Ordinance amending the Ordinance on public rides
In executive order No. 502 of 17. June 2005 on public rides, as amended by Decree No. 1326 by 14. December 2005, is amended as follows:
1. section 16, paragraph 4 is replaced by the following: ' (4). It must be set out in a permit to use an amusement machine subject to section 16, the police can prohibit the use of the apparatus in accordance with article 21, paragraph 7, and that the police and the company in accordance with § 21 (1), the sight of that amusement machine, at any time request to be given access to carry out surveys or otherwise inspect amusement apparatus If it is considered relevant by the police or the establishment of vision. '
2. Chapter 4 shall be replaced by the following: ' Chapter 4
Approval, survey and control, etc.
Survey of special amusement apparatus
§ 17. The police may approve special amusement apparatus, see. § 16.
(2). In the case of approvals in accordance with paragraph 1 shall take the police decide whether there should be tighter controls on amusement apparatus. The police shall, in this context, the decision about the duration of the increased control.
(3). The company, pursuant to section 18 (2) shall issue regulatory paper for that amusement machine, makes the issue of monitoring the book an option to the police about whether and, where appropriate, how long must be kept tighter control of amusement equipment.
§ 18. Application for approval of amusement machines, which have not previously been used in this country, must be submitted by the owner or keeper to the officers of the police district in which the applicant resides or, if the applicant is a company, the company's head office, where the equipment is produced or in which it is intended to be put into use for the first time.
(2). The application must be accompanied by a sealed logbook issued by the company in accordance with § 21 (1), the sight of that amusement apparatus, of which it shall indicate that the apparatus is the sight to ensure that use does not present a danger to the public or for the staff to serve the book must specify the conditions of supervision., who for security reasons be made with regard to the set's construction , fixing and application. Supervisory paper must contain headings to listing of later inspection and of any shortcomings that must be rectified, as well as a sketch indicating the device's main objectives and an instruction manual. Monitoring the book must also be provided on the first page with the following endorsement: "the owner or user of the amusement machine, as this logbook relates shall be obliged to give the staff serving the appliance, the instruction to operate and supervise the equipment, which is necessary for the proper conduct of the relevant incentives. Supervisory book shall be kept by amusement apparatus and, upon request, be presented to the police and the company carrying out the vision of the amusement machine. "
(3). Book for the supervision of section 16, paragraph 2, referred to amusement devices shall be provided on the first page with the following endorsement: "the owner or user of the amusement machine, as this logbook relates, is responsible for ensuring that the appliance be operated only by persons who are 18 years of age. The owner or keeper also has a duty to provide it staff, serving equipment, the instruction to operate and supervise the equipment, which is necessary for the proper conduct of the relevant incentives. Supervisory book shall be kept by amusement apparatus and, upon request, be presented to the police and the company carrying out the vision of the amusement machine. "
(4). Name and date of birth on the personnel of the owner or keeper of an amusement machine is authorized to operate the appliance, must be set out in an annex to the regulatory paper for amusement apparatus, which are covered by section 16, paragraph 2.
(5). The company, which, in accordance with article 21, paragraph 1, shall carry out surveys of the amusement machine, after prior consultation of the other companies, which are accredited by the Danish accreditation and Metrology Fund (DANAK) to conduct surveys of special amusement apparatus, set in the monitoring book whether amusement apparatus covered by article 16, paragraph 2. The companies, which are heard, must be informed of the result of vision, when monitoring the book is done.
(6). Surveillance must be accompanied by two copies of the book the drawings necessary for the documentation of safety, including a sketch indicating the device's main objective, description and calculations as well as operating instructions, which must be drawn up by the supplier.
§ 19. Approval must be in writing and specify the conditions for safety reasons shall be made with regard to the set's construction, the fixing and application of the basic regulation. Article 18, paragraph 2.
(2). The authorisation shall also specify whether there should be tighter controls on the instrument and, where appropriate, how long, see. section 17, paragraph 2.

