Law on the amendment of the right to sustainable biofuels 1)

(Ply for importers or producers of petrol, gas or diesel for the reduction of greenhouse gases from transport, etc.)

We, by God's grace, the Queen of the Danes, do our thing.

The parliament has adopted the following law, and we know that the following law has been approved by Parliament's consent :

§ 1

Law no. 468 of 12. In June 2009 on sustainable biofuels, the following changes are made :

1. Loven title ITREAS :

'The promise of sustainable biofuels and the reduction of greenhouse gases from transport'

2. Foot notation the title shall be replaced by the following :

" 1) The law shall implement parts of Directive 2009 /28/EC of the European Parliament and of the Council of 23. April 2009, on the promotion of the use of renewable energy sources and amending and subsequent repealing of Directive 2001 /77/EC and 2003 /30/EC, EU-Official Journal 2009, nr. L 140, page 16, and parts of Directive 2009 /30/EC of the European Parliament and of the Council of 23. April 2009 amending Directive 98 /70/EC as far as the specifications for petrol, diesel and gas oil are concerned and the introduction of a mechanism for monitoring and reducing greenhouse gas emissions and amending Council Directive 1999 /32/EC for then the specifications for fuel used in inland waterway navigation, and repealing Directive 93 /12/EEC, EU Official Journal 2009, nr. "L 140, page 88."

3. I § 1 the following shall be inserted after ' land transport ' means : 'and to reduce the cradle of the tomb of greenhouse gas emissions from transport'.

4. § 2 ITREAS :

" § 2. For the purposes of this Act :

1) Biofuel : Liquid or gaseous fuels for the use of the transport sector produced on the basis of biomass.

2) Biomass : The biodegradable part of products, waste and residues of the biological origin of agriculture, including vegetable and animal substances, forestry and related industries, including fisheries and aquaculture, and the biodegradable part of industrial waste and municipal waste.

3) Fuel : Gas, diesel, gas or biofuel to the transport sector.

4) Greenhouse gases : CO 2 , CH 4 and N 2 O.

5) Eleccaterer : The unit responsible for the expedition of electricity through an excise collection site and which provides electricity for use in road vehicles.

6) Emissions of greenhouse gases per year. energy unit : The total mass of CO 2 -equivalence of greenhouse gas emissions linked to the fuel or to energy, divided by the fuel feats or of the combined energy content of the energy. In the energy content of fuel, the energy content of the fuel is expressed as its lower combustion value.

7) Land transport : Drift of road vehicles and railway operations.

8) Transport : Drift of road vehicles, railways and mobile non-road machinery, including vessels for inland waterway navigation, when they are not at sea, agricultural and forestry tractors, and recreational craft when they are not at sea.

9) Company : Importers or producer of petrol, gas or diesel fuels.

10) Vugge to tomb-emission of greenhouse gases : All Net emissions of CO 2 , CH 4 and N 2 O that can be attributed to the fuel, including all non-mixed components, or inferred energy. This includes all relevant stages of extraction or cultivation, including the change of land use, transport and distribution, processing and incineration, irrespective of where these emissions are carried out. `

5. Insert after section 3 :

" § 3 a. In accordance with the rules laid down by the climate and energy minister each year, according to rules laid down by the Climate and Energy Minister every year, the Energy Management Board shall report on the greenhouse gas intensity of the fuels and electricity for use in road vehicles, cf. § 3 e, which in Denmark has been supplied by the company.

§ 3 b. Establishments must gradually reduce the cradle to the tomb of greenhouse gas emissions per year. energy unit from supplied fuel and electricity for use in road vehicles, cf. section 3 e, with at least 6%. by 31. December 2020.

Paragraph 2. The climate and energy minister may lay down rules to reduce the reduction in accordance with paragraph 1. 1 shall be 2%. by 31. December 2014 and 4%. by 31. December 2017.

Paragraph 3. The climate and energy minister may lay down rules that the undertakings in excess of the requirements referred to in paragraph 1 shall be made. 1 that has been reduced to 6%. a further reduction of 2 pct; to be met by 31 shall be reduced. December 2020 by providing electricity for use in road vehicles, cf. section 3 e, or by using technology restricting the cradle to the tomb-emissions per energy unit from supplied fuel and energy.

Paragraph 4. In addition to the one in paragraph 1. 1 that has been reduced to 6%. and any obligation laid down in accordance with paragraph 1. 3 the climate and energy minister may provide for reductions in the fuel supply sector for a further reduction of 2 pctates to be met by undertakings not later than 31. In December 2020, the purchase of credits under the conditions laid down in the European Parliament and Council directive on a scheme for greenhouse gas emissions trading in the Community is being purchased.

Paragraph 5. The climate and energy minister lay down rules on the method for calculating the cradle of fuels on the ground-emission of greenhouse gases.

Paragraph 6. The climate and energy minister lays down rules on the method for establishing the basis for the reduction obligation, cf. paragraph 1.

§ 3 c. Companies can agree that they will, in whole or in part, meet their obligations under section 3 b.

§ 3 d. To the extent that a company will use biofuels to fulfil its obligations under Section 3 b, biofuels can only be counted as biofuels that meet requirements for the sustainability of biofuels in rules laid down in Article 4.

§ 3 e. Elders may choose to contribute to an undertaking ' s reduction obligations in accordance with section 3 b if the supplier of the supplier can demonstrate that this may adequately measure and monitor the electricity supplied for use in road vehicles.

Paragraph 2. The climate and energy minister shall lay down detailed rules on the method for calculating electricity for use in the electric road vehicles. `

6. I § 4 the ' and the sustainability of biofuels ' shall be replaced by : ', the sustainability of biofuels and the reduction of greenhouse gases from transport'.

7. I Section 5 (5). 1, is inserted after ' Section 3 (1). 1, ' or section 3 (b) (b) ; 1, "

8. I Section 5 (5). 1, is inserted after ' Section 3 (1). 5, " : section 3 b, paragraph. 2-4, "

9. I Section 5 (5). 2, the following shall be inserted after ' as mentioned in Section 3 (1). 4, ":" or § 3 c, ".

10. I Section 6 (2). 3, is inserted after "Accredited Certification" : ", Verification".

11. I § 6 pasted as paragraph FOUR :

" Stop. 4. The cost of accredited certification, verification or inspection by rules laid down in accordance with paragraph 1. 3 is the responsibility of the company or the supplier. `

12. § 8 ITREAS :

" § 8. Unless higher penalties have been inflished on any other law, the penalty shall be penalised by the penalty which :

1) violates the obligation to comply with Article 3 (1) 1,

2) violates the obligation to comply with section 3 (b). 1, to reduce the cradle of the greenhouse gas emissions of greenhouse gases per year ; energy unit from supplied fuel and electricity for use in road vehicles, cf. section 3 e, with at least 6%. by 31. December 2020,

3) provide false or misleading information or information that is significant for the size of the commitment after section 3 (s). 1,

4) provide false or misleading information or information that is important for the size of the commitment after section 3 b (s). 1,

5) fail to report in accordance with section 5 (4). 1 and 2,

6) omits to provide or provide information in accordance with section 6 (2) ; 2, or

7) omits to comply with the opening of section 7 (2) ; 1.

Paragraph 2. The rules laid down by the law may lay down fines for violation of the rules and rules laid down in accordance with the rules.

Paragraph 3. Companies can be imposed on companies, etc. (legal persons) punishable by the rules of the penal code 5. Chapter. "

§ 2

The law shall enter into force on the 31. December 2010.
