Law on the amendment of the law of foodstuffs with more laws

(Food control and sanction options, etc.)

We, by God's grace, the Queen of the Danes, do our thing.

The parliament has adopted the following law, and we know that the following law has been approved by Parliament's consent :

§ 1

Law no. 526 of 24. June 2005 on foodstuffs, as amended by Section 6 of Law No 1430 of 21. In December 2005 and section 1 of the Law No 1549 of 20. December 2006, the following changes are made :

1. § 39, paragraph. 2, ITREAS :

" Stop. 2. The minister may lay down rules or make provision for food that is carried through the country as a transit freight, is stored as transit goods or imported from abroad for its own use. ` ;

2. The following section 52 is inserted :

" § 52 a. The Minister for Food, Agriculture and Fisheries may inform you of the provision of assistance from a counselor and on the participation of training.

Paragraph 2. The Minister may lay down detailed rules on the advice and training. `

3. § 55, paragraph 1. 1 and 2, is hereby repealed and the following shall be inserted :

' The Minister for Food, Agriculture and Fisheries shall set up the Food Control Committee with the task of monitoring compliance with the rules on food and veterinary checks in accordance with the rules of the area, the control strategy and control plans and on a resource-appropriate manner.

Paragraph 2. The Committee shall consist of 8 expert members appointed by the Minister. Of these, 4 members of animal protection organisations and consumer organisations and 4 members of relevant inter-branch organizations are being set.

Paragraph 3. The Minister shall establish the Committee ' s Rules of Procedure and shall determine the tasks of the Committee

Paragraph 3-5 shall then be referred to in paragraph 3. 4-6.

4. I § 55, paragraph 1. 5, there will be paragraph 1. 6, the following shall be inserted after ' for food control ' : ' and animal welfare and animal health checks `.

5. § 56, paragraph. ONE, THREE. pkt., revoked.

6. I § 56 inserted after paragraph 1. 1 as new paragraph :

" Stop. 2. The Minister may lay down rules on how and in what form undertakings shall make control results in accordance with paragraph 1. 1 accessible to the public, including under what conditions, undertakings may be exempt from the obligation to make control results available. '

paragraphs 2 and 3 shall then be set out in paragraph 1. 3 and 4.

7. I § 60, paragraph. 1, no. 2, inserted after ' section 52 (1) 1, "§ 52 a".

§ 2

In the legislation on seeds, potatoes and plants, cf. Law Order no. 261 of 26. April 1999, as amended by Section 3 of Act 3. 279 of 25. In April 2001 and section 4 of Law No 404 of 1. June 2005 shall be amended as follows :

1. § 1 (1) (a) ONE, THREE. pkt., revoked.

2. I § 1 a inserted after paragraph 1. 1 as new paragraph :

" Stop. 2. The Minister may lay down rules on how and in what form undertakings shall make control results in accordance with paragraph 1. 1 accessible to the public, including under what conditions, undertakings may be exempt from the obligation to make control results available. '

paragraphs 2 and 3 shall then be set out in paragraph 1. 3 and 4.

§ 3

In the case of the administration of the European Community regulations on the market organisation of agricultural products, etc., cf. Law Order no. 297 of 28. April 2004, as amended by Section 3 of Act 3. 366 of 24. May 2005, section 27 of law no. 430 of 6. June 2005, section 33 of Law No 431 of 6. June 2005 and § 68 in law no. 538 of eight. June 2006, the following changes shall be made :

1. § 4 (a) (a) ONE, THREE. pkt., revoked.

2. I § 4 a inserted after paragraph 1. 1 as new paragraph :

" Stop. 2. The Minister may lay down rules on how and in what form undertakings shall make control results in accordance with paragraph 1. 1 accessible to the public, including under what conditions, undertakings may be exempt from the obligation to make control results available. '

paragraphs 2 and 3 shall then be set out in paragraph 1. 3 and 4.

§ 4

In the Ecological Act, cf. Law Order no. 761 of 29. June 2006, the following changes shall be made :

1. § 8 (3) ONE, THREE. pkt., revoked.

2. I § 8 inserted after paragraph 1. 1 as new paragraph :

" Stop. 2. The Minister may lay down rules on how and in what form undertakings shall make control results in accordance with paragraph 1. 1 accessible to the public, including under what conditions, undertakings may be exempt from the obligation to make control results available. '

paragraphs 2 and 3 shall then be set out in paragraph 1. 3 and 4. "

§ 5

The law shall enter into force on 1. March 2008.

§ 6

The law does not apply to the Faroe Islands and Greenland, but can, in the case of Greenland, be implemented in full or in part to Greenland, with the deviations from which the special Greenland conditions are worded.
