Under section 1, paragraph 2, paragraph 1 (a), paragraph 2, § 2 and § 3, paragraph 1, of the lov nr. 1214 of 27. December 2003 on distribution grants for certain periodic magazines and periodicals as amended by law No. 271 of 31. March 2006 amending the Act on distribution grants for certain periodic magazines and periodicals shall be fixed:

Chapter 1

Periodic magazines and periodicals

Criteria for grants

§ 1. Be granted to distribution in Denmark and from Denmark to the Faroe Islands and Greenland to publishers of periodic magazines and periodicals, provided that the publication is published by at least two numbers per calendar year and mainly consists of information on:





1) non-profit or general interest-shattering topics, mainly general information on society and the environment, social conditions, health and illness.

2) Humanitarian organisations.

3) teaching and school relationships, including individual subjects.

4) Sport, mainly information about sports and voluntary associations associated with it.

5) Art and culture, primarily information about Visual art, literature, music, film and theatre, as well as the dissemination of culture and conservation.

6) Environment, preferably information about nature conservation and improvement, alternative energy, environmental protection and straightening.

7) religious topics, IE. magazines published by religious communities, an Association of religious communities or an organization that is created by one or more religious communities or circle of trossamfunds members. By a religious community shall mean an organization/Association, recognized or approved as religious communities, in accordance with Ministry practice.





(2). Notwithstanding the provisions of paragraph 1 shall not be granted subsidies to the Publisher of a publication that falls within one of the following categories:





1) governmental/regional/municipal information, IE. publications published by the State, regional or local authorities, agencies and institutions or in connection with the work performed in or by such institutions. These institutions are enclosed in this context so that it relates to institutions that are part of the public administration, as actual state, regional or municipal institutions, or institutions which can equivalent, such as private institutions, associations, etc., if continuous operation exclusively financed by public funds.

2) Weeklies and magazines, IE. publications of any kind, published by the professional Publisher/publishers with a commercial purpose. Also be eligible magazines published for the purpose of marketing or branding of the companies, products or services, except in the case of magazines that are distributed to the holders of season passes, and similar to the cultural institutions and similar medlemskort Association

3) professional publications, IE. publications published for the purpose of a specific business profession, practitioners of a particular profession or to inform about a profession, as well as publications that target a particular interest group, that have a significant common interest of economic character, such as community associations and tenant associations.

4) Trade Union publications, IE. publications published by trade unions and professional associations, which have a significant common interest of economic character.

5) Hobby publications, IE. publications published by associations, organisations, etc., in order to introduce or inform about the hobby characterized the activities, apart from the actual sport.

6) Scientific publications, i.e. publications published by public and private research institutions to introduce or provide information about their research.

7) Political publications, IE. publications published by political parties, associations and unions, including their local associations.





(3). section 1, paragraph 2, no. 3 and 4, shall not apply to publications that are published for the purpose of purely technical information within a given profession without having to deal with issues of cooperation or economic nature.

Distribution

§ 2. It is a condition for a publisher of a publication may receive grants in a given fiscal year, the Publisher shall give for the allocation and payment of the necessary information on an application form, which is available in Danish Agency for libraries and media. It is furthermore a condition that the form is received in the Agency in a yearly period.

(2). The accuracy of the information on the application form shall be confirmed by the signature of the Publisher. It is the responsibility of the applicants, immediately to inform the Danish Agency for libraries and media changes.

(3). Applicants and recipients of grants must also provide the information that the Danish Agency for libraries and media requesting with regard to the processing of applications for reimbursement and administration of the rules of this order.

(4). An allocation Committee shall decide on the basis of the information provided, whether a publisher of a publication is eligible for reimbursement in accordance with the provisions of § 1. The Committee has the final administrative decision.

(5). The allocation Committee appointed for 4 years at a time by the Minister of culture and has three members:





1) A President, who must have the legal knowledge and insight in information activities,

2) one Member who shall be granted access to the categorization of serials and

3) one Member who shall be granted access to the publication company.





(6). In paragraph 5, no. referred Member are appointed upon the recommendation of the Royal Library. In paragraph 5, no. referred member appointed on the recommendation of the Danish professional publications.

(7). Danish Agency for libraries and Media provides secretarial support to the Committee.

Calculation and payment

§ 3. The administration of the grant scheme is carried out by the Danish Agency for libraries and Media.

§ 4. The financial contribution shall be granted for one calendar year.

§ 5. The grant is calculated according to a point system on the basis of the application form information about a publication page number and the number of distributed copies per year.

