Under section 7 (1) (8). 1, 2, 5 and 8, Section 7a, section 67, paragraph 80, section 88 (1) and (2) and § 110, paragraph 3, of the law on environmental protection, see. lovbekendtgørelse nr. 879 of 26. June 2010, and § 46, section 72 (1) (8). (3) and section 74 of the Act on occupational safety and, see. lovbekendtgørelse nr. 1072 of 7. September 2010, as amended by Act No. 597 of 14. June 2011 fixed: Chapter 1 section 1 purpose and definitions. This notice sets out the rules relating to regular vision of it in section 2 of the mentioned spraying equipment.
§ 2. The notice applies to spraying equipment in professional use, see. § 3, nr. 4 and 5, with the exception of the handheld sprayer with a tank with a capacity of 25 litres or less, syringes that are meant to be worn on the back and harvesters on which are mounted on pesticide sprayers, see. However, paragraph 2 (2). Aerosol sprays, however, is always covered by the Executive order rules, regardless of volume and shape, see. § 3, nr. 8.
§ 3. For the purposes of this order: 1) directions for use: Instructions for the proper use of the sprayer, performance tables and other material provided by the manufacturer of the syringe in order to ensure the correct use of the sprayer, including environmentally optimal use, has made available to the user.
2) Syn: review of a syringe in order to ensure that it complies with the requirements set out in section 5 and annex 1.
3) Pesticide: a plant protection product, as defined in the law on chemicals to section 33, paragraph 1, 1 point.
4) professional use: the use of spraying equipment by any person who uses pesticides in the context of his professional activity, including syringe drivers, technicians, employers and the self-employed in the agriculture sector and other sectors.
5) spraying equipment: any apparatus specifically intended for application of pesticides, with the accessories that are necessary for the effective functioning of the appliance, URf.eks. nozzles, manometers, filters and strainers, as well as equipment for cleaning of the tanks.
6) Vision establishment: an establishment, which is approved by the environmental protection agency, to carry out surveys of spraying equipment.
7) certificate: Certificate documenting that a syringe lives up to the requirements of section 5 and annex 1. The certificate also includes certificates issued in other EU countries like to see evidence of spray equipment to comply with European Parliament and Council directive 2009/128/EC art. 8.8) By an aerosol spray, for the purposes of this Ordinance a syringe containing a compressed, liquefied or under pressure dissolved gas, with or without a liquid, paste or powder, and fitted with a device which allows the discharge of contents in the form of solid or liquid particles in a gas or in the form of foam, paste or powder or in a liquid state.
9) Owner of spray equipment includes in this notice also the owner or tenant of a farm that uses or has used borrowed or rented spraying equipment in its holding.
Chapter 2 requirements for syringe § 4. The owner of injection equipment is responsible for the professional application of pesticides only is done using spray equipment, approved by vision according to the rules laid down in this Ordinance.
(2). Spray equipment is purchased for or has been used in a company or in a municipality, if VAT number ending in 0, 1 or 2, prior to the 26. November 2014, must appear before the 26th. November 2014, unless taken out of scheduled use syringe prior to the 26. November 2016.
(3). Spray equipment is purchased for or has been used in a company or in a municipality, if VAT number ending in 3, 4, 5 or 6, prior to the 26. November 2015, must appear before the 26th. November 2015, unless the sprayer scheduled taken out of use in advance of the 26. November 2016.
(4). Spray equipment is purchased for or has been used in a company or in a municipality prior to the 26. November 2016, should not be used after the 26. November 2016, unless it is approved by sight.
(5). Drops a concrete spraying equipment in several of the above time frames, see. paragraphs 2 to 4, the earliest time frame followed.
(6). Spray equipment must be reviewed and approved by sight not later than 5 years after the first vision, and then at least every 3. years in order to continue to have to be used.
(7). New spraying equipment, purchased as new equipment after 26. November 2016, must be reviewed and approved by sight within 5 years after the acquisition, and then at least every 3. years in order to continue to have to be used.
§ 5. The owner of spraying equipment must perform or have performed regular calibration and technical inspection of spraying equipment.
(2). Spray equipment shall at all times be in such a condition that it can 1) filled and emptied safely, easily and completely without leakage of pesticides, 2) be cleaned lightly, but thoroughly, 3) are handled safely, 4) ensure accurate dosage and delivery, 5) checked and stopped immediately from spraying the driver's seat and 6) adapted to single, accurate and reproducible way.
§ 6. Inspection of spraying equipment must be performed by a vision company.
Chapter 3-approval of vision business section 7. The environmental protection agency approves vision companies upon application.
(2). Application for approval as a vision company must be submitted via the Environment Agency's website on a special table.
(3). The application must, among other things. include the company name, address, telephone number, VAT number and company kind.
(4). The application shall be accompanied by evidence that the company includes at least one person who is a qualified cf. § 8.
(5). The application shall further be accompanied by a concrete investment plan extensive relevant equipment, as the company does not already possess, to verify injection equipment function, etc. in accordance with § 5 and annexes 1 and 2. If the company obtains approval, it must within 6 months submit documentation to the environmental protection agency for having made the investments described in the investment plan.
(6). View plant shall be in possession of IT-communication equipment, which enable the use of the features on www.virk.dk, which is assumed to be used by vision company, as well as equipment which enables electronic archiving and transmission of survey reports, etc.
§ 8. Companies that carry out surveys, must have at least one person employed, who trained as a mechanical engineer, blacksmith, mechanic, agricultural mechanic or other equivalent training or who can demonstrate practical experience, which enables the person concerned to evaluate sprayer technical condition and their ability to deliver pesticides in accordance with the instructions for use for the respective spray.
(2). Market gardens and nurseries, seeking approval as vision company alone for the company's own injection equipment, must have at least one person employed, which have a relevant educational background or can provide evidence of practical experience with the spraying equipment used in the company.
(3). The defense can authenticate as the optic business for own injection equipment.
§ 9. All persons who carry out inspection of spraying equipment, must have passed a course in conducting surveys of spraying equipment.
(2). Passing of the exam after completing the execution of the course gives the person the right to carry out surveys of syringes on a Visual business for a period of 5 years.
(3). The course shall include the items in annex 3.
(4). The offered course must be approved by the environmental protection agency.
Processing of application
§ 10. Application for approval as a Visual company submitted via the Environment Agency's website.
§ 11. The environmental protection agency deals with applications for approval as soon as possible.
(2). The environmental protection agency shall take a decision within 3 months of receipt of a fully documented application. The reasons for the decision shall be communicated to the applicant.
(3). The deadline can be extended by one month if the complexity of the case so warrants. The environmental protection agency justifies the extension and its duration, and provide the applicant with notice before the expiry of the time limit referred to in paragraph 2.
(4). Although the environmental protection agency has not informed the applicant of the decision before the expiry of the deadlines referred to in paragraphs 2 or 3, the application can not be considered as met.
(5). Refusal of application for approval or non-approval decision within the prescribed time cannot be appealed to any other administrative authority.
§ 12. Within one month after the environmental protection agency has received an application for approval, sends the Agency a receipt to the applicant. Agency shall inform the applicant of any missing documents at the same time.
(2). Agency shall inform the applicant about 1) Furthermore, the deadline for the notification of the decision and the possibility of extending the deadline by one month, 2) that the applicant is unable to consider the application of accepted, if the decision has been taken and announced before the deadline expires, and 3) to justice.
Refusal and revocation
§ 13. Approval as a Visual company can be denied or revoked if 1) company or the owner of the establishment is or will be convicted of a criminal offence, justifying a nearby danger for abuse of access to exercise vision company, 2) the company or the owner of the establishment has shown such a behavior, that there is reason to believe that the company will not be driven safely, or 3) the company does not meet the requirements to be licensed as of vision company.
(2). The environmental protection agency to obtain information from public authorities, as well as ask the company about information in order to assess whether there are grounds to refuse or revoke an authorisation.
(3). Provided that the conditions laid down in order to drive company vision changed after a company has gained approval as vision company, the environmental protection agency gives the company a reasonable period of time to demonstrate that the company complies with the amended requirements.
Information duties to customers
§ 14. Vision companies must inform their customers of: 1) to complain about the optic unit's decisions can be challenged before the environmental protection agency and its address, including e-mail address, and 2) interbranch organisations or similar, as he or she is a member of.

