Publication of the energy supervision of the internal market for electricity and natural gas and so on. 1)

In accordance with Article 78 (2), 7, in the field of electricity supply, cf. Law Order no. 516 of 20. May 2010, as amended by law no. 466 of 18. May 2011, and section 41 a, in the law of natural gas supply, cf. Law Order no. 996 of 13. October 2011, shall be determined :

§ 1. The energy monitoring monitors are as follows :

1) the degree and effectiveness of market opening and competition at wholesale and retail sales, including on electricity and gas exchanges ;

2) consumer prices, including the amount of prepaid requirements,

3) share of consumers switching to the supplier ;

4) share of consumer disruption,

5) the payment for and execution of maintenance services ;

6) the extent and nature of complaints from consumers to the Energy or Energy-sighted Board of the Energy,

7) the time it takes power transmission undertakings and gas transmission undertakings, and network companies and gas distribution companies to carry out connecting and repaiving,

8) the existence of restrictive contractual practices relating to the supply of electricity and gas, including one-clause clauses, which may hinder or limit the ability of consumers to conclude contracts with more than one supplier at the same time ; and

9) any distortion of competition or restriction of competition.

Paragraph 2. In the context of monitoring, the Energy Agency may conduct investigations on the operation of electricity and natural gas markets and establish and impose measures in the applicable legislation in order to promote effective competition and ensure that the market is carried out ; works.

Paragraph 3. To the extent that the other authorities, Energinet.dk or the Indicator Board of Energy are already carrying out analyses or other inventories of the conditions referred to in paragraph 1. 1, they shall make the request, the results of their work at the request of the energy supply for the Energy monitoring.

§ 2. The oversight shall ensure that Energinet.dk, electricity transmission undertakings, gas transmission companies, network companies, gas distribution companies, supply and commercial undertakings, other users of the collective power supply network and others ; Whereas market participants fulfil their duties and comply with their obligations under the European Parliament and Council Regulation laying down the conditions for access to the network in connection with cross-border electricity development and after the European Parliament and the Council Regulation on the conditions for access to the natural gas transmission network.

§ 3. Energy supervision is collaborating with the European Agency for the Cooperation of Energy Regulators and other EU Member States ' energy regulators on cross-border matters in the field of electricity and gas and participating in relevant cooperation forums. within the European Union.

§ 4. The energy supervision must help to ensure that the procedures for exchanging information, such as on data and settlement, are compatible with the most important market processes at EU level.

§ 5. The Energy Agency may ask the Agency for a statement on the conformity of a decision by a Member State's energy regulator in accordance with the guidelines adopted by the European Commission, referred to in the European Parliament and the Council ; Whereas Directive on common rules for the internal market in electricity, in the Regulation of the European Parliament and of the Council on the conditions for access to cross-border electricity, in the European Parliament and Council Directive on common standards, rules for the internal market in natural gas or in the European Parliament and of the Council ; Regulation on the conditions for access to the natural gas transmission network.

§ 6. If the energy supervision considers that a decision taken by another country's energy regulator relevant to cross-border trade in electricity or natural gas, does not comply with the guidelines provided for in the European Parliament and Council Directive laying down common rules for the internal market in electricity or in the Regulation of the European Parliament and of the Council laying down the conditions for access to the network in connection with cross-border electricity exchanges, in the directive of the European Parliament and of the Council on common rules for the internal market in natural gas or in the European Parliament and the Council Regulation laying down the conditions for access to the natural gas transmission network, the Energy-monitoring may inform the European Commission within two months of the date of that decision.

§ 7. The announcement shall enter into force on 1. November 2011.
