Completion of feed and feed business 1)
In accordance with section 1, sections 2 and section 6 (4), 2, in the law of feedingstuffs, cf. Law Order no. 192 of 12. March 2009, and after authorisation, the following shall be determined :
Chapter 1
The scope and general requirements of the Convenom
§ 1. This notice includes the activities of feed business, including manufacture, transport, storage, marketing, import, export and use of feed.
Paragraph 2. In this notice, the definitions in the European Union regulations on feedingstuffs shall be used. A list of regulations referred to in this notice shall be made in the notice of Appendix 2 of the notice.
Paragraph 3. In addition to the definitions mentioned in paragraph 1, 2, the following definitions shall apply in the notice :
1) Imports : imports from third countries
2) Export : Export to third countries
3) Undesirable substances : any substance or product other than pathogens occurring in and / or on products intended for animal feed and which constitute a potential danger to animal and human health or to the environment, or which may affect animal production ; less-favoured
4) ' plant protection products ' means active substances and preparations containing one or more active substances in the form in which they are supplied to the user and which are intended to :
a) protect plants or plant products against all harmful organisms, or to prevent attacks from such harmful organisms ;
b) the life processes of plants affecting plants other than as a nutrient,
c) conserve plant products as far as the use of such substances does not have special provisions as additives ;
d) destroy unwanted plants or parts of plants ;
(e) brake or prevent undesirable growth of plants.
§ 2. Feed shall comply with the provisions laid down in accordance with the feed legislation, including the European Union regulations on feedingstuffs, in accordance with the rules applicable to animal feed. Annex 2 : Feeding of healthy and unfaded and of the usual marketable quality.
Paragraph 2. Foods shall not be liable to be placed on the market and in the form of appropriate use being a hazard to human and animal health or to the environment and must not be sold in a way that may be misleading.
Paragraph 3. Fodder establishments shall comply with the provisions laid down in the feed legislation. Feedingers shall include, in particular, the requirements for registration, approval and preparation of quality assurance systems as provided for in the Food Regulation, the BiProduct Regulation and in the Animal Health Regulation, cf. Annex 2, 2, respectively, 2 and 3, and Annex 2, no. 9, in this notice.
§ 3. The person who possesses or owns a batch of feedingstuffs which poses a serious risk to human or animal health or to the environment, or which does not comply with the provisions on undesirable substances, cf. Section 6 shall immediately inform the Plantedirectorate, regardless of whether batches have been destroyed or agtes destroyed.
Paragraph 2. Signature shall also take place in the case where the owner or possesses assumes or has reason to assume that a feed will be able to constitute the one in paragraph 1. 1 mentioned risk or that a feed does not comply with the provisions on undesirable substances, cf. Article 20 of the Food Regulation.
Paragraph 3. The notification must contain information which may identify the feed batch and all available information to track the batch and to describe the risk to or be considered by the parties or parties concerned. In addition, the notification shall include a description of the actions undertaken in order to counteract the risks of human or animal health or the environment.
Chapter 2
Feedingstuffs and compound feedingstuffs
§ 4. Feedingstuffs and compound feedingstuffs, including feed for special nutritional purposes, may only be manufactured, placed on the market and shall be applied in accordance with the provisions of Annex 3, the animal register and the marketing regulation.
Paragraph 2. Feedingers fall within the scope of Article 7 of the TSE Regulation and Annex IV may be used only as specified in the Regulation.
Paragraph 3. The person responsible for marketing food for particular nutritional purposes shall be able to provide data and information that proof that the feed is in accordance with Annex 3. If the information is available in an easily available publication, a reference to the publication is sufficient.
Chapter 3
Feeding additives and premixtures
§ 5. Feedingstuffs and premixtures may be placed on the market only and applied in accordance with the provisions of the feedingstuffs Regulation.
Paragraph 2. Feed additives approved in accordance with Council Directive 70 /524/EEC concerning additives in feedingstuffs must be manufactured, placed on the market and used in accordance with Article 10 of the Fodder additive Regulation and must comply with the provisions, as well as : in Annex 4, in this notice, as in the approval.
Paragraph 3. Feed additives approved in accordance with Council Directive 82 /471/EEC concerning certain products used in animal nutrition, that is, ' amino acids, their salts and analogues ' and ' urine and derivatives ' shall be manufactured, marketed and be used in accordance with Article 10 of the feedingstuffs Regulation and comply with the provisions of Annex 5 and Annex 5, table, in this notice.
Chapter 4
Undesirable substances and pesticide residues
§ 6. Feedingstuffs containing undesirable substances in greater quantities than those laid down in Annexes 6, Table 1 and 2 above may not be placed on the market or used for feeding. In Annex 6, Table 1 and 2, the maximum permissible maximum levels of undesirable substances in the case of feed are not permitted in the case of any undesirable substances applicable to full feedingstuff, in the light of the quantity prescribed for use, of the subsidy feed.
Paragraph 2. Products intended for feeding, containing undesirable substances in greater quantities than those listed in Annexes 6, Table 1 and 2, may not be mixed with the same product or feed for the purpose of diluting.
§ 7. For pesticide residues in feedingstuffs, the Regulation on maximum levels for pesticide residues is applicable.
Paragraph 2. For the substances aldrine, dieldrine, camphechchlorine, chlordan, DDT, endosulfan, endrine, heptachlor, hexachlorcyclohexane, and hexachlorine benzene, the maximum limit values set out in Appendix 6, Table 1.
Salmonella
