Ordinance amending Ordinance on the management of waste electrical and electronic udstyr1)

(Requirements relating to the export, application requirements, information and disclosure requirements, etc.)

§ 1

In executive order No. 664 of 27. June 2005 on the management of waste electrical and electronic equipment, as amended by Decree No. 591 of 9. June 2006 and Decree No. 1226 of 11. December 2008, shall be amended as follows:

1. Article 3, paragraph 1, no. 15 is replaced by the following: ' 15) dangerous substance or product shall mean any chemical substance or product, which is considered dangerous within the meaning of the Executive order on classification, packaging, labelling, sale and storage of chemical substances and products. '

2. section 16 (1), (2). paragraph is replaced by the following:» the WEEE system assigns to the manufacturer or importer a quantity of waste electrical and electronic equipment (WEEE) from households, which the manufacturer or importer must collect or pick up from the communal arrangements and arrange separately handled. '

3. In article 20, paragraph 2 2. paragraph, the words ' or the ' to: ' and '.

4. In section 21 shall be inserted before paragraph 1 as new paragraph: ' it is the responsibility of everyone, including producers and importers or the person acting on their behalf, who shall establish arrangements for the treatment of waste electrical and electronic equipment, see. § 3, nr. 2 (b), using the best available treatment, recovery and recycling techniques. '




Paragraph 1-6 becomes paragraph 2-7.



5. Article 21, paragraph 2, which becomes paragraph 3 is replaced by the following: ' (3). Sampling of substances, materials and components referred to in annex 2 shall be carried out indoors on a when the production area with spillage collection and, if necessary, decanters and cleanser-degreasers,. '

6. Article 21, paragraph 5, which becomes paragraph 6 is replaced by the following: ' (6). Places for storage, including temporary storage, prior to the treatment of waste electrical and electronic equipment (WEEE), must be done under cover and on appropriate areas with impermeable surfaces and waterproof covering, spillage collection and, if necessary, decanters and cleanser-degreasers,. '

7. In article 23 the following paragraph 3 is added: ' (3). As regards exports of waste electrical or electronic equipment to third countries, this waste is considered only if the requirements laid down in paragraph 1 and the goals are met, and provided the exporter can submit proof that the waste has been recovered in accordance with the rules laid down in this Decree. '

8. In article 24 the following paragraph 3 is added: ' (3). As regards exports of waste electrical or electronic equipment to third countries, this waste is considered only if the requirements laid down in paragraph 1 and the goals are met, and provided the exporter can provide documentary proof that the waste is reused or recycled in accordance with the rules laid down in this Decree. '

9. section 29 (1) (8). 9 is replaced by the following: ' 9) fail to collect or pick up the assigned waste electrical and electronic equipment (WEEE), or fails to comply with the conditions laid down for the removal, under section 16.0 '

§ 2

The notice shall enter into force on 9 November. December 2009.