Chapter 4 Temporary and occasional provision of certain services Review
§ 15. The first time companies that are established in other EU/EEA countries or in countries with which the EU has entered into an agreement on access for the pursuit of regulated professions, temporary and occasional intends to exercise vision company in Denmark, that person must notify, in writing, prior to the environmental protection agency.
(2). With the notification must follow 1) documentation for the company's nationality, 2) certificate from the competent authority of the home Member State stating that the company is legally established in one of the countries referred to in paragraph 1 and practising with the sight of injection equipment in accordance with European Parliament and Council directive 2009/128/EC art. 8, and that at the time of issue of the attestation is not forbidden the company to engage in that activity, not even temporarily and 3) documentation for the company's professional qualifications.
(3). The notification must be renewed once a year.
(4). The company must be set up as a user on www.virk.dk.
Information from service providers who temporarily and occasionally provides services in Denmark
§ 16. Undertakings established in other EU/EEA countries or in countries with which the EU has entered into an agreement on access for the pursuit of regulated professions, and as temporary and occasionally performs vision company in Denmark, in addition to the information referred to in section 14 shall inform their customers about 1) name and address of the public register in the home Member State to which the person concerned is registered in, as well as the person's registration number, or equivalent identification in that register; , 2) the name and address of the competent authority of the home Member and 3) registration number, if that driver taxable activities in the country of establishment.
Chapter 5 Vision of spraying equipment paragraph 17. Within sight of the sprayer must be cleaned in accordance with the instructions for use of the syringe and the Executive order on filling and washing, etc. of syringes for application of plant protection products on the market.
(2). The sight of the sprayer must either be carried out indoors in a room without drain to the sewer or on a space that meets the requirements for setting up and running of the wash bays for pesticide application equipment, see. Executive order on filling and washing, etc. of syringes for application of plant protection products on the market. The sight can therefore also take place on the land or in the greenhouse, where the pesticide was sprayed.
(3). At the sight of a syringe, the matters referred to in annex 1 shall be investigated and assessed.
(4). When spraying equipment be brought to view on a desktop vision company, spraying equipment be filled with sufficient water to implement the vision. The water must be collected, be filled with spray equipment and home be taken with this.
§ 18. If the sprayer conforms to the requirements of section 5 and annex 1, shall issue a certificate as a company vision, among other things. Specifies the identity of the owner, the serial number, injection syringe type that the syringe is approved by sight, the time of the sight and the deadline for the next vision. the certificate shall be completed and available for download via www.virk.dk, after which it shall be signed and handed over to spray the owner. Spray the owner shall retain 15,8 g certificate of the supervisory authority.

