education to the higher commercial examination (hhx) and the higher technical examination (htx) for that section, see. section 16 (a) (1), (3). PT.

(2). Shipping time is calculated as the time between the pupil's place of residence (registered address) and education institution with public means of transport according to the

or similar systems. The nearest alternative tender shall be an institution subject to the law on institutions of general secondary education or general adult education, etc. or the law on institutions for vocational training.

Derogation under education



§ 16 e. An institution may derogate from the provisions of paragraph 15 (b), education (1) and (2) of the law on institutions for vocational training and section 39 (a), paragraph 1, of the law on education to the higher commercial examination (hhx) and the higher technical examination (htx) with a view to admission of a student who meets one of the following conditions: 1) the pupil moves during his secondary education to the region , and the student will get a travel time of more than 5 district to the nearest alternative tender place of that training, as the pupil would recording on. Shipping time is calculated as the time between the pupil's place of residence (registered address) and education institution with public means of transport according to the

or similar systems. The nearest alternative tender shall be an institution subject to the law on institutions of general secondary education or general adult education, etc. or the law on institutions for vocational training.

2) the pupil moves during his secondary education to the region, and the pupil has a special field of study, where it in incomer settler area alone is the institution that offers the corresponding subjects.

3) Eleven recorded temporarily on the institution as part of an Exchange stay from abroad, and specific reasons for that pupil must go at the institution, e.g. that he or she is domiciled with a student that already goes on the institution.

4) the pupil returns to the institution after having been on Exchange abroad for a minimum of six months and have applied for a leave of absence from the institution during the Exchange.

5) the pupil has, in accordance with the admission notice entered into a prior arrangement with the institution's Manager on leave from training of up to one year.

6) Eleven must go step on education about, and class the institution considers that it is essential to improve the pupil's possibilities to carry out the training, possibly in association with a special effort in the face of the pupil, it is done at the institution.


7) the pupil is absorbed at the institution after being expelled from another institution in the middle of a school year for violation of study and conduct, and the pupil meets the condition set out in point 2. 1, however, in such a way that the institution the student is expelled from not included among possible alternative tender spots.

Derogated in particular individual organisation



§ 16 such an institution may derogate from paragraph 15 (b), paragraphs 1 and 2, of the law on institutions for vocational training and section 39 (a), paragraph 1, of the law on education to the higher commercial examination (hhx) and the higher technical examination (htx), for a student who is not part of a class subject to section 16 (a), paragraph 4, nr. 1, if the pupil is in need of a special individual organisation on the grounds of disability, disease, exercise, elite musical basic course or similar, see. section 40 (2), section 41, paragraph 2, and section 46 of the law on education to the higher commercial examination (hhx) and the higher technical examination (htx), but participates in a range of popular education, without prejudice. section 16 (a), paragraph 3.

Conditions for derogation



§ 16 g. it's a playing field for derogation in accordance with §§ 16 d-16 (f), to the institution's Board of Directors shall establish and implement a plan for the supply of additional teacher resources in relation to the derogation of an average class grade point average at 28.0 so that teacher aid per student is the same regardless of class size.

Documentation and reporting through the use of the derogation option



§ 16 h. an institution that uses a derogation option after §§ 16 d 16 f should send a statement to that effect to the Ministry for children and education. The statement must include: 1) A description of the derogation options and the impact of derogation applied in relation to the average class grade point average at 28.0.

2) proof of the conditions for applying the derogation options in question have been met. Documentation must be certified by the institution's Director and Auditor.

3) the institution's assessment of whether the scope of the institution's derogations in accordance with §§ 16 d-16 (f) should lead to the creation of new classes and the time of the formation of any new classes. The assessment should be done on the basis of: (a)) the scope of derogation, b) number of classes on the class pass on that training, c) how long is left in the appropriate grade levels, d) the institution's expectation for the reduction of class sizes and the crossing of time perspective for doing so, as a result of the institution's documented experience with student movements, and (e)) other matters which the institution attaches weight to the assessment of whether the breach of class sizes should result in the creation of new classes.

4) A plan for the supply of additional teacher resources, see. § 16 g.

(2). An institution that has applied the derogation option under section 16 d, shall also draw up a reasoned explanation of the circumstances leading to the need for the derogation, and a description of the circumstances leading to that students cannot refer to another institution.

§ 16. Institution's statement under section 16 (h) (1) and (2) are to be transmitted to the Ministry of children and education in the immediate extension of the institution's decision to apply the derogation option after §§ 16 d-16 (f) of the basic regulation. However, paragraph 2.

(2). The institution's statement under section 16 h, paragraphs 1 and 2, for derogations pursuant to section 16 (d) must happen simultaneously with the institution's first transmission of activity for purposes of calculating the State grants, see. section 16 (b). ' 3. Annex 2 shall be replaced by Appendix 1 to this notice.

§ 2

The notice shall enter into force on the 1. July 2012 and has effect only for the classes that are created for the purpose of teaching students who begin teaching the 1. August 2012 or later.