(2). The individual publications are assigned points as follows:





1) Publications with 32 pages or less is assigned 2 points per copy distributed.

2) Publications with more than 32 pages is assigned 3 points per copy distributed.

3) within both categories are assigned distributed copies in addition to 100,000 pieces per year only 1 point.





(3). The aggregate score is put in relation to this year's appropriation of the budget bill. Danish Agency for libraries and Media then calculates the amount that year must be paid per point. The Publisher will receive grants equal to the number of points assigned to his or her publication, see. However, § 5, paragraph 6.

(4). For publications that are distributed in less than 3,000 copies per issued number, distributed over the period 2005-2011 besides the in section 5, paragraphs 1 to 4 described distribution, a special subsidy of 5 million. KR. (2005-level) annually. The special allowances shall be allocated in accordance with the applicable criteria, see. § 1. The special allowances are calculated the same way as the ordinary grants the meaning. section 5, paragraphs 1 to 3, and be established by payment to the person concerned leaves on top of their share of the ordinary supplements.

(5). The grant is calculated only in proportion to the part of the warehouse, which in printed form distributed in subscription, see. § 8, paragraph 4, or to paying members of associations or persons treated as such.

(6). The grant is calculated only in proportion to the part of the warehouse, which is distributed by shipping and can not exceed the actual costs incurred for that purpose.

(7). In the total cost of the distribution can be included documentable direct and indirect costs for the distribution of copies, which are covered by the grant scheme.

§ 6. Payment of grants be made comprehensive when the allocation Committee has completed the review of this year's applications, and points calculation is carried out.

(2). If changes in the individual publications evidence indicates, or Publisher does not carry out the intended activity, must grant already paid will be refunded in whole or in part, if it paid out grants in excess of 500 USD in relation to the contribution which the documented activity warrants.

(3). The annual grants must, in accordance with article 3. § 5, paragraph 6, shall not exceed the actual costs incurred for distribution. If it is of the submitted documentation, see. section 7, States that the grant for the preceding year exceed the actual costs incurred by more than 500 DKK, repaid the overpayments made or deducted in the following year's grants.

Documentation

§ 7. The Publisher shall, before December 31. may the following year the grant year submit documentation for the number of distributed copies, including copies distributed from Denmark to the Faroe Islands and Greenland, and page numbers of the eligible publication as well as information on the total costs incurred for the distribution of the publication.

(2). In cases where the Publisher is unable to substantiate the number of distributed copies, or the costs associated with the distribution of the publication, the subsidy required wholly or partially repaid.


(3). Detailed rules concerning documentation, including requirements for revision shall be determined by the Danish Agency for libraries and Media.

Chapter 2

Newspaper-like publications

Criteria for grants

§ 8. Be granted to distribution in Denmark and from Denmark to the Faroe Islands and Greenland to the publishers of certain commercially-released publications, whose content matches the actual newspapers, but have a lower frequency than such release.

(2). In order to obtain the grant provided for in paragraph 1 shall:





1) Publication the livelihood of between one and four times a week for at least 36 weeks per year or at least 2 times a month for at least 10 months per year.

2) publication, turn to a wide circle of readers and must not be directed towards particular professional or occupational groups, members of the individual political parties or associations.

3) Publication be nationwide in the sense that the magazine for at least 6 of 11 leaf circles, see. Danish Warehouse Control Division of the country into geographical regions, has a penetration – IE. issue in relation to the number of households-of at least 0.1 percent.

4) at least half of the publication's content be editorial (d.v.s. not ads) in the form of articles, etc. within a broad topic area and with treatment of currently newsworthy, and so that at least half of the editorial substance must deal with political, social and cultural themes. At least a third of the editorial substance must be independent journalistic worked for publication in that publication.





(3). The grant is calculated only in proportion to the part of the warehouse, which in printed form is distributed in the subscription.

(4). A subscription is included in the grant scheme, if there is an agreement between a manufacturer and an end user, whether the end user gets delivered the copy for his home address. An agreement on that Publisher provides a copy to a recipient with a view to their subsequent allocation to end user e.g. resale, are not covered by the grant scheme. The agreement shall be free to be terminated by the Subscriber, and a subscription must therefore not be compulsory attached to other relationships – e.g. Association membership or employment relationship – between Publisher and Subscriber. It is a condition for a subscription conditions is covered by the grant scheme, to actively renew his subscription to the Subscriber at least once a year, e.g., by payment. In the case of free newspapers, which are covered by the reimbursement scheme shall be made in writing confirmation.

