Law amending the law on veterinary surgeons and law on keeping of animals

(Compulsory Health advice, etc.)

WE, MARGRETHE the SECOND, by the grace of God Queen of Denmark, do indeed:

The Danish Parliament has adopted and we know Our consent confirmed the following law:

§ 1

In Act No. 433 of 9. June 2004 about veterinarians, as amended most recently by Act No. 411 of 28. May 2009, is amended as follows: 1. In article 2, paragraph 1, insert after no. 3 as the new number: ' 4) to exercise veterinary health advice to the owner of a crew or his representative as part of a regime established pursuant to the provisions of this law, '

No. 4 and 5 is then no. 5 and 6.

2. In section 4, paragraph 2, shall be replaced by ' section 2 (1) (8). 2-5 ': ' § 2 (1) (8). 2-6 '.

3. In article 6, paragraphs 1 and 4, the words ' article 2, paragraph 1, no. 1-3 ' to: ' section 2 (1) (8). 1-4 '.

4. section 13, paragraph 1 is replaced by the following:

' If the conditions set out in article 12, paragraph 1, are met, a veterinarian must not dispense or prescribe prescription medicines to the crew of the owner or his representative, after treatment of adult bovine animals, referred to in article 6. However, section 14, paragraphs 1 to 4. '

5. section 14 shall be replaced by the following: ' § 14. If the owner of a pig or cattle herd has concluded a written agreement on the Basic module in a health advisory scheme under section 34 a, paragraphs 1 and 2, of the law on the keeping of animals, the veterinarian may prescribe or dispense prescription medicines to the owner or his representative to the crew after treatment of pigs and young, if the vet has made diagnosis and started treating the individual animal, see. section 12, paragraph 1.

(2). In pig and cattle herds that are the subject of a written health advisory agreement, opt-in module 1 of the basic regulation. section 34 (a), paragraph 3, of the law on the keeping of animals, the veterinarian may prescribe or dispense prescription medicines to crew the owner or his representative to 1) the treatment of the crew pigs and young cattle, there is likely to be suffering from a disease which the vet has already diagnosed in crew, see. section 12, paragraph 1, and 2) after treatment of adult bovine animals.

(3). In bovine herds covered by a written health advisory agreement, opt-in module 2 of the basic regulation. section 34 (a), paragraph 3, of the law on the keeping of animals, the veterinarian may prescribe or dispense prescription medicines to crew the owner or his agent for the treatment of the crew cattle, there is likely to be suffering from a disease which the vet has already diagnosed in crew, see. section 12, paragraph 1.

(4). The Minister of food, agriculture and fisheries may lay down rules to the effect that a veterinarian in a herd of animals other than those referred to in section 34 (a) (1) and (2) of the law on the keeping of animals, and which are the subject of a written health advisory agreement may prescribe or dispense prescription medicines to crew the owner or his representative to the treatment of animals in the herd that is likely to be suffering from a disease which the vet has already diagnosed in crew, see. section 12, paragraph 1.

(5). The Minister may lay down rules on extradition or prescription of prescription medicines to the crew of the owner or his representative, prior treatment and after treatment of adult bovine animals in the herds, which are not covered by the health advisory agreements, see. paragraphs 2 and 3.

(6). In the cases referred to in paragraphs 1 to 5, the veterinarian for the crew of the owner or his representative to carefully describe the clinical symptoms, which must be found before processing begins. '

6. In paragraph 15, the words ' section 14, paragraphs 2-6 ' to: ' section 14, paragraph 1-3 '.

7. In article 24, paragraph 1, the words ' section 14, paragraphs 2-4 ' to: ' section 14, paragraph 1-3 ', ' 14 (5) and (6) ' to: ' section 14, paragraphs 4 and 5 ' and ' 14, paragraphs 2-6 ' to: ' section 14, paragraph 1-5 '.

8. In article 24, paragraph 2, 1. and (4). paragraph, the words ' section 14, paragraphs 2-6 ' to: ' section 14, paragraph 1-5 '.

9. In article 24, paragraph 3, the words ' section 14, paragraphs 2-6 ' to: ' section 14, paragraph 1-5 '.

10. In article 24, paragraph 4, nr. 1 and 2, section 14, shall be replaced by ' paragraphs 2-6 ' to: ' section 14, paragraph 1-5 '.

11. In article 25, paragraph 2, the words ' section 14, paragraphs 2-6 ' to: ' section 14, paragraph 1-5 '.

12. In article 38, paragraph 1, no. 1, the words ' section 13, paragraph 1 ' to: ' section 13 ' and ' section 14, paragraphs 2 to 4 and 7 ' to: ' section 14, paragraphs 1 to 3 and 6 '.

§ 2

In Act No. 432 of 9. June 2004 on the keeping of animals, as amended by section 12 of Act No. 404 of the 1. June 2006, section 30 of Act No. 431 of 6. June 2005, § 1 of lov nr. 105 of 20. February 2006 and section 53 of Act No. 1336 of 19. December 2008, is amended as follows: 1. Pursuant to section 34 is inserted: ' § 34 a. the Minister of food, agriculture and fisheries may lay down rules to the effect that large and larger pig and cattle herds must be covered by a written mandatory health advisory agreement entered into between the crew base module owner or his/her representative and a veterinarian, including regarding the content of the agreements and on notification of agreements.

(2). The Minister may lay down rules to the effect that the owner or his representative and the crew a veterinarian health advisory agreement may conclude a voluntary basis module for pig and cattle herds, which are not covered by paragraph 1.

(3). The Minister may lay down rules to the effect that the crew the owner or his representative, in addition to mandatory health advisory agreements, see. paragraph 1, on a voluntary basis can establish written health advisory agreements opt-in modules with a veterinarian.

(4). The Minister may lay down rules to the effect that the herds with species other than those referred to in paragraphs 1 and 2 shall be covered by a written mandatory health advisory agreement concluded between the crew, the owner or his representative and a veterinarian, including regarding the content of the agreements and on notification of agreements. '

§ 3 paragraph 1. The law shall enter into force on the 1. July 2010, see. However, paragraph 2.

(2). The Minister of food, agriculture and fisheries shall fix the time of the entry into force of § 1.

section 4 of the Act does not apply to the Faroe Islands and Greenland but may by Royal Decree be totally or partially into force for Greenland of the discrepancies that the Greenlandic conditions warrant.
