Law on the amendment of the law on research advice and so on and the law on Denmark's Grundresearch fund

(Strengthening Denmark's Research Council, the decommissioning of the Coordinating Committee, clarifying the objectives, responsibilities and task allocation for research advice, etc.)

We, by God's grace, the Queen of the Danes, do our thing.

The parliament has adopted the following law, and we know that the following law has been approved by Parliament's consent :

§ 1

In the area of the law on research advice, etc., cf. Law Order no. 1348 of 11. In December 2008, the following changes are made :

1. I Section 1 (1). 1, the ', the Strategic Research Council and the Coordination Committee ' shall be replaced by : ' and the Strategic Research Council `.

2. Section 1 (1). THREE, ONE. pkt., ITREAS :

' Denmark's Research Council has the main purpose of promoting the development of Danish research for the benefit of society by ensuring the Minister for Science, Technology and Development, the People's Things and the Government, an independent and expert advice on the overall level of research. ` ;

3. I Section 1 (1). FOUR, ONE. pkt., and paragraph FIVE, ONE. pkt., changes "fondses" to : "appropriation operation".

4. I Section 1 (1). FOUR, TWO. pkt., and paragraph FIVE, TWO. pkt., ' scientific advice ` shall be replaced by the following : 'advice on research'.

5. Section 1 (1). 6, revoked.

6. I Section 1 (1). 7, the first paragraph of the Member The provisions of paragraph 6 shall be replaced by ' and the Committee Four-six 'to :' in paragraph 1. 4 and 5. "

7. I § 2 pasted as no. FOUR :

" 4) Research on research : consulting services which can relate to all aspects of research, including political and professional aspects. '

8. Section 3, paragraph 3. 1 and 2, ITREAS :

The aim of Denmark ' s Research Council is to promote the development of Danish research in the interests of society. The Council has a responsibility to give the Minister of Science, Technology and Development Independent and expert advice on research at general level, including about future research needs, and must ensure that the advisory role involves relevant national and international experiences and trends.

Paragraph 2. Parliament and any minister can obtain advice from the Council. The Council's advice shall be made at the request or on its own initiative. ` ;

9. I Section 3, paragraph 3. THREE, ONE. pkt., in the words ' research policy ' shall be replaced by ' research policy ' ;

10. I Section 3, paragraph 3. THREE, TWO. pkt., the ', the Strategic Research Council and the Coordination Committee ' shall be replaced by : ' and the Strategic Research Council `.

11. I Section 3, paragraph 3. SIX, ONE. pkt., "research policy" shall be replaced by : ' research `.

12. Section 4 (4). TWO, ONE. pkt., ITREAS :

The President and other members of the Council must be recognised researchers or research haitable, which together represent widely available research into both public and private and broad insights into national and international research. ` ;

13. The title before section 7 is replaced by the following :

"Aends and responsibilities"

14. § 7 ITREAS :

" § 7. The aim of the Free Research Council is to support Danish research on the basis of researchers ' own initiatives. The Council has a responsibility to develop the level of research in Denmark and must ensure the opportunities for new research in coordination with the other research system.

Paragraph 2. The Council must ensure support for both individual scientific research areas, for transscientific research and to the international activities of Danish research.

Paragraph 3. The Council must ensure that appropriations are allocated on the basis of published criteria and that appropriations are allocated for international cooperation, cf. § 30 a. The Council may grant appropriations both for individual specific research activities and for special initiatives, cf. Section 11 (1). 4.

Paragraph 4. The Council may, in specific cases, support political priority instruments where the provision has been made for the purpose of the authorization.

Paragraph 5. The Council must contribute to strengthening the dissemination and use of research results. '

15. The title before paragraph 8 is deleted.

16. I § 8 (3) 1-3, in five different places ' research technical advice ` shall be replaced by : 'advice on research'.

17. I § 8 (3) 5, the following shall be inserted after ' operation ` shall mean the following year and a plan for the coming years '.

18. The title before paragraph 9 is replaced by the following :

"Board of Governess and Technical Research Council."

19. The following section 9 is inserted :

" § 9 a. The Management Board shall ensure a reality of the Council's purpose, cf. § 7.

Paragraph 2. The Management Board shall ensure that appropriations for research purposes are allocated according to guidelines binding for all technical research advice, including that the professional assessment of applications is carried out under the relevant inclusion of external assessments. The Management Board shall draw up and coordinate the design of the Guidelines with the Strategic Research Council.

