(Implementation of directives in the field of nature protection)

WE, MARGRETHE the SECOND, by the grace of God Queen of Denmark, do indeed:

The Danish Parliament has adopted and we know Our consent confirmed the following law:

§ 1

The law on nature protection, see. lovbekendtgørelse nr. 749 of 21. June 2007, shall be amended as follows:

1. The footnote to the title of the Act is replaced by the following: ' 1) Act contains provisions implementing parts of Council Directive 79/409/EEC of 2. April 1979 on the conservation of wild birds (birds directive) (Official Journal 1979 No. L 103, page 1), as last amended by Council Directive 2006/105/EC of 20. November 2006 (Official Journal of the European Union 2006 nr. L 363, page 368), and Council Directive 92/43/EEC of 21 December 1988. May 1992 on the conservation of natural habitats and of wild fauna and Flora (EC habitats directive) (Official Journal 1992 nr. L 206, p. 7), as last amended by Council Directive 2006/105/EC of 20. November 2006 (Official Journal of the European Union 2006 nr. L 363, page 368). '

2. In section 30, paragraph 1, the words ' can fix the ' to: ' sets '.

3. In section 30 shall be inserted after paragraph 1 as new pieces: ' (2). The Minister will implement the conservation measures necessary to ensure that it does not result in a significant negative effect on the conservation status of the species listed in annex 3 to the law when they inadvertently captured or killed. Conservation measures implemented on the basis of monitoring or further studies.

(3). The Minister shall implement the measures necessary to ensure that the taking in the wild of specimens of species of wild fauna and flora, as referred to in annex 4 of the law, and their exploitation is compatible with the need to preserve these species.

(4). The Minister for the environment lays down rules for the implementing measures as referred to in paragraphs 2 and 3. ';




Paragraphs 2 and 3 become paragraphs 5 and 6.



4. section 31 (2) and (3) are repealed and replaced by: ' (2). The Minister examines the appropriateness of reintroducing the animal and plant species listed in annex 3 to the Act, and which are indigenous, when this might contribute to their conservation.

(3). The Minister shall lay down, in order to safeguard nature's rules on the release of certain animals that do not occur naturally wild in Denmark.

(4). The Minister shall lay down for the purpose of protecting the wild rules requiring that certain plants that are not found naturally wild in Denmark, may only be planted or sown with special permission. '

5. section 50, paragraph 2 2. paragraphs, are hereby repealed.

6. In section 50 shall be inserted after paragraph 2 as new pieces: ' (3). Conservation Board may only grant a derogation from a conservation or a proposed conservation, if the mark applied for cannot





1) damaging or destroying breeding sites or resting places of the natural range of the species referred to in annex 3 to the Act, or

2) destroy the plant species listed in annex 5 to the law, in all stages of life.





(4). Even though the conditions laid down in paragraph 3 are not fulfilled, the preservation Board, if there is not a satisfactory alternative, grant a derogation. The derogation shall not prevent the maintenance of the conservation status of the stocks concerned in its natural range and shall aim at the





1) protect wild fauna and flora and conserving natural habitats,

2) prevent serious damage, in particular to crops, livestock, forests, fisheries, water and other forms of property,

3) ensure respect for public health and safety or other imperative reasons of overriding public interest, including the social and economic nature, and terms of significant beneficial effects on the environment,

4) promote research and teaching,

5) restore a stock, discarding or breeding species, including artificially different plants, or

6) allow the collection or storage of specimens of species listed in annex 3 to the Act, in a limited and specified quantity and under strictly controlled conditions.





(5). It must be reflected in the decisions referred to in paragraph 1, that the conditions laid down in paragraphs 2 to 4 are fulfilled. '




Paragraph 3 becomes paragraph 6.



7. paragraph 55 (a) repealed, and instead reads ' section 55 a. Regional Council can provide limited subsidies to projects, which contribute to the realisation of the vision and objectives of the regional development plan within the Act's purposes. '

8. Under section 56 shall be inserted before the heading "right of first refusal ':

» § 56 a. Recovery requirement in connection with grants, which are funded by national funds as well as EU funds, shall become statute-barred in their entirety in accordance with the rules laid down in the regulations in force. '

9. In section 71 is inserted as paragraphs 4 to 6:

' (4). The Minister shall lay down for the purpose of implementation of the European Community directives and decisions on nature protection area rules on the grant of injunctions and prohibition under section 11, paragraph 1.

