In accordance with section 21 h, in the law of rail, cf. Law Order no. 1171 of 2. In December 2004, as amended by law no. 477 of 30. In May 2007, the Traffic Management Board shall determine the authority of the Transport Minister, in accordance with section 24 (a) :
§ 1. The announcement shall make the decision of the Commission of 23. April 2008 amending Annex A to Decision 2006 /679/EC of 28. March 2006, on the technical specification for interoperability of the control-command subsystem and signalling of the trans-European conventional rail system and Annex A, Decision 2006 /860/EC of 7. In November 2006, on the technical specification for interoperability of the train control and signalling subsystem of the trans-European rail system, the technical specification for the high-speed rail system.
Paragraph 2. The Commission ' s decision and its annexes shall be annexes to this notice.
§ 2. The announcement shall enter into force on 1. June 2008.
Paragraph 2. Annex 1 to Provisions concerning the implementation of technical specifications for interoperability (TSI) for the subsystem train control and signalling in the trans-European conventional rail system and for high-speed trains, BJ 4-02, are hereby repealed in Annex A the list of compulsory specifications and the list of indicative specifications.

THE COMMISSION FOR THE EUROPEAN COMMUNITIES HAS-
Having regard to the Treaty establishing the European Community,
Having regard to Council Directive 96 /48/EC of 23. July 1996 on the interoperability of the trans-European high-speed rail system 1) , and in particular Article 6 (2), 1,
Having regard to Directive 2001 /16/EC of the European Parliament and of the Council of 19. March 2001 on the interoperability of the trans-European rail system for conventional trains 2) , and in particular Article 6 (2), 1, and
in the following considerations :
(1) Commission Decision 2006 /679/EC 3) the first technical specification for interoperability (TSIs) relating to the train control and signalling subsystem (referred to as ' Control-command and signalling ") of the trans-European conventional rail system.
(2) Commission Decision 2002/731/EC 4) Whereas the first technical specification (TSI) is established for the interoperability of the train control and signalling subsystem (called " control-command and signalling ") of the trans-European high-speed rail system ; it has been repealed and dissolved by : Commission Decision 2006 /860/EC 5) .
(3) In Decision 2007 /153/EC, Annex A to Decision 2006 /679/EC and 2006 /860/EC has been adapted to technical progress.
(4) Annex A should be updated again, because the work groups in the European Railway Agency have reached agreement on sub-requirements 108.
(5) Article 6 (1). 2, of Directive 96 /48/EC and Article 6 (1). 2, in Directive 2001 /16/EC, the Agency shall prepare the review and updating of the TSIs and to submit all relevant recommendations to the Committee referred to in Article 21 to take account of technical developments or the development of the social requirements.
(6) Article 12 of Regulation (EC) No 2 of the European Parliament and of the Council 881/2004 6) If the European Railway Agency is to ensure that the TSIs are adapted to technical developments, market developments and the social requirements, and propose to the Commission the changes in the TSIs as it considers necessary.
(7) The European Railway Agency adopted the 14. January 2008 a recommendation on the list of compulsory specifications and the list of indicative specifications in the TSIs for conventional trains and high speed trains.
(8) The provisions of this Decision are in accordance with the opinion of the Committee set up by Article 21 of Directive 96 /48/EEC;
DECIDUON THE FOLLOWING DECISION :
ARTICLE 1
The encoding of mandatory specifications and the list of indicative specifications, cf. Annex A to TSIM annexed to Decision 2006 /679/EC on the control-command and signalling subsystem of the trans-European conventional rail system and Annex A to the TSIM annexed to Decision 2006 /860/EC of the Community on the railway and signalling subsystem of the trans-European high-speed rail system, the lists of the compulsory and indicative specifications annexed to this Decision shall be replaced by the records of the trans-European high-speed rail system.
ARTICLE 2
Before the 31. In December 2008, the specifications of the European train control system ETCS attached as annexed to this Decision shall be completed with up-to-date common test specifications and corrections of errors.
ARTICLE 3
Before the 31. December. 2008, unless otherwise stated in Directive 96 /48/EC, Article 7 of Directive 2001 /16/EC, Article 7 of Directive 2001 /16/EC, the Commission shall inform the Commission which of their ETCS equipped lines with the applicable mandatory specifications ; or will be before this Decision enters into force.
By the same date, the Member States shall inform the Commission of when the trains which comply with the specifications referred to in this Decision may be operated on each of their ETCS lines.
ARTICLE 4
This Decision shall apply from 1. June 2008.
Article 5
This Decision is addressed to the Member States.
