Law on the amendment of the law on chemical substances and products 1)

(The extension of certain data protection periods for biocidal products and repealing provisions on the notification of new substances and other substances, etc.)

We, by God's grace, the Queen of the Danes, do our thing.

The parliament has adopted the following law, and we know that the following law has been approved by Parliament's consent :

§ 1

In the law on chemical substances and products, cf. Law Order no. 1755 of 22. In December 2006, as amended by Section 4 of Law No 172 by 12. March 2008, section 3 of the law. 173 by 12. March 2008, Section 25 of Law. 1336 of 19. In December 2008 and Section 1 of the Law No 97 of 10. In February 2009, the following changes are made :

1. Foot notation the title shall be replaced by the following :

2. I Section 7 (2). 1, the following shall be inserted after ' after other legislation ` shall mean : `, including the Regulations of the European Communities '.

3. Section 7 (2). 2, revoked.

4. After paragraph 7 a is inserted :

" § 7 b. The Environment Minister may lay down rules for the fulfilment of Community legal obligations on the sale or import of substances intended to be included in products to be approved in accordance with Chapter 7. ` ;

5. The heading for Chapter 3 ITREAS :

"Export notification"

6. § § 11-15 is deleted.

7. Section 35 (b) (b) THREE, ONE. pkt., ITREAS :

' Data protection period for information on assets that are not new, cf. § 33 a, paragraph. THREE, TWO. a pkton and which has been submitted in accordance with Directive 98 /8/EC of the European Parliament and of the Council of 16. February 1998 on the placing on the market of biocidal products runs from the entry into the 14th. "May 2014."

8. Section 35 (b) (b) SIX, ONE. pkt., ITREAS :

' Data protection period for information relating to non-biocidal products other than those referred to in paragraph 1. 5 mentioned, submitted in accordance with Directive 98 /8/EC of the European Parliament and of the Council of 16. February 1998 on the placing on the market of biocidal products runs from the entry into the 14th. "May 2014."

9. I § 41 ' a chemical substance declared in this country in accordance with section 12 (3). 1, or of "and" § 12 or ".

10. I § 59, paragraph. 1, no. 1, paragraphs 11 (1) are deleted. 1, "

13. I § 61 paragraphs 12 (2) shall be deleted. 1, 2, and 5, ".

§ 2

Paragraph 1. The law shall enter into force on 1. January, 2010.

Paragraph 2. The rules which have been issued under the applicable section 15 in the Act of Chemical Products and Products Act shall remain in force until they are repealed or replaced by requirements pursuant to section 7 b in the law on chemical substances and products as drawn up by this legislative section. 1, no. 4.
