Under section 1, paragraphs 1 to 4 and articles 4, 24 and 27 of the law on the administration of the European Community regulations concerning the Organization of markets for agricultural goods, etc., see. lovbekendtgørelse nr. 297 of 28. April 2004 determined under the authority:

§ 1. This notice concerns the application of the Community rules on aid for the supply of milk and certain milk products to pupils in schools and educational institutions.

§ 2. Aid shall be granted for the supply of milk and certain milk products to pupils who regularly participates in teaching in the following institutions:





1) the municipal primary school, freedom elementary schools and private training schools created in association with governmental and private seminars.

2) Public and private secondary schools, matriculation courses and HF-courses.

3) After schools and municipal youth kostskoler.

4) Trade schools and technical schools.

5) crèches, kindergartens and recreation centers, operating in accordance with the law on social assistance.

6) other educational institutions for children and young people, including after-school and institutions for children and young people with extensive physical or mental disabilities.





(2). Food Profession, Nyropsgade 30, 1780 København V, may, on application, allow schools and kindergartens, which are not referred to in paragraph 1, to be covered by the scheme.

§ 3. Aid shall be granted for a maximum quantity of milk or milk products equivalent to 0.25 litres of milk per pupil per school day. By a day means a day on which are made active, scheduled classes, and where there is compulsory attendance for students.

§ 4. There is only support for the products which comply with the provisions in force at any time on konsummælks products and cheese, etc.

(2). The eligible products are laid down in annex 1.

§ 5. The aid granted under this scheme, to be used for the reduction of the price that students pay for the products in question. This must be reflected in the accounting data, which is drawn up in respect to the application of the aid scheme. Accounting data must be kept for at least 5 years.

§ 6. Eligible applicants must be in order to qualify for aid under the scheme be registered with the Food Business. The request must be submitted to the Food Profession on a form that can be obtained from the food industry.

(2). If the aid sought by a supplier of the eligible products or an organization applying for aid on behalf of one or more schools or implementing bodies and specially created for this purpose, vendor or organization prior to registration to support candidate approved by the Danish plant Directorate.

§ 7. Form for application for payment of the support can be obtained from the food industry. Applications for payment of the aid must be submitted to in § 6, paragraph 2, suppliers and organisations to the Danish plant Directorate. Other applicants must submit their application for disbursement to the food industry.

(2). Aid applications are submitted on a quarterly basis and must be received in the Food industry or the Danish plant Directorate no later than the last day of the third month following the quarter in which the products are distributed, see. However, paragraph 3.

(3). Constitutes the mark applied for amounts 20,000 DKK for a month or more, can the aid application referred to in paragraph 2 are submitted monthly. In this case, the aid application shall be received in the Food industry or the Danish plant Directorate no later than the last day of the third month after the month in which the products are distributed.

(4). Support the candidate for at least 5 years must keep copies of all requests for payment of the aid and the supporting documents that form the basis for the requests.

§ 8. Food Business shall take a decision in accordance with this Ordinance.

(2). Food Profession responsible for carrying out the administrative control.

(3). The Danish plant Directorate carries out the physical checks.

§ 9. The accuracy of the information, which will form the basis for the payment of aid, can the food industry or the Danish plant Directorate require confirmed by the municipal auditor of chartered or certified accountant.

§ 10. Violation of section 3, 4 and 5 of this Ordinance is punishable by a fine, unless a higher penalty is inflicted pursuant to the provisions of Chapter 5 of the law on the administration of the European Community regulations on market organisations for agricultural products, etc.

§ 11. The notice shall enter into force on the 1. January 2009. The provision in section 4, paragraph 2, however, shall enter into force on 1 January. July 2009.

(2). At the same time repealed Executive Order No. 802 of 13. July 2006 on the granting of aid for milk and certain milk products to pupils in schools and educational institutions. The provision in section 4, paragraph 2 shall remain in force to 30. June 2009. The provision in section 10 is also applicable to 30. June 2009, as regards violations of § 4, paragraph 2.

(lactose, fruit sugar and added sugar and/or honey), with the exception of cocoa milk (regardless of fat and sugar content).

c) fermented dairy products, also with frugtsaft4), whether or not flavoured, with a content of milk as referred to in point (a)) of at least 90% by weight, and with a maximum concentration of sukker5)

and/or honey not exceeding 9% total incl. (lactose, fruit sugar and added sugar and/or honey).






 





Category II






 





Flavoured and non-flavoured fermented milk products with fruit 6), with a content of milk as referred to in category I (a)), at least 80% by weight, and with a maximum concentration of sukker5)

and/or honey not exceeding 9% total incl. (lactose, fruit sugar and added sugar and/or honey).






 





Category III






 





Flavoured and non-flavoured fresh and processed cheese, with a content of cheese at least 90% by weight.






 





Category IV






 





Grana Padano cheese and Parmigiano Reggiano cheese.






 





Category V






 





Flavoured and non-flavoured cheese that has a content of cheese at least 90% by weight, and which do not fall within category III and IV.
Official notes 1) Ordinance contains provisions which are necessary for the application of the following regulations: Council Regulation (EC) No 1782/2003. 1234/2007 of 22. October 2007 establishing a common organisation of agricultural markets and on specific provisions for certain agricultural products (single CMO Regulation) and Commission Regulation (EC) No 1782/2003. 657/2008 of 10. July 2008 implementing Council Regulation (EC) No 1782/2003. 1234/2007 as regards Community aid for supplying milk and milk products to schoolchildren. The notice is included in certain provisions of the aforementioned regulations. According to article 249 of the EC Treaty where a regulation is directly applicable in each Member State. Version of these provisions is thus entirely justified in practical terms and shall not affect the validity of the said regulations look in Denmark.

4) Fruit juice is used in accordance with the provisions of Council Directive 2001/112/EC of 20. December 2001 relating to fruit juices and certain similar products intended for human consumption.

5) in this category, the term ' sugar ' goods falling within CN codes 1701 and 1702. There must be no added artificial sweeteners to dairy products.

6) in this category must be fermented milk products with fruit always contain fruit, fruit pulp, fruit purees or fruit juice. In this category, the term ' fruit ' products falling under Chapter 8 of the combined nomenclature with the exception of nuts and products containing nuts. Fruit juices, fruit pulp and fruit puree is used in accordance with the provisions of Council Directive 2001/112/EC of 20. December 2001 relating to fruit juices and certain similar products intended for human consumption.
