Publication of syringe of sprayed equipment 1)

In accordance with section 7 (2), 1, no. 1, 2, 5 and 8, section 7a, section 67, section 80, section 88 (2), 1 and 2, and section 110 (1). 3 in the law of environmental protection, cf. Law Order no. 879 of 26. June 2010, section 46, section 72. 1, no. 3 and section 74 of the Work Environment Act, cf.. Law Order no. Seventy-seven of seven. September 2010, as amended by law no. 597 of 14. June 2011 shall be :

Chapter 1

Objections and definitions

§ 1. This notice shall determine the rules on a regular basis of the spraying equipment referred to in section 2.

§ 2. The notice shall apply to sprayed equipment in professional use, cf. § 3, nr. 4 and 5, with the exception of hand-held syringes with a tank with a capacity of 25 litres or less, syringes intended to be carried on the back and logging machinery on which pesticide pesticide is fitted, cf. however, paragraph 1 2

Paragraph 2. However, Aerosolsyringes are always subject to the rules of the notice, regardless of the volume and shape of the notice, cf. § 3, nr. 8.

§ 3. For the purposes of this notice :

1) Usage view : Showing for the right use of syringes, benefits tables and other materials, as the manufacturer of the syringe, to ensure the correct use of the syringe, including environmental optimal use, made available to the operator of the syringe.

2) " Syn : Review of a syringe with a view to ensuring that it complies with the requirements of section 5 and Annex 1.

3) Pesticide : A plant protection product as defined in the Act on chemicals, section 33 (3). ONE, ONE. Act.

4) Professional use : use of syringe equipment of any person who uses pesticides in the context of its business activities, including sprayers, technicians, employers and self-employed in the agricultural sector and other sectors.

5) Spray equipment : any appliance specifically intended for the application of pesticides, with the accessories necessary for the effective operation of the appliance, e.g., dyes, manometers, filters, and aims and equipment for cleaning the tanks.

6) Synthetic : Business approved by the Environmental Management Board to perform pestisy-sprayed equipment.

7) Certificate : The certificate that documents that a syringe complies with the requirements of section 5 and Annex 1. Certificates shall also include certificates issued in other EU countries as evidence of the application of the European Parliament and of the Council of the European Parliament and of the Council Directive 2009 /128/EC. 8.

8) For an aerosol syringe, this notice shall mean a syringe containing a compressed, floating or under pressure dissolved air type with or without a liquid, pasta or powdered and fitted with a device to facilitate the exhaustion of the content in the form of : solid or liquid particles in a gas or in the form of foam, pasta or powder or in liquid mode.

9) The owner of the spraying equipment shall include in this notice also the owner or tenant of an agricultural holding which uses or uses borrowed or leased equipment in his holding.

Chapter 2

Requirements for the syringe

§ 4. The owner of the sprayed equipment is responsible for the use of a pesticide by means of pesticide approved by the use of syringe equipment approved by the application of the rules in this notice.

Paragraph 2. Spray equipment that has been purchased for or have been applied to a company or a municipality whose CVR number ends on 0, 1 or 2, ahead of the 26th. November 2014, I want you to think before the 26th. November 2014, unless the syringe is scheduled to be taken out of use prior to the 26th. November 2016.

Paragraph 3. Spray equipment that has been purchased for or have been applied to a company or a municipality whose CVR number ends on 3, 4, 5 or 6, ahead of the 26. November 2015 must appear before 26. In November 2015, unless the syringe is scheduled to be taken out of use prior to the 26th. November 2016.

Paragraph 4. Spray equipment that has been purchased for or have been applied to an establishment or a municipality prior to the 26th. November, 2016, may not be used after the 26th. November 2016, unless it is approved by vision.

Paragraph 5. Fage a concrete spraying device within several of the above time frames, cf. paragraph 2-4, the earliest time frame must be followed.

Paragraph 6. The syringe equipment shall be reviewed and approved by surveys no later than five years after the first sight and then at least every 3. Year to continue to be used.

