Law on the amendment of law on nature protection, law on hunting and game management and different laws 1)

(Implementation of Directives on the Protection of Nature)

We, by God's grace, the Queen of the Danes, do our thing.

The parliament has adopted the following law, and we know that the following law has been approved by Parliament's consent :

§ 1

In the law of nature conservation, cf. Law Order no. 749 of 21. June 2007 shall be amended as follows :

1. Foot notation the title shall be replaced by the following :

" 1) The law provides for the implementation of parts of Council Directive 79 /409/EEC of 2. April 1979 on the protection of wild birds (the European Bird Protection Directive) (EC Official Journal of 1979). L 103, page 1), as last amended by Council Directive 2006 /105/EC of 20. November 2006 (EU Official Journal, 2006 # In 363, page 368), and Council Directive 92 /43/EEC of 21. May 1992 on the conservation of natural habitats and wild fauna and flora (EC Habitats Directive) (EC Official Journal of 1992. In 206, page 7, as last amended by Council Directive 2006 /105/EC of 20. November 2006 (EU Official Journal, 2006 # L-363, page 368). "

2. I ~ 30 (5)) 1, the words ' may fix ' shall : ` shall mean the fixing '.

3. I § 30 inserted after paragraph 1. 1 as new slices :

" Stop. 2 The Environment Minister shall implement the conservation measures necessary to ensure that it does not result in a significant negative impact on the conservation status of the species listed in Annex 3 to the law when the inadvertenment or the death of the inadvertents. The warning measures shall be carried out on the basis of monitoring or further investigations.

Paragraph 3. The Environment Minister shall implement the measures necessary to ensure that the collection of the wild animal and plant species referred to in Annex 4 to the law and the use are compatible with the need to retain these provisions ; species.

Paragraph 4. The Environment Minister shall lay down rules in order to implement measures as referred to in paragraph 1. Two and three. "

paragraphs 2 and 3 shall then be set out in paragraph 1. Five and six.

4. Section 31 (1). 2 and 3, is hereby repealed and the following shall be inserted :

" Stop. 2 The Environment Minister is examining the suitability of reintroducing the animal and plant species listed in Annex 3 to the law, and which are naturally indigenous when this could contribute to their conservation.

Paragraph 3. The Committee on the Environment, Public Health and Consumer Policy, in order to safeguard the environment, rules on the deliberate release of certain animals that do not naturally exist in Denmark.

Paragraph 4. The Committee on the Environment, Public Health and Consumer Policy stipulates that certain plants which do not naturally have a natural wilderness in Denmark may only be planted or planted with special permission. ` ;

5. § 50, paragraph. TWO, TWO. pkt., revoked.

6. I § 50 inserted after paragraph 1. 2 as new slices :

" Stop. 3 . The Board of Peace may only grant a derogation from a freer or proposed freination if it is not available for the application ;

1) damaged or roasting areas of the natural range of animal species referred to in Annex 3 to the law, or

2) destroy the plant species listed in Annex 5 to the Law, in all stages of life.

Paragraph 4. Although the conditions laid down in paragraph 1 are 3 is not fulfilled, if there is no satisfactory alternative, grant the grant board, if no satisfactory alternative is available. The suspension must not prevent the preservation of the conservation status of the affected conservation status in its natural range and must be intended to :

1) protect wild animals and plants and preserve the natural habitat ;

2) prevent serious damage, in particular on crops, crew, forests, fisheries, water and other types of property ;

3) ensure public health and safety or other essential considerations of social interest, including social and economic terms, and considerations of significant beneficial effects on the environment ;

4) promoting research and training,

5) restore a stock, reposting or rearing species, including artificially propagated plants ; or

6) permit the collection or storage of specimens of species referred to in Annex 3 to the law in a limited and specified number and under strictly controlled conditions.

Paragraph 5. The decisions shall be made in accordance with paragraph 1. Paragraph 1 that the conditions set out in paragraph 1 2-4 is met. "

Paragraph 3 becomes paragraph 3. 6.