(5). The Minister shall lay down for the purpose of implementation of the European Community directives and decisions on nature protection area rules about in which cases and under what conditions





1) authorisations may be given under section 8, paragraph 5, no. 7. Article 15, paragraph 4, nr. 7, and section 20,

2) dune conservation can be repealed pursuant to section 9, paragraph 3,

3) permissions may be granted under section 29, article 31, paragraph 1, and section 32,

4) derogations may be granted under section 3, paragraphs 1 to 3, and section 8, paragraph 1, of the basic regulation. § 65,

5) derogations may be granted from the rules issued under section 51 (1), or from the rules, which remain in force pursuant to section 101 (1)

6) building or protection lines may be withdrawn in whole or in part in accordance with sections 15 to 19 of the basic regulation. section 69, paragraph 1, and

7) decisions can be taken under rules issued under section 8, paragraphs 6 and 7, § 15, paragraph 1, article 16, paragraph 1, article 17, paragraph 1, and article 18, paragraph 1, of the basic regulation. section 65.





(6). The Minister of the environment shall take appropriate measures to protect, maintain or restore sufficient diversity and area of habitats for wild birds species. '

10. In article 73, paragraph 2, the words ' and section 15 on beach protection line ' to: ', section 15 on beach protection line and rules in the Cape. 5 on the protection of plant and animal species, etc. ' 11. Annexed to the law shall be inserted as annex 3-5, which is replaced by Annex 1-3 to this law.

§ 2

The law on hunting and wildlife management, see. lovbekendtgørelse nr. 747 of 21. June 2007, shall be amended as follows:

1. The footnote to the title of the Act is replaced by the following: ' 1) Act contains provisions implementing parts of Council Directive 79/409/EEC of 2. April 1979 on the conservation of wild birds (birds directive) (Official Journal 1979 No. L 103, page 1), as last amended by Council Directive 2006/105/EC of 20. 2. In article 3, paragraph 2, be inserted as new numbers: ' 1) the hunting of birds must not be inconsistent with the protective measures taken in their distribution areas.

2) hunting of birds must meet a wise use and be ecologically balanced.

3) must not be operated hunting of birds during the breeding season and on birds during their return to their rearing grounds. '




Nr. 1-3 is then no. 4-6.



3. Under section 9 shall be added:

» § 9 a. Minister shall implement the conservation measures necessary to ensure that it does not result in a significant negative effect on the conservation status of the mammals, which are listed in annex 1 to the law when they inadvertently captured or killed. Conservation measures implemented on the basis of monitoring or further studies.

(2). The Minister shall implement the measures necessary to ensure that the taking in the wild of specimens of the mammals, which are mentioned in annex 2 of the Act, and their exploitation is compatible with the need to preserve these species.

(3). The Minister for the environment lays down rules for the implementing measures as referred to in paragraphs 1 and 2. '

4. section 33, paragraph 1 is replaced by the following: ' the Minister for the environment creates game reserves on land, in fresh waters and on fishing territory in order to protect and promote the country's wildlife resources and safe roosting and feeding areas for migratory birds. '

5. section 37 shall be replaced by the following: ' section 37. The Minister may lay down rules to regulate the game. If there is no satisfactory alternatives to regulation, regulation can be carried out in order to





1) counter danger to humans or human health,

2) face the risk of infection of humans or animals,

3) face the risk of air safety,

4) protect flora and fauna and

5) prevent extensive damage to houses, crops, livestock, forests, fish farming or fishing and water areas.






(2). For the species listed in annex 1 to this regulation rules in accordance with paragraph 1 shall not prevent the maintenance of the conservation status of the stocks concerned in its natural range.

(3). The Minister for the environment may by setting the rules in accordance with paragraph 1 may derogate from the rules laid down in chapters 2, 3, 4 and 7. '

6. section 46 is replaced by the following: ' § 46. The Minister may, in exceptional cases derogate from the provisions of section 4, paragraph 1, article 18, paragraphs 1 and 2, article 19, paragraph 2, article 23, paragraphs 1 and 3, § 24, § 26, section 28 and section 30, paragraph 1.

(2). The Minister may, in the absence of a satisfactory alternative, derogate from the provisions of section 8 and section 25 to





1) counter danger to humans or human health,

2) face the risk of infection of humans or animals,

3) face the risk of air safety,

4) protect flora and fauna,

5) prevent extensive damage to houses, crops, livestock, forests, fish farming or fishing and water areas,

6) permit, on strictly controlled conditions to capture, possess or use certain species of birds in small numbers,

7) promote research and teaching,

8) restore a stock, discarding or breeding species of birds and the species listed in annex 1 to the law or

9) allow the collection and storage of specimens of the species listed in annex 1 to the law, in a limited and specified quantity and under strictly controlled conditions.





