Notice of penalties for violation of certain regulations on food hygiene

Under section 60, paragraph 3, of law No. 526 of 24. June 2005 on foods shall be fixed:

§ 1. Unless a higher penalty is inflicted upon the rest of the legislation, is punishable by a fine the food business operator who violates the following rules of European Parliament and Council Regulation (EC) No 1782/2003. 852/2004 of 29 April 2004. April 2004 on the hygiene of foodstuffs:





1) article 4, paragraph 1-3,

2) article 5, paragraphs 1 to 4, or

3) article 6.





§ 2. Unless a higher penalty is inflicted upon the rest of the legislation, is punishable by a fine anyone who violates the following rules of European Parliament and Council Regulation (EC) No 1782/2003. 853/2004 of 29 April 2004. April 2004 laying down specific hygiene nebestemmelser for food of animal origin, as amended by Commission Regulation (EC) No 1782/2003. 1688/2005 of 14. October 2005, Commission Regulation (EC) No 1782/2003. 2074/2005 of 5. December 2005, Commission Regulation (EC) No 1782/2003. 2079/2005 of 5. December 2005, Commission Regulation (EC) No 1782/2003. 1662/2006 of 6. November 2006 and Commission Regulation (EC) No 1782/2003. 1243/2007 of 24. October 2007:





1 article 3),

2) article 4, paragraph 1-4,

3 article 5),

4) article 6,

5) article 7, paragraph 1, or

6) article 8, paragraph 1-2.





§ 3. Unless a higher penalty is inflicted upon the rest of the legislation, is punishable by a fine anyone who violates the following rules of Commission Regulation (EC) No 1782/2003. 1688/2005 of 14. October 2005 on the implementation of European Parliament and Council Regulation (EC) No 1782/2003. 853/2004 as regards special guarantees concerning salmonella for consignments to Finland and Sweden of certain meat and eggs:





1) article 1,

2) article 2,

3 article 3),

4 Article 4),

5) article 5, or

6) article 6.





§ 4. Unless a higher penalty is inflicted upon the rest of the legislation, is punishable by a fine anyone who violates the following rules of Commission Regulation (EC) No 1782/2003. 2073/2005 of 15. November 2005 on microbiological criteria for foodstuffs, as amended by Commission Regulation (EC) No 1782/2003. 1441/2007 of 5. December 2007:





1 article 3),

2 article 4),

3 article 5),

4) article 6, paragraph 1,

5) article 7, or

6) article 9.





§ 5. Unless a higher penalty is inflicted upon the rest of the legislation, is punishable by a fine the food business operator who violates the following rules of Commission Regulation (EC) No 1782/2003. 2074/2005 of 5. § 6. Unless a higher penalty is inflicted upon the rest of the legislation, is punishable by a fine the food business operator who violates the following rules of Commission Regulation (EC) No 1782/2003. 2075/2005 of 5. December 2005 laying down specific rules on official controls for Trichinella in meat, as amended by Commission Regulation (EC) No 1782/2003. 1665/2006 of 6. § 7. Unless a higher penalty is inflicted upon the rest of the legislation, is punishable by a fine the food business operator who violates the following rules of Commission Regulation (EC) No 1782/2003. 2079/2005 of 5. December 2005 on transitional arrangements in the context of the implementation of the European Par la Parliament's and Council Regulation (EC) No 1782/2003. 853/2004, (EC) No 1782/2003. 854/2004 and (EC) No 1782/2003. 882/2004 and amending Regulation (EC) No 1782/2003. 853/2004 and (EC) No 1782/2003. 854/2004, as amended by Regulation (EC) No 1782/2003. 1666/2006 of 6. No vem ber 2006, Commission Regulation (EC) No 1782/2003. 479/2007 of 27. April 2007 and Commission Regulation (EC) No 1782/2003. 1246/2007 of 24. October 2007:





1) article 7,

2 article 8),

3) article 10, paragraph 1-2, or

4) article 13, paragraph 2.





§ 8. The penalty can rise to imprisonment for up to 2 years, if it knows the action or failure occurred violations are committed with intent or gross negligence, and there in the infringement is





1) caused damage to the health or caused danger therefor, or

2) achieved or intentional obtained a financial benefit for the person himself or others.





§ 9. That can be imposed on companies, etc. (legal persons) criminal liability in accordance with the provisions of the criminal code 5. Chapter.

§ 10. The notice shall enter into force on 7 August. January 2008.
