Report on prohibition of certain types of fishing in closer areas of Kattegat and northern part of Øresund

Pursuant to Section 34 and § 130(2) and 4 of the Act on fishing and fishing (the fishing law), in accordance with the Act of Law No. 978 of 26 September 2008, and by authorisation,:

§ 1. In Kattegat and northern Øresund, in detailed areas, areas are subject to restrictions on commercial and recreational fishing. §§ 2 - 3 and § 5.

§ 2. In an area called area No. 1 located in the southeastern Kattegat and northern Øresund and bordered as specified in Annex 1, seasonal prohibition is established against commercial and recreational fishing. In the part of the area located in Kattegat, the prohibition of the period from 1 January to 31 March and in the part of the area located in the Øresund applies to the ban in the period from 1 February to 31 March. The border between Kattegat and Øresund is the right line between Gilbjerg Head and Kullen.

Substances. 2. Except from the ban in paragraph 1 is:

1) Trawl fishing with selective tools that reduce beard of cod to a minimum, cf. section 4.

2) Fishing after herring with the planerawl.

3) 3) Fishing of lobster and crabs with teajner.

4) Fishing after stone bites with yarn with stitch size of at least 220 mm.

5) recreational fishing that is not targeted for cod.

§ 3. In an area called area No 2 located in the southeast Kattegat and bordered as specified in Annex 2, a closed area is established with prohibition of any type of commercial and recreational fishing during the period from 1 January to 31 December.

Substances. 2. Except from the ban in paragraph 1, fishing of lobsters and crabs with tejner.

3. Except from the ban in paragraph 1 is in the period from 1 April to 31 December:

1) Trawl fishing with selective tools that reduce beard of cod to a minimum, cf. section 4.

2) Fishing after herring with the planerawl.

3) 3) recreational fishing that is not targeted for cod.

§ 4. Requirements for the design of tools that can be legally applied pursuant to Section 2(2)(2), 1 and Section 3(3) of Annex 4.

§ 5. In an area called area no. 3 located in the southeast Kattegat and bordered as specified in Annex 3, a permanent closed area is established with prohibition of any type of commercial and recreational fishing during the period from 1 January to 31 December. No exceptions apply from the ban.

§ 6. With fines, the one who violates or tries to breach §§ 2 - 5.

Substances. 2. Companies, etc. (legal persons) criminal liability under the rules of Chapter 5 of the Criminal Code.

§ 7. The decision shall enter into force on 21 April 2010.

Substances. 2. Decision No 182 of 13 March 2009 on prohibition of certain types of fishing in the area of Kattegat and northern part of the Øresund is repealed.

Annex 4

Requirements for tools that can be legally used for fishing in the specified areas of Kattegat and Northern Øresund, cf. section 4 and section 2(2)(b) and section 3(3), no. 1 and Section 3(3), No. 1

The requirement for selectiveness in the above provisions is met, using trawl tools designed as described below:

1) Trawl tool mounted with Swedish maidhummerrist
a) The artsselektive grate should be mounted in trawl, if the sealing bag consists of square masks with a stitch size of at least 70 mm, but under 90 mm. The prisoner must be at least 8 m long. It is forbidden to use trawl on over 100 square masks in the circle of the catch bag, apart from stitching and seamliners.
b) The Risten must be rectangular. The three-piece of the Rist must be parallel to the rist. The distance between the threemms must not be 35 mm. It is allowed to use one or more hinges, so the rice can be easily stored on the net drum.
c) The Risten must be mounted diagonally in the trawl with the edge of the grate backwards and upwards. It can be mounted just in front of the catch bag or longer promote the extension piece. The Risten must be attached to the trawl on all sides.
d) In the top panel of the trawl, there must be an unblocked opening where the fish can escape. The release opening must be as wide as the rice and in front of a tip where the sides are cut along the mask chair on each side of the rice.
(e) It is allowed to attach a funnel scheme in front of the rice to lead the fish against the bottom of the trawl and the rice. The mask size in the funnel must be at least 70 mm. The stem must have a vertical opening at the rice at least 15 cm. The opening of the rice must be as wide as the rice.
2) Trawl tool mounted with seltra catch bag with sorting window with stitch size of at least 300 mm
The Seltrafangst bag must consist of a square mesh section of 6 metres in length and 4 sides that are just wide. The sides are made of traditional masks with a stitch size of at least 90 mm. Each side of the seltra catch bag must consist of a maximum of 25 stitches apart from the ones used for sewing and nailliners. In the top section, a 3 meter long sorting window that ends maximum 3 metres from the end of the catch bag. The blacking window should have a stitch size of at least 300 mm and consist of 3 open square masks in the width. When mask size of at least 400 mm must be used 2 open square masks in the width. Schematic drawing appears in fig. 1.
3) 3) Topless trawl mounted with seltra catch bag with sorting window with stitch size of at least 175 mm
By a topless trawl, a standard trawl is understood, where there is no changes in the tool's lower half, which is the part of the tool that is under the side seam, but where the traditional wings are removed from the tip of the wing to the point A (see fig. 2) so that the seam in the wing will then constitute the cast of the tool. From the point A is carried out a cutting, e.g. 1N4B, back in the trawl so that the center of the overcrow (point C on Fig. 3) is led at least 6 metres (the distance D) behind the center of the sub-folder (point B of Fig. 3). The cutting can also be sharper, e.g. 1N5B or more. This cutting must be one in the right and left side (see fig. 3). The cutting rate must be one until the minimum distance (D) of 6 metres between B and C is achieved. The cutting rate can then be changed. There must not be empty, liner, net pieces or similar arrangements that go over the topless part of the tool or otherwise can obstruct this opening in the tool. The Seltrafangst bag mounted in a topless trawl must consist of a square mesh section of 6 metres in length and 4 sides that are just wide. The sides are made of traditional masks with a stitch size of at least 90 mm. Each side of the seltra catch bag must consist of a maximum of 25 stitches apart from the ones used for sewing and nailliners. In the top section, a 3 meter long sorting window that ends maximum 3 metres from the end of the catch bag. The blacking window should have a stitch size of at least 175 mm and consist of 5 open square masks in the width. When mask size of at least 200 mm must be used 4 open square masks in the width.
