Law amending the law on local government administration and law on regions and of the decommissioning of the county municipalities, the capital's Development and the capital's Hospital community

(Calculation and submission of control tenders as well as a municipal form of Government with the Finance Committee and Standing Committee without part in the immediate management)

WE, MARGRETHE the SECOND, by the grace of God Queen of Denmark, do indeed:

The Danish Parliament has adopted and we know Our consent confirmed the following law:

§ 1

The law on local government administration, see. lovbekendtgørelse nr. 1060 of 24. October 2006, as amended by section 1 of Act No. 510 of 6. June 2007, shall be amended as follows:

1. Pursuant to section 62 (c) is added:

» § 62 d. Welfare Minister may lay down rules on the calculation of the costs of the municipality's own execution of a task, as the municipality decides to send in invitations (control tenders) and about the relinquishment of control tenders.

(2). Welfare Minister may lay down rules to the effect that the klagenævnet for Udbud according to the rules of law on the klagenævnet for Udbud and regulations issued thereunder may deal with complaints relating to the municipality's violation of the rules laid down pursuant to paragraph 1. '

2. Pursuant to section 64 (a) shall be inserted:

» § 64 b. Municipal Council can in bylaw may provide, to the standing committees and the Committee on Economic Affairs is not or only in some of their territories assume the immediate management of Municipal Affairs, see. However, paragraph 2.

(2). The Finance Committee shall carry out the tasks for which the Committee on Economic Affairs is attributed to pursuant to section 18, paragraph 2-4, section 37 and section 45 (1) and (2).

(3). Paragraphs 1 and 2 shall also apply if the municipality is managed according to the rules laid down in paragraph 64 (a), section 65 or both provisions. '

3. In paragraph 65 (b), paragraph 1 1. point, and (2) and § 65 c, paragraph 2, 1. paragraph shall be added after ' 64 (a), ': ' 64 (b), '.

§ 2

In Act No. 537 of 24. June 2005 on the regions and on the closing of county municipalities, the capital's Development and the capital's Hospital community, as amended by section 11 of Act No. 382 of 3. May 2006, article 40 of law No. 499 of 7. June 2006 and article 2 of law No. 510 of 6. June 2007, shall be amended as follows:

1. In the title of the Act shall be inserted after ' the capital's Hospital community «:» (region code) '.

2. Under section 35 shall be added:

» § 35 a. Welfare Minister may lay down rules on the calculation of the cost of the region's own execution of a task, as the region decides to send in invitations (control tenders) and about the relinquishment of control tenders.

(2). Welfare Minister may lay down rules to the effect that the klagenævnet for Udbud according to the rules of law on the klagenævnet for Udbud and regulations issued thereunder may deal with complaints relating to the region's violation of the rules laid down pursuant to paragraph 1. '

§ 3

The law shall enter into force on the 1. July 2008.

§ 4

Exemptions granted pursuant to § 65 c, paragraph 2, of the law on local government administration to the form of Government that is subject to section 64 (b) of the law on local government agency as amended by this Act, section 1, no. 2, applies to the remainder of the parliamentary term.

§ 5

The law does not apply to the Faroe Islands and Greenland.