Paragraph 3. The Management Board shall be responsible for coordinating the activities of the Council with the Strategic Research Council, Denmark's Basic Research Fund, the High Technology Fund, the Council of Technology and Innovation and the other research system, in particular as regards : activities aimed at international cooperation.

Paragraph 4. The Management Board shall be the senior officer responsible for the advice given after ~ 8. `

20. I Section 11 (1). 1, pasted as Act 2. :

' As one of the technical research councils, the Management Board may set up a multidisciplinary research council, which may be composed of members appointed by the Minister for Science, Technologies and Development in accordance with section 14 (1). 2, for the product acceptance of cross-disciplinary tasks. ` ;

21. Section 11 (1). 3, revoked.

22. I Section 11 (1). 6, there will be paragraph 1. The fifth paragraph is replaced by paragraph 5. Five shall : ' shall mean the following : 4 ".

23. § 12 revoked.

24. § 13 ITREAS :

" § 13. The professional science councils have responsibility for allocating appropriations in their territory in accordance with section 7.

Paragraph 2. A grant is awarded to the main applicant in person. The hovedaneers are responsible for the appropriation.

Paragraph 3. The technical research advice shall follow the guidelines drawn up by the Administrative Board in accordance with section 9 (a) (a). TWO, TWO. Act.

Paragraph 4. The professional science councils shall assist the Management Board with advice on research after Article 8. `

25. Section 14, paragraph 14. 2, ITREAS :

" Stop. 2. The Minister for Science, Technology and Development designates up to 75 members of the Technical Research Council. The members shall be appointed in their personal capacity and in such a way that wide technical coverage within the Council works and wide experience, both in Danish and international research. ` ;

26. Section 14, paragraph 14. 3, revoked.

27. I Section 15 (3). 1, no. 1 and no. FOUR, ONE. pkt., change the "fondser" to : "appropriation function".

28. The title before section 17 is replaced by the following :

"Aends and responsibilities"

29. § 17, paragraph 1. 1-3, ITREAS :

" The Strategic Research Council is intended to support Danish research in the fields of policy priorities and thematic defined areas of research, including initiatives that are delimited according to their content. The Council is responsible for contributing to increased interaction between public and private research and must actively seek to make its own strategic research efforts for relevant private operators to attract funds from funds and businesses to : cofinanced research projects.

Paragraph 2. The Council must ensure support for inter-scientific research and to the international activities of Danish research.

Paragraph 3. The Council must ensure that grants are allocated research activities on the basis of published criteria and grant appropriations for international cooperation, cf. § 30 a. "

30. § 17, paragraph 1. 6, revoked.

31. I § 17, paragraph 1. SEVEN, TWO. pkt., there will be paragraph 1. SIX, TWO. pkt., after ' research trends ' means the following : ' or allocate larger appropriations for activities considered to be of benefit to Danish research '.

32. I § 17, paragraph 1. 7, there will be paragraph 1. 6, pasted as Three. Point. :

' The Ministry of Science, Technology and Development may, at the request of the Management Board of the Strategic Research Council, in the case of co-financed activities, approve derogations from the provisions of section 19-23 and section 36, paragraph 1. 1. "

33. § 17, paragraph 1. 8, revoked.

34. The headline before Section 18 is repealed.

35. I Section 18 (2). 1, 3 and 4, in four different places ' research technical advice ` shall be replaced by : 'advice on research'.

36. Section 18 (2). 5, revoked.

37. I Section 18 (2). 6, there will be paragraph 1. 5, the following shall be inserted after ' operation ` shall mean the following year and a plan for the coming years. '

38. The headline before section 19 is replaced by the following :

39. The following section 19 is inserted :

" § 19 a. The Management Board shall ensure a reality of the Council's purpose, cf. § 17.

Paragraph 2. The Management Board must ensure that appropriations for political priority and thematic delimited research areas are allocated according to guidelines binding on all the programme committees and so on, including that the professional assessment of applications is carried out under the relevant inclusion of external asses;. The Management Board shall draw up and coordinate the design of the Guidelines with the Free Research Council.

Paragraph 3. The Management Board shall be responsible for coordinating the Council ' s activities with the Free Research Council, Denmark's Basic Research Fund, the High Technology Fund, the Council of Technology and Innovation and the rest of the research system, in particular as regards activities ; directed at international cooperation.

