Publication of the delegation of the Environment Minister's powers in law on polluted soil to the Environmental Management Board and the Environmental Ministry's environmental centres

In accordance with section 59 (5), 1 and 2, in the law of polluted soil, cf. Law Order no. 282 of 22. March 2007 shall be determined :

Chapter 1

Delegated powers to the Environmental Management Board

§ 1. The following powers of the law on the polluted land are delegated from the Environment Minister to the Environmental Management Board :

1) Develation of road cords in the territory of the law.

2) Development and testing of new technology in the field of soil contamination and in the context of the expenditure and provision of grants to projects relating to remediation measures, development projects, criteria of assessment, risk assessment, information, experience collection, the provision of projects, management, auditing, evaluation and for insurance, where applicable, liability in the execution of the task, cf. Section 17 (3) of the law. 3 and 4.

3) Receipt of advice from the Depostrating, cf.. Article 24 (2) of the law. 3.

4) the retention of expenditure, including the grant of grants, as part of the system of valuation for information, administration, auditing, evaluation, and results dissemination, etc., cf. Act 36.

5) Receiving a request for notification by national associations and organisations concerning decisions taken with legal basis in Chapter 4 of the law and the notification of the regional councils, the local authority or the environmental centre to be discharged, cf. Article 56 a (1) of the law. 2.

6) Provinces to the regional councils and the municipal boards of taking matters, including specific cases, concerning soil contamination up to the treatment and decision, cf. Section 61 (1) of the law. 1.

7) Preparation of the Minister for the Environment, Decision of the Environment Council to impose the area of inquiry and disposal measures on areas that are mapped or may have been mapped, cf. Section 61 (1) of the law. 2.

8) Clause of the regional advices and the municipal boards of providing information for the assessment of conditions governed by the law within the territory of the individual municipality or region, including that the information is to be provided in a specific form, cf. Section 61 (1) of the law. 3.

9) Notification as a supervisory authority at the request of the Regional Council of all information that is relevant to the assessment of conditions governed by the law in the individual municipality, cf. Act 62.

Chapter 2

Delegated powers to environmental ministry centres

§ 2. The following powers of the law on the polluted land are delegated from the Environment Minister to the Environment Centre, Århus, Environmental Centre Odense and the Environmental Centre Roskilde, cf. however, paragraph 1 2 :

1) Decision on the poricages concerning pollution, cf. Section 39, paragraph. 2.

2) Receiving a request for notification from local associations and organisations concerning the specific types of decisions following the Chapter 4 of the law the association of the association, cf. Article 56 a (1) of the law. 1

3) Notification as a supervisory authority at the request of the Regional Council of all information that is relevant to the assessment of conditions governed by the law in the individual municipality, cf. Act 62.

4) Receipt of cases from the municipality Board for failure to comply with the injunction, cf. Section 65 (5) of the law. 2.

5) Confusing to comply with the descendants, cf. Article 66 a (3) of the law. 1.

6) Signature of the deputy working approach, cf. Article 66 a (3) of the law. 2.

7) Notify of the place for a place to build, cf. Article 66 a (3) of the law. 3.

9) Receipt of notification from the municipality board about a soil contamination, cf. Article 70 (1) of the law. 1.

10) Competence to request any owner or user to provide all information necessary for the purpose of performing the tasks of the environment by the law or in accordance with the rules laid down by the law in accordance with the law, cf. Act 72, paragraph. 1.

11) Requirements for expenditure under cover, cf. Section 73 (3) of the law. 1.

Paragraph 2. § 3. Environmental Center Ringkøbing, Environmental Centre Aalborg, Environment Center Aarhus, Environmental Centre Ribe, Environmental Centre Odense, Environmental Center Roskilde and Environmental Center Nykøbing Falster are responsible for the announcement of the notice of the local authorities ' notice of the notice of the notice of the notice ; Annex 1.

§ 6. § 7. The Minister for the Environment may decide to delegate the exercise of a power, including the preparation of the Minister's exercise of an authority which, after the notice, lies with the Environmental Protection Agency, to the Environmental Ministry's environmental centres.

Paragraph 2. The Environment Minister may also decide to delegate the exercise of a power which, after the notice, lies with the Environmental Ministry's environmental centres, to the Environmental Management Board.

§ 8. The Director of the Environmental Management Board may decide to delegate the exercise of a power, including the preparation of the Minister's exercise of an authority which, after the notice, lies with the Environment Board, to the Environmental Ministry's environmental centres.

Instructions competence and supervision

§ 9. The Environment Minister may give the Director of Environmental Management instructions for the exercise of the powers delegated to the Environmental Management Board in the notice.

§ 10. The Director of the Environmental Management Board shall supervise and allow the directors of the Environmental Ministry's environmental centres to carry out the powers delegated to them in the notice by the Ministry of the Environment.

§ 11. Decisions made by the Environmental Management Board shall not be impected to the Minister for the Environment.

Paragraph 2. Decisions made by the EPA's environmental centres may not be complained to the Environmental Management Board or the Minister for the Environment.

Paragraph 3. In any case, decisions may be made to the Committee on the Environment, in accordance with the rules laid down in Article 77 (3) of the law. 1.

Chapter 4

Entry into force

§ 12. The announcement shall enter into force on 1. July 2008.

Paragraph 2. Publication no. 1645 of 13. In December 2006, on the delegation of the Minister for the Environment, Public Health and Consumer Protection Act on the polluted land to the Environmental Management Board and the State Environmental Centre under the Environment Ministry.