Paragraph 7. New spray equipment, purchased as new equipment after 26. In November 2016, review shall be reviewed and approved by five years after the acquisition and then at least every 3. Year to continue to be used.

§ 5. The owner of the spraying equipment must carry out or make regular calibration and technical control of syringe equipment.

Paragraph 2. Spray equipment must at any time be in such a state that it can :

1) Make up and be emptied, easily and completely unleashed by pesticides,

2) pursed easily, but thoroughly,

3) handled safely,

4) ensure precise dosing and delivery,

5) be checked and stopped immediately from the seat driver's seat and,

6) adapted to single, accurate and reproducible.

§ 6. Syn of syringe equipment must be carried out by a caretaker company.

Chapter 3

Approval as a caretaker

§ 7. The Danish Environmental Management Board shall accept their application.

Paragraph 2. The application for approval is to be submitted through the Eco-Management website on a special schema.

Paragraph 3. The application shall include, inter alia, the name, address, telephone number, CVR number and company form of the company.

Paragraph 4. The application shall be accompanied by evidence that the undertaking shall comprise at least one person trained in accordance with the training of the undertaking. § 8.

Paragraph 5. The application must be further attached to a specific investment plan comprehensive equipment that the company does not already have in order to verify the function of the injecteable equipment, etc. in accordance with section 5 and Annexes 1 and 2. approval shall, within 6 months, submit documentation to the Environmental Management Board in order to have made investments described in the investment plan.

Paragraph 6. IT communication equipment must be in possession of IT communications equipment enabling the use of the functions of www.virk.dk to be used by the caretaker, as well as equipment enabling electronic archiving and forwarding of vision reports, etc.

§ 8. Businesses performing survey must have at least one employee who is trained as a mechanical engineer, blacksmith, mechanic, agricultural mechanic or other equivalent training or which may prove practical experience to enable the person concerned to assessing the technical condition of pestis and their ability to produce pesticides in accordance with the instructions for the syringe concerned.

Paragraph 2. Gardening and nurseries, which seek approval as a caretaker of the company's own equipment, must have at least one person employed who have a relevant educational background or can document practical experience with it ; spraying equipment used in the establishment.

Paragraph 3. The defence can obtain approval as a caretaker of its own equipment.

§ 9. All persons who carry out spraying equipment must have undergone a course in the export of syringe of syringe.

Paragraph 2. Confession of the examination after completion of the course of the course gives the person the right to inject a syringe to a caretaker for a period of five years.

Paragraph 3. The course shall include the subjects set out in Annex 3.

Paragraph 4. The tendering course must be approved by the Environmental Management Board.

Case examination of the application

§ 10. Applications for the approval of the company ' s approval shall be submitted through the Eco-Management website.

§ 11. The EPA shall examine applications for approval as soon as possible.

Paragraph 2. The Environmental Management Board shall take a decision within three months of receipt of a fully substantiated application. The reasons for the decision shall be communicated to the applicant.

Paragraph 3. The period of time may be extended by one month, if the complexity of the case justifies it. The Environmental Management Board shall justify its extension and its duration and shall notify the applicant before the end of the time limit laid down in paragraph 1. 2.

Paragraph 4. Although the EPA has not notified the applicant the decision before the expiry of the time limits laid down in paragraph 1. In the case of 2 or 3, the application shall not be deemed to be granted.

Paragraph 5. refusal of application for approval or a failure to decide on the approval of the time provided for in the period laid down may not be lodged with the second administrative authority.

§ 12. Within one month after the Environmental Management Board has received an application for approval, the Management Board shall send an acknowledgment to the applicant. The Management Board shall at the same time provide the applicant for any missing documents.

Paragraph 2. The Management also illus the applicant for :

1) the period for the notification of the decision and the possibility of extending the deadline by one month,

2) the applicant may not consider the application for accommodates if the decision has not been taken and notified before the deadline expires, and

3) redress.