§ 8. Feedingstuffs registered in section 14 shall have a duty to prevent and combat salmonella bacteria in animal feed, cf. the requirements of the animal feed hygiene Regulation.
Paragraph 2. Feed for breeding flocks including breeding for breeding flocks of breeding flocks including for breeding here and for carcases (of the species Gallus gallus) and turkeys, must be treated as heating, so that the feed has obtained a temperature of 81º C in the process flow. However, the whole cores of cereals and whole seeds of seed exempted from the demand for heat treatment if it is protected from cross-contamination during storage, handling and transport.
Paragraph 3. Where, in the fodder, salmonella bacteria, which may be presumed to constitute a hazard to human or animal health, the undertaking has a duty to treat the feed effectively to minimize the risk, to use the feed for a purpose other than feeding ; or destroy the feed.
Paragraph 4. Where salmonella bacteria is shown in the production, storage or transport equipment, the undertaking has a duty to combat these.
Chapter 5
Export and Import
§ 9. In the marketing of feed in a non-member state, the provisions of Article 12 of the Food Regulation shall apply to the provisions of Article 12 of the Food Regulation.
§ 10. The import of feed referred to in Annex I to Regulation No 2 ; 669/2009, or to which the regulations of the European Union are subject to special conditions, have been associated with it, cf. in Annex 2, no. 14-16, must be notified to the plant directorate at least 24 hours before arrival, cf. Article 17 (1). 1, in the control regulation.
Paragraph 2. Imports of products referred to in paragraph 1. 1 shall be carried out over an approved inspection post.
Paragraph 3. The application for approval of the control site shall be sent to the Directorate-General and shall comply with the requirements of Article 4 of Regulation 669/2009. In addition, it is a condition of the approval that :
1) the establishment is approved for "temporary termination" at SKAT, and
2) that the warehousing room or storage area is not at the same time being used for the second storage of feed.
Chapter 6
Packaging and marking
§ 11. In the case of marketing, feed shall be packed and labelled in accordance with the provisions of the marketing regulation.
Paragraph 2. Feedingstuffs must not in the context of the marketing of feed mention that the feed or company is under the control of the Plant.
§ 12. In the marketing of feed materials and compound feedingstuffs approved in accordance with Council Directive 82 /471/EEC of certain products used in animal nutrition, that is, ' amino acids, salts and analogues ' ; and ' urea and derivatives ` shall, in addition to the consequences of the marketing regulation, be labelled in accordance with the provisions of Annex 5 and Annex 5, the table, in this notice.
Paragraph 2. In the case of labelling of feed materials in compound feed for non-food-produced animals, other than furry animals, the category names listed in Annex 7 may be used.
Paragraph 3. The content of feed medicinal products shall be declared in accordance with the provisions of the notice on the production and negotiation etc. of feed medicinal products for animals or proclamations relating to the production and negotiation, etc. of feed medicinal products for fish.
§ 13. There are supplementary provisions on labelling, in accordance with the provisions of the TSE regulation, the BiProduct Regulation, the GM food and feed regulation, the GMO traceability and labelling system and the feedingstuffs regulation.
Chapter 7
Registration and approval of feedingstuffs
§ 14. Any feed business must be registered or approved by the Plant Directorate, cf. Articles 9 and 10 respectively of the Animal Health Regulation.
Paragraph 2. For changes in the activities of the feed undertaking, this shall be communicated to the Directorate-General for the purpose of changing registration or approval, cf. Article 16 of the Animal Health Regulation.
Paragraph 3. Feedingstuffs involved in some of the activities referred to in the TSE Regulation, cf. Article 7 and Annex IV shall be registered or approved by the Board of Directors.
Paragraph 4. Feedingstuffs which deal with certain activities covered by Articles 24 and 44 of the by-product Regulation shall be approved by the Directorate-General for this purpose.
Paragraph 5. The unit of the feed company is identified by the CVR register (s), if any such unit exists for the unit. If P-no. does not exist, assign the unit directorate to a PD ident.
§ 15. Agriculture, which deals only with the primary production of feed materials, which provides these to other farms for use on these, shall be registered and comply with the provisions of the Animal Health Regulation if :
1) the producer provides more than 5 tonnes of feed materials per year ; calendar year, or
2) if a recipient of feed materials is more than 20 kilometres from the manufacturer.
Paragraph 2. The animal hygiene Regulation shall not apply to agriculture which feeds on animals and which only sells at the stables, cf. Article 2 (2) of the Regulation. (b) 2 (b).
Paragraph 3. Notwithstanding paragraph 1 2 shall be subject to the requirements of the Animal Health Regulation in accordance with the requirements of the Animal Health Regulation, cf. Article 2 (2) of the Regulation. 3 if they
1) sells unopened carcasses of poultry and rabbit to the final consumer at the stables, or
2) sells hunting game which has been fed, raw milk or eggs to the final consumer at the stableor or supplying these products to retail trade locally.
§ 16. The application for registration or approval pursuant to section 14 shall be submitted to the Directorate-General. An application document can be obtained from the Plant Directorate, if applicable, at www.pdir.fvm.dk.
Paragraph 2. Agriculture submitting an application for the Single Payment Scheme shall not submit a separate registration scheme to the Plant Directorate.
Paragraph 3. Farm that has reported information to CHR (Central Livestock Register) or which has reported information in the GHI (Gull and Livestock Report) that agriculture uses feed additives in pure form or in the form of premixtures ; shall not submit a separate registration scheme to the Plant Directorate.
§ 17. The Directorate-General may recall the registration or approval of a feed undertaking by section 14 for activities to which registration or approval is carried out, where it is found that the feed company no longer fulfils the conditions of : to be registered or approved for the activities concerned.