7. § 55 a is hereby repealed and the following shall be inserted :

" § 55 a. The Committee of the Regions can give temporary subsidies to projects which contribute to achieving vision and objectives of the regional development plan within the law. '

8. After section 56, pasted before heading ' Prospective purchasers ' means :

" § 56 a. Billing claims relating to grants financed by both national and EU funds shall be subject to the limitation of their entirety according to the rules laid down in the applicable regulations. ` ;

9. I § 71 pasted as paragraph 4-6 :

" Stop. 4. The Environment Minister shall lay down for the implementation of the Directives and decisions of the European Community in the field of nature protection rules on the notification of injunction and prohibitions after Article 11 (1). 1.

Paragraph 5. The Environment Minister shall lay down for the purpose of implementing the Directives and decisions of the European Community in the field of nature protection, in which case and under what conditions,

1) approvals may be granted in accordance with section 8 (3). 5, no. 7, section 15, paragraph 1. 4, no. 7, and 20,

2) decoding may be deleted in accordance with section 9 (3). 3,

3) authorisations may be granted in accordance with section 29, section 31 (1). 1, and section 32,

4) derogations may be granted in accordance with section 3 (3). One-three, and paragraph 8, paragraph 8. 1, cf. § 65

5) derogations may be granted from rules issued in accordance with section 51 (1). 1 or from rules which continue to be in force pursuant to Article 101 (1). 1,

6) the construction or protection lines may be repealed in whole or in part by section 15 to 19, cf. ~ 69, paragraph. 1, and

7) decisions may be taken in accordance with the rules laid down in Article 8 (3). 6 and 7, section 15. Paragraph 1, section 16, paragraph 1. Paragraph 17, paragraph 17. Paragraph 18 (1) and section 18 (1). 1, cf. § 65.

Paragraph 6. The Environment Minister takes appropriate measures to protect, maintain or restore sufficient diversity and extensive habitats of wild birds of birds. ` ;

10. I § 73, paragraph 1. 2, the words ' and section 15 on the seashore safeguard line ` shall be replaced by : `, section 15 on the beach protection line and the rules in caps. 5 for the protection of plant and animal species etc. ` ;

11. As supporting documents, the following : Annex 3-5 the text of Annex 1-3 to this Act.

§ 2

In the law of hunting and feral management, cf. Law Order no. 747 of 21. June 2007 shall be amended as follows :

1. Foot notation the title shall be replaced by the following :

" 1) The law provides for the implementation of parts of Council Directive 79 /409/EEC of 2. April 1979 on the protection of wild birds (the European Bird Protection Directive) (EC Official Journal of 1979). L 103, page 1), as last amended by Council Directive 2006 /105/EC of 20. November 2006 (EU Official Journal, 2006 # In 363, page 368), and Council Directive 92 /43/EEC of 21. May 1992 on the conservation of natural habitats and wild fauna and flora (EC Habitats Directive) (EC Official Journal of 1992. In 206, page 7, as last amended by Council Directive 2006 /105/EC of 20. November 2006 (EU Official Journal, 2006 # L-363, page 368). "

2. I Section 3, paragraph 3. 2, the following new numbers are added :

" 1) Hunting of birds must not be in breach of the safeguard measures taken in their range of activities.

2) Hunting for birds must take account of sensible exploitation and be environmentally balanced.

3) There must be no hunting of birds in breeding time and birds in a row for the nesting of the nesting site. `

No 1-3 becomes the second paragraph. 4-6.

3. The following section 9 is inserted :

" § 9 a. The Environment Minister shall implement the conservation measures necessary to ensure that it does not result in a significant negative impact on the conservation status of the mammals referred to in Annex 1 to the law when the inadvertenants or fights are inadvertented ; . The warning measures shall be carried out on the basis of monitoring or further investigations.

Paragraph 2. The Environment Minister shall implement the measures necessary to ensure that the collection in the natural environment of the mammals referred to in Annex 2 to the law, and the use thereof, shall be compatible with the purpose of preserving these species.

