Decree amending the Decree on aid to producer organisations, operational funds within fruit-and grøntsagssektoren1)

§ 1

In executive order No. 1113 of 24. November 2008 concerning aid to producer organisations, operational funds within the fruit and vegetables sector shall be amended as follows: 1. The introductory part shall be replaced by the following: ' under section 1, paragraphs 1 to 5, and section 4, paragraphs 1, 5 and 7, of the law on the administration of the European Community regulations concerning schemes under the common agricultural policy is financed by the European agricultural guarantee fund, etc. (support Act), see. lovbekendtgørelse nr. 445 of 23. 3. In section 7 shall be inserted after paragraph 3 as a new paragraph: "(4). Aid ceilings as set out in paragraphs 1 to 3 shall not apply to the calculation of the aid pursuant to § 7a. Aid under section 7a are calculated on the basis of the aid ceilings laid down by the European Union and those of the EUROPEAN UNION provided maximum support amount for temporary grants to emergency measures. "

Paragraph 4-7 becomes paragraph 5-8.

4. In section 7, paragraph 5-7, there will be 6-8, the words ' paragraph 4 ': ' paragraph 5 '.

5. Pursuant to section 7 shall be added:

Temporary subsidies for crisis measures section 7a. section 7b. The following can advance review and apply for temporary grants: 1) recognised producer organisations in the fruit and vegetable sector 2) Producers of fruit and vegetables who are not members of a recognised producer organisation in the fruit and vegetable sector 3) Producers of fruits and vegetables, which is a member of a producer organisation whose recognition is suspended by the authorities at the time of notification.

§ 7 c. Applicants must complete and submit a prior notification to the Food industry with indication of CN code, product variety and quantity. By green harvesting and non-harvesting shall be the area planted to be supplied. Form for advance notice exists on Food Business website.

(2). The Danish plant Directorate conducts physical inspections of the products and/or areas on the basis of the applicant's prior notification.

(3). Products, which are supplied by a producer organisation referred to in article 6. section 7b, subparagraph (a), and which are selected for physical inspection of Food profession and where withdrawal, green harvesting and non-harvesting shall be carried out before the Danish plant Directorate has carried out a physical check, are not eligible. For products that are not selected for physical checks, the producer organisation shall furnish necessary documentation when applying for withdrawal, green harvesting or non-harvesting has taken place.

(4). Products, which are supplied by manufacturers, without prejudice. section 7b, (b) and (c), and where withdrawal, green harvesting or non-harvesting shall be carried out before the Danish plant Directorate has carried out a physical check, are not eligible.

§ 7 d. Application for temporary subsidies for withdrawals, green harvesting and non-harvesting shall be submitted to the Food Business after physical check has taken place, and the measure is implemented. Application form can be found at Food Industry website.

(2). The application deadline is 11. July 2011. '
