Under section 7 (a), paragraph 6, paragraph 7 (c), paragraph 2, § 10, section 10 (a), section 10 (b) and section 10 (c), of the law on the posting of workers, etc., see. lovbekendtgørelse nr. 849 of 21. July 2006, as amended by Act No. 263 of 23. April 2008, and Act No. 509 of 19. May 2010, fixed: Chapter 1 Register section 1. The Danish Commerce and companies agency keeps a register of foreign service providers (RUT-register) of the basic regulation. § 2.

(2). The Danish Commerce and companies Agency is responsible for the registration, maintenance and development of the register.

§ 2. A foreign company when performing work in Denmark provides services without the deployment of workers to Denmark, or a foreign company posting workers in Denmark in connection with the provision of services, must notify it to the register referred to in article 6. Chapter 3.

(2). An entity shall not be entered in the register and notification in accordance with paragraph 1, without prejudice to article. section 7 (b) of the law on the posting of workers, etc., if: 1) the supply of the service is not more than 8 days, and 2) the delivery of the service is done in the framework of the provision of a technical plant or a technical installation and 3) the seconded employee or self-employed activities, see. section 7 (a), paragraph 2 has the task and is specialized in, or qualified to mount, install, inspect, repair or to inform you about a technical plant or a technical installation in Denmark.

Chapter 2 of the register contents § 3. The register contains basic data on: 1) Foreign companies which, as employers posting employees in connection with the provision of services in Denmark, see. § 4.

2) foreign companies that work in Denmark for the purpose of providing services without the deployment of workers to Denmark.

3) employees who are stationed in an employment relationship in Denmark by a foreign company, see. § 3.

4) services at the nature, place and duration of the basic regulation. section 7 (a) (1). 2, 3 and 5 and Section 7a (2), nr. 2, 3 and 4.

§ 4 . The register contains the following data about the foreign company: 1) The foreign company's RUT-number, see. Article 10, paragraph 5.

2) company name.

3) company's business address in home country.

4) the company's phone number.

5) the company's e-mail address.

6) company's foreign registration number and place of registration.

7) company CVR-nr. or tax exempt number.

(2). If the company is registered in the central register, the following master data about the company will be delivered from here: 1) Name.

§ 5. The register contains the following data about the expatriate employee: 1) Name.

2) citizenship.

3) Sex.

4) identification type.

5) identification number.

6) Possible birth date.

7) Start date of the period of secondment.

8) end date of the period of secondment.

§ 6. The register contains the following data about the expats company contact person on performance: 1) Name.

2) citizenship.

3) Sex.

4) type Identification (passports, visas, driving license, identity card).

5) identification number.

6) Possible birth date.

7) Start date of the period of secondment.

8) end date of the period of secondment.

9) phone number.

10) work and residence address.

§ 7. The register contains the following data about the service: 1) Start date for delivery of the service.

2) end date for delivery of the service.

3) Industry.

§ 8. The register contains the following data relating to the various places of work: 1) Workplace addresses for delivery of the service.

2) Start date per working place for the delivery of the service.

3) end date per working place for the delivery of the service.

4) number of persons per working place for the delivery of the service.

Chapter 3 Review for registration in the register of section 9. Review for inclusion in the register shall contain the information set out in section 4, paragraph 1, and articles 5, 6, 7 and 8.

§ 10. Notification to the register as well as changes to the registered information, shall be made to the Danish Commerce and companies Agency.

(2). Registration pursuant to paragraph 1 can only be done via the Danish Commerce and companies agency electronic self-registration system at www.virk.dk.

(3). Notification to the register of foreign service providers must be carried out by either the foreign business owner, the Danish contact person or a company of other authorised person.

(4). Notification must take place no later than at the same time that the supply of the service in Denmark begins. Changes concerning the information to be notified no later than 8 days after the change.

(5). During the registration procedure assigns the Danish Commerce and companies Agency the foreign company a unique identification number (RUT-number).

(6). When registering will receive a receipt by the notifier.

Chapter 4 access to and use of data from the register section 11. Any can from the Danish Commerce and companies Agency access to the data, as recorded in the register, with the exceptions and on the conditions laid down in § § 12 – 17.

§ 12. Data from the register to persons other than the Danish authorities will be limited to the following: 1) company name, business address and contact information.

2) Place of delivery of the service.

3) contact person for the company.

4) the company's industry group code.

(2). The information referred to in paragraph 1, are publicly available at www.virk.dk.

§ 13. The transmission from the register includes information about individual units or whether all the units are recorded in the register.

(2). By disclosure of information from the register of all units passed on the information that can be communicated to the person concerned in accordance with sections 11 and 12.

(3). Information from the register shall be made by subscription scheme available on an ftp server and by single extraction via e-mail.

§ 14. Data received from the register via subscription or by single extraction, see. section 13, paragraph 3, must only be used for internal use and is not passed on to third parties. It is not allowed to disseminate or publish the data received from the register via subscription or by single extraction for third parties.

§ 15. Danish authorities may only use information received from the register: 1) in connection with their control of whether companies comply with the law, which applies in connection with posting, and 2) to statistics on foreign businesses and expatriate workers.

§ 16. Data from the register shall not be used with commercial purpose or commercial context. This refers to all forms of sale, advertising inquiries or other requests that do not have specific legal basis in the law, rules, issued pursuant to the law, or consent.

§ 17. Everyone is entitled to upon written request to the Danish Commerce and companies Agency to find out the basic data that are recorded in the register of the person concerned.

Chapter 5 Penalty section 18. Anyone who fails to report information in a timely manner, in accordance with article 3. section 7 (a), be punished by a fine.

(2). That can be imposed on companies, etc. (legal persons) criminal liability in accordance with the provisions of the criminal code 5. Chapter.

Chapter 6 Payment section 19. For access to information from the register via subscription or by single extraction, see. section 13, paragraph 3, shall apply the fees set out in annex 1.

Chapter 7 entry into force of § 20. The notice shall enter into force on the 1. January 2011.

(2) Decree No. 301 of 6. April 2009 concerning the Register of foreign service providers (RUT-register), is repealed.
