Annex 8 the full text notice on the preservation and disposal of judicial archives

Under section 5, paragraph 1, of the Culture Ministry's Decree No. 591 of 26. June 2003 on public archives and public archives shall be specified:

Area

§ 1. The provisions apply to archival records, which until 31 December 2004. January 2006 is created or obtained, and which are in the custody of the Supreme Court, the Court of the Reich, the Special Court of final appeal, a sideline activity Board, the maritime and commercial court, national courts and the district courts as well as up to 1. April 2008 with land registration offices.

(2). The provisions do not apply to archival material stored on electronic medium.

Retention and disposal

§ 2. All archival material from retsafdeling, which is registered in accordance with the Supreme Court the Supreme Court journal level are preserved.

(2). All archival material, which is registered in the Chief Justice journal up to and including 2004, are preserved.

(3). Archives, which is registered in the Chief Justice journal from 2005, is maintained as set out in annex 1.

§ 3. All archival material from the Danish national court is preserved.

§ 4. Archival material from the Special Court of final appeal, which concerns the judgments are preserved.

§ 5. All archival material from a sideline activity Board, which is registered in a sideline activity Committee's journal, is preserved.

§ 6. Archival material from the maritime and commercial court, as is registered according to the maritime and commercial court's journal plan is maintained as set out in annex 2.

§ 7. Archival material from the national courts, which are registered in accordance with the country's courts journal plan is maintained as set out in annex 3.

(2). Archives, which is registered in the Vestre Landsret President journal 1919-1993, is maintained as set out in annex 4.

(3). Archives, which is registered in the Vestre Landsret President journal from 1994, is maintained as set out in annex 5.

(4). Archives, which is registered in the Østre Landsret President journal 1919-1993, is maintained as set out in annex 6.

(5). Archives, which is registered in the Østre Landsret President journal from 1994, is maintained as set out in annex 7.

§ 8. Archival material from the district courts, which are filed after the municipal journal plan is maintained as set out in annex 8.

§ 9. Archives, which are not to be preserved in accordance with §§ 2-8, discarded when the retention obligation for other provisions are met, and when after the Authority's own assessment, moreover, no longer has legal or administrative significance.

Entry into force, etc.

§ 10. Provisions shall enter into force on 8 November. November 2008.

(2). Executive Order No. 1013 of 8. October 2008 about the preservation and disposal of judicial archives shall be repealed.
