Law on the amendment of the Health Act

(Extended processing rights for mentally ill adults)

We, by God's grace, the Queen of the Danes, do our thing.

The parliament has adopted the following law, and we know that the following law has been approved by Parliament's consent :

§ 1

In the health code, cf. Law Order no. 95 of 7. February 2008, as amended, among other things, by § 1 in Act 1. 539 of 17. June 2008 and at the latest by law no. 288 of 15. In April 2009, the following changes are made :

1. After section 87 (d) the following :

" Chapter 20 b

Expanded the right to treatment for mentally ill adults

§ 87 e. Persons who, at the time of psychiatric treatment, are full 19 years, may choose to be treated in accordance with section 87 f-87 h.

§ 87 f. A person referred to a psychiatric treatment may choose to be treated in one of the hospitals or one of the clinics and so on, which has concluded agreement with the regional councils after Article 87 g (3). 1 (contract sickness houses) if the region of the region of residence does not, within two months of the referral to be received, be able to offer treatment to their own hospitals or any of the hospitals referred to by the regional council with or usually use, in section 79, (cooperative houses).

Paragraph 2. The right of paragraph 1. 1 to choose to be treated in a contract sickness house, if waiting for treatment at the contract lawnhouse is more than the waiting period to this end in the hospitals and cooperation hospitals of the Member State in the place of residence.

§ 87 g. The regional counties of the association conclude an agreement with the private hospitals, clinics, etc. in Denmark and hospitals, clinics, etc. abroad, who wish to enter into agreement on treatment after sections 87 e and 87 f. If the parties cannot reach agreement, the terms of the Health and Prevention Minister are laid down.

§ 87 h. The Ministry of Health and Prevention shall lay down rules on the extended processing law in accordance with this Chapter, including the requirements for documentation, etc. for the contracting houses, in accordance with the provisions of the contract disease. section 87 g (s), 1, and on the procedure for the reference of patients, etc. ` ;

2. I § 90, paragraph. 1, no. 2, in section 87 a, 87 b, 87 b, 87 and 87 (f ` shall be replaced by '.

3. I § 90, paragraph. 1, no. 3 and 6, is inserted after ' § 87 b ' : ' and 87 e-87 f `.

4. I § 171, paragraph 1 2, in section 86, 87 and 87 b ' to : ' § § 86, 87, 87 b and 87 f `.

5. I § 262 (2) ONE, ONE. pkt., is inserted after ' § 87 b, ` : "§ 87 f".

§ 2

The law shall enter into force on 1. January, 2010.

§ 3

The law does not apply to Greenland and Faroe Islands.
