Annex 1 The full text of the Announcement about pharmacy opening hours and on-call service

Pursuant to § 40 of the law on pharmacy company, see. lovbekendtgørelse nr. 855 of 4. August 2008, fixed opening hours: Chapter 1 section 1. Pharmacies, pharmacy branches and pharmacy outlets can stay open as laid down in Act No. 606 of 24. June 2005 about retail sales from shops, etc., with subsequent amendments.

(2). Pharmacies and pharmacy branches must stay open on weekdays and Saturday during the following times: Monday to Thursday

Friday





KL. 9.00-18.00







Saturday





KL. 9.30-13.30, or

KL. 10.00-14.00





 

 









(3). New year's Eve to pharmacies and pharmacy branches keep open as on a Saturday, see. (2).

(4). Pharmacy sale follows in paragraph 2 and 3 opening hours, which, however, can be waived with up to 6 hours weekly.

(5). Pharmacies, pharmacy branches and pharmacy outlets to signs with the chosen fixed opening hours, see. paragraphs 1 to 4.

Chapter 2 section 2 of the call. By guard service for a pharmacy located in one of the cities that are included in list I of the annex to this order (list of pharmacy), means that the pharmacist contact outside the pharmacy opening hours must be available for the expedition by an officer in charge of a pharmacist, who find themselves at the pharmacy.

(2). By guard service for a pharmacy located in one of the cities, which are listed in Appendix II and Appendix III (a)-(b) of the annex to this notice, shall be taken to mean that the pharmacy during the time the pharmacist is on call service, must be made available for the expedition by an officer in charge of a pharmacist or business consultant, who find themselves at the pharmacy.

(3). If the pharmacy using pharmaconomists, see. (2) the pharmacist must ensure that a pharmacist who is on call on a list of pharmacy can be contacted throughout the vigil service in the event of doubts.

(4). The pharmacist must ensure that there is a written instruction that describes in what situations, a pharmacist must be contacted.

§ 3. § 4. Any pharmacy and pharmacist who does not have on-call service in accordance with the Executive order on sections 5 and 6, are required to comply with a request for the extradition of persons from pharmaceutical drugs, etc. outside the pharmacy opening hours. The obligation applies only if the pharmacist or the pharmacist living in the immediate vicinity of the pharmacy or one of the pharmacy's branches and taken home.

§ 5. In the cities, which are listed in Appendix I of the annex to the Ordinance, establish guard service throughout the period outside the pharmacy opening hours.

(2). In the cities, which are listed in Appendix II of the annex to the Ordinance, establish guard service on Saturdays from 21:00. 5:30 pm until 8 pm. 18:30 and on Sundays and public holidays from 12 noon. 16:00 to 23:00. 18. The pharmacist may, however, place the guard service at other times adapted to local needs.

(3). The Danish Medicines Agency determines which (t) pharmacy (s) in those cities, which must have on-call service.

§ 6. In the cities, which are listed in Appendix III, (a) to (c) of the annex to the Ordinance, one pharmacy have on call service throughout the period outside the pharmacy opening hours.

(2). This call service may, in accordance with the Danish Medicines Agency's detailed provision for the individual city either imposed a pharmacy shall or be alternating between appropriate located pharmacies.

(3). Pharmacies that have on call service and located in the cities, which are listed in Appendix III (a), of the annex to the Ordinance, should have guard service on weekdays until 8 pm. 22:00, on Saturdays until 20:00. 14:00 and from 18:00. 18:00 to 23:00. 22:00, and on Sundays and public holidays from 12 noon. 10.00 to 14.00 and from kl. 18:00 to 23:00. 22.00. Paragraph 4. Pharmacies that have on call service and located in the cities, which are listed in Appendix III, (b), of the annex to this order must be on-call at least 1 hour on weekdays, at least 2 hours on Saturdays, and at least 3 hours on Sundays and public holidays. Guard service must be coordinated with the local vagtlæge system in terms of time and, in fact, be adapted to local needs.

§ 7. The Danish Medicines Agency may, in addition to it in sections 5 and 6 provided to order or allow guard service for a certain period of time outside the pharmacy opening hours where there is a need therefore.

§ 8. The pharmacies, as after the Executive order on sections 5 and 6 are on call or on call service is in the time period of on-call service, or obligation for service on call, each within its natural area, free of charge to let deliver medicines, etc. to the patients. Transit service is subject to the condition that the prescribing physician, dentist or veterinarian deems it necessary that medicinal products, etc. come to consider before these can be obtained in the usual way.

§ 9. By expedition from pharmacies and pharmacy branches under guard service between kl. 20:00 and 23:00. However, on Saturdays from 8.30 a.m. 17:00 and on Sundays and public holidays shall be assigned a fee for the entire expedition (guard fee), see. Consolidated Act on calculation of consumer prices etc. on medicines section 17. The fee, however, is not conferred by guard expedition of prescriptions, dated one of the days covered by the guard.

(2). Customers ' attention should be drawn to the guard in an appropriate manner the fee.

§ 10. The notice shall enter into force on the 1. May 2011.

(2). Executive Order No. 50 of 23. January 2003 about pharmacy opening hours and on-call service shall be repealed.

(3). Waivers and injunctions granted pursuant to section 1, paragraph 3-6 or § 2, paragraph 2 of Decree No. 50 of 23. January 2003 about pharmacy opening hours and on-call service is repealed with the entry into force of this order.
