Under section 21 (h) of the law on rail, see. lovbekendtgørelse nr. 1171 by 2. December 2004, as amended by Act No. 477 of 30. May 2007 sets Traffic Agency after authorization from the Secretary of State pursuant to section 24 (a) the following:

§ 1. The Executive order implementing the Commission's decision of 23. April 2008 amending Annex A to decision 2006/679/EC of 28 June 1999. March 2006 concerning the technical specification for interoperability relating to the control-command and signalling subsystem of the trans-European conventional rail system and Annex A to decision 2006/860/EC of 7. November 2006 concerning the technical specification for interoperability relating to the control-command and signalling subsystem of the trans-European high-speed rail system.

(2). The Commission's decision and its annexes are annexed to this order.

§ 2. The notice shall enter into force on the 1. June 2008.

(2). In annex 1 to the Rules on the implementation of technical specifications for interoperability (TSI) for the control-command and signalling subsystem of the trans-European conventional rail system and high-speed, BJ 4-02, repealed in Annex A list of mandatory specifications and a list of indicative specifications.

THE COMMISSION OF THE EUROPEAN COMMUNITIES –

having regard to the Treaty establishing the European Community,

having regard to Council Directive 96/48/EC of 23. July 1996 on the interoperability of the trans-European high-speed rail system 1), and in particular article 6, paragraph 1,

having regard to European Parliament and Council Directive 2001/16/EC of 19. March 2001 on the interoperability of the trans-European conventional rail system 2), and in particular article 6, paragraph 1, and

on the basis of the following considerations:

(1) Commission decision 2006/679/EC 3) established the first technical specification for interoperability (TSI) relating to the control-command and signalling subsystem (then called ' control-command and signalling ") of the trans-European conventional rail system.

(2) Commission decision 2002/731/EC 4) established the first technical specification for interoperability (TSI) relating to the control-command and signalling subsystem (then called ' control-command and signalling ") of the trans-European high-speed rail system the iron; It has been repealed and replaced by Commission decision 2006/860/EC 5).

(3) by decision 2007/153/EC, annex A to decision 2006/679/EC and 2006/860/EC have been adapted to technical progress.

(4) Annex A should be updated again, because the working groups of the European Railway Agency have reached agreement on the subset 108.

(5) Article 6, paragraph 2, of Directive 96/48/EC and article 6, paragraph 2 of Directive 2001/16/EC obliges the Agency to prepare the revised legislation, Commission and updating of TSIs and making appropriate recommendations to the Committee referred to in article 21 in order to take account of technical progress or developments in the societal demands.

(6) Article 12 of the European Parliament and Council Regulation (EC) No 1782/2003. 881/2004 6) instructs the European rail Agency to ensure that the TSIs are adapted in the technical development ling, market developments and the societal demands and propose to the Commission the amendments to the Tsis which it considers necessary.

(7) the European Railway Agency adopted on 14 December. January 2008 a recommendation on the list of mandatory specifications and a list of indicative specifications tions in the TSIs for conventional and high-speed hedstog.

(8) the provisions of this decision are in accordance with the opinion of the Committee established by article 21 of Directive 96/48/EEC —

HAS ADOPTED THE FOLLOWING DECISION:

Article 1

The list of mandatory specifications and a list of indicative specifications, see. Annex A to the TSI attached as annex to decision 2006/679/EC relating to the control-command and signalling subsystem of the trans-European conventional rail, and vote be Annex A to the TSI attached as annex to decision 2006/860/EC of on the control-command and signalling subsystem of the trans-European high-speed rail system, replaced by the lists of respectively. compuls riske and indicative specifications annexed to this decision.

Article 2

Before 31 December 2003. December 2008, the specifications of the euro the European train control system ETCS, as annexed to this decision, be completed with up-to-date common test specifications and corrections of errors.

Article 3

Before 31 December 2003. December. 2008 gives the Member States, without prejudice to Directive 96/48/EC, article 7, and Directive 2001/16/EC, article 7, the Commission communication on which of their ETCS equipped lines in operation with the applicable mandatory specifications or will it be before this decision enters into force.

At the latest, Member States shall inform the Commission of the same date, when trains meet the specifications referred to in this decision, can be put into operation on each of their ETCS-lines.

Article 4

This decision shall apply from the 1. June 2008.

Article 5

This decision is addressed to the Member States.