Paragraph 3. The Environment Minister shall lay down rules in order to implement measures as referred to in paragraph 1. One and two. "

4. Section 33 (4). 1, ITREAS :

" The Environment Minister creates feral reserves on the ground, in fresh waters and on the fishing ritorium to protect and help country ' s feral stocks and ensure raste and food storage areas for tractive birds. ` ;

5. § 37 ITREAS :

" § 37. The Environment Minister may lay down rules on the regulation of wild game. If there are no satisfactory alternatives to the regulation, regulation can be done to ensure that :

1) respond to the danger of human or human health ;

2) the risk of contamination of humans or animals,

3) in response to the risk of air safety,

4) protect flora and fauna ; and

5) prevent extensive damage to the construction, crops, livestock, forests, fish farming or fishing and water areas.

Paragraph 2. For the species listed in Annex 1, rules must be laid down in accordance with paragraph 1. 1 shall not prevent the preservation of the conservation status of the relevant conservation status in its natural range.

Paragraph 3. The Environment Minister may lay down rules pursuant to paragraph 1. 1 derogate from the rules laid down in Chapters 2, 3, 4 and 7. ` ;

6. § 46 ITREAS :

" § 46. The Environment Minister may, in exceptional cases, make exception in section 4 (4). Paragraph 18, paragraph 18. 1 and 2, section 19 (4). 2, section 23, paragraph. Paragraph 1 and 3, section 24, section 26, section 28, and section 30 (3). 1.

Paragraph 2. The Environment Minister may, if there is no satisfactory alternative, make exception from the provisions of sections 8 and § 25 to :

1) respond to the danger of human or human health ;

2) the risk of contamination of humans or animals,

3) in response to the risk of air safety,

4) protect flora and fauna,

5) prevent extensive damage to building, crops, livestock, forests, fish farming or fishing and water areas ;

6) permit, on strictly controlled conditions, that inmate, possess or use certain species of birds in smaller quantities,

7) promoting research and training,

8) restore a stock, repostponds or farmed species of birds and the species listed in Annex 1 to the Act ; or

9) permit the collection or storage of specimens of the species listed in Annex 1 to the Act, in a limited and specified number and under strictly controlled conditions.

Paragraph 3. In the case of the species listed in Annex 1, the derogation must be deviated from the provisions of paragraph 1. 2 shall not prevent the preservation of the conservation status of the relevant conservation status in its natural range of products.

Paragraph 4. The Environment Minister may, for reasons other than those mentioned in paragraph 1. Two, in exceptional cases, make the exception of § 25. `

7. I § 52 pasted as paragraph 4 and 5 :

" Stop. 4. The Environment Minister shall lay down for the purpose of implementing the Directives and decisions of the European Community in the field of nature protection, in which case and under what conditions,

1) derogations may be granted in accordance with Article 4 (1). One, section 8, section 18, section. 1 and 2, section 19 (4). 2, section 23, paragraph. 1 and 3, sections 24 to 26, section 28 and section 30 (3). 1, cf. § 46,

2) the establishment and decommissioning of wild game reserves may take place after section 33 and section 36 and

3) opening after section 38 may be communicated.

Paragraph 5. The Environment Minister takes appropriate measures to protect, maintain or restore sufficient diversity and extensive habitats of wild birds of birds. ` ;

8. I Section 54 (1). 2 and paragraph THREE, TWO. pkt . , shall be deleted or ' booklet or '.

9. As supporting documents, the following : Annex 1 and 2, the text of Annex 4 and 5 to this Act.

§ 3

In the case of environmental targets and so on for water bodies and international natural protection areas (the environmental target sloven), cf. Law Order no. 1756 of 22. In December 2006, the following changes are made :

1. § 36, paragraph. 1, is hereby repealed and the following shall be inserted :

" The Environment Minister designates international nature protection areas on land and on the sea.

