Publication of the amendment of the notification of aid to producer organisations ' s operating funds in the fruit and vegetable sector 1)

§ 1

Notice no. 1113 of 24. In November 2008, in support of the operating funds of producer organisations in the fruit and vegetable sector, the following changes are made :

1. Inline ITREAS :

" In accordance with section 1, paragraph, 1-5, and section 4, paragraph 4. 1, 5 and 7, in the administration of the European Community regulations on schemes under the common agricultural policy funded by the European Guarantee Fund for Agriculture and so on. (The agricultural aid law), cf. Law Order no. 445 of 23. April 2010 shall be : "

2. I § 1 pasted as paragraph 2 :

" Stop. 2. Following this notice, a temporary subsidy may be granted to austerity measures for producers of fruit and vegetables which are not a member of a producer organisation or a member of a producer organisation whose recognition is suspended by the competent authority. `

3. I § 7 inserted after paragraph 1. 3 as new paragraph :

" Stop. 4. Support for the aid referred to in paragraph 1. 1-3 shall not apply to the calculation of the aid under section 7a. The aid according to section 7a shall be calculated on the basis of the aid ceilings set by the EU and the maximum amount of aid provided for in the EU for temporary aid for crisis measures. `

Paragraph 4-7 shall then be referred to in paragraph 1. 5-8.

5. The following section 7 is inserted :

" Chapter 4a

Temporary contribution to crisis measures

§ 7a. The Ministry of Food, Agriculture and Fisheries may, within the framework of the European Union, provide special subsidies for the implementation of withdrawals, green harvests and not harvesting during the period 26. May to 30. June 2011 for the following products :

1) Tomatoes falling within CN code 0702 00 00

2) Balanced falling within CN code 0705 11 00 and CN code 0705 19 00 and CROWD, endivie and broadblade of endices falling within CN code 0705 29 00

3) Cucumbers falling within CN code 0707 00 05

4) Cute peppers falling within CN code 0709 60 10

5) Courgettes falling within CN code 0709 90 70

Paragraph 2. Withdrawals are the withdrawal of products from the market.

§ 7b. The following may be subject to pre-notification and applications for temporary grants :

1) Recognized producer organisations in the fruit and vegetable sector

2) Producers of fruit and vegetables which are not members of an approved producer organisation in the fruit and vegetable sector

3) Producers of fruit and vegetables, which are members of a producer organisation, whose recognition is suspended by the authorities at the time of notification.

§ 7c. Applicants must complete and submit an advance notice to the Food Business with an indication of CN code, product, variety and quantity. In the light of green harvests and the harvest, the area planted shall be illused. Schema for pre-announcement is found on the Food Business Homepage.

Paragraph 2. The Directorate-General shall carry out physical checks on the products and / or areas on the basis of the application prior to the application.

Paragraph 3. Products pre-announced by a producer organisation, cf. Section 7b (a) and which has been taken into physical control of the Food business and where the withdrawal, green harvests and failing crop operations are carried out before the Plant has carried out physical checks is not eligible for assistance. In the case of products not subject to physical checks, the producer organisation shall require the necessary supporting evidence on the application to repurchase, green harvests or unvetted.

Paragraph 4. Products pre-announced by producers, cf. Section 7b (b) and (c) and where the withdrawal, green harvesting or failing harvest shall be made before the Plant ' s physical checks have been carried out shall not be eligible for entitlement.

§ 7d. Applications for a temporary grant for withdrawals, green harvests and abreast shall be submitted to the Food Erstice after the physical checks have taken place and the admissions has been carried out. A schedule for application is found on the Food Business Homepage.

Paragraph 2. The application deadline is 11. "July 2011."

§ 2

The announcement will enter into force on the 29th. June 2011.

1) The publication shall include certain provisions of the following Regulations : Council Regulation (EC) No, 1234/2007 of 22. October 2007 on the common organisation of agricultural markets and the specific provisions applicable to certain agricultural products (the single CMO) and Commission Regulation (EC) No 1580/2007 of 21. December 2007 laying down detailed rules for the application of Council Regulation (EC) No (EC) No 2200/96, 2201/96 and (EC) No Regulation 1182/2007 concerning fruit and vegetables and Commission implementing Regulation (EU) 543/2011 of 7. June laying down detailed rules for the application of Council Regulation (EC) No (EC) No 1234/2007 as regards fruit and vegetables and processed fruit and vegetables and Commission implementing Regulation (EU) No 2. 585/2011 of 17. June 2011 on temporary exceptional support measures for the fruit and vegetable sector. According to Article 288 of the Treaty on European Union, a Regulation shall apply immediately in each Member State. Consequently, the reproduction of these provisions shall be based solely on practical considerations and shall be without prejudice to the immediate validity of the said Regulations in Denmark ;
