Completion on penal provisions for infringements of certain regulations on food hygiene

In accordance with section 60 (2), Three, in the law. 526 of 24. June 2005 on foodstuffs shall be fixed :

§ 1. Without prejudice to other legislation, penalties shall be penalised by the food business that violates the following provisions of Regulation (EC) No 2 of the European Parliament and of the Council. 852/2004 of 29. April 2004 on food hygiene :

1) in Article 4 (4), 1-3,

2) Article 5 (5), 1-4, or

3) Article 6.

§ 2. Unless higher penalties have been imposed on the other legislation, the penalty shall be punished by fine, which violates the following provisions of Regulation (EC) No 2 of the European Parliament and of the Council. 853/2004 of 29. April 2004 on the specific hygiene rules applicable to foodstuffs of animal origin, as amended by Commission Regulation (EC) No (EC) No ; 1688/2005 of 14. October 2005, Commission Regulation (EC) No, 2074/2005 of 5. December 2005, Commission Regulation (EC) No, 2076/2005 of 5. December 2005, Commission Regulation (EC) No, 1662/2006 of 6. in writing.-November 2006 and Commission Regulation (EC) No 1243/2007 of 24. October 2007 :

1) Article 3,

2) in Article 4 (4), 1-4,

3) Article 5,

4) Article 6,

5) Article 7 (2) ; 1, or

6) Article 8 (2) ; 1-2.

§ 3. Unless higher penalties have been imposed on the other legislation, the penalty shall be penalised by the penalty which infringes the following provisions of Commission Regulation (EC) No 2. 1688/2005 of 14. § 5. Unless higher penalties have been imposed on the other legislation, the food business undertaking shall be punished by the penalty of the following provisions of Commission Regulation (EC) No 2. 2074/2005 of 5. In December 2005 laying down detailed rules for the application of certain products pursuant to Regulation (EC) No 2 of the European Parliament and of Regulation (EC) No 853/2004 and under the official supervision of the European Parliament and of the Council. § 6. Unless higher penalties have been imposed on the other legislation, the food business undertaking shall be punished by the penalty of the following provisions of Commission Regulation (EC) No 2. 2075/2005 of 5. § 7. Unless higher penalties have been imposed on the other legislation, the food business undertaking shall be punished by the penalty of the following provisions of Commission Regulation (EC) No 2. 2076/2005 of 5. In December 2005, on transitional arrangements for the implementation of Regulation (EC) No 2 of the European Parliament and of the Council. (EC) No 853/2004, no. (EC) No 854/2004 and (EC) No Regulation (EC) No 882/2004 and amending Regulation (EC) No 2. § 8. The sentence may rise to a maximum sentence for two years if it has been committed by the action or omission, with a set of or gross negligence, and there is a breach in the infringement proceedings ;

1) damage to health or to the detriment of such risks ; or

2) obtained or intended to benefit from the economic advantage of the person concerned himself or others.

§ 9. Companies can be imposed on companies, etc. (legal persons) punishable by the rules of the penal code 5. Chapter.

§ 10. The announcement will enter into force on the seventh. January 2008.