Paragraph 2. The Environment Minister may make changes to already designated international nature protection areas.

Paragraph 3. During a bilateral consultation procedure between Denmark and the Commission of the European Communities, in order to consider the designation of an international nature protection area, the Environment Minister shall take appropriate measures in order to : avoid the deterioration of the priority type of natural habitat or the habitat of the priority species and disorders of the priority species if these disturbances have significant consequences for the priority natural type or nature. The Minister may, in particular, provide that the regional councils, the municipality boards and the governmental authorities in their administration of the law are obliged to protect the area. The measures shall be valid until a decision has been taken and, where appropriate, a designation of the area.

Paragraph 4. The Environment Minister takes a decision on measures to protect an area that is not designated as an international nature protection area, but where new information on the presence of birds means that the area should be designated.

Paragraph 5. The Minister shall lay down rules on the protection of the provisions of paragraph 1. 4 mentioned areas. "

paragraphs 2 and 3 shall then be set out in paragraph 1. Six and seven.

§ 4

In the law on the protection of the marine environment, cf. Law Order no. 47 of 7. of January 2008, as amended by Section 3 of Act 3. 172 by 12. March 2008 and section 2 of the Law No 173 by 12. March 2008, the following changes are made :

1. Foot notation the title shall be replaced by the following :

" 1) The law contains provisions implementing Council Directive 95 /21/EC of 19. June 1995 on the enforcement of ships entering Community ports and sailing in waters under the jurisdiction of the Member States, of international standards for the safety of ships, for pollution prevention and for living and working conditions on board ; (port State control), (Official Journal of the Official Journal of the European Communities) In 157, page 1), parts of Directive 2002 /59/EC of the European Parliament and of the Council of 27. June 2002 establishing a Community vessel traffic monitoring and information system for shipping in the Community and repealing Council Directive 93 /75/EEC (EC Official Journal 2002). In 208, page 10-27), parts of Council Directive 92 /43/EEC of 21. May 1992 on the conservation of natural habitats and wild fauna and flora (EC Habitats Directive), (EC Official Journal of 1992). In 206, page 7, as last amended by Council Directive 2006 /105/EC of 20. November 2006, (EU-Official Journal of the European Journal. In the case of Directive 2005 /35/EC of the European Parliament and of the Council of 7, L 363, page 368), September 2005 on pollution from ships and on the introduction of sanctions for infringements, (EU Official Journal, 2005 # L 255, page 11). "

2. Section 26 (1). THREE, TWO. pkt., revoked.

3. I Section 26 (1). 4, the words ', cf. paragraph THREE, TWO. Pct. "

4. Insert after section 45 c :

" § 46. The Environment Minister shall take appropriate measures to prevent the deterioration of natural habitats and habitats of species in international protection of nature and the disturbance of the species designated for which such disturbances are to be affected ; significant consequences for the objectives of the Directive on the conservation of natural habitats and wild fauna and flora. The Minister may, in particular, notify injunction or prohibitions, establish new terms and conditions, and amend or withdraw authorizations and approvals. `

5. The following section 57 is inserted :

" § 57 a. The Minister for the Environment, Public Health and Consumer Policy, shall lay down rules and decisions in the field of nature protection in respect of the rules of the European Communities, in which case and on what conditions,

1) authorisations may be granted under Section 26 (3). 1, and Section 54 (1). 1, and in accordance with the rules laid down in Article 30 (1). 1-3,

2) authorisations may be granted in accordance with the rules laid down in Article 33 (1). 2 and 3, and

3) preparation of contingency plans may occur after section 35. ' ;

§ 5

In the law of raw materials, cf. Law Order no. 784 of 21. June 2007 shall be amended as follows :

1. I Section 20 (2). 4, are deleted ' Community bird protection areas, Community habitats, RamsarAreas and '.

2. Section 20 (2). 5, revoked.

Paragraph 6 becomes paragraph 6. 5.

