Publication of the amendment of the notification for the approval of advisers on the food sector 1)

(Implementation of the Services Directive)

§ 1

Notice no. 121 by 15. In February 2008, on the approval of advice on the food sector, the following changes are made :

1. As footnote the following shall be added to the title of the notice :

" 1) The commotion contains provisions which implement parts of the directive of the European Parliament and of the Council. 2006 /123/EC of 12. In December 2006 on services in the internal market (EU Official Journal of the European Union, L 376, p. 36). "

2. I § 1 pasted as paragraph 2 :

" Stop. 2. For the purposes of this notice, any natural or legal person who uses or wishes to use a service shall be understood to mean any natural or legal person who applies or wishes to use a service.

3. I § 4 pasted as paragraph 3, 4, 5 and 6 :

" Stop. 3. No later than 10 working days after receipt of the application, the Food Authority shall send a receipt to the applicant for information on :

1) the time-out period,

2) that the applicant must not start the notified activity before the approval has been received from the Food Authority, and

3) redress.

Stk.4. The Food Safety Management Board shall decide on approval pursuant to section 6 and 7 no later than four weeks after receipt of the application.

Paragraph 5. The period laid down in paragraph 1 4 may be extended once, if the complexity of the case justifies it. The FDA shall justify the extension and duration of the extension and shall forward this to the applicant before the expiry of the time limit laid down in paragraph 1. 4.

Paragraph 6. Consulting as part of the announcement of food business operators must not be commended before the applicant has received approval from the Food Authority. `

4. After Section 13 is inserted in Chapter 5 :

" § 13 a. The Food business shall inform the recipient of the contact information to the Food Authority. ` ;

5. Section 14, paragraph 14. 1, ITREAS :

" With fine punishment, the one who

1) in violation of section 4 (4). 6, section 13 a,

2) use personnel who do not comply with the requirements of section 5 (5) ; 1 and 2,

3) does not have and follow a system as mentioned in section 7,

4) have not taken measures, as referred to in Article 8, or

5) do not communicate information referred to in paragraph 11 (1). One and two, and section 12. "

§ 2

The announcement will enter into force on the 12th. February, 2010.