(3). If the syringe does not live up to the requirements of section 5 and annex 1, shall be the subject of a report of the errors that must be corrected to the sprayer can live up to the requirements in accordance with DS/EN 13790-1 or-2, Annex A and b. The must of the comment field in the annexe (B) indicate that the syringe is not approved by sight. This certificate shall be issued to the sprayer owner and stored in copy of vision's premises for at least 6 years.
Chapter 6 authorities, oversight, fee and complaints section 19. The environmental protection agency oversees the vision companies and educational establishments.
(2). The environmental protection agency oversees that only sprays, which have undergone syn as specified in section 4, shall apply to the application of pesticides and a regular calibration and technical control of spray equipment as specified in section 5, paragraph 1. Danish agrifish agency leads, however, supervision on farming.
(3). By land use in paragraph 2 for the purposes of the agricultural holdings covered by the treasure's track access code 05 (agriculture, developed), 07 (Orchard, greenhouse and nursery), or 17 (undeveloped landbrugslod, etc.), or 01 (living quarters), in the case of properties with character of agriculture or horticulture.
§ 20. I have to pay a fee per issued certificate to cover the environmental protection agency's costs of administration and supervision in accordance with the notice. The fee paid in connection with that vision company downloads the certificate via www.virk.dk.
(2). There must not, however, paid fee for more than 10 certificates per year granted to the same undertaking identified by the certificate recipient VAT number.
(3). The fee is on us $175.00. The fee will be adjusted annually on 1 October. January on the basis of the latest published price-and lønindeks in the Economic-Administrative guidance from the Ministry of finance. The first time the 1. January 2013. The current fee rate published on the environmental protection agency's website www.mst.dk.
(4). Fee is not filed in due time, in accordance with paragraph 1 shall be paid interest for doing so in accordance with the rules in article 88, paragraph 2 2. and (3). paragraph, of the law on environmental protection.
(5). The fees are attributed to udpantningsret.
§ 21. Spray the owners and Visual operators are obliged to provide all personnel and materials available to the competent authorities in connection with the performance of their tasks in accordance with the authorities ' notice.
§ 22. The environmental protection agency may in exceptional cases derogate from the Executive rules.
(2). However, there may not be dispensed from section 4.
§ 23. Decisions of the undertakings may be brought according to the environmental protection agency.
(2). Complaint deadline is 4 weeks from the day the decision was announced.
(3). Appeal against a decision does not relieve the complainant in order to comply with this.
(4). Environmental Protection Agency's and NaturErhvervstyrelsens decisions after the notice cannot be brought before another administrative authority.
Chapter 7 Penalties section 24. Unless a higher penalty is inflicted for other legislation, is punishable by a fine 1) the spray owner who uses or has used a syringe that is not sight, to the application of pesticides, see. § 4, 2) the spray owner who use injection equipment, which does not live up to the rules in section 5, paragraph 2 or 3) on issuing a certificate of approval of a concrete spraying equipment without that this conforms to the rules of the order, see. § 18.
(2). That can be imposed on companies, etc. (legal persons) criminal liability in accordance with the provisions of the criminal code 5. Chapter.
(3). The penalty can rise to imprisonment for up to 2 years if the infringement was committed intentionally or through gross negligence, and if the infringement is 1) caused damage to human or animal life or health or caused danger therefore, 2) caused damage to the environment or caused danger therefore or 3) achieved or intended an economic advantage, including savings, for the person himself or others.
Chapter 8 entry into force of § 25. The notice shall enter into force on the 20. December 2011.

