In accordance with Article 89 (a), 1 and 2, and Article 89 b in the law of environmental protection, cf. Law Order no. 879 of 26. In June 2010 on the protection of the environment,

Chapter 1

Scope of application

§ 1. The notice shall apply to the participation of organisations in the voluntary Community eco-management and audit scheme (EMAS), cf. The EMAS Regulation.

Paragraph 2. Both organisations with sites within the European Union, as organisations whose sites are located in third countries, can be registered under the EMAS Regulation in Denmark.

Chapter 2

Registration body

§ 2. The Environmental Management Board shall be the competent body of the competent body in Denmark and carries out the tasks of the Regulation, in particular the tasks relating to the application, registration, the construction of lists and supervision. In addition, the Committee on the Environment, Public Health and Food Safety shall also monitor the unlawful use of the EMAS logo in Denmark with unregistered organisations.

Chapter 3

Application for EMAS registration

§ 3. Organizations wishing to be EMAS-registered, submit applications to the Environmental Management Board.

Paragraph 2. The application for registration shall contain the information provided in the declaration form of the Environment Management Board, the elements described in Article 5 of the Regulation, and a declaration by the supervisory authority to respect compliance with statutory environmental requirements. Declarations may be carried out on the form in Annex 1 and must be available in Danish or English, if any. as authorized translation from the original language.

Paragraph 3. Registration shall be renewed in accordance with Articles 6 and 7 of the Regulation. The application for renewal shall contain information on any changes made in the information given in the Environmental Management Board and the elements described in Article 6 of the Regulation. For organizations with sites located outside the EU, the requirement to submit a declaration from the supervisory authority shall also apply to the renewal of the EMAS registration.

Chapter 4

Fees

§ 4. In the case of the organisation ' s application for registration, the Management Board shall charge a registration fee and a participant fee.

Paragraph 2. In the case of the organisation ' s application for renewal of the registration, the Environmental Management Board shall charge a participant fee.

Paragraph 3. The amount of fees for the registration and participation of the organisation is stated in Appendix 2 of the notice Annex 2 may be amended by the Environmental Management Board.

Chapter 5

Supervision of the Environmental Protection Act

§ 5. The Environmental Management Board shall ensure that the EMAS logo is not used in breach of the EMAS Regulation.

Chapter 6

Compliance with statutory environmental requirements

§ 6. If an EMAS registered organisation fails to comply with environmental requirements in the legislation, the supervisory authority shall inform the Committee on the Environment, as soon as possible, and within one month after failure to comply with the environmental requirements.

Paragraph 2. The Supervisory Authority shall inform the Environmental Management Board, if any new actions in the case, cf. Annex 3, and the conclusion of the case.

Paragraph 3. Notify by paragraph 1 and 2 may be carried out on the form in Annex 3 and shall be sent to the Environmental Management Board.

Chapter 7

Entry into force

§ 7. The announcement shall enter into force on the 15th. February, 2011.

Paragraph 2. At the same time, notice No 896 of 10. October 2001 on the voluntary participation of organisations in a Community eco-management and audit scheme (EMAS).
