Law on the Change of the Alien Act

(Implementing and infecting access to business visas and visiting visas)

We, by God's grace, the Queen of the Danes, do our thing.

The parliament has adopted the following law, and we know that the following law has been approved by Parliament's consent :

§ 1

In the law of foreigners, cf. Law Order no. 808 of 8. July 2008, as amended by law no. 431 of 1. June 2008, the following changes are made :

1. Section 4 (4). 4-7, ITREAS :

" Stop. 4. The amount referred to in paragraph 1. 2, shall be payable if the foreigner after the entry of the country ;

1) in accordance with Chapter 4,

2) the application for asylum in this country or in another Schengen country ; or

3) make an application for a residence permit on another basis, cf. however, paragraph 1 5.

Paragraph 5. Notwithstanding paragraph 1 4, no. the amount referred to in paragraph 1 shall be the amount referred to in paragraph 1. 2, not for payment, if :

1) The foreigner shall apply for residence permits in accordance with section 9 (4). 1, no. 1 or 2,

2) The foreigner shall apply for a residence permit in accordance with section 9 (c). 1, on the basis of such a family association referred to in section 9 (1). 1, no. 1 or 2,

3) The foreigner shall apply for a residence permit in accordance with section 9 (c). 1 in order to study,

4) The foreigner shall apply for a residence permit in accordance with section 9 (c). 4,

5) The foreigner is covered by Section 9 (a) (a). 2, no. 1-4 or 6, and seeking a residence permit on this basis or

6) On the contrary, the issue of humanitarian nature is crucial.

Paragraph 6. Paragraph 5 shall not apply where there are certain reasons for the assumption that the essential objective of the application is to avoid the amount referred to in paragraph 1. There are two reasons for payment, or there are certain grounds for assuming that the purpose of the application is to extend the stay in this country, and it is apparently that the application cannot lead to the granting of residence permits.

Paragraph 7. The Minister for Refugees, immigrants and integration lays down detailed rules on how to economic security in accordance with paragraph 1. 2 shall be ordered and for the payment of amounts due in accordance with paragraph 1. 3 and 4. The one in paragraph 1. 2 specified amounts are fixed in 2004-level and regulated from and by 2005 once a year on the 1 year. In January, after the Rate Adjustment%, cf. Act of a rate adjustment percentage. ` ;

2. § 4 c ITREAS :

" § 4 c. A foreigner can't get a visa after paragraph 4, paragraph 4. 1, for 5 years, if the foreigner after the entry without any necessary authorisation is in Denmark or in another Schengen country beyond the period specified in the issued visa. This period shall be three years if the inventory is for up to one month in addition to the time specified.

Paragraph 2. Paragraph 1 shall not apply if the foreigner proves that the time limit for the period specified in the issued visa is due to circumstances that may not be placed on the foreigners, or if there are any specific reasons.

Paragraph 3. A foreigner can't get a visa after paragraph 4, paragraph 4. 1, for 5 years, if the foreigner after the entry ;

1) in accordance with Chapter 4,

2) applying for asylum in this country or in another Schengen country, cf. however, paragraph 1 6, or

3) make an application for a residence permit on the second basis, cf. however, paragraph 1 4.

Paragraph 4. Paragraph 3, no. 3, shall not apply where :

1) The foreigner shall apply for residence permits in accordance with section 9 (4). 1, no. 1 or 2,

2) The foreigner shall apply for a residence permit in accordance with section 9 (c). 1, on the basis of such a family association referred to in section 9 (1). 1, no. 1 or 2,

3) The foreigner shall apply for a residence permit in accordance with section 9 (c). 1 in order to study,

4) The foreigner shall apply for a residence permit in accordance with section 9 (c). 4,

5) The foreigner is covered by Section 9 (a) (a). 2, no. 1-4 or 6, and seeking a residence permit on this basis or

6) On the contrary, the issue of humanitarian nature is crucial.

Paragraph 5. Paragraph 4 shall not apply if there are specific reasons for assuming that the purpose of the application is to extend the stay in this country, and it is apparently that the application cannot lead to the granting of residence permits.

Paragraph 6. Paragraph 3, no. Paragraph 2 shall not apply where the foreigner has filed an application for a residence permit in accordance with section 7 of this country and works to the information provided, cf. § 40, paragraph. ONE, ONE. and 2. and, after disclaimes or reductions of the application itself or the accomplis of the journey without undue delay. `

3. Insert after section 4 c :

" § 4 d. The Immigration Service shall decide to involve prior approval of an undertaking informed by the undertaking to receive a business visit from non-nationals from visa-based countries where the approval has been obtained by fraud, or the conditions for the approval shall no longer be present. The Immigration Service can also decide to include prior approval granted to an undertaking to receive business visits from foreigners from visa-based countries where the conditions of approval are not complied with. '

§ 2

Paragraph 1. The law shall enter into force on 1. In March 2009, cf. however, paragraph 1 2.

Paragraph 2. The section 4 of the drainment section 4 d as written by this Act's section 1, no. 3, enter into force on 1. July, 2009.

§ 3

The law does not apply to the Faroe Islands and Greenland, but can, by means of a royal contraption, be fully or partially put into force for these parts of the village, with the deviations which are attributed to the special ferry or Greenland conditions.
