The full text of the Decree on delegation of powers of the Minister of the environment contaminated soil to the environmental protection agency and the Ministry of the environment environment centres

Under section 59 (1) and (2) of the law on contaminated soil, see. lovbekendtgørelse nr. 282 of 22. March 2007 shall be determined:

Chapter 1

Delegated powers to the environmental protection agency

§ 1. The following powers in law on contaminated soils be delegated from the Minister of the environment for the environmental protection agency:





1) Preparation of guides within the area.

2) development and testing of new technologies in the field of soil pollution area and in this context the holding of expenditure and the provision of grants for projects on mitigation measures, development projects, criteria setting, risk assessment, information, lessons, selection of projects, administration, auditing, evaluation and for assurances regarding possibly liability in connection with the execution of the task, see. section 17, paragraph 3 and 4.

3) receipt of advice from Depot Council regulation. Article 24, paragraph 3.

4) expenditure, including the award of grants, as part of the værditabs system for information management, auditing, evaluation and dissemination of results, etc., see. § 36.

5) receipt of request for notification from the nationwide associations and organizations of decisions taken on the basis of Chapter 4 (a), and under the direction of the Regional Council, Municipal Council or environmental center on this, see. section 56 (a), paragraph 2.

6) cold cuts to regional councils and municipal councils to take questions, including specific cases concerning soil contamination up to treatment and decision, see. Article 61, paragraph 1.

7) Preparation by Environment Minister's decision to impose regional councils to carry out investigation and preemptive measures on land that is mapped or could have been mapped, see. Article 61, paragraph 2.

8) cold cuts to regional councils and municipal councils to provide information for the assessment of the facts which is regulated according to the law within the individual municipality or regional area, including whether the information shall be given in a particular form, see. Article 61, paragraph 3.

9) message as the supervisory authority at the request of the Regional Council of all information which is of importance for the assessment of the facts which is regulated according to the law within the individual municipality's area, see. § 62.





Chapter 2

Delegated powers to the Ministry of the environment environment centres

§ 2. The following powers in law on contaminated soils be delegated from the Minister for the environment, Environment Centre Odense and Aarhus center Environmental center, Roskilde, see. However, paragraph 2:





1) decision on injunction relating to contaminants, see. § 39, paragraph 2.

2) receipt of request under direction from local associations and organisations about which specific types of decisions in accordance with Chapter 4 (a) the Association wants to be informed of, see. section 56 (a) (1)

3) message as the supervisory authority at the request of the Regional Council of all information which is of importance for the assessment of the facts which is regulated according to the law within the individual municipality's area, see. § 62.

4) receipt of cases from the Municipal Council of failure to comply with orders, see. section 65 (2).

5) supervision of that injunction is granted without prejudice. section 66 (a), paragraph 1.

6) Under the direction of the local labour inspectorate, see. section 66 (a), paragraph 2.

7) Under the direction of the local building authority, see. section 66 (a), paragraph 3.

8) Under the direction of the affected water supplies, see. section 66 (a), paragraph 4.

9) receipt of notification from the Municipal Council of a soil contamination, see. section 70 (1) of the Act.

10) Competence to ask any owner or keeper to give all information required for performance of the tasks of the centres of the environment in accordance with the law or in accordance with the rules laid down on the basis of the law, see. Article 72, paragraph 1.

11) requirements on the coverage of the costs of the basic regulation. section 73, paragraph 1.





(2). The powers referred to in paragraph 1, however, is delegated to the Environment Centre Ringkøbing, Environmental center Aalborg, Aarhus, Environmental center environmental center Ribe, Environment Centre Odense, Roskilde and environmental center Environmental center Nykøbing Falster, when pollution originate from establishments where supervision after the environmental protection act is delegated to these centres by virtue of executive order on classification tasks and powers of the management for urban and landscape Agency and Ministry of the environment environment centres.

(3). Receipt of the decision from the order authority about the existence of an environmental damage or an imminent threat of environmental damage and the material which is concluded in the assessment of the case, see. § 38 h, paragraph 1, is located at the Environment Centre Ringkøbing, Environmental center Aalborg, Aarhus, Environmental center environmental center Ribe, Environment Centre Odense, Roskilde and environmental center Environmental center Nykøbing Falster.

§ 3. Environment Centre Ringkøbing, Environmental center Aalborg, Aarhus, Environmental center environmental center Ribe, Environment Centre Odense, Roskilde and environmental center Environmental center Nykøbing Falster carries out their powers in the notice within the municipalities, listed in the annex 1 of the Executive order.

Chapter 3

Call in in specific cases

§ 4. The Minister may decide to take over a power which must be carried out after the publication of the environmental protection agency.

(2). The Minister may also decide to take over a power that should be exercised by the Ministry of the environment after the publication environment centres.

§ 5. The Director of the environmental protection agency can decide to take over a power that should be exercised by the Ministry of the environment after the publication environment centres.

Delegation in specific cases

§ 6. The Minister may decide to delegate the exercise of a power, which after the notice or after the Minister's decision to call in the Secretary of State, to the Environment lies with the agency or Ministry of the environment environment centres.

§ 7. The Minister may decide to delegate the exercise of a power, including the preparation of the Minister's exercise of a power which after publication lies with the environmental protection agency, the Ministry of the environment environment centres.

(2). The Minister may also decide to delegate the exercise of a power, that after the Ordinance rests with the Ministry of the environment environment centres, to the environmental protection agency.

§ 8. The Director of the environmental protection agency may decide to delegate the exercise of a power, including the preparation of the Minister's exercise of a power which after publication lies with the environmental protection agency, the Ministry of the environment environment centres.

Instructional power and supervision

§ 9. The Minister may provide the Director of the environmental protection agency instructions relating to the exercise of the powers delegated to the environmental protection agency in the notice.

§ 10. The Director of the environmental protection agency supervises and can give the directors of the Environment Ministry's instructions concerning the environment environment centres centres carrying out of the powers delegated to them in the order.

Complaint

§ 11. Decisions taken by the environmental protection agency may not be appealed to the Minister of the environment.

(2). Decisions of the Ministry of the environment environment centres cannot be appealed to the environmental protection agency or the Minister for the environment.

(3). Decisions can be appealed to the Environmental complaints board, moreover, according to the rules laid down in article 77, paragraph 1.

Chapter 4

Date of entry into force of

§ 12. The notice shall enter into force on the 1. July 2008.

(2). Executive Order No. 1645 by 13. December 2006 on the delegation of powers of the Minister of the environment contaminated soil to the environmental protection agency and state environment centres under the Ministry of the environment shall be repealed.
