Notice of penalties for violation of the regulation on food information to forbrugerne1)
Under section 60, paragraph 3, of the law on food, see. lovbekendtgørelse nr. 820 of 1. July 2011, fixed: § 1. Unless a higher penalty is inflicted upon the rest of the legislation, is punishable by a fine the food business operator who violates the following rules of the European Parliament and of the Council Regulation (EU) No. 1169/2011 by 25. October 2011 on the provision of food information to consumers (labelling regulation) 1) article 30, paragraph 1-5, 2) article 31 (1), (3) or (4) 1. led.
3) article 32, article 33, paragraph 4), 1-4, 5) article 34, paragraphs 1 to 4 and 5, paragraph 1. led, or 6) article 35, paragraph 1.
(2). The penalty can rise to imprisonment for up to 2 years, if it knows the action or failure occurred violations are committed with intent or gross negligence, and there in the infringement is 1) caused damage to the health or caused danger for doing so, or 2) achieved or intentional obtained a financial benefit for the person himself or others.
(3). That can be imposed on companies, etc. (legal persons) criminal liability in accordance with the provisions of the criminal code 5. Chapter.
§ 2. The notice shall enter into force on 25 July. July 2012.
(2). At the same time repealed Executive Order No. 1144 by 9. December 2011 on the penalties for violation of the regulation on food information to consumers (labelling regulation).

October 2011 on the provision of food information to consumers, amending European Parliament and Council Regulation (EC) No 1782/2003. 1924/2006 and (EC) No 1782/2003. 1925/2006 and repealing Commission Directive 87/250/EEC, Council Directive 90/496/EEC, Commission Directive 1999/10/EC, the European Parliament and of the Council Directive 2000/13/EC, Commission Directive 2002/67/EC and 2008/5/EC and Commission Regulation (EC) No 1782/2003. 608/2004. According to article 288 of the Treaty where a regulation is directly applicable in each Member State. Council Regulation (EU) No. 1169/2001 (labelling regulation) shall only apply from the 13. December 2014 for the general part and the 13. December 2016 for the nutrition declaration part. The provisions of the regulation concerning nutrition labelling on a voluntary basis, however, can be used from the 13. December 2011.
