Notice on the Secretariat of the food and Veterinary complaints
Under section 58 (1)-(3) of law No. 526 of 24. June 2005 on food, section 66 of Act No. 432 of 9. June 2004 on the keeping of animals, § 36 of law No. 433 of 9. June 2004 on veterinary surgeons, § 3, paragraph 2, of the law on seeds, potatoes and plants, see. lovbekendtgørelse nr. 261 of 26. April 1999 and section 9 in økologilov of the basic regulation. lovbekendtgørelse nr. 761 of 29. June 2006 lays down:
The scope of the
§ 1. The Secretariat of the food and veterinary complaints is an authority under the Ministry of food, agriculture and Fisheries.
(2). The Secretariat of the food and Veterinary Office is headed by a Chief complaints.
§ 2. The Secretariat of the food and veterinary complaints deal with appeals from decisions of the regions food and Food Agency in the first instance, unless other remedies is required under the law in the area in question.
(2). The Secretariat of the food and veterinary complaints deal with appeals from decisions of first instance by other authorities and private or public institutions, which have been given delegated powers in the field of food and veterinary field.
(3). The Secretariat of the food and veterinary complaints deal with complaints over decisions taken in accordance with paragraph 1 and paragraph 2 referred to authorities or institutions, as part of the proceedings, including decisions on access to documents and party status.
§ 3. Complaint deadline is 4 weeks, see. However, paragraph 2. The appeal must be filed through the authority or institution which took the decision.
(2). The Secretariat of the food and veterinary complaints may within 6 months after the decision to ignore the exceeding of deadline, when the breach of the specific complaint reasons is excusable.
§ 4. Decisions of the Secretariat of the food and Veterinary complaints cannot be brought before another administrative authority, unless otherwise provided for in the legislation in that area.
Entry into force of the
§ 5. The notice shall enter into force on 9 November. February 2008.