3. I § 24 inserted after paragraph 1. 2 as new paragraph :

" Stop. 3. The Environment Minister shall take measures to prevent the deterioration of natural habitats and habitats of species in international protection of nature and the disturbance of the species designated for which such disturbances are significant ; consequences for the objectives of the Directive on the conservation of natural habitats and wild fauna and flora. The Minister may, in particular, notify injunction or prohibitions, establish new terms and conditions, and amend or withdraw authorizations and approvals. `

Paragraph 3-5 shall then be referred to in paragraph 3. 4-6.

4. I Section 26 (1). 1, change ' section 24 (2) ; 3, ' to : section 24 (4). FOUR, "

5. I § 41 pasted as paragraph 3 and FOUR :

" Stop. 3. The Environment Minister shall lay down rules necessary for the application in this country by the regulations of the European Communities relating to matters covered by this law.

Paragraph 4. The Environment Minister shall lay down for the implementation of the Directives and decisions of the European Communities in the field of protection of nature, in which case and under which conditions permit, in section 7 (3). One and two, and section 20 (2). 1 may be communicated, as well as rules on the content of planning in accordance with section 5 a, cf. § 6. "

§ 6

In the law on planning, cf. Law Order no. 813 of 21. June 2007 shall be amended as follows :

1. I § 3 inserted after paragraph 1. 2 as new paragraph :

" Stop. 3. The Environment Minister shall lay down for the implementation of the Directives and decisions of the European Communities in the field of protection of nature, in which case and under what conditions, in accordance with section 11 g (s), 4, and section 35 and derogations from provisions of a local level, cf. section 19 may be communicated, as well as rules relating to the content of planning under the law. `

paragraphs 3 and 4 are then referred to in paragraph 1. 4 and 5.

2. I § 17, paragraph 1. 3, and § 27, paragraph. 1, in section 3, paragraph 1 shall be amended. 4 " to : section 3, paragraph 3. FIVE. "

§ 7

In the law of polluted soil, cf. Law Order no. 282 of 22. In March 2007, as last amended by Section 10 of Law No 1587 of 20. In December 2006, the following changes are made :

1. After paragraph 62 is inserted :

" § 62 a. The Committee on the Environment, Public Health and Consumer Policy, lays down in order to comply with the directives and decisions of the European Community in the field of nature protection, in which case and under what conditions, as referred to in Article 8 (3). 1 and 2, and derogations in accordance with section 52 (3). 2, notified. "

§ 8

In the law of forests, cf. Law Order no. 793 of 21. June 2007 shall be amended as follows :

1. I § 46 pasted as paragraph FOUR :

" Stop. 4. The Environment Minister shall lay down for the implementation of the Directives and decisions of the European Communities in the field of nature protection, in which case and under which conditions

1) permissions may be granted in accordance with section 6,

2) derogations may be granted under the law of the section 8, section 9, no. 1 and 2, section 10, nr. 4, section 11, paragraph 1. 1, section 26-28, and

3) authorisations may be granted in accordance with section 11 (3). 3 and 4. "

§ 9

Law no. 1572 of 20. In December 2006, on the environmental approval etc. of livestock farms, the following changes are made :

1. I § 73, paragraph 1. 1, is replaced by ' § 75, paragraph 1. Two, to : " § 75, paragraph. 3, ".

2. I § 75 inserted after paragraph 1. 1 as new paragraph :

" Stop. 2. The Minister for the Environment, Public Health and Consumer Policy, shall lay down rules and decisions in the field of nature protection in respect of the rules of the European Communities, in which case and on what conditions,

1) permissions may be granted in accordance with section 10,

2) approvals may be granted in accordance with section 11, sections 12 and § 16 ; and

3) derogations may be granted in accordance with section 9 (4). 3, cf. § 8 (3) 1, no. 3. "

Paragraph 2-4 is then being referred to in paragraph 1. 3-5.