(3). For the species listed in annex 1, by way of derogation under paragraph 2 must not hinder the maintenance of the conservation status of the stocks concerned in its natural range.

(4). The Minister may, for reasons other than those specified in paragraph 2, in exceptional cases derogate from section 25. '

7. In section 52 shall be inserted as paragraphs 4 and 5:

' (4). The Minister shall lay down for the purpose of implementation of the European Community directives and decisions on nature protection area rules about in which cases and under what conditions





1) derogations may be granted under section 4, paragraph 1, § 8, § 18, paragraphs 1 and 2, article 19, paragraph 2, article 23, paragraphs 1 and 3, § § 24-26, section 28 and section 30, paragraph 1, of the basic regulation. § 46,

2) creation and abandonment of game reserves may be made under section 33 and section 36 and

3) injunctions under section 38 may be indicated.





(5). The Minister of the environment shall take appropriate measures to protect, maintain or restore sufficient diversity and area of habitats for wild birds species. '

8. In section 54 (2) and (3), 2. PT. , the words ' or ' booklet.

9. the Act is added as an annex to annexes 1 and 2, shall be replaced by annexes 4 and 5 of this Act.

§ 3

The law on environmental objectives, etc. for water bodies and international nature protection areas (environmental target practice law), see. lovbekendtgørelse nr. 1756 by 22. December 2006, is amended as follows:

1. section 36, paragraph 1, shall be repealed, and replaced by: ' the Minister shall appoint the international nature protection areas on land and at sea.

(2). The Minister of the environment may make changes to the already designated international nature protection areas.

(3). Under a bilateral consultation procedure between Denmark and the Commission of the European communities with a view to the consideration of an area's designation as a regional nature protection area shall take Environment Minister interna tio appropriate steps to avoid deterioration of the priority natural habitat type or living place of the priority species as well as disturbance of the priority species, if these disorders have significant consequences for the priority Habitat or species. The Minister may determine, including to regional councils, municipal councils and Government authorities by their administration by law is required to protect the area. The measures shall apply until such time as a decision has been taken on and possibly made a designation of the area.

(4). The Minister shall decide on the measures that can protect an area which is not designated as international nature protection area, but where new information on the incidence of birds implies that the area to be designated.

(5). The Minister shall lay down rules on the protection of the areas referred to in paragraph 4. '




Paragraphs 2 and 3 become paragraph 6 and 7.



§ 4

In the law on the protection of the marine environment, see. lovbekendtgørelse nr. 47 of 7. January 2008, as amended by section 3 of Act No. 172 of 12. March 2008 and section 2 of Act No. 173 of 12. March 2008, shall be amended as follows:

1. The footnote to the title of the Act is replaced by the following: ' 1) Act contains provisions implementing Council Directive 95/21/EC of 19. June 1995 on enforcement with respect to ships calling at Community ports and sailing in the waters under the jurisdiction of the Member States, of international standards for ship safety, pollution prevention and shipboard living and working conditions (port State control), (Official Journal 1995, nr. L 157, page 1), parts of the European Parliament and Council Directive 2002/59/EC of 27. June 2002 establishing a Community vessel traffic monitoring and information system for maritime traffic in the community and repealing Council Directive 93/75/EEC (Official Journal of the European communities 2002 nr. L 208, p. 10-27), parts of Council Directive 92/43/EEC of 21 December 1988. May 1992 on the conservation of natural habitats and of wild fauna and Flora (EC habitats directive), (Official Journal 1992 nr. L 206, p. 7), as last amended by Council Directive 2006/105/EC of 20. November 2006 (Official Journal of the European Union 2006 nr. L 363, page 368), parts of Council Directive 79/409/EEC of 2. April 1979 on the conservation of wild birds (birds directive), (Official Journal 1979 No. L 103, page 1), as last amended by Council Directive 2006/105/EC of 20. November 2006 (Official Journal of the European Union 2006 nr. L 363, page 368), and European Parliament and Council Directive 2005/35/EC of 7. September 2005 on ship-source pollution and on the introduction of sanctions for infringements (the official journal of the European Union 2005 nr. L 255, p. 11). '

2. section 26 (3), 2. paragraphs, are hereby repealed.