Declamation and revocation

§ 13. Approval as a caretaker may be refused or revoked if :

1) the establishment or owner of the undertaking is or is convicted of a criminal offence which undergoes a near-risk of misuse of access to the pursuit of the sight of the company ;

2) the establishment or owner of the establishment has shown that there is reason to assume that the company will not be driven safely, or

3) the establishment does not comply with the requirements to be approved as a caretaker.

Paragraph 2. The Environmental Management Board may obtain information from public authorities and request information from the company to assess whether there is a basis for granting or revoking an approval.

Paragraph 3. Where the conditions laid down for the operation of a company are amended after a company has obtained approval as a custodiator, the Environmental Management Board shall provide the undertaking with a reasonable period of time to document the fulfils of the amended requirements.

Enlightenment to customers

§ 14. Syncing business must inform their customers of :

1) to complain of decisions of the caretaker ' s decisions may be made for the Environmental Management Board and its address, including e-mail address, and

2) inter-branch organizations or similar cases, such as those who are members.

Paragraph 2. If a customer asks for it, the caretaker must inform you of the legislation relating to the equipment for spraying equipment and how you might be familiar with this.

Paragraph 3. The information must be made available before an agreement on surveys shall be concluded or, if no contract is concluded before the delivery of the service. The company itself determines how and in what form the information is given.

Chapter 4

Non-Persistent and occasional provision of certain services

Notification

§ 15. The first time undertakings established in other EU/EEA countries or in countries with which the EU has entered into agreement on access to the practice of regulated professions, on a temporary and occasional basis, shall act in the field of vision in Denmark, the person concerned shall, prior to writing notification of this to the Environmental Management Board.

Paragraph 2. The notification must follow

1) the documentation of the nationality of the undertaking,

2) attestation from the competent authority of the home Member State that the establishment is legally established in one of the provisions referred to in paragraph 1. 1 the countries referred to above and carrying out activities with a view of spraying equipment in accordance with Directive 2009 /128/EC of the European Parliament and of the Council. 8 and that, at the time of the issuing of the attestation, the undertaking shall not be prohibited by carrying out this undertaking, nor is it provisionally and

3) the documentation of the professional qualifications of the undertaking.

Paragraph 3. The notification shall be renewed once a year.

Paragraph 4. The company must be created as a user on www.virk.dk.

Information from service providers who provide temporary and occasional services in Denmark

§ 16. Entities established in other EU/EEA countries or in countries with which the EU has concluded agreement on access to the practice of regulated professions and, as a temporary and occasional undertaking, in Denmark, in addition to the information referred to in Article 1, 14 inform their customers about

1) the name and address of the public register of the home Member State to which the person concerned is admitted and the identification number of the person concerned or the corresponding identification in this register,

2) name and address of the competent authority of the home Member State and

3) the registration number if the person concerned is operating in the establishment country.

Chapter 5

Syn of syringe equipment

§ 17. Before the syringe of the syringe, this must be cleaned in accordance with the instructions for the use of the syringe and proclamation of the filling and washing etc. of syringes for the application of plant protection products.

Paragraph 2. The syringe of the syringe must be carried out indoors in a room without drains to sewers or in a place that satisfies the requirements for the construction and operation of detergents for pesticide delivery equipment, cf. the notice of filling and washing etc. of syringes for the application of plant protection products. The sight may therefore also take place in the area or in the area of liquids where the pesticide has been carried out.

Paragraph 3. In the case of a syringe, the conditions referred to in Annex 1 shall be examined and evaluated.

Paragraph 4. Where the spraying equipment is brought to a station in a stationary company, the syringe equipment must be sufficiently watered to carry out the sight. The water must be collected, fill the sprayed equipment and be taken home with this.

§ 18. If the syringe complies with the requirements of section 5 and Annex 1, the inspection company shall issue a certificate indicating, inter alia, the identity of the sprayed owner, the serial number, the sprayed type that the syringe is approved for inspection, the timing of the sight and the deadline for the next vision. The certificate must be completed and downloaded via www.virk.dk, and then it is signed and provided to the syringe owner. The syringe owner shall keep and request the certificate for the supervisory authority.