(5). If a subscription is drawn by a Subscriber on behalf of another person as the end user, included a copy of the subscription included in the grant scheme when the following conditions are met:





1) Publisher shall forward the copy to the end user

2) end user independently decides on subscription maintenance, and

3) end user at least once annually confirms this in the face of the one who has taken out the subscription, or Publisher.





(6). If the copies of a publication household delivered anywhere, regardless of whether there is an agreement between the manufacturer and the end user, are not subject to the publication of the grant scheme.

(7). Paragraph 6 shall not apply in cases where copies will be distributed as part of household time-limited promotions, regardless of whether there is an agreement between Publisher and end-user.

(8). Assessment of a publication's content as an overall assessment must be carried out on the basis of a number of tracks per year. The assessment shall be carried out in the context of application and if applicable. during the grant year.

Distribution

§ 9. It is a condition for a publisher of a publication may receive grants in a given fiscal year, the Publisher shall give for the allocation and payment of the necessary information on an application form, which is available in Danish Agency for libraries and media. It is furthermore a condition that the form is received in the Agency in a yearly period.

(2). The accuracy of the information on the application form shall be confirmed by the signature of the Publisher. It is the responsibility of the applicants, immediately to inform the Danish Agency for libraries and media changes. If the grant requested paid to someone other than the Publisher, this must indicate this to the Danish Agency for libraries and Media.

(3). Applicants and recipients of grants must also provide the information that the Danish Agency for libraries and media requesting with regard to the processing of applications for reimbursement and administration of the rules of this order.

(4). An allocation Committee shall decide on the basis of the information provided, whether a publisher of a publication is eligible for reimbursement in accordance with the provisions of section 8. The Committee has the final administrative decision.

(5). The allocation Committee appointed for 4 years at a time by the Minister of culture and consists of the Chairman of the distribution Committee and the Member of it in article 2, paragraph 4, the Committee referred, who is appointed on the recommendation of the Danish professional publications, of two additional members with a special insight into the newspaper business, as are appointed on the recommendation of the Danish journalists ' Association on the one hand and, on the other hand, Ddf.

(6). Danish Agency for libraries and Media provide assist discussions atsbistand to the Committee.

Calculation and payment

§ 10. The administration of the grant scheme is carried out by the Danish Agency for libraries and Media.

§ 11. The financial contribution shall be granted for one calendar year.

§ 12. The grant is calculated according to a point system on the basis of the application form information on the number of distributed copies per year.

(2). The individual publications are assigned 1 point per copy distributed.

(3). The aggregate score is put in relation to this year's appropriation of the budget bill. Danish Agency for libraries and Media then calculates the amount that year must be paid per point. The Publisher will receive grants equal to the number of points assigned to his or her publication, see. However, section 13, paragraph 3.

§ 13. Payment of grants be made comprehensive when the allocation Committee has completed the review of this year's applications, and points calculation is carried out.

(2). If changes in the individual publications evidence indicates, or Publisher does not carry out the intended activity, must grant already paid will be refunded in whole or in part, if it paid out grants in excess of 500 USD in relation to the contribution which the documented activity warrants.

(3). The annual contribution to a publication may not exceed 50% of the costs actually incurred for distribution. If it is of the submitted documentation, see. section 14, paragraph 1, States that the grant for the prior year exceeds the prescribed limit with more than 500 DKK, repaid the overpayments made or deducted in the following year's grants.

(4). In the total cost of the distribution can be included documentable direct and indirect costs for the distribution of copies, which are covered by the grant scheme.

§ 14. The Publisher shall, before December 31. may the following year the grant year submit a demonstration of the number of subscribers and copies distributed in Denmark, incl. copies distributed from Denmark to Faroe Islands and Greenland, as well as documentation for the total cost of this distribution. Documentation must be signed by the Publisher's auditor.

(2). In cases where the Publisher is unable to substantiate the number of distributed copies, or the expenses that have been associated with distribution, the financial contribution will be required fully or partially repaid.

(3). Detailed rules for documentation shall be determined by the Danish Agency for libraries and Media.

Chapter 3

Date of entry into force of

§ 15. The notice shall enter into force on the 1. July 2008.

(2). Executive Order No. 1509 by 14. December 2006 on distribution grants for certain periodic magazines and periodicals and newspaper-like publications are hereby repealed so that it continues to apply to applications received in the period between the 1. January 2007 and 1 January 2008. July 2008.
