Confescation of the tasks and powers of the State Air Service, on the knowledge of the requirements laid down by the air carrier and on the right to appeal ;

In accordance with section 152, 152 a, 153, paragraph 1. 2, and section 153 a, paragraph 2, in the law of air transport, cf. Law Order no. 731 of 21. June 2007 shall be determined :

Tasks

§ 1. The State Air Pharaman is a government in the Department of Transportation.

§ 2. The State Aviation Service is responsible for the transport minister and other authorities in matters of aviation. The air transport services regulate and oversee the exercise of civil aviation. In addition, the State's Airspace Service is driving the airport of Bornholm Airport.

§ 3. Where the Minister for Transport has been granted powers under the law on air transport or EU regulations in the area, cf. However, section 4, these powers are exercised by the State's Aviation Service on behalf of the minister.

Paragraph 2. The State Air Service may be able to do so pursuant to section 152 (3) of the air transport law. 2, lay down rules concerning the overlapping of powers to other public authorities, private organisations or experts to make decisions which, after the air law or this notice, have been attributable to the air transport system, within it ; long-scheduled air services, which shall also be considered to be a safe flight safety.

Paragraph 3. The valor of the valor. § 4. The following powers are not delegated to the State's Aviation Service :

6) § 134, paragraph 1. 1 and 2, and section 144 b (b), 1, 2, 4 and 7 on the establishment of a port commission, determine the composition of the Commission and lay down rules for the activities of the Commission, etc.

7) § 135, paragraph 1. 3, and paragraph 137 (3). 4, to establish rules on the obligation to notify and so on for flight accident or on flight events.

8) Section 152 to leave powers to make decisions which, in accordance with the law, have been attached to the minister or air services, to others and to lay down rules relating to the proceedings and appeal proceedings for such decisions, cf. however, section 3 (3). 2.

Requirements

§ 5. Regulations issued by the State's Aviation Service shall be drawn up as Provisions for Civil Aviation (BL), cf. however, paragraph 1 4.

Paragraph 2. Provisions for Civil Aviation shall not be introduced in law-law.

Paragraph 3. Information on the content of the regulations may be obtained by way of a call to the State's Aviation Service. In addition, the rules on the State Airlines website are located at www.slv.dk.

Paragraph 4. Requirements established pursuant to section 40 g (s) of the air carrier. 1, 3 and 4, section 50 (4). 9, sections 70 and 70 a, section 70 b (3) (b), 1 5, and sections 76, 85 and 130, 130 a and 131, shall be issued as an executive order that is hereby introduced in law.

§ 6. The State's Aviation Service may, in exceptional cases, dispense with the requirements.

Appeal access

§ 7. Decisions taken pursuant to provisions laid down in section 3 (3). Two can be complained to the State's Aviation Service.

Paragraph 2. Complaining does not have a prorative effect. However, the State's Aviation Service may add a griering effect when there are special conditions.

Paragraph 3. The decisions taken by the State Air Pharaman in accordance with section 7 (4). 1, and pursuant to the air law, notices established under this, Provisions for Civil Aviation and EU Regulations in this field cannot be complained to the Minister for Transport.

Entry into force

§ 8. The announcement shall enter into force on the 15th. In February 2009.

Paragraph 2. At the same time, notice No 1597 of 18. December 2007 on the tasks and powers of the State Air Service, on the knowledge of the provisions laid down by the air transport system and on the right to appeal.
