(Urste measures concerning Rhynchophorus ferrugineus (Olivier))

§ 1

Notice no. 32 of 23. 1 January 2009 on plants, as amended by publication No 2 ; 244 of 27. March 2009, proclame no. 313 of 26. March 2010 and Notice no. 750 of 24. In June 2010, the following changes are made :

1. I footnote to the title of the notice, ' Commission Decision 2007 /365/EC (OJ L 139, p. Directive 24) as amended by Commission Decision 2008 /776/EC (2008, L 266, p. EUR 14) 'to :' Commission Decision 2007 /365/EC (OJ L 139, p. Directive 24 (24), as last amended by the Commission Decision of 17. In August 2010 (EUT 2010, L 226, p. 42), "

2. Annex 1, Title II, point (a), 8.a ITREAS :

" 8.a Rhynchophorus ferrugineus (Olivier), red palmessnle. "

3. Annex 4, item 32.a the text of Annex 1 shall be replaced by this notice.

§ 2

The announcement shall enter into force on 4. September, 2010.

Plants, however not fruits and seeds,

of the following species, with a diameter at the bottom of the strain of over 5 cm : Areca catechu, Arecastrum Romzoffianum (Cham) Becc ,
a)
the plants throughout their life have been cultivated in a Member State or a third country, where : Rhynchophorus ferrugineus (Olivier) is not known to occur,
Arenga pinnata, Borassus
or
Flabellifer, Brahea armata, Butia capitata, Calamus merillii, Caryota maxima, Caryota cumengii, Chamerops saw s, Cocos nucifera, Corypha gebanga, Corypha gebanga, Corypha elatata, Elaeis guineensis, Howea fossieriana, Jubea chilensis,
b)
the plants throughout their life have been cultivated in a place of production in an area by the national plant health authority in the country of origin, in accordance with the relevant international Standards for Phytosanitary Measures ; for Rhynchophorus ferrugineus (Olivier),
Livistona australis, Livistona
or
decipiens, Metroxylon sagu, Oreodoxa regia, Phoenix canariensis, Phoenix dactylifera,
c)
that the plants for two years immediately prior to the movement have been cultivated in a place of production, where :
Phoenix theophrasti, Phoenix sylvestris, Sabal umbraculifera, Trachycarpus fortunei and Washingtonia spp.
1)
the plants have been positioned in a place of total physical protection from the introduction of : Rhynchophorus ferrugineus (Olivier) or there has been appropriate preventive treatments
and
2)
there at official inspection every 3. Month has not been observed characters in Rhynchophorus ferrugineus (Olivier),
or
d)
in the case of plants imported according to the provisions of Annex 4, 32a, point (c of notice on the importation of plants and plant products, and so on, that the plants since imports for at least one year prior to the movement have been cultivated in a place of production, and under which :
1)
the plants have been placed in a place of total physical protection against the introduction or spread of : Rhynchophorus ferrugineus (Olivier),
and
2)
