Bekendtgørelse om henlæggelse af certain powers to the Patent and Trademark Office



§ 1. The power to regulate, as subsequent laws is vested in the Minister for economic and business affairs, exercised by the Patent and Trademark Office, see. However, section 2:

6) law on secret patents, see. lovbekendtgørelse nr. 732 of 27. November 1989.

7) section 4, paragraph 4, of the law on local government administration, see. lovbekendtgørelse nr. 696 of 27. June 2008.

8) law on the protection of topographies of design, law No. 778 of 9. December 1987.

9) section 7 (1) of søloven of the basic regulation. lovbekendtgørelse nr. 538 of 15. June 2004.





§ 2. The following powers assigned not to the Patent and Trademark Office:





1) Powers under section 7, paragraphs 2 and 4 in the row, see. lovbekendtgørelse nr. 91 of 28. January 2009, for reduction of the Patent Board of appeals (Appeals Board for patents and trademarks) and on payment of fees.

2) Powers under section 17 (1) and (2) of law No. 778 of 9. December 1987 on the protection of the layout designs (topographies) of semiconductor products for the Constitution of an Appeals Board and laying down rules on the Appeals Board composition and rules of procedure, as well as for payment of fees.

3) the power under section 19 of the Act No. 778 of 9. December 1987 on the protection of the layout designs (topographies) of semiconductor products to fix the time of the entry into force of the Act on the Cape. 3 for a compulsory licence.





§ 3. The notice shall enter into force on the 1. March 2009.

(2). Executive Order No. 39 of 17. January 2002 on provision of certain powers to the Patent and Trademark Office shall be repealed.
