Annex 3 The full text of the Ordinance allowing voluntary participation by organisations in a Community eco-management and audit scheme (EMAS) 1)

Under section 89 (a) (1) and (2) and section 89 (b) of the law on environmental protection, see. lovbekendtgørelse nr. 879 of 26. June 2010 on the protection of the environment, lays down: Chapter 1 scope § 1. The Ordinance shall apply to the organisations ' participation in the voluntary Community eco-management and audit scheme (EMAS), see. The EMAS regulation.

(2). Both organizations with fixed areas within the European Union as organizations whose sites are located in third countries, can be registered in accordance with the EMAS regulation in Denmark.

Chapter 2 section 2 of the competent body. The environmental protection agency is the competent registration organ in Denmark and performing tasks, including in particular the regulation tasks around application, registration, implementation of lists and supervision. Environment Agency officer supervision of non-registered organisations, improper use of the EMAS logo in Denmark.

Chapter 3 application for EMAS registration § 3. Organisations wishing to become EMAS-registered, submit the application to the environmental protection agency.

(2). Application for registration shall contain the information set out in the environmental protection agency's notification form, the elements described in article 5 of the regulation as well as a statement from the competent enforcement authority that statutory environmental requirements are complied with. Declarations can be made on the form in annex 1 to this regulation and shall be available at Danish or English, if necessary. as an authorised translation from the original language.

(3). The registration must be continuously renewed pursuant to articles 6 and 7. The application for renewal must include a statement of any changes in the information provided in the environmental protection agency's notification form as well as in article 6 of the regulation the described items. For organizations with sites located outside of the EUROPEAN UNION apply the requirement of submission of the Declaration by the supervisory authority also by renewal of the EMAS registration.

Chapter 4 section 4 of the Charges. In the context of the Organization's application for registration, the environmental protection agency will charge a registration fee and a participation fee.

(2). In the context of the Organization's application for renewal of registration charges the environmental protection agency a participant fee.

(3). The amount of fees for your organization's registration and participation shown by the Executive order on Annex 2. Annex 2 may be amended by the environmental protection agency.

Chapter 5 surveillance in accordance with section 5 of the environmental protection act. The environmental protection agency supervises the EMAS logo must not be used in contravention of the EMAS regulation.

Chapter 6 compliance with statutory environmental requirements section 6. If an EMAS-registered organisation does not comply with environmental requirements in legislation, the supervisory authority shall notify the environmental protection agency on this matter as soon as possible and no later than one month after a non-compliance is found.

(2). The supervisory authority shall notify the environmental protection agency about EVS. new developments in the case, see. Annex 3, as well as of the end of the trial.

(3). Notification in accordance with paragraphs 1 and 2, may be made on the form in annex 3 and sent to the environmental protection agency.

Chapter 7 entry into force of § 7. The notice shall enter into force on the 15. February 2011.

(2). At the same time repealed Executive Order No. 896 of 10. October 2001 allowing voluntary participation by organisations in a Community eco-management and audit scheme (EMAS).