3. In article 26, paragraph 4, the words ' without prejudice to article. (3) 2. section ' 4. Under section 45 c shall be inserted:

» § 46. The Minister of the environment shall take appropriate measures to avoid the deterioration of natural habitats and habitats of species in international nature conservation areas as well as disturbance of the species for which the areas have been designated for, if these disorders have significant implications for the objectives of the directive on the conservation of natural habitats and of wild fauna and flora. The Minister may grant injunctions or prohibitions, including set new terms and modify or revoke permissions and approvals. "

5. Under section 57 shall be inserted:

» section 57 (a). The Minister shall lay down for the purpose of meeting the European communities directives and decisions on nature protection area rules about in which cases and under what conditions





1) permissions may be granted under section 26 (1) and section 54, paragraph 1, and in accordance with regulations issued under section 30, paragraph 1-3,

2) authorisations may be granted in accordance with the regulations issued under section 33 (2) and (3), and

3) preparation of contingency plans can be made under section 35. '





§ 5

The law on raw materials, see. lovbekendtgørelse nr. 784 of 21. June 2007, shall be amended as follows:

1. In article 20, paragraph 4, the words ' community bird protection areas, EC-habitat areas, Ramsar sites and '.

2. Article 20, paragraph 5, shall be repealed.




Paragraph 6 becomes paragraph 5.



3. In section 24 shall be inserted after paragraph 2 as new paragraph: "(3). The Minister of the environment shall take measures to avoid the deterioration of natural habitats and habitats of species in international nature conservation areas as well as disturbance of the species for which the areas have been designated for, if these disorders have significant implications for the objectives of the directive on the conservation of natural habitats and of wild fauna and flora. The Minister may grant injunctions or prohibitions, including set new terms and modify or revoke permissions and approvals. "




Paragraph 3 becomes paragraph 4-5-6.



4. In article 26, paragraph 1, the words ' section 24, paragraph 3.0 ' to: ' section 24, paragraph 4 '.

5. In section 41 is inserted as paragraph 3 and 4:

' (3). The Minister for the environment lays down rules which are necessary for the use in this country by the European communities regulations relating to matters covered by this law.

(4). The Minister shall lay down for the purpose of implementation of the European communities directives and decisions on nature protection area rules about the cases in which and the conditions under which licences under section 7, paragraphs 1 and 2, and article 20, paragraph 1, may be issued, as well as rules on the content of planning under section 5 (a) of the basic regulation. § 6.«

§ 6

Of the law on planning, see. lovbekendtgørelse nr. 813 of 21. June 2007, shall be amended as follows:

1. In paragraph 3 shall be inserted after paragraph 2 as new paragraph: "(3). The Minister shall lay down for the purpose of implementation of the European communities directives and decisions on nature protection area rules about the cases in which and the conditions under which licences under section 11 (g), paragraph 4, and section 35 and derogations from the provisions of a local plan, see. section 19, may be indicated, as well as rules on the content of the planning in accordance with the law. '




Paragraphs 3 and 4 become paragraphs 4 and 5.




2. In article 17, paragraph 3, and article 27, paragraph 1, shall be replaced by ' article 3 (4) ' to: ' section 3, paragraph 5 '.

§ 7

The law on contaminated soil, see. lovbekendtgørelse nr. 282 of 22. March 2007, as amended most recently by § 10 of lov nr. 1587 by 20. December 2006, is amended as follows:

1. Under section 62 shall be inserted:

» § 62 a. Minister shall lay down for the purpose of meeting the European Community directives and decisions on nature protection area rules about the cases in which and the conditions under which permits under section 8, paragraphs 1 and 2, and waivers under section 52, paragraph 2, must be reported. '

§ 8

Of the law on forests, see. lovbekendtgørelse nr. 793 of 21. June 2007, is amended as follows:

1. In section 46 shall be inserted as paragraph 4:

' (4). The Minister shall lay down for the purpose of implementation of the European communities directives and decisions on nature protection area rules about in which cases and under what conditions





1) permissions may be granted under section 6,

2) derogations may be granted in accordance with article 8, § 9, nr. 1 and 2, section 10, no. 4, section 11, paragraph 1, and articles 26-28 and

3) approval may be granted in accordance with section 11, paragraph 3 and 4. '





§ 9

In Act No. 1572 by 20. December 2006 on the environmental approval, etc. of livestock, shall be amended as follows:

1. In section 73, paragraph 1, the words ' section 75, paragraph 2.0 ' to: ' section 75 (3) '.

2. In section 75 shall be inserted after paragraph 1 as new paragraph: "(2). The Minister shall lay down for the purpose of meeting the European communities directives and decisions on nature protection area rules about in which cases and under what conditions





1) permissions may be granted under section 10,

2) approvals may be granted under section 11, section 12 and section 16 and

3) derogations may be granted in accordance with section 9, paragraph 3, of the basic regulation. section 8 (1) (8). 3. '








Paragraph 2-4 become paragraphs 3-5.



