Publication of the amendment of the proclaus for development and demonstration activities relating to the primary agricultural use and the processing of the food sector

§ 1

Notice no. 932 of 19. July 2010 on subsidies for the development and demonstration activities in the food sector, as amended by the notice of publication No 2 ; 1473 of 16. In December 2010, the following changes are made :

1. All in the notice, 'Food business' is replaced by the 'Natural Business Authority' and 'Food Errecruits' is replaced by 'The Natural Business'.

2. I § 2 pasted as paragraph 5, 6, and 7 :

" Stop. 5. For the purposes of primary soil, this notice shall mean an agricultural holding where agricultural products are produced and where the products are not covered by the agricultural holding. Activities on the farm farm to prepare the product for the first sale shall not be regarded as processing.

Paragraph 6. For the purposes of a programme group, this notice shall mean a group consisting of a region and one or more of the municipalities of the region in question, which has drawn up a regional programme, cf. paragraph 7, and for which group of Natural Business Services has set out a special indicative EU co-financing framework within which participants in the region group can grant national public cofinancing for projects seeking to obtain grants under this announcement.

Paragraph 7. For the purposes of a regional programme, the publication of a programme drawn up by a programme group and which forms the basis for decision on whether one or more of the participants in the programme group will grant national public cofinancing for : projects under one or more of the following notices issued in accordance with the rural area :

1) Compilation of grants for network activities and subsidies for the promotion of food derived from an EU-quality system.

2) Publication of subsidies for nature and environmental projects.

3) Announceance on subsidies for the development and demonstration of primary agricultural use and processing in the food sector.

4) Publication of grants to projects relating to the creation of new jobs in rural areas.

5) Publication of grants to attractive living conditions in rural areas. `

3. § 3 ITREAS :

" § 3. The Office of the Natural Acquidation Management Board shall carry out checks on the administration following this notice. Inspecting visits as part of the administrative checks shall be carried out by the Office of the Natural Acquilime Management Board.

Paragraph 2. The Wildlife Services shall be responsible for the physical checks and subsequent accounting checks.

Paragraph 3. The Office of the Natural Acquires may, where necessary, obtain information from other authorities in accordance with the rural section ' s section 12. ` ;

4. Section 4 (4). 2, ITREAS :

" Stop. 2. Applications may be submitted from 1. December of a calendar year and shall be received in the Natural Acquial Management Board no later than 31. In January of the following calendar year, applications for 2012 shall be submitted only from 2. 1 January 2012 and shall be received by the Management Board no later than 15. -February 2012. The management may fix additional application periods published on the board's website at the latest four weeks before the start of the application period. In the case where the last day of the application period is a Saturday, Sunday, Monday or holiday, the deadline shall expire on the second weekday (Saturday not counting) that follows thereafter. '

5. Section 4 (4). 3, ITREAS :

" Stop. 3. Within the appropriation framework, the Natural Business Authority may define one or more incatives for one or more areas of action or to a specific activity. The steering can determine the partial incative framework in which financing comes from the Finance Bill appropriation of the FDA and from EU co-financing from the European Agricultural Fund for Rural Development (EAFRD), and the incaumatic framework for funds from the ELFUL to projects co-financed by public funds other than funds from the Finance Bill appropriation of the Ministry. In the case of the setting of the indicative framework, which only deals with funds from the EAFRD, the Management Board may decide that projects under such a framework can only be cofinanced by the national public funds provided. Which national public funds can only co-finance projects within such a framework shall be published on the board's website at the latest at the beginning of the application period. `

6. I § 5 pasted as paragraph FOUR :

" Stop. 4. The people in paragraph 3. The criteria referred to above shall be used as a priority basis if the total amount applied for in an application period is greater than the amount allocated under the respective indicative framework. ` ;

7. The following section shall be added after section 5 :

" Chapter 3 a

Specific concerning projects covered by special envelope for co-financing from regions and municipalities

§ 5 a. In 2012 and 2013, the National Security Agency will launch an indicative framework for EU funds for projects for which national public co-financing can only be provided by one or more participants in a programme group. The Benefit Agency shall publish each calendar year the indicative framework for EU funds for each programme group on the Board of Direction. The publication shall be published no later than one month before the first draft application.

