Ordinance on notification of complaint justified for decisions in cases relating to mining and quarrying on the sea

Under section 26 (b), paragraph 6, of the law on raw materials, see. lovbekendtgørelse nr. 950 of 24. September 2009, as amended by Act No. 1273 of 21. December 2011, lays down: § 1. Nature agency decisions taken after raw material section 20, section 23 and section 24 shall be communicated to the addressee of the decision), 2 1) those who have been involved in administrative proceedings, 3) public authorities, who are assumed to have an interest in the case, 4) DI, 5) the Danish Shipowners ' Association, 6) the Association of Danish Ral and Sandy cleaners, and 7) the Danish fishermen's Association.

(2). The decisions referred to in paragraph 1 shall be communicated also to the following associations and organizations, provided that they have applied nature agency thereof: 1) an affected national park Fund created after the law on national parks, 2) local associations and organisations with a substantial interest in the decision, 3) nationwide associations and organizations whose main purpose is the protection of nature and the environment, and 4) nationwide associations and organisations which, by their purpose carries significant recreational interests When decision affects such interests.

(3). Nature Agency must publish permissions under section 20, section 23 and section 24, paragraph 3, if the resolutions are considered to be of greater importance or of general public interest. Nature Agency shall also publish other such permits, when these are not of secondary importance, and when they are deemed to be of interest to other complaint justified than those who are informed in accordance with the rules laid down in paragraphs 1 and 2. The publication can be done solely on nature agency homepage.

(4). The notice shall contain information on the main content of the decision) 1, 2) the place or places where the decision is presented, and 3) right of appeal.

(5). Publication of the review authority's decision in a complaint occurs after complaint authority quantification. The publication can be done only on complaint Authority website.

§ 2. The notice shall enter into force on the 2. January 2012.

(2). Executive Order No. 1441 of 11. December 2007 on notification of complaint justified for decisions in cases relating to mining and quarrying at sea is hereby repealed.