§ 20. An amusement machine, whose construction has been changed in relation to the latest announced permission must not be put into service before the police have approved the change.
(2). The provisions of §§ 18 and 19 shall apply mutatis mutandis. Approved the change, please indicate this in the monitoring book. Also corrected the drawings, descriptions and calculations, etc.., which came with the first application for approval of the device.
§ 21. An amusement apparatus, which are covered by section 16 must appear every year, just before it is taken into use for the first time, to ensure that no changes have been made to the approved design that it is properly maintained, and that it in fact does not present a danger to the public or for the staff to serve the particular circumstances so require. how (complicated or particularly heavily used appliances, etc.) can police demand sight several times over the course of a year. This requirement shall, where appropriate, shall be entered in the monitoring book.
(2). Amusement apparatus, which are covered by section 16, paragraph 2, should also appear at least once a year by an unannounced survey during the season.
(3). Vision in accordance with paragraph 1 shall only be carried out by companies that are accredited to carry out inspection of special amusement apparatus by the Danish accreditation and Metrology Fund (DANAK) or an equivalent accreditation body that is a signatory to the European co-operation for Accreditation's multilateral mutual recognition agreement (EA 01/06). The firm carries out the inspection of all parts of amusement equipment.
(4). Unannounced surveys in accordance with paragraph 2 shall be carried out by the same company which has conducted surveys of the appliance in accordance with paragraph 1.
(5). By unannounced survey after paragraph 2, he or she must also ensure that business about any deficiencies previously noted in the monitoring book, has been rectified, and the fact that the equipment alone is served by persons whose name and date of birth are entered in the annex to the instrument, as referred to in the book for supervisory. section 18, paragraph 4.
(6). The company shall specify the date of the unannounced survey after paragraph 2 of the basic regulation. paragraph 5, as well as any comments on the result in the monitoring book. The company must immediately disclose information on these results to the local police in cases where by sight in accordance with paragraph 2 of the basic regulation. paragraph 5, is found missing, etc.
(7). The police may at any time prohibit the use of amusement machines subject to section 16, if it is considered necessary for reasons of safety for the audience or the staff that serves it.
(8). The police and the company in accordance with paragraph 1 shall carry out surveys of the said amusement apparatus, shall, on request, be given access at any time to carry out surveys or otherwise inspect amusement apparatus, if it is considered relevant by the police or vision company.
(9). If errors or omissions are found, the police can tighten up the conditions for the approval of amusement apparatus, see. section 19 (1), like the authorisation may be withdrawn if necessary.
§ 21 a. Amusement apparatus within the scope of § 16 shall be provided with a certificate of inspection referred to in article 6. Annex 1. The certificate must contain the information about the results of the latest survey, and it must appear on the certificate, which amusement device it relates.
(2). The company, which, in accordance with article 21, paragraph 1, shall carry out surveys of the amusement device must sign the inspection certificate and provide it with its stamp or mark.
(3). The owner or keeper of amusement equipment shall without undue delay put it last issued certificate of inspection at the entrance of the forlystelsen in a place that is visible to the audience.
§ 22. The cost of the in §§ 18-21 of the said survey shall be borne by the owner of amusement equipment.
§ 23. The owner of a public amusement must take out statutory workers ' compensation insurance for any assistance and liability insurance to cover any liability towards the audience. Liability insurance must, as a minimum, pose 5 mill. DKr. for personal injury and 2 mill. DKr. for damage to property. '
3. Annex 1 shall be inserted As annex to this Ordinance.
(1). The notice shall enter into force on the 1. July 2009, see. However, paragraph 2.
(2). section 21 (a) of the Ordinance on public rides, as amended by section 1 of this order, no. 2, shall enter into force on the 1. August 2009.
(3). § 1, nr. 1, shall not apply to licences issued before the entry into force of this order.
(4). Amusement apparatus within the scope of § 16, who before the entry into force of this order is the sight under section 21, shall be provided with a certificate of inspection no later than the first survey after the 31. July 2009.
