The Fund's creation, purpose and the means



§ 1. Occupational safety and health research fund is set up as part of the implementation of the rate adjustment pool for 2003.1) (2). The Fund's purpose is to strengthen OSH research in Denmark.

(3). The Fund supports research and development in the work environment in order to improve the working environment and thus prevent, reduce and mitigate the exhaust of persons from the labour market due to work accidents, work-related disorders, attrition, etc.

§ 2. By the Fund for the purposes of this order: 1) Employment Minister.

2) Strategic Osh forskningsudvalg.

3) the scientific safety and health forskningsudvalg.

4) Committee for Development and Clearing (2). The Labour Inspectorate is the Secretariat of the Fund.

§ 3. The Fund represents 47.5 million. DKK in 2007, 50.0 mln. USD in 2008, 54.7 million. USD in 2009, 51.8 mio.kr. in 2010, 50.0 mln. USD in 2011 and 50.0 mln. USD in 2012.

(2). In addition, the occupational safety and Health Council annually transfer an amount of EUR 10 million. DKK for fund distribution in 2003-2011.

Chapter 2 the Fund's structure and Committee Structure



§ 4. The Fund's structure to separate the assessment of relevance and quality.

§ 5. The Fund should obtain professional advice from the Danish Strategic Research Council research in connection with the determination of the distribution procedure, including lookups, and research professional assessment of research applications received, see. law on research advice.

(2). The scientific safety and health forskningsudvalg can act as Advisory Subcommittee for strategic research, see. law on research advice.

§ 6. The strategic Osh forskningsudvalg must ensure that the Foundation awards funds for research and development, which from a safety and health strategic assessment is appropriate.

(2). The Committee on Development and the assessment must ensure that the Foundation awards funds for development and elucidation regarding the working environment of high quality.

(3). The labour inspectorate shall ensure coordination of the work of the Fund's secretariat of the Committee.

The Strategic Osh forskningsudvalg



§ 7. The strategic Osh forskningsudvalg consists of 9 members.

(2). The President and his Deputy are appointed by the Minister of employment.

(3). The other 8 members and delegates for those designated by the occupational safety and Health Council in accordance with the following breakdown: 1) Two members nominated by the national organisation in Denmark.

2) a member nominated by the salaried employees and civil servants ' Permanent Joint Council.

3) a member nominated by academic Central organisation.

4) a member nominated by the Danish employers ' Confederation.

5) a member nominated by the finance sector's employers ' Association, the Association of agriculture employers ' associations and agricultural Council jointly.

6) a member nominated by the public employers in the community.

7) a member nominated by the main leaders in the organization.

The Scientific Safety And Health forskningsudvalg



§ 8. The scientific safety and health forskningsudvalg consists of 7 members. Employment Minister shall appoint, upon a proposal from the Danish Strategic Research Council Chairman and the other 6 members in their personal capacity.

(2). The Committee shall elect from its midst a Vice-President.

(3). The members of the Committee should be recognized scientists and have access to at least one of the following research areas: 1) and safety factors for safety, health, well-being, welfare, etc., 2) occupational safety and health efforts in business, industry, and society level, or 3) the societal development importance to the working environment.

(4). The aim is that the Committee is composed of a broad representation of areas of research, see. paragraph 3, nr. 1-3. the provisions of paragraph 5. The aim is that the members of the Committee, taken together, represent an insight into occupational safety and health research in a broad range of institutions and others.

The Committee for the development and Assessment



§ 9. The Committee on Development and Elucidation consists of 5 members. The President and the other 4 members appointed by the Minister of employment in their personal capacity.

(2). The Committee shall elect from its midst a Vice-President.

(3). The members of the Committee should be recognized scientists or research savvy and have access to at least one of the following research areas: 1) and safety factors for safety, health, well-being, welfare, etc., 2) occupational safety and health efforts in business, industry, and society level, or 3) the societal development importance to the working environment.

(4). The aim is that the Committee is composed of a broad representation of areas of research, see. paragraph 3, nr. 1-3. the provisions of paragraph 5. The aim is that the members of the Committee, taken together, represent an insight into occupational safety and health research in a broad range of institutions and others.

Designation period



§ 10. The strategic Osh forskningsudvalgs members and their deputies are appointed for the period 2009-2010.

(2). The Scientific safety and health forskningsudvalgs members are appointed for the period 2009-2010.

(3). The Committee on Development and co-morbidity, members are appointed for the period 2009-2010.

Chapter 3 provisions common to the committees § 11. The strategic Osh forskningsudvalg is a quorum when at least half of the members or their alternates are present.

(2). The Scientific Committee for occupational safety and health forskningsudvalg and Development and Elucidation is a quorum when at least half of the members are present.

(3). The committees shall decide by majority vote among the members present or their deputies.

(4). In a tie, the Chairman of the Committee vote.

§ 12. Members of the Committee or their alternates may not take part in any proceedings if he or she is not qualified, see. Chapter 2 of the Act on administrative procedures.

§ 13. The committees shall adopt rules of procedure.

Chapter 4 Strategy for research and development in the work environment, etc..

§ 14. The strategic Osh forskningsudvalg sets for employment Minister's approval: 1) A rolling strategy for research and development in the work environment.

