Law on the amendment of the law on the organisation and economic conditions of the water sector and different laws

(The postponement of the price ceiling for 2011 and others.)

We, by God's grace, the Queen of the Danes, do our thing.

The parliament has adopted the following law, and we know that the following law has been approved by Parliament's consent :

§ 1

Law no. 469 of 12. June 2009 on the organisation and economic situation of the water sector is hereby amended as follows :

1. Section 21 (1). FOUR, ONE. and 2. pkt., ITREAS :

" The funds of the Fund shall be made by deposits from the water companies. In the period 2011-13 the Environment Minister shall pay an amount equal to the deposits received from the companies. `

2. § 36 ITREAS :

" § 36. The provisions relating to the price ceiling regulation in Chapter 3 apply to the award of the year 2011. `

§ 2

Law no. 460 of 12. June 2009 amending the law on environmental protection, law on water supply, the law on payment rules for waste water services, etc., and different laws. (Consequences of the rule of organisation and economic conditions of the water sector) are hereby amended as follows :

1. § 2, nr. 7, revoked.

2. § 3, nr. 3, revoked.

§ 3

In accordance with the law on water supply, etc., cf. Law Order no. 935 of 24. In September 2009, the following changes are made :

1. § 52 A (3) (a) 1, ITREAS :

' In the case of water supplied by an alment water supply plant, in compliance with the price ceiling fixed for the supply under section 6 of the rules governing the organisation and economic conditions of the water sector, they are included in this ; the expenditure indicated in accordance with the provisions of however, paragraph 1 3 and 4. Charges include

1) required costs for the abstraction and distribution of water,

2) wages and other operating costs,

3) administration,

4) contributions to the expenditure of the secretariat established pursuant to Chapter 4 of the organisation and economic situation of the water sector ;

5) operating depreciation,

6) the interest of the presence of foreign capital,

7) deficits arising from previous periods in connection with the establishment and substantial development of supply systems,

8) provisions for new investments,

9) expenditure on the consultancy of the water-saving customers of the water supply, the financing of water-saving measures and participation in water-service cooperation and the lignable ;

10) the costs of mapping, monitoring and protection of the water resources obtained from the plant from or in the future may be expected to be obtained from such additional surveillance and protection beyond the public mapping ; monitoring and protection are necessary or appropriate to the water supply system,

11) costs of covering charges, cf. ~ ~ ~ ~ 24 (a, 24 (b) and 35 of the law on environmental objectives etc. for aquatic occurrences and international protection of nature), and

12) contributions to cover costs of tasks falling within the Technology Development Fund of the Water Fund, cf. Chapter 7 of the Regulation on the organisation and economic conditions of the water sector. ` ;

2. I § 52 a inserted after paragraph 1. 1 as new paragraph :

" Stop. 2. The partial or partial transfer of a general water supply system shall not directly or indirectly lead to higher prices for benefits from the installation in question, including as a result of an increase in the cost of financing with foreign capital, operating depreciation or interest-rate capital. ` ;

paragraphs 2 and 3 shall then be set out in paragraph 1. 3 and 4.

3. I § 52 A (3) (a) 2, there will be paragraph 1. 3, the following shall be inserted after ' Stk. 1 ": and 2".

§ 4

In the Act on the rules on payment for waste water plants, etc., cf. Law Order no. 281 of 22. March 2007, as amended by section 22 of the Act 1336 of 19. In December 2008 and section 3 of the law no. 460 of 12. In June 2009, the following changes are made :

1. Section 1 (1). 1, is hereby repealed and the following shall be inserted :

' The law is intended to ensure the principle of cost cover, including the environmental and resource-related costs, and pricing with incentive effect. In addition, account must be taken of the fact that the various water use sectors make an appropriate contribution and to the 'polluter pays' principle.

Paragraph 2. For the purposes of this law, the means of waste water supply undertakings, unless otherwise specified, shall be those of such waste-water supply companies covered by Section 2 (2). Paragraph 1, in the organisation and economic situation of the water sector.

2. 4. I § 2 b (3) (b) 2, the ' public waste water system ` shall be replaced by ' the waste water supply company ' s water supply system.

5. I Section 7 (a) (a) 1, in the words ' section 30 (1), The fourth shall be replaced by : 1 '.

§ 5

Paragraph 1. The law shall enter into force on 1. January, 2010, cf. however, paragraph 1 2.

§ 6

Paragraph 1.