Paragraph 2. The syncracy shall draw up a vision report in accordance with the DS/EN 13790 -1 or -2, Anneks A and B and retain this for at least six years. The entry point of the Annex B comment shall show that the syringe has been approved by vision. It must also be stated in the view of the report, the number of dyes the sprayed equipment was fitted with and, as a result, tested at the sight.

Paragraph 3. If the syringe does not conform to the requirements of section 5 and Annex 1, a report shall be drawn up of the errors to be corrected in order to ensure that the syringe can meet the requirements in accordance with the DS/EN 13790 -1 or -2, Anneks A and B. It shall be of the explanatory statement in the field of the said field ; The Annex B will show that the syringe is not approved by sight. This is provided to the syringe owner and stored in a copy of the visual company for at least six years.

Chapter 6

Agencies, inspection, fee and complaint

§ 19. The Environmental Management Board shall supervise the inspection and training sites.

Paragraph 2. The Committee on the Environment, Public Health and Consumer Protection shall ensure that only syringes which have been subjected to inspection as specified in Section 4 are used for the application of pesticides and to carry out a regular calibration and technical inspection of syringe equipment as specified in section 5 (5). 1. The Office of Natural Acquisito, however, is in charge of soil use.

Paragraph 3. Grounders in paragraph 1. 2 means the agricultural holdings covered by SKAT's use code 05 (agriculture, bebuilt), 07 (fruit plantation, gardenneri and nursery), or 17 (unbuilt agricultural pariezers, etc.), or 01 (inhabitable), as regards the property with the nature of agriculture or gardenneri.

20. A fee shall be paid per certificate to cover the costs incurred by the Agency for the Management of the Environment, Public Health and Consumer Protection following the notice. The fee is paid in connection with the viewing company downloading the certificate via www.virk.dk.

Paragraph 2. However, no charge shall be paid for more than 10 certificates per year to the same company identified by the certificate consignon's CVR number.

Paragraph 3. The fee is at DKK 175.00. The fee shall be adjusted annually per year. 1. On the basis of the most recent published price and salary index in the Finance-Administrative Guidance from the Ministry of Finance. First time on 1. January 2013. The current fee rate shall be published on the website of the Environment Management website : www.mst.dk.

Paragraph 4. Pavement of the fee pursuant to paragraph 1 In a non-timely manner, interest shall be paid in accordance with the rules laid down in Article 88 (3). TWO, TWO. and 3. pkton, in the law of environmental protection.

Paragraph 5. The fees have been added to the panting.

§ 21. The syringe and custodians shall be obliged to make available to the authorities all the personnel and material available to the competent authorities in connection with their duties in accordance with the notice.

§ 22. The Environmental Management Board may, in exceptional cases, dispense with the rules of the notice.

Paragraph 2. However, section 4 cannot be dispensed.

-23. Decisions taken by the caretaker companies may be brought to the EPA.

Paragraph 2. The time limit shall be four weeks from the date on which the decision was issued.

Paragraph 3. Complained by a decision does not release the complainant in order to comply with this.

Paragraph 4. The decisions of the environmental management and of the Natural Acquilices shall not be made for the second administrative authority following the notice.

Chapter 7

Punishment

§ 24. Unless higher penalties have been inflished on any other law, penalty shall be punished

1) the pesticide which uses or is used to inject an injectable syringe to the application of pesticides, cf. § 4,

2) the operator of the sprayed equipment which does not comply with the rules in section 5 (5) ; 2 or

3) the one issuing a certificate of approval of a specific spraying equipment without prejudice to the rules in the notice, cf. § 18.

Paragraph 2. Companies can be imposed on companies, etc. (legal persons) punishable by the rules of the penal code 5. Chapter.

