Law on the amendment of the use of fertilizer and plant-cover fertilizer

(Cultive-related measures etc.)

We, by God's grace, the Queen of the Danes, do our thing.

The parliament has adopted the following law, and we know that the following law has been approved by Parliament's consent :

§ 1

In the case of land use of fertilizers and plant cover, cf. Law Order no. 757 of 29. June 2006, the following changes shall be made :

1. I § 1 the following shall be inserted after ' plant cover ` : ' and other crop-related measures. `

2. I Section 2 (2). 2 and 3, the words ' cf. Annex 1 of the law and ' VAT-registered ' means ` shall be replaced by ' taxable turnover '.

3. I Section 2 (2). 2, changes "20 000 kr." to : "50,000 kroner."

4. Section 2 (2). 6 and 7, ITREAS :

" Stop. 6. Companies which are subject to registration (s). 2, notify the company for registration during the period in accordance with the plan. Section 4, in which the duty is to be entered. Registration pursuant to paragraph 1 2 and 3 shall have effect throughout the period during which the notification takes place. However, the Minister may, in exceptional cases, detect establishments having an impact on previous schedule periods.

Paragraph 7. When the undertaking is no longer required to be registered in accordance with paragraph 1. 2, or the registered person no longer wants to register for the first paragraph. 3, the company may be reported from the register. The Minister may cancel an undertaking from the register of the first period, if the company's taxable turnover of plant breeding, livestock farming, forestry or any combination of the undertaking will fall to less than 20 000 kr. yearly. "

5. § 3 ITREAS :

" § 3. The law provisions on plant cover and other cultivation-related measures, cf. in Chapter 3, undertakings with plant breeding or livestock breeding or combinations thereof, which have an annual tax liable for taxable turnover, which exceeds 50,000 kroner. from planteakeeping or livestock breeding or combinations thereof and which have a total area of 10 hectares or more. In the case of the area of reckoning, chartered and chartered land shall be included. '

6. § 4, 3. pkt., revoked.

7. I Section 6 (2). 1, pasted as Three. Point. :

' The minister of food, agriculture and fisheries shall lay down rules on the size and crop of the field. ` ;

8. Section 6 (2). 3, is hereby repealed and the following shall be inserted :

" Stop. 3. The minister lays down the nitrogen standards for crops and can lay down different standards for different regions in the country.

Paragraph 4. The minister may lay down rules for the allocation of a nitrogen standard to wheat for breadmaking, including setting an upper limit for the area to be assigned to this standard. ` ;

Paragraph 4 becomes paragraph 4. 5.

9. Insert after section 6 :

" § 7. The Minister for Food, Agriculture and Fisheries may lay down rules for the establishment of dutiful crops, in whole or in part, to a reduction in the overall quota for nitrogen.

Paragraph 2. The minister may also lay down rules on additions to the company ' s total quota for nitrogen, if the establishment is established in excess of dutiful crops.

Paragraph 3. The Minister may lay down rules on the specification of the reduction in accordance with paragraph 1. 1 and on the calculation of the supplement in accordance with paragraph 1. 2 and the undertaking ' s information on the application of the said possibilities. `

10. I § 8 (3) 1, the words ', cf. Section 6 (2). 3 ".

11. § 8 (3) 3, revoked.

12. The heading for Chapter 3 the following shall be replaced by the following : ' Plantecover and other cultivation-related measures `.

13. Section 18 (2). 1, ITREAS :

" The Minister for Food, Agriculture and Fisheries may lay down rules on the construction of plant cover and other cultivation-related measures. The Minister may lay down rules on the crop types which may be used as plant cover and on the extent to which part of the company ' s area of plant cover must be established. The Minister can also lay down rules for the implementation of a pilot project for meltdown crops. '

14. I § 18 inserted after paragraph 1. 1 as new paragraph :

" Stop. 2. The Minister for Food, Agriculture and Fisheries may lay down rules on special schemes which each company can choose as an alternative to the development of crops. '

Paragraph 2 is then referred to in paragraph 2. 3.

15. I Section 18 (2). 2, the following shall be inserted after ' plant cover ` : ' and other cultivation-related measures `.

16. Section 22 (2). 1, ITREAS :

' The company shall prepare fertilizer accounts for the period completed. The fishing accounts shall be reported to the Minister for Food, Agriculture and Fisheries. `

17. Insert after section 24 a Chapter 6 :

" section 24 b. The Minister for Food, Agriculture and Fisheries may take soil samples to be used in order to prepare the nitrogen forecast, cf. Section 6 (2). Two, without paying for it. At the request of the establishment, the establishments shall provide the Minister with all information necessary for the preparation of the forecast. `

18. I Section 26 (1). 1, change ' section 6 (1). 3, 3. Pct. " to : section 6 (4). 4 ".

19. § 29, paragraph. 1, ITREAS :

" Unless higher penalties have been inflished on other law, penalty shall be punished by fine.

1) is in violation of section 5, section 21 (1). Paragraph 1, paragraph 22, paragraph 22. 1-4, section 23, paragraph. 1 and 3, and section 24,

2) omits to report the undertaking to register in accordance with section 2 (2). 2 or fail to provide information or to provide assistance at section 24 b, section 27 and section 28. ` ;

20. Appendix 1 revoked.

§ 2

The law shall enter into force on 1. January, 2010.