Paragraph 4. The Management Board shall be the senior officer responsible for the advice given in section 18. The Management Board may set up the case preparatory programming committee composed of recognised scientists to assist with the advisory function. The Board of Directors may also obtain the same assistance from one or more technical research advice from the Board of Directors of the Free Research Council. `

40. Section 21 (1). 4 and 8, revoked.

41. I Section 21 (1). 7, there will be paragraph 1. 6, shall be amended ' paragraph 1. 6 ` shall be replaced by the following : FIVE. "

42. The following section 21 is added :

" § 21 a. The programme committees shall be responsible for allocating appropriations within their territory in accordance with section 17.

Paragraph 2. A grant is awarded to the main applicant in person. The hovedaneers are responsible for the appropriation.

Paragraph 3. The programme committees shall follow the guidelines drawn up by the Administrative Board in accordance with section 19 (a) (a). TWO, TWO. Act.

Paragraph 4. If one or more technical research advice or the Commission for Scientific Studies in Greenland is completed, tasks shall be in accordance with section 21 (2). 4, the guidelines drawn up by the Administrative Board shall be drawn up by the Administrative Board after paragraph 19 (a), TWO, TWO. Pkton, followed.

Paragraph 5. The programme committees and the Commission for Scientific Investigation in Greenland welcome the Management Board with advice on research after Section 18.

§ 21 b. All members of a programme committee must be recognised researchers. The members of a programme committee shall have the competence to assess the quality, effect and relevance of research activities together.

Paragraph 2. The members shall be appointed by the Board of Directors of the Strategic Research Council. `

43. § 22 revoked.

44. I Section 23, paragraph 1. 1, no. 1, and no. FOUR, ONE. pkt., change the "fondser" to : "appropriation function".

45. I Section 23, paragraph 1. 1, no. 5, the words ', cf. § 17, paragraph 1. 3 ".

46. Chapter 6 revoked.

47. I § 30 (1) (a) 1, changes "fondses" to : "appropriation operation".

48. I § 30 (1) (a) 3, the ' paragraph shall be amended The following shall be replaced by the following : SIX. "

49. § 35 ITREAS :

" § 35. The Secretary of Denmark of Denmark's Science Council, the Free Research Council, the Strategic Research Council and the Scientific Committee for Scientific Committees shall be carried out by the Ministry of Science, Technologies and Development. The Ministry shall ensure that Denmark's Research Council secretarial is served by a special unit at the Ministry.

Paragraph 2. The Minister for Science, Technology and Development will oversee the appropriation and legality of the Free Research Council and the work of the Strategic Research Council. '

50. I § 36, paragraph. TWO, ONE. pkt., in the words ' section 21, paragraph, Paragraph 1, and section 22 (2). TWO, ONE. ' to : section 19 (a) (i). FOUR, TWO. pkt., and section 21 (1). 1 '.

51. I § 36, paragraph. TWO, TWO. pkt., the words ' shall be deleted from the members of the Coordination Committee whose membership comes from their office, cf. § 28, paragraph 1. Two, and. "

52. I § 36, paragraph. TWO, THREE. pkt., in the words ' section 22 (4), 2 ' shall be : section 19 (a) (1). FOUR, TWO. Pct. "

53. § 40 revoked.

§ 2

In the Act of Denmark's Basic Research Fund, cf. Law Order no. 833 of 13. August 2008, the following changes are made :

1. I § 5, 1. pkt., the ' Coordinating Committee ' shall be deleted.

§ 3

Paragraph 1. The law shall enter into force on 1. January, 2011.

Paragraph 2. The President and the members of the Danish Research Council and the members of the technical research councils may be re-appointed for the period during the whole calendar year in which they have been in the Council in question for less than six years and where they meet the requirements ; to membership, cf. Section 4 (4). TWO, ONE. pkt;, in the law of research advice, etc. as drawn up by the section 1 of this law. Twelve, and section 14, paragraph 14. 2, in the law on research advice, etc. as drawn up by the section 1 of this law. 25.

Paragraph 3. Guidelines drawn up by the Coordination Committee pursuant to the applicable section 25 (5). 3, in the case of research advice, etc., shall apply until further instructions have been drawn up by the Board of Directors of the Free Research Council pursuant to section 9 (a) (a). TWO, TWO. pkt;, in the law of research advice, etc. as drawn up by the section 1 of this law. 19, and by the Management Board of the Strategic Research Council, pursuant to section 19 (a) (a).