§ 10

In the law of environmental protection, cf. Law Order no. 1757 of 22. In December 2006, as amended by Section 1 of law no. 172 by 12. March 2008 and Section 1 of the Law No 173 by 12. In March 2008, the following changes are made :

1. The following paragraph 13 is inserted :

" § 13 a. The Committee on the Environment, Public Health and Consumer Policy, shall lay down, in respect of the Directives and decisions of the European Community in the field of nature protection, rules on the circumstances and conditions under which conditions

1) authorisations may be granted in accordance with section 19 (1) 1 and 2, section 27 (4). 2, and § 28,

2) authorisations may be granted in accordance with section 33 (3). 1, sections 38 and 39 ;

3) authorisations, derogations, notifications, etc. in accordance with the rules laid down in Article 7 (1). Paragraph 1, section 19, paragraph 1. 5, and section 27 (2). 3, may be communicated or processed ;

4) the establishment or extension of an environmental zone may take place in accordance with section 14 a and

5) planning of the disposal of waste in the municipality may take place in accordance with section 47 (s). TWO. "

§ 11

In the rule of water, cf. Law Order no. 789 of 21. June 2007 shall be amended as follows :

1. After section 70 is inserted in Chapter 12 :

" § 70 a. The Environment Minister shall lay down for the purpose of implementing the Directives and decisions of the European Community in the field of nature protection, in which case and under what conditions,

1) permits or approvals may be granted in accordance with section 17, 18, 21, 38, 47 and 48,

2) waterflow regulations can be drawn up in accordance with sections 12 and 14 ;

3) provisions on water flows may be laid down in sections 15 and 36,

4) water-flow restoration can be adopted in accordance with section 37 and 37 a,

5) public pumpeworks can be created after paragraph 39 and

6) ' (a) river storage facilities may be laid down in section 49 ' ;

§ 12

In the Act of Owns, cf. Law Order no. 786 of 21. June 2007 shall be amended as follows :

1. After section 14 a is inserted before heading "Straf."

" § 14 b. For the purpose of implementing the European Community Directives and decisions on the protection of nature, the Minister for the Environment, Public Health and Consumer Policy shall lay down rules on the application of the provisions of the European Community, in which cases, and under which terms and conditions are granted under sections 2 and 3

§ 13

In accordance with the law on water supply, etc., cf. Law Order no. 71 of 17. January 2007, as amended by Section 2 of Law No 172 by 12. In March 2008, the following changes are made :

1. I § 2 pasted as paragraph 2 :

" Stop. 2. The Committee on the Environment, Public Health and Consumer Policy, shall lay down, in respect of the Directives and decisions of the European Community in the field of nature protection, rules on the circumstances and conditions under which conditions

1) authorisations or derogations may be granted in accordance with sections 18, 20, 21, 25-27 and 69 (4). 2,

2) may be granted in accordance with section 36,

3) the intervention plans shall be administered in accordance with section 13 and

4) rules concerning the establishment, location and maintenance of irrigation systems, the supply facilities and on water plants are drawn up after section 56. ` ;

§ 14

In the case of the protection of the outer boils of the Tøndermarsh, cf. Law Order no. 792 of 21. June 2007 shall be amended as follows :

1. After paragraph 49 a is inserted in Chapter 10 :

" § 49 b. The Environment Minister shall lay down for the implementation of the Directives and decisions of the European Community in the field of nature protection, in which cases and under which conditions may be granted derogations in accordance with section 38 (4). One and two. "

§ 15

In the area of the environment and gene technology, cf. Law Order no. 811 of 21. June 2007 shall be amended as follows :

1. The following section 27 is inserted :

" § 28. The Minister for the Environment, Public Health and Consumer Policy shall lay down rules on the application of the Directives and decisions of the European Community in the field of nature protection, in which cases and under which conditions may be granted approvals after paragraph 9. `

§ 16

The law shall enter into force on 1. July 2008.

§ 17

Paragraph 1. The law does not apply to the Faroe Islands and Greenland.

Paragraph 2. Article 4 may, by means of a king, power in the case of Greenland, with the deviations from which the special Greenland conditions are attributed.