Paragraph 3. The sentence may rise to prison for two years if the infringement has been committed intentionally or by gross negligence and if there is a breach of the infringement proceedings ;

1) damage to human or animal life or animal health or, therefore, hazard,

2) damage to the environment or caused by danger, or

3) obtained or intended to be economically advancuable, including in the case of savings, for the person concerned or others.

Chapter 8

Entry into force

§ 25. The announcement will enter into force on the 20th. December 2011.

Appendix 1

Requirements for a syringe

The following points must always be reviewed, and it must be checked that the syringe equipment meets the description in all respects. In the checks, the DS/EN 13790-1 and -2 shall be followed to the extent that has not been issued by other CEN standards for the approach taken in accordance with Directive 2009 /128/EC. As new standards are being issued in accordance with the directive, these must be followed.

In the case of a syringe, the operator shall pay particular attention to the fact that the syringe to the relevant extent meets the requirements of this Annex.

1) Requirement parts

For the protection of the operator, the forecasting of a power supply and power roof must be installed and in good condition, and protective equipment and moving parts and rotating power transfer parts must be able to operate unfettered.

2) Pumping

Pumping capacity must be adapted to the equipment and the pump shall operate properly to ensure stable and sound injection speed. The pump needs to be close.

3) Repiping

Diflation devices must ensure good circulation, so that a steady concentration is achieved in all the syringe in the tank.

4) Tank for pestis

Inject tanks, including indicator of tank content, filling equipment, sirens and filters, cleaning and purification devices and blending equipment shall operate in a manner that minimizes discharges, unbalanced concentration distribution, the exposure of the operator and the operator of the equipment ; residues of pestisybody residues.

5) Measurement systems and control systems and regulatory systems

All devices for measuring, opening and closing, and setting the pressure or service must be properly calibrated and operating properly and be without incarpeas. It must be easy to regulate the pressure and handle the pressure-setting devices when spraying. The pressure-setting devices must maintain a constant work pressure at constant pumpeat-speed for the safety of steady spraying.

6) Touch and serpents

Stirs and serpents must be in good order, so interference in the flow of liquid or spillage caused by leaks is avoided. There must be no leakage from pipes or serpents when the system is powered by the highest possible pressure.

7) Filtering

In order to avoid any turbulence and unequations in the column, filters must be in good condition and the size of the filters shall correspond to the size of the dyes mounted on the syringe. If a system for setting the filter log is provided, it shall function properly.

8) Inject bom (i.e. equipment where spraying takes place by means of a horizontal bom placed in close range from the crop or the material to be processed) ;

The syringe must be in good condition and steady in every direction. The fastening and adjustment systems and devices for oscillation and inclination compensation shall function properly.

9) Dyser

Dyses must function properly, so that the dripping does not occur when the spraying is set. In order to ensure an evenly split image, the performance of the individual diver must not significantly differ from the information supplied by the manufacturer supplied benefits tables.

10) Liquid distribution

The syringe must be distributed evenly in the target area. The level of balance must be ensured both to the sides and vertically (by the treatment of highly-growing crops).

11) The air is winding up on equipment where the spraying liquid is spread by air ;

The blower must be in good condition and must ensure a stable and reliable air flow.


Appendix 2

Equipment requirements for vision companies

A company must, prior to the intake of surveys, be in possession of the following equipment

1. In the regular place of vision, a suitable room without drainas and the possibility of liquidate fluid used in sight or in a place that satisfies the requirements for the construction and operation of the washing grounds for pesticide delivery equipment, cf. the notice of filling and washing etc. of syringes for the application of plant protection products.

2. A spray scanner or a handheld scanner (electronic sanizer test)

3. Straight-up tool and measurement tool including flow meter

4. IT Communications equipment and Internet Connection

5. Pump Equipment


Appendix 3

Course in syringe of syringes

A test equipment class must have a duration of at least 20 hours and include the following topics :

1. The legislation on injections and syringes

2. Requirements for the test site and test equipment

3. Structure and operation of the various injector

4. Calibrate of the various syringes

5. Theory and practice of the various syringes

6. Safety and health of the staff

The course must be completed by a written test,