Annex 1 requirements for a syringe
The following points should always be examined by sight and it must be checked that the syringe equipped to live up to the description at all points. By Checker to DS/EN 13790-1 and-2 are followed to the extent not issued other CEN-standards for procedures for vision in accordance with Directive 2009/128/EC. As the new standards issued pursuant to the directive must be followed.

1) transmission parts

The pump capacity shall be suited to the equipment and the pump must function properly to ensure a stable and reliable application rate. The pump must be close.
Agitation devices must ensure a proper recirculation in order to achieve an even concentration of al spray mixture in the tank.
4) Tank to spray fluid
Spray tanks including indicator of tank content, filling devices, strainers and filters, emptying and cleaning devices and mixing devices shall operate in a way that minimizes spillage, uneven concentration distribution, exposure of the operator and residual content of spray fluid.
5) measuring systems and control and regulatory systems
All devices for measuring, opening and closing and setting of pressure or performance must be properly calibrated and working correctly and be without leaks. It should be easy to regulate pressure and handle press the setting devices during spraying. Press the setting devices must maintain a constant working pressure at constant speed pump to ensure stable application rate.
6) Pipes and hoses
Tubes, pipes and hoses must be in good condition to avoid disturbance of liquid flow or leakage as a result of leaks can be avoided. There shall be no leakages from pipes or hoses when the system is operated with the highest possible pressure.
In order to avoid turbulence and heterogeneity in diffusing filters shall be in good condition, and the hole size of the filters shall correspond to the size of nozzles fitted on the sprayer. If there is a system for the filter blockage indication, it should work correctly.
8) spray boom (IE. for equipment spraying pesticides by means of a horizontal beam, which are placed in close distance from the crop or the material to be treated)
Spray boom must be in good condition and stable in all directions. Fastening and adjustment systems and devices for damping and slope compensation to work properly.
Nozzles must work properly, so control dripping when spraying is set does not occur. In order to ensure an evenly spread the image must benefit from the individual nozzle does not deviate significantly from the data of the flow rate tables provided by the manufacturer.
10) Fluid distribution
Spray mixture is distributed evenly in the target area. The regular distribution must be secured both to the sides and vertical (in case of treatment of high growing crops).

Annex 2 Equipment requirements to view companies
An entity shall, prior to the making of sight be in possession of the following equipment 1. A course in survey of spraying equipment must have a minimum duration of 20 hours and cover the following topics: 1. The legislation on syringes and syringe inspection

5. Theory and practice around the vision of the various syringes