Chapter 8
Adj to Vetstat
§ 18. Livestock users shall at the purchase of premixtures and compound feed containing coccidiostats shall inform the seller of the CHR number of the livestock farm in which the feedingstuffs in question is to be used. These livestock users are end users of the feed additives mentioned.
Paragraph 2. Feedingstuffs, which to end users provide premixtures and compound feedingstuffs containing coccidiostats, for each of the animal feed additives, the information referred to in paragraph 1 shall be reported to each of the feed additives. Five, to the Vetstat. Notification shall be made by the 10th of the 10. for each month. The report shall include information on the deliverability of the preceding month for end users, cf. paragraph 1. The deliveries must be reported on the information given by CHR numbers. Deliverable deliveries without CHR number must be reported on the fictional CHR number 999999. The report shall, in this case, be combined for the same feed additive in the same concentration.
Paragraph 3. For the reports referred to in paragraph 1, 2 the report must use their CVR number as the alert ident.
Paragraph 4. For end-users directly from other EU countries or third countries, premixtures or compound feedingstuffs containing coccidiostats content shall apply as follows :
1) For each of the feed additives, the information referred to in paragraph 1 shall be reported. Five, to the Vetstat.
2) The report shall be made by 10. for each month.
3) The report shall contain information about the prior month's purchase of premixtures or compound feedingstuffs containing coccidiostats.
4) The deliveries must be reported on the CHR number of the livestock farm where the feed materials are used.
5) As a report-ident, end users must use their own CVR number.
Paragraph 5. Feedingstuffs which produce premixtures containing coccidiostats, and end-users must, cf. paragraph 2 and 4 reporting the following information on premixtures and compound feedingstuffs containing coccidiostats content :
1) the identification number of the feed additive,
2) the quantity of forage as specified in kilograms of premixture or compound feedingstuffs,
3) active substance content, expressed in mg/kg,
4) date of delivery and
5) the animal species for which the feed is intended.
Chapter 9
Inspection
§ 19. The Directorate-General will check that feed business operators comply with the provisions of feed legislation, including the European Union regulations on animal feed.
Paragraph 2. The Board of Directors shall carry out tests to verify that feed business, including agriculture, complies with the provisions of feed legislation. Feedinges produced for the placing on the market of a non-member state of the European Union shall be subject to the checks.
Paragraph 3. After Section 2 (2), 4, in the Act of feedingstuffs law, the Directorate-General shall communicate the injunction and prohibitions deemed necessary to ensure compliance with feed legislation, including the regulations of the European Union with effect for feed and feed business, cf. the list of these Regulations in Annex 2. The Directorate-General may, in particular, prohibit the use of a batch or batch of feed until the result of the initiation of the investigation. The Directorate-General may also determine that feed that does not comply with the rules must be brought into line with these, that they must be used for purposes other than feeding that they must be destroyed that the feed is to be called back from : at a later stage, the production of which or the sale of feed must be temporarily suspended or feed in the country must be returned.
Stk.4. The cost of fulfillment and prohibition shall be granted in accordance with paragraph 1. 3 shall be the responsibility of the measures against which the measures are intended.
Chapter 10
Publication
20. The control and analysis results of the plant directorate shall be published.
Chapter 11
Penalty provisions
§ 21. The violation of the following provisions shall be punished by fine :
1) ~ § 2-6, § § 8-15 and § 18,
2) the provisions of Regulation (EC) No 2 of the European Parliament and of 999/2001 of 22. May 2001 laying down rules for the prevention, control and eradication of certain transmissible spongiform encephalopathies, with subsequent changes,
3) the provisions of Regulation (EC) No 2 of the European Parliament and of 8/178/2002 of 28. In January 2002 on general principles and requirements in food law, the establishment of the European Food Safety Authority and on food safety procedures,
4) the provisions of Regulation (EC) No 2 of the European Parliament and of 1069/2009 of 21. Oct 2009 on animal by-products and derived products that are not intended for human consumption and repealing Regulation (EC) No (EC) No (EC) No (EC) No (EC) No (EC) No 1774/2002 (Regulation on animal by-products),
5) the provisions of Regulation (EC) No 2 of the European Parliament and of 1829/2003 of 22. September 2003 on genetically modified food and feed,
6) the provisions of Regulation (EC) No 2 of the European Parliament and of 1830/2003 of 22. September 2003 on the traceability and labelling of genetically modified organisms and the traceability of food and feed produced from genetically modified organisms and amending Directive 2001 /18/EC,
7) the provisions of Regulation (EC) No 2 of the European Parliament and of 1831/2003 of 22. September 2003 on feed additives,
8) the provisions of Regulation (EC) No 2 of the European Parliament and of 2160/2003 of 17. November 2003 on the control of salmonella and other specific food-borne zoonotic agents,
9) the provisions of Regulation (EC) No 2 of the European Parliament and of 183/2005 of 12. January 2005 on the requirements of feed hygiene,
10) the provisions of Regulation (EC) No 2 of the European Parliament and of 396/2005 of 23. February 2005 on MRLs for pesticide residues in or on vegetable and food of animal origin and feedingstuffs amending Council Directive 91 /414/EEC,
11) the provisions of the European Parliament of the Council Regulation (EC) No, 767/2009 of 13. July 2009 on the marketing and use of animal feed, amendment of Regulation (EC) No 2 of the European Parliament and of the Council. The following March 2010 laying down specific conditions concerning the import of guar-rubber originating in or consigned from India as a result of the risk of contamination with pentachlorophenol and dioxins and repealing Decision 2008 /352/EC, or

