Law on the amendment of the law of rail

(Supplementary rules as a result of the passenger rights Regulation and others)

We, by God's grace, the Queen of the Danes, do our thing.

The parliament has adopted the following law, and we know that the following law has been approved by Parliament's consent :

§ 1

In the law of rail, cf. Law Order no. 567 of 9. June 2008, as amended by section 129 of Law No 1. 1336 of 19. In December 2008 and section 2 of the Law No 134 of 24. In February 2009, the following changes are made :

1. I Section 6 (2). 2, ' the practical part of the driver ' s licence ' shall be replaced by ' the practical part of train driver ' s training. ` ;

2. The following section 8 is inserted :

" § 8 b. The infrastructure manager shall be responsible for a secure transport management for the part of the rail network that is responsible for the management.

Paragraph 2. Where an infrastructure manager wants responsibility for the traffic management to be handled by another company, the Traffic Management Board shall approve this. The Traffic Management Board may lay down conditions for this. ` ;

3. I § 8 d inserted after paragraph 1. 1 as new paragraph :

" Stop. 2. Railway undertakings and railway infrastructure managers must also carry out necessary planning and take necessary measures to ensure passenger safety in contingency situations and other extraordinary situations. '

Paragraph 2-6 will then be referred to in paragraph 2. 3-7.

4. I § 8 d (d) 4, there will be paragraph 1. 5, the following shall be inserted after ' safety of the railways ' means : 'personal safety for passengers'.

5. I § 8 d (d) 5, there will be paragraph 1. 6, shall be amended ' paragraph 1. 6 ` shall be replaced by the following : 7 ".

6. I § 8 d (d) 6, there will be paragraph 1. 7, is replaced by ' paragraph 1. Five shall : ' shall mean the following : SIX. "

7. § 12, paragraph 1. 1, ITREAS :

' Railway undertakings shall draw up business conditions, which shall specify the rules on the transport of undertakings, including liability for passengers on baggage, and the rules laid down in Regulation (EC) No (EC) of the European Parliament and of the Council. 1371/2007 of 23. October 2007 on the rights and obligations of rail passengers and on compensation in the case of national freight transport. The business conditions must be notified to the Traffic Management Board. `

8. I § 12, paragraph 1. 3, the words ' and the sale of the public at the railway stations operated by the company. ` ;

9. I § 17, paragraph 1. ONE, TWO. pkt., the following shall be inserted after ' hereto ` : `, including in the translation of foreign insurance policy etc. ` ;

10. I § 21 i, paragraph 1 1, no. 6, is changed " cf. § 8 d (d) 3, and "to :" cf. § 8 d, and ".

11. Section 22 (2). 1, no. 5 and 6, is hereby repealed and the following shall be inserted :

" 5) in violation of section 19 (1). 2, section 20, section 21 (1). 1, section 21 a-21 d, section 21 g or § 21 q, paragraph 1. 2,

6) do not comply with the requirements of section 8 (d). 1 and 3, or

7) is in breach of Regulation (EC) No 2 of the Regulation 1371/2007 of 23. 'October 2007 on the rights and obligations of rail passengers'. '

12. section 24 (2). FOUR, ONE. pkt., ITREAS :

' Decision on the choice of the tenderer in connection with tenders in accordance with Article 8 (3). 2, and Decisions in accordance with Article 8 (3). 3 and 4 may be refiled to the Board of Appeal for the Committee on Prohibition. `

13. I § 24 inserted after paragraph 1. 6 as new paragraph :

" Stop. 7. The Minister for Transport may lay down rules that the Railway Agency shall be responsible for supervising and redress for the rules of Regulation (EC) No 2 of the European Parliament and of the Council. 1371/2007 of 23. October 2007 on the rights and obligations of rail passengers. The Minister for Transport may, in particular, establish that the Railway Board does not address complaints concerning civil disputes. `

Paragraph 7 will then be paragraph 1. 8.

14. I § 26 pasted as Act 2. :

' The Minister for Transport may, in particular, lay down rules for notification of obligations and prohibitions and on the parties responsible for providing information. ` ;

§ 2

Paragraph 1. The law shall enter into force on 1. July 2009, cf. Oh, the size of the .2.

Paragraph 2. Raillight section 8 d, 12, 21 in and 22 and section 24 (4). 7, as amended respectively by the section 1 of this law. 3, 8, 10, 11 and 13, enter into force on the third. December, 2009.
