Publication of the publication of companies ' work environment and so on.

In accordance with section 73 and Section 78 a in the work environment, cf. Law Order no. Seventy-seven of seven. September 2010 shall be determined :

Objective and region

§ 1. The purpose of the smiley scheme is external publication and thus the visibility of the individual company ' s working environment with a green, yellow, red smiley face or a coronesmiley, cf. Annex 1, on the Work of Work (www.at.dk).

Paragraph 2. Green, yellow or red smiley shall be assigned to production units, cf. The CVR definition of the CVR.

Paragraph 3. Kronesmiley is assigned to the production units that are covered by the certificate. Cronesmiley is also assigned to legal entities, cf. The CDE shall be defined in the period during which all production units belonging to the legal entity have simultaneously published a coronesmiley.

Paragraph 4. The announcement shall apply to companies with employees, cf. § 2 and section 3 of the Work Environment Act.

Paragraph 5. The notice shall also apply to developers, cf. Section 37 of the law of work environment, to the extent that they are covered by the CVR Act.

§ 2. The work shall publish by the name and address of the legal entity or the production unit of the production unit, cf. § 1, on the Work site's website on the basis of

1) the outcome of the supervision. In the case of infringements of the working environment legislation, the Member or the topics on the basis of the decisions of the Work shall be included, or

2) the evidence of a good working environment recognized by rules laid down by the Employment Minister, which, at the entry into force of this notice, is,

a) a certificate obtained by accredited certification or accredited inspection under the law of the work environment certificate to undertakings, or

b) a certificate obtained by accredited certification after notification of the recognition of DS/OHSAS 18001, etc. as evidence of a good working environment.

Paragraph 2. For decisions on breaches of labour legislation, including the time limit for the termination of the WA, at the level of supervision of the production unit, the publication shall be published after the expiry of the complaint. However, in case of a stretch of curricocress and prohibitions which have no effect from any complaint, the publication shall be immediately published.

Paragraph 3. In the case of decisions to carry out investigations, examinations and examinations as referred to in Article 21 (1). 1, in the law on work environment, is not awarded to smiley.

Businesses that have achieved a recognized environment

§ 3. Production units and legal entities which have obtained a certificate in accordance with section 2 (2). 1, no. 2 (a) or (b) has the right to be awarded and published a coronesmiley on the Homework website. Publication is subject to the request to the Board of Business, and

1) send a copy of the certificate concerned to the Board of Work, and

2) by accredited certification, a declaration of the undertaking has entered into an agreement with the certification body that the certification body gives the Board of Information if the certificate is withdrawn, suspended or disposed of.

Paragraph 2. A chronesmiley assigned to a production unit will be removed :

1) where the Working Board finds infringements of the work environment legislation on the production unit where the decision has been taken and which carries a yellow or red smiley ; or

2) if the certification body at accredited certification has given Work in the Commission's indication that the certificate of production is withdrawn, suspended or suspended, cf. paragraph 1, no. 2.

Paragraph 3. Kronesmiley is reassigned when

1) The worker has received a feedback from the company that the alleged relation to the production unit which has resulted in a yellow or red smiley face has been complied with, cf. however, sections 5 and Clause 6, or

2) the accredited certification body has given the Board of Information that the conditions under which there was a waiver or suspension of the undertaking ' s certificate, cf. paragraph 1, no. 2 is no longer a deviation from the company ' s working environment management system.

Paragraph 4. The revocation of paragraph 1. 3, no. 1 must be endorsed by the work environment organization or a representative of the staff in which the establishment does not have a duty to create the work environment organisation.

Green smiley

§ 4. Grøn smiley is assigned when the Work is after a risk-based oversight on the production unit,

1) have no reason to take decisions concerning breaches of the legislation of the labour market ; or

2) have established that a decision concerning infringement of the working environment legislation has been complied with, cf. however, section 5 (5), Paragraph 6 (1) and Section 6, 1, after which yellow and red smiley is granted for a minimum period of six months.

Paragraph 2. Green smiley contains a date on which a risk-based inspection on the production unit has been carried out by a risk-based inspection or decision taken by the Board of Work has been complied with.

Paragraph 3. Green smiley face is removed five years from the date of the most recent risk-based monitoring of the production unit.

Paragraph 4. The green smiley face shall be temporarily removed if the production unit during the 5-year publication period in the context of other supervisory powers other than risk-based inspections shall receive decisions which result in a yellow or red smiley face, cf. § § 5 and 6. When the Work is receiving feedback that these decisions have arrived, the company will have a green smiley face until it has been five years from the date of the most recent risk-based monitoring of the production unit.

Paragraph 5. If the Work is to carry out a new risk-based inspection at a production unit, a new 5-year publication period will start.

Yellow smiley

§ 5. Yellow smiley shall be granted for a minimum period of six months when the Board of Health at the production unit has taken a decision on the infringement of the work environment legislation, unless the decision is covered by Section 6.

Paragraph 2. Yellow smiley will be removed, cf. however, paragraph 1 1, when the Employment Board has received a feedback from the company,

1) the supply of the contract or the decision has been complied with ; or

2) the required interim measures have been carried out and a lasting solution to the work environment problem has been initiated.

Paragraph 3. The callback must be endorsed by the work environment organization or a representative of the employees where the company does not have a duty to create the work environment organisation.

Red Smiley

§ 6. In a minimum period of six months, red smiley shall be granted in a minimum period of six months when the Board of Health in the production unit has issued an injunction in the form of a prohibition or has issued advice as provided for in the case of a consultation process, cf. publication of the use of authorised working environment advisers.

Paragraph 2. Red smiley will be removed, cf. however, paragraph 1 1, when the Employment Board has received a feedback from the company,

1) the prohibition or advice on advice has been complied with ; or

2) the required interim measures have been carried out and a lasting solution to the work environment problem has been initiated.

Paragraph 3. The callback must be endorsed by the work environment organization or a representative of the employees where the company does not have a duty to create the work environment organisation.

Topics for work environment problems that form the basis for decisions

§ 7. The subjects of infringements of the labour environmental legislation which form the basis for decisions which have led to yellow and red smiley shall be published on the Work site ' s website.

Visit supervision for the allocation of smiley

§ 8. A company may order a risk-based supervision of the Work for Business, if one or more of the company ' s production units :

1) have a green smiley and continue to wish to publish their work environment after the end of the publication of the publication of five years, or

2) does not have a green yellow or red smiley face.

Paragraph 2. The order of inspections shall be carried out within six months of the order received by the Board of Work.

The entry into force, etc.

§ 9. The announcement shall enter into force on 1. January 2012.

Paragraph 2. At the same time, notice No 255 of 20. March 2007 on the publication of the company ' s working environment (Smey scheme).

Paragraph 3. Grøn smiley, granted up to and by 31. December 2011, will be removed after 5 years, calculated from the date of the screening visit. Expires the allocation period before 30. However, until this date, the allocation period shall be extended to the allocation period.