The year 2011, on the implementation of Regulation (EC) No, of the European Parliament and 1069/2009 on health rules for animal by-products and derived products not intended for human consumption and for the implementation of Council Directive 97 /78/EC in respect of certain samples and articles exempted from veterinary checks at the time of the inspection by the Council ; the limit as referred to in the same Directive.
Paragraph 2. Failure to comply with an injunction or prohibition notified in accordance with section 19 (1). Three, punishable by fine.
Paragraph 3. Companies can be imposed on companies, etc. (legal persons) punishable by the rules of the penal code 5. Chapter.
Chapter 12
Entry into force
§ 22. The announcement shall enter into force on 4. March, 2011.
Paragraph 2. Publication no. 1023 of 27. The end of August 2010 on feed and feed business shall be deleted.
Paragraph 3. Foods for pet animals, tagged by the provisions of the notice of publication No 2 ; 1177 by 11. October 2007 on feed and feed business may be placed on the market until 31. In August 2011, and can then remain on the market until the stocks are emptied.

Feed for particular nutritional purposes may be placed on the market only if the nutritional objectives are shown in the table below, and it satisfies the other provisions of the table.
|

If a group of feed additives is specified in the table, column 2 or 4, they must be approved and have the essential nutritional properties specified.
|
3.
|
If a feed material must satisfy more than one particular nutritional purpose, it shall be in accordance with the corresponding information in the table.
|
4.
|
In the case of more than one group of nutritional properties in the table, column 2, indicated by ' and/or ` for the same nutritional purposes, the producer may, in order to satisfy the special nutritional uses specified in the table, column 1, either select :

