WE, MARGRETHE the SECOND, by the grace of God Queen of Denmark, do indeed:

The Danish Parliament has adopted and we know Our consent confirmed the following law:

§ 1

The law on nature protection, see. lovbekendtgørelse nr. 1042 by 20. October 2008, as amended by section 31 of Act No. 1336 of 19. December 2008, shall be amended as follows: 1. Footnote 1 and 2 to the Act's title is repealed, and instead is inserted: ' 1) Act contains provisions implementing parts of Council Directive 79/409/EEC of 2. April 1979 on the conservation of wild birds (Official Journal 1979 No. L 103, page 1), as last amended by Council Directive 2006/105/EC of 20. November 2006 (Official Journal of the European Union 2006 nr. L 363, page 368), Council Directive 92/43/EEC of 21 December 1988. May 1992 on the conservation of natural habitats and of wild fauna and Flora (EC habitats directive), (Official Journal 1992 nr. L 206, p. 7), as last amended by Council Directive 2006/105/EC of 20. November 2006 (Official Journal of the European Union 2006 nr. L 363, page 368) and parts of the European Parliament and of the Council Directive 2004/35/EC of 21. April 2004 on environmental liability with regard to the prevention and remedying of environmental damage (the official journal of the European Union 2004 nr. L 143, p. 56). '

2. Under section 29 shall be inserted in Chapter 5: ' section 29 a. the animal species listed in annex 3 to this law, may not intentionally disrupted with harmful effect for the species or stock. The ban applies in relation to all life stages of the covered species.

(2). Breeding sites or resting places of the species listed in annex 3 to the law, must not be damaged or destroyed.

section 29 (b). The Minister may draw up management plans and undertake other initiatives, including grants, with a view to the conservation of the species or stocks of those listed in annex 3 to this law. '

3. In article 31, paragraph 2, shall be added after ' Annex 3 ': ' and 5 '.

4. section 50, paragraph 3-5, shall be repealed, and replaced by: ' (3). Unless the conditions set out in section 65 (6) are met, the Tribunal does not grant exemption from a conservation conservation or a proposed conservation, if it applied for May 1) damaging or destroying breeding sites or resting places of the natural range of the animal species listed in annex 3 to the Act, or 2) destroy the plant species listed in annex 5 to the law, in all stages of life.

(4). It must be reflected in the decisions referred to in paragraph 1, that the conditions laid down in paragraphs 2 and 3 are fulfilled. '

Paragraph 6 becomes paragraph 5.

5. In paragraph 65 (6) and (7) shall be inserted: ' (6). The Minister may, in the absence of a satisfactory alternative, grant a derogation from the prohibition provided for in paragraph 29 (a). The derogation shall not prevent the maintenance of the conservation status of the stocks concerned in its natural range and must be aimed at 1) protect wild fauna and flora and conserving natural habitats, 2) prevent serious damage, in particular to crops, livestock, forests, fisheries, water and other forms of property , 3) ensure respect for public health and safety or other imperative reasons of overriding public interest, including the social and economic nature, and terms of significant beneficial effects on the environment, 4) promote research and teaching, 5) restore a stock, discarding or breeding species, including artificially different plants, or 6) allow the collection and storage of specimens of species listed in annex 3 to the law , in a limited and specified quantity and under strictly controlled conditions.

(7). Decisions under the legislation or rules thereunder, which involve derogation of protection under section 29 (a), in lieu of the derogations referred to in paragraph 6, if the decision is taken under conditions corresponding to paragraph 6, as provided for in the law. '

6. section 71, paragraphs 4 and 5, shall be replaced by the following: ' (4). The Minister shall lay down for the purpose of implementation of the European Community directives and decisions on nature protection area rules about the cases in which and the conditions under which permits may be issued after 1) § 8, paragraph 5, no. 7. Article 15, paragraph 4, nr. 7, section 31, paragraph 1, and section 32, 2) dune conservation can be repealed pursuant to section 9, paragraph 3, 3) injunctions and prohibitions may be granted under section 11 (1) and (2), section 26 (3) and section 26 (a), paragraph 3, 4) waivers may be granted from article 3, paragraphs 1-3, section 8, paragraph 1, article 11, paragraph 3, article 15, paragraph 1, and articles 16-19 of the basic regulation. § 65, 5) derogations may be granted from the rules issued pursuant to section 8, paragraph 7, article 51, paragraph 1, or from the rules, which remain in force pursuant to article 101, paragraph 1, 6) approval may be granted under rules issued under section 20, paragraphs 2 and 7) build-or protection lines may be withdrawn in whole or in part under section 8 and sections 15-18 of the basic regulation. section 69, paragraph 1.

