Law on the amendment of the law on certain consumer contracts

(Bindor period and termination notice in current consumer contracts)

We, by God's grace, the Queen of the Danes, do our thing.

The parliament has adopted the following law, and we know that the following law has been approved by Parliament's consent :

§ 1

Law no. 451 of 9. In June 2004 on certain consumer contracts, the following changes are made :

1. § 25 ITREAS :

" § 25. The consumer may terminate an agreement on the ongoing supply of goods or services by 1 month's notice to the end of a month when the contract has been concluded for five months after the agreement is concluded. however, paragraph 1 Two and four.

Paragraph 2. Paraguation 1 and 4 shall not apply where the termination notice or longest binding period is regulated in or under other legislation. Paragraph 1 shall not also apply to contracts which relate solely to goods or services to be provided no later than 1 years after the conclusion of the contract, if the total price for the goods or services covered by the Agreement does not apply ; is more than $2,000. and the full payment shall be made within 14 days of the conclusion of this Agreement.

Paragraph 3. A contract shall be subject to paragraph 1. 1 or 4, which have been concluded using a standard form, shall contain a provision which clearly indicates which premonition and, where appropriate, from which the agreement may be terminated by the consumer. The determination must not be incompatible with the consumer's right to termination under paragraph 1. One and four.

Paragraph 4. Where the total price to be paid pursuant to an agreement on the ongoing supply of goods or services exceeds 20 000 DKK an annual and commencement of the delivery, either that the operator shall keep a one-off cost exceeding the average price of the contract for 6 months of continuous supply, or resulting in a corresponding value for the equivalent of : traders, the consumer may terminate the Agreement with 1 month's notice to the end of one month after the period of 11 months after the commencement of the contract. `

2. I § 26 pasted as paragraph 2 :

" Stop. 2. For the purposes of calculating the amount which the consumer shall have back in accordance with paragraph 1. 1 may take account of seasonal fluctuations in the value of the current service. `

§ 2

Paragraph 1. The law shall enter into force on 1. January 2010, and shall apply to consumer contracts entered into after the law comes into force, cf. however, paragraph 1 2.

Paragraph 2. The law shall apply to consumer contracts for the delivery of television programmes, which, at the same time as part of the agreement, provide receipts for the consumer when the agreement is reached on 1. January 2012 or later.

§ 3

The law does not apply to the Faroe Islands and Greenland, but can, by means of a royal device, be brought into force for these parts of the village, with the deviations which are attributable to the special ferry and Greenlandic conditions.