For each option, the table, column 4, has been determined for the corresponding label information.

Where the origin of the ingredients or analytical components in accordance with the table, column 4 is indicated, precise information shall be given that makes it possible to assess whether ingredients and constituents are in accordance with the main objectives ; nutritional properties.

|
The environment according to the table, column 4, concerning analytical best-case components and additives, must be quantitative.
|
7.
|
If, in the table, column 4, the indication of a substance that is also approved as a feed additive is required and the words ' in total ` shall be indicated by the reference to :

the natural amount if it is not in question, or,

|

the total quantity of the naturally occurring substance and the quantity added to the feed additive.

8.

When the particulars set out in the table, column 4, have been added "if added", the particulars must be indicated on the label if :

The recommended service period specified in the table, column 5, is the range within which the nutritional objective should normally be met.

Appendix 4
Transitional provisions concerning the use of feed additives
(Chapter 3)
|
Foot additives approved in accordance with Council Directive 70 /524/EEC must also comply with the provisions of the feedingstuffs Regulation in accordance with this Annex and in the approval.
|
|
I. General provisions on the use of additives :
|
A.
|
Additives may only be used in the manufacture of feed with the restrictions set out in the approval of the animal species or category of animal, the minimum and maximum content of the feed and the category of animal feed to which additives may be used ; To. In the case of "animal species or animal category" in the authorization, the additive may be used for all animal species or animal categories.
|
B.
|
Additives may only be used for other than compound feedingstuffs if the approval of the additive is 'All feedingstuffs' in the " Special provisions " column.
|
"C."
|
The minimum and maximum levels laid down shall be applicable to full feed of a water content of 12%, unless otherwise specified in the approval.
|
D.
|
The additives shall be used in accordance with the conditions set out in Annex IV, no. 1 and 2 of the feedingstuffs additive Regulation.
|
|
|
II. Supplementary provisions for coccidiostats, vitamin A, vitamin D, copper and selenium :
|
A.
|
In the manufacture of compound feedingstuffs containing coccidiostats, histomonostatics, potassium diformat, vitamin A, vitamin D, copper and selenium for food-producing animals and fur animals, these additives must be added in the form of premixtures with a carrier.
|
B.
|
For premixtures referred to in A, the share of the premixtures of the final feed mixture must be at least 0,2% weight by weight of the premixtures. However, the premixtures may be included down to 0,05% by weight of the compound feedingstuff if :
|
|
1.
|
the qualitative and quantitative composition of the premixtures permit a uniform distribution and thus ensures the content of additives established for complete feedingstuff, and
|
|
2.
|
the feed company using these premixtures has been approved for this production in accordance with section 14 of this notice.
|

|
Coccidiostats must not be mixed with each other when they have the same effect unless there is a mixture set in approval.
|
D.
|
Coccidiostats must not be mixed with micro-organisms, unless this is permitted by the approval of the micro-organism in question.
|
|
III. Supplementary provisions for the use of feed containing additives :
|
The content of other substances, such as proteins or minerals, must be so large that the feed cannot be used as complete feedingstuff, but must be used in conjunction with other feed.
|
|
|
|

Feed additives approved in accordance with Council Directive 82 /471/EEC shall comply with the provisions of the feedingstuffs Regulation and the provisions of this Annex, including the table.

In the case of labelling of feed materials in compound feedingstuffs for animals not used in food production, other than fur animals, the name of the category to which the feed money belongs shall be replaced by the name of the feed materials.
The conditions for this are :