(5). Implementation of the European Community directives and decisions happen also in the rules, as the Minister determines under section 8, paragraphs 6 and 7, § 27, paragraphs 1-4, section 29 (1) and (2), section 30, paragraph 1-3, and section 31, paragraph 2 and 3. ';

7. Under section 71 shall be inserted: ' § 71 (a). The Minister may for the fulfilment of Council Directive 92/43/EEC of 21 December 1988. May 1992 on the conservation of natural habitats and of wild fauna and Flora (EC habitats directive) change the law's annex 3-5.

§ 71 b. Defense Minister lays down rules or provisions shall take on the armed forces ' activities in order to implement the European Community directives and decisions in the nature area '.

8. In article 89, paragraph 1, no. 1, shall be inserted after ' section 28 section 29 (a), ': ', '.

9. Annex 3 and 4 is replaced by the following: ' Annex 3

§ 2


The law on hunting and wildlife management, see. lovbekendtgørelse nr. 1045 of 20. October 2008, as amended by section 24 of Act No. 1336 of 19. December 2008, shall be amended as follows: 1. Footnote 1 and 2 to the Act's title is repealed, and instead is inserted: ' 1) Act contains provisions implementing parts of Council Directive 79/409/EEC of 2. April 1979 on the conservation of wild birds (Official Journal 1979 No. L 103, page 1), as last amended by Council Directive 2006/105/EC of 20. November 2006 (Official Journal of the European Union 2006 nr. L 363, page 368), Council Directive 92/43/EEC of 21 December 1988. May 1992 on the conservation of natural habitats and of wild fauna and Flora (EC habitats directive), (Official Journal 1992 nr. L 206, p. 7), as last amended by Council Directive 2006/105/EC of 20. November 2006 (Official Journal of the European Union 2006 nr. L 363, page 368) and parts of the European Parliament and of the Council Directive 2004/35/EC of 21. April 2004 on environmental liability with regard to the prevention and remedying of environmental damage (the official journal of the European Union 2004 nr. L 143, p. 56). '

2. In section 6 shall be inserted after paragraph 2 as new pieces: ' (3). The Minister may lay down rules on the biotope plans.

(4). The Minister may lay down rules to the effect that only individuals who have undergone a course, can postpone the game birds. The Minister may also lay down the rules on course in restocking of game birds.

(5). The Minister may lay down rules concerning the handing over of wild animals found dead in the wild. '

Paragraphs 3 and 4 become paragraphs 6 and 7.

3. Pursuant to section 6 shall be inserted: ' article 6 (a). Breeding sites or resting places of the mammals, which are mentioned in annex 1, must not be destroyed or damaged.

(2). Birds ' nests may not intentionally destroyed, damaged or removed. Eggs shall not be intentionally destroyed or damaged.

(3). The Minister may lay down rules on felling of certain trees and ban on destruction of or damage to nesting sites and breeding sites or resting places. '

4. Article 7 shall be replaced by the following: ' article 7. The mammals, which are mentioned in annex 1 shall not be intentionally disrupted with harmful effect for the species or stock. The ban applies in relation to all life stages of the covered species.

(2). Do not intentionally disturb birds with harmful effect for the species or stock. '

5. In paragraph 9 (a) shall be inserted as paragraph 4: ' (4). The Minister may establish an advisory system, advising on the protection of the mammals, which are mentioned in annex 1 of the law. '

6. In paragraph 15 the following paragraph 3 is added: ' (3). The condition set out in paragraph 1 of permanent residence in this country does not apply to persons who are covered by the European Community and EEA ´ s rules of establishment, free movement of workers and the provision of services, and which therefore have achieved a closer connection to the country. '

7. In article 46, paragraph 2, shall be inserted after ' the provisions of section 6 (a), ': ' (1) and (2) section 7 (1) and (2) '.

8. In article 52, paragraph 4, nr. 1, shall be inserted after ' § 4 (1) ': ' section 6 (a) (1) and (2) section 7 (1) and (2) '.

9. In article 52, paragraph 4, shall be inserted after nr. 1 as new number:» 2) derogations may be granted from the rules of game reserves issued under section 33.0 '

No. 2 and 3 is then no. 3 and 4.

10. Under section 52 shall be inserted: ' § 52 (a). The Minister may for the fulfilment of Council Directive 92/43/EEC of 21 December 1988. May 1992 on the conservation of natural habitats and of wild fauna and Flora (EC habitats directive) change the law's annex 1 and 2. '

11. In section 54 (1). 1, shall be inserted after ' § 4, paragraph 1, «:» section 6 (a), section 7, '.

§ 13 Act shall enter into force on the 1. October 2009.