Paragraph 2. By way of derogation from paragraph 4, paragraph Paragraph 2 shall apply for a commitment to grants under one of the provisions of paragraph 1. 1 covered special indicative frameworks for EU funds shall be sent to the Natural Acquisitions Agency via the region included in the programme group where one or more of the participants are providing the national public cofinancing for a project. The Program Group shall forward all received applications to the Natural Acquire Management Board prior to the next application period, cf. paragraph 3. The application group provides information on each request for one or more of the participants in the Application Group to grant public national co-financing for the project, as well as with what amount.

Paragraph 3. By way of derogation from paragraph 4, paragraph Paragraph 2 shall apply for commitments to grants under the provisions of paragraph 1. 1 covered indicative frameworks for EU funds have been received in the Natural Acquisitions Management Board no later than 1. March, 1. May, 1. July or 1. -October. However, in 2013, the application for a commitment to grant has to be received in the Office of Natural Acquisior by 15. January, 1. March, 1. May, 1. July, or 1. September. In cases where the application deadline falls on a Saturday, Sunday, Monday or a national holiday, the application deadline shall expire on the second weekday (Saturday not counting) that follows thereafter. The application may not be submitted after the 1. September 2013. "

8. I § 6 pasted as paragraph 8 and 9 :

" Stop. 8. Applying must indicate whether the project is covered by a contract covered by the EU procurement rules or the rules of the contract law.

Niner. 9. If the project is covered by a contract covered by the EU procurement rules or the rules of the contract law, enshaver keep documents which document that the EU procurement rules or the rules of the contract have been complied with, available for at least five years ; from the date of final payment ; "

9. I § 8 pasted as paragraph 2 :

" Stop. 2. Producer organisations, as defined in Council Regulation (EC) No, 1234 of 22. October 2007 on the common organisation of agricultural markets (the single CMO Regulation) or members of a producer organisation which, in its operational programme under the same period, has the possibility of receiving aid for activities covered by : this notice, or activities relating to the case in the main case, are not eligible for a grant of any subsidy. ` ;

10. Section 9 (1). 1, no. 1, ITREAS :

" 1) the cost of the payment to the staff of the Saver, to the extent that the work is directly related to the project and subject to the fact that the expenditure may be documented by invoice or equivalent documentation, '

11. ~ 10 (1)) 1, no. 10 and 11, ITREAS :

" 10) expenditure on research activities,

11) the expenditure incurred by the FDA prior to the authorisation of the Natural Agency for the purposes of implementing projects, in accordance with the approval of the undertaking. Section 4 (4). 5, and "

12. I ~ 10 (1)) 1, pasted as no. 12 :

" 12) expenditure in the form of benefits in kind referred to in Article 54 of Commission Regulation (EC) No 2, 1974/2006 of 15. December 2006 laying down detailed rules for the application of Council Regulation (EC) No EUR 1698/2005 on the support for rural development by the European Agricultural Fund for Rural Development (EAFRD). `

13. I § 12 pasted as paragraph 3 :

" Stop. 3. Producer organisations, as defined in Council Regulation (EC) No (EC) No, 1234 of 22. October 2007 on the common organisation of agricultural markets (the single CMO Regulation) or members of a producer organisation which, in its operational programme under the same period, has the possibility of receiving aid for activities covered by : this notice, or activities relating to the case in the main case, are not eligible for a grant of any subsidy. ` ;

14. I § 15 pasted as paragraph 5 :

" Stop. 5. The National Services Agency may reduce the total value of eligible project expenditure on a project if the management board assesses that the EU procurement rules or the rules of the tender have not been complied with. Reduction of eligible project expenditure will be determined from an assessment of the nature and causality of the infringement, and on the basis of an assessment of the financial loss to the European Rural Development Fund for Rural Development (EAFRD), are considered to be associated with it. ` ;

15. I § 20 inserted after paragraph 1. 1 as new paragraph :

" Stop. 2. Notwithstanding paragraph 1 1, the National Services Agency may maintain the defendant, even though the provision is in section 6 (4). No 9 is not complied with if the Benefit of the Natural Business Authority considers that the failure to comply with section 6 (s). "9 is not essential."

Paragraph 2 is then referred to in paragraph 2. 3.

16. Chapter 12 revoked.

§ 2

The announcement shall enter into force on 1. January 2012.
