Under section 20 (2). 1, 3, and 4 of law No. 1392 by 27. December 2008 on the promotion of renewable energy, be determined in accordance with the authorization given pursuant to section 70:

Chapter 1

Application and communication of grants commitments

§ 1. Application for grant commitments to activities, and more subject to section 18, paragraph 3, of the law on the promotion of renewable energy be filed at Energinet.dk.

(2). The application form, which can be downloaded on UREnerginet.dk .com's Web site




www.energinet.dk






must be completed and signed by the Municipal Council or the Chairman of the Municipal Council.



(3). The application form has to be settled:





1) Project description of the activity.

2) Specified budget.

3) Municipal Board's published proposal for a municipality level, proposals for municipality plan appendix or draft local plan on the establishment of new wind turbines, where the application is filed in connection with the processing of the application for the erection of wind turbines by virtue of law planning.





(4). Energinet.dk can set terms for commitment subsidies, including





1) permission is given for the erection of a wind turbine,

2) wind turbine will be erected, and

3) municipality has a duty to inform the Energinet.dk changes in the activity.





(5). There is no commitment for funding to commenced activities.

Chapter 2

Application for payment of the grant

§ 2. The Municipal Council must submit an application to the Energinet.dk for payment of grants. Payment of grants pursuant to section 19 of the Act on the promotion of renewable energy, can be done on the basis of the documentary evidence of expenditure incurred after the final implementation of the activity.

(2). Before the final implementation of the activity can Energinet.dk pay out grants for partial implementation, where Energinet.dk has pledged grants amounting to 500,000 USD or more.

must be completed and signed by the Municipal Council or the Chairman of the Municipal Council.



(4). The application form has to be settled:





1) Commitments for grants under section 1.

2) Documentation for the full or partial implementation of the activity.

3) Documentation for the fulfilment of the conditions set out commitments for grants.

4) Accounts for the activity developed by the municipality bears the auditor's statement.





(5). The review must be carried out by a State-authorised, registered auditor or of municipal audit body.

Chapter 3

Cancellation of commitments and repayment of grants

§ 3. Energinet.dk may decide that the commitment to grant, see. § 1, in whole or in part shall lapse if





1) Municipal Council has given false or misleading information or omitting information of importance in connection with the decision on commitments for grants under section 1, or

2) conditions set out in the commitment of supplements are not met.





§ 4. The Municipal Council should repay subsidies paid, if the Municipal Council has made false or misleading information or omitting information of importance in the application of the basic regulation. § 2, paragraph 3, nr. 1-4.

Chapter 4

Supervision

§ 5. Energinet.dk shall draw up an annual report, which describes the scheme's administration, including which activities are given grants to. The report submitted to the Ministry of climate and energy.

Chapter 5

Complaint rules

§ 6. Decisions of the Energinet.dk may be appealed to the Energy complaints pursuant to section 66, paragraph 2, of the law on the promotion of renewable energy.

(2). Decisions to be adopted pursuant to article 18, paragraph 3, of the law on the promotion of renewable energy sources, see. the Executive order on sections 1 and 2 are not subject to appeal.

(3). A complaint under paragraph 1 shall be submitted in writing to the Energy complaints board before 4 weeks after the decision is announced.

§ 7. The notice shall enter into force on the 1. June 2009.