§ 10

The law on environmental protection, see. lovbekendtgørelse nr. 1757 by 22. December 2006, as amended by section 1 of Act No. 172 of 12. March 2008 and § 1 of lov nr. 173 of 12. March 2008, is amended as follows:

1. Under section 13 shall be added:

» section 13 (a). The Minister shall lay down for the purpose of meeting the European Community directives and decisions on nature protection area rules about in which cases and under what conditions





1) permissions may be granted under section 19 (1) and (2), section 27, paragraph 2, and section 28,

2) authorisations may be granted in accordance with § 33 (1), sections 38 and 39,

3) permissions, waivers, reviews, etc. in accordance with the regulations issued pursuant to section 7, paragraph 1, article 19, paragraph 5, and article 27, paragraph 3, can be communicated to or treated,

4) establishment or extension of an environmental zone can take place under section 14 (a) and

5) planning for the disposal of waste in the municipality can happen under section 47 (2). '





§ 11

In the Act on streams, see. lovbekendtgørelse nr. 789 of 21. June 2007, is amended as follows:

1. Pursuant to section 70 shall be inserted in Chapter 12:

» section 70 (a). The Minister shall lay down for the purpose of implementation of the European Community directives and decisions on nature protection area rules about in which cases and under what conditions





1) permits or approval may be granted in accordance with §§ 17, 18, 21, 38, 47 and 48,

2) can be drawn up in accordance with the regulations of river sections 12 and 14,

3) provisions on the streams may be determined in accordance with sections 15 and 36,

4) River restoration may be adopted in accordance with articles 37 and 37 (a),

5) public pump facilities can be created under section 39 and

6) flodemål for opstemnings plant may be determined in accordance with section 49. '





§ 12

The law on ochre, see. lovbekendtgørelse nr. 786 of 21. June 2007, is amended as follows:

1. Under section 14 (a) shall be inserted before the heading ' penalty ':

» section 14 (b). The Minister shall lay down for the purpose of implementation of the European Community directives and decisions on nature protection area rules about the cases in which and the conditions under which approval according to §§ 2 and 3 may be granted. '

section 13

Of the law on water supply, etc., see. lovbekendtgørelse nr. 71 of 17. January 2007, as amended by section 2 of Act No. 172 of 12. March 2008, is amended as follows:

1. In section 2 is inserted as paragraph 2:

' (2). The Minister shall lay down for the purpose of meeting the European Community directives and decisions on nature protection area rules about in which cases and under what conditions





1) permits or waivers may be granted in accordance with §§ 18, 20, 21, 25-27 and 69 (2),

2) injunctive relief may be granted under section 36,

3) response plans administered pursuant to section 13 and

4) rules on the interior design, location and maintenance of the water reclamation plant, about utility and water installations shall be compiled according to § 56. '





§ 14

In the law on the protection of the outer Cook for tøndermarsken, see. lovbekendtgørelse nr. 792 of 21. June 2007, is amended as follows:

1. Pursuant to section 49 (a) shall be inserted in Chapter 10:

» § 49 (b). The Minister shall lay down for the purpose of implementation of the European Community directives and decisions on nature protection area rules about the cases in which and the conditions under which derogations may be granted under section 38 (1) and (2). '

§ 15

In the law on the environment and genetic engineering, see. lovbekendtgørelse nr. 811 of 21. June 2007, is amended as follows:

1. Under section 27 shall be inserted:

» § 28. The Minister shall lay down for the purpose of implementation of the European Community directives and decisions on nature protection area rules about the cases in which and the conditions under which the authorisations may be granted in accordance with article 9. ';

§ 16

The law shall enter into force on the 1. July 2008.

§ 17

(1). The law does not apply to the Faroe Islands and Greenland.

(2). section 4 may, by Royal Decree put into force for Greenland of the variances, as the special Greenlandic conditions warrant.