2) the broad, priority research themes in the strategy.

3) A plan for recruitment and training of researchers.

§ 15. The Scientific Committee for occupational safety and health forskningsudvalg and Development and Assessment Adviser for strategic Osh research forskningsudvalg professional issues.

§ 16. The strategy aims to ensure better prioritisation and utilisation of financial resources for research and development of occupational safety and health.

(2). The strategy must include the objectives and the broad, priority themes for research and development in the work environment.

(3). The strategy must contribute to enhancing the coordination of research and development activities and collaboration between research institutions.

(4). The strategy must at the same time, helping to strengthen the dissemination and use of research results, etc. as a basis for health and safety efforts, including on the individual company.

(5). The strategy must include a plan for recruitment and training of researchers in working environment with a view to greater research capacity.

§ 17. In support of the strategy mapped it: 1) what safety and health conditions of Danish research has illuminated or missing to illuminate, 2) which Danish institutions conducting research in occupational health, including research capacity, and 3) which financial Foundation Danish working environment research.

Chapter 5 the Fund's distribution of funds § 18. Foundation awards after application resources to research and development activities. Funds will be awarded in open competition.

(2). The Fund can, among other things. awarded to: 1) Multiannual appropriations for cross-disciplinary research themes involving multiple institutions.

2) funding for research into new, neglected or outstanding research themes.

3) Experimental and development projects.

4) Retention of accumulated competence.

5) research education.

Decision-making process



§ 19. The strategic Osh forskningsudvalg decides on the basis of the research strategy of the specific themes, which the Fund wants to support.

(2). The Fund invites applications in open lookup, where the themes are described. Spreads must specify the economic framework.

(3). The labour inspectorate shall ensure as a secretariat, to the applications received meet the form requirement and submitted in a timely manner, in accordance with article 3. § 25.

(4). If the requirements under paragraph 3 have not been fulfilled, it shall reject the application as the Labour Inspectorate Secretariat.

Quality



§ 20. Applications for grants for research presented to the Danish Strategic Research Council, see. § 5.

(2). If the Council determines that an application is not qualified, gives the Labour Inspectorate as secretariat of the applicant a refusal.

(3). If the Council determines that an application is not within the specified themes on the spread, giving the Labour Inspectorate as secretariat of the applicant a refusal.


§ 21. Applications for grants for the development and Assessment Committee for Development and Clearing (2). The Committee assesses the applications for grants for development and elucidation after professional quality criteria, which the Committee designing.

(3). The Committee may, in deciding to involve external experts.

(4). If the Committee determines that an application does not meet the quality criteria, provide the Labour Inspectorate as secretariat of the applicant a refusal.

(5). If the Committee determines that an application is not within the specified themes on the spread, giving the Labour Inspectorate as secretariat of the applicant a refusal.

Relevance



§ 22. The strategic Osh forskningsudvalg evaluates the qualified applications for relevance criteria, as the Committee decides.

(2). The strategic Osh forskningsudvalg planning in assessing, among other things. emphasis on promoting cross-institutional and technical cooperation in the work environment research, see. section 16 (3).

Giving away



§ 23. The strategic Osh forskningsudvalg set applications to employment Minister's approval.

(2). Foundation awards funds for the approved research and development activities, see. section 26, paragraph 1.

(3). The Fund provides by giving away the requirement that the research and development results be made available to the public, with a view to the application of the basic regulation. section 16, paragraph 4.

(4). The Labour Inspectorate provides the Secretariat to the other candidates as a refusal.

Quick procedure



§ 24. The strategic Osh forskningsudvalg can decide that after opening aid may be granted to a concrete theme, which is outside the strategy, if the Committee finds a special need to provide practical, solution-oriented knowledge within a short period of time.

(2). The strategic Osh forskningsudvalg may in its rules of procedure provide that the Labour Inspectorate Secretariat assesses the relevance and sets of applications applications to employment Minister's approval, see. section 22 and section 23, paragraph 1.

(3). The quality of applications to be evaluated by respectively the Danish Strategic Research Council and Committee for Development and Elucidation of the basic regulation. section 20 and section 21.

Chapter 6 Fund administration section 25. The Danish working environment authority will draw up a guide on the application requirements.

section 26. The labour inspectorate shall undertake reimbursement for approved research and development activities, see. Article 23, paragraph 2.

(2). The labour inspectorate shall establish standard conditions for grants from the Fund, including in terms of funds, disbursement, accounting, auditing, professional reporting, etc.

§ 27. The Labour Inspectorate supervises the research and development activities, receiving grants from the Fund.

section 28. The grant recipient must inform the Labour Inspectorate, if planned activities is delayed, or the conditions for the grant, substantially altered.

section 29. The labour inspectorate may decide to grant repayment or lapse if the grant conditions are not complied with.

Chapter 7 miscellaneous provisions § 30. The strategic Osh forskningsudvalg delivers an annual report to the occupational safety and Health Council on the Fund's work.

section 31. The Danish working environment service's decisions cannot be brought before another administrative authority.

(2). Decisions under section 19, paragraph 4, and section 29 may, however, be referred to the employment Minister.

section 32. The notice shall enter into force on the 1. January 2009.

(2). At the same time repealed Executive Order No. 417 of 21. April 2008 on OSH research.
