June 2007 and after debate with the Finance Minister in accordance with section 12 (2). 6, in the law on public payments, etc., cf. Law Order no. 798 of 28. June 2007 shall be :

Chapter 1

The procedure for establishing a free elementary school that wants state grants.

§ 1. Notification of a free primary school wishing for state grants shall be carried out by submitting the following to the Ministry of Education :

1) A notification scheme with information on the conditions indicated on the scheme.

2) Deposit of $30,000 kr. paid in two installments of 20,000 kroner. and 10,000 kroner.

3) The Statute adopted for approval, cf. Section 5 (5) of the law. 1.

4) A schema containing information on the conditions indicated on the table and evidence that the school's buildings have been approved by the site-building and fire department for school and teaching purposes. The scheme shall be signed by the drawing-entitled character of the school's Staff Regulations.

Paragraph 2. The Schema referred to in paragraph 1. 1, no. 1 and 4 of the Ministry of Education shall be drawn up by the Ministry of Education and resides on the Home Affairs website www.uvm.dk.

§ 2. It is a condition to receive grants that the notification dossier is the Ministry of Education in the event at the latest by the following dates :

1) August 15, the year ahead of the school year, for which the school wishes to grant grants : anestionnaire and 1. the deposit of the deposit of 20,000 krin;, cf. Section 1 (1). 1, no. One and two.

2) February 1, prior to the school year, for which the school wishes to grant grants : Graduing and 2. the rate of the deposit of 10,000 krin; cf. Section 1 (1). 1, no. Two and three.

3) 1 June preceding the school year for which the school wishes for grants : the information document in accordance with Annex, cf. Section 1 (1). 1, no. 4.

Paragraph 2. Deposit shall be repaid when, in the case of notification to the calculation of the subsidy calculation in September, it has been established that the school meets the minimum number of the law in the section 19 of the law. No interest is calculated by the amount collected. If the school does not receive grants for the year in which the deposit is paid, the deposit of the treasury shall be deposits.

§ 3. § 4. Chapter 2

Other conditions for grants

§ 5. A free elementary school must not acquire buildings and land for the purpose of rental, except for service and rent for the school staff.

§ 6. It is a condition for a grant that the school by the student body or in any other way provides a reasonable level of coverage of the school's operating costs. Estimated charges for broom, lighting and heating, etc. and rent for employees ' s rent shall not be included in the own cover. The minimum limit for the exclusive parental payment for school-free time schemes is 1/8 of the average subsidy per year. a number of years, cf. Article 10 (1) of the law. 3 and 4.

Paragraph 2. It is a condition for the granting of grants to the school-free time scheme, that an orphan payment is required for the student and that the student has not received a reduction in the school money payment due to the entry into the school-free time regime.

Paragraph 3. Reclaimaging tuition and parental pay for school-free time-sharing must be included in the collection of the amount of a proportion of each of the two payments.

§ 7. A lease, including lease, is of an insignificant extent, cf. Section 5 (5) of the law. 7, and section 24, paragraph l, 5. pkt., if the rent amounts to 2,0%. or thereunder of the school's total property costs, including priority interest and depreciation on buildings including installations.

Chapter 3

Defeagent students

a) Alive that should not be registered in CPR, and Greenland students, cf. paragraph 1.

b) Foreign students who have been granted a residence permit to follow the teaching of a Danish school as part of an exchange.

c) Owes which, pursuant to the European Union's right or the EEA Agreement, are entitled to participate in the decision.

d) Evers who have come to Denmark as asylum seekers without their parents and subsequently received a residence permit pursuant to the law of foreigners.

Paragraph 3. If a student is enrolled in a free elementary school after the beginning of the school year, and before the 5th. September must be included in the inventory in accordance with paragraph 1. 1, the school must be able to document the receipt of a copy of the student certificate from the former school of the student or that it has sent a copy of the letter ' s written notification, stating the first day of school day to the elevens of the student ' s former school. § 9. The Minister of Education can approve the addition of schools with costing both for primary school pupils and high school students, even though the minimum rate requirement in the section 13 (3) of the Act of the Law of Article 13 (1). 2, because primary school boarding students have not been met. Chapter 4

Deposits for school-free schemes and language stimulus

§ 10. The subsidy to the school-free time scheme is calculated as the subsidy per. the number of seasors laid down on the Finance Bill, the number of years of the year.

Paragraph 2. The number of annual years shall be calculated as the payment of parental payment and subsidies in accordance with section 14 (4). Chapter 5

Advance to special education, additional expenses for the training of the disabled and supporting training in Danish of bilingual pupils ;

§ 12. The Management of the Statens Education Support (the Management Board) administers special education grants, extra costs for the teaching of disadvantaged pupils and support classes in Danish of two-language trainees, cf. Act 11, paragraph 1. 1, no. 1. Applications for grants shall be made on schematics drawn up by the Management Board. The management of the school may obtain the necessary information for the allocation and administration of the grants.

Paragraph 2. For applications for grants to specialist training and subsidies for extra-cost students with severe disabilities, a statement from the school and educator-psychological advice in the school municipality is attached. To apply for aid to training in Danish of a two-language student, a professional evaluation of the student ' s needs in Danish and the parent ' s written consent shall be attached to the student ' s need for the student to have a need for the student ' s need for assistance in Danish and the parents ' s the training of aid.

Paragraph 3. Applications for additional costs for students with difficult disabilities shall be the management of the board at the latest by 1. February before the next school year. However, applications for grants may be submitted throughout the school year for new pupils.

Paragraph 4. Applications for grants to specialist training and training in Danish of two-language trainees must be at the hands of the board at the latest by 1. February before the next school year. For new students, the application deadline is 1. October of the school year.

Paragraph 5. The school shall notify the Management Board of interruption and substantial changes in relation to the requested application.

Paragraph 6. Deposits for special education, extra expenses for the teaching of disadvantaged pupils and support classes in Danish of two-language trainees must be used solely for the purposes of the purposes. The school shall inform the parents of the student that a grant has been granted for this part of the student ' s subdisplay activity. The school shall inform the Management Board, in writing, of the termination of the subsidiary allowance for which the aid is granted.

Chapter 6

Special grants

Deposits for the transport costs of sick and disabled students, reducing school money, reducing parental payment for school-free time schemes, reducing subsistence expenses on a boarding school

§ 13. The school is required to provide for whole or partial transport between the school and the home, provided that the student is unable to degrade himself due to illness or disability.

Paragraph 2. In case of doubt, the school may require the parents to obtain a medical statement or other expert declaration for the assessment of the needs of the student's transport needs.

Paragraph 3. After the criteria set by the allocation secretariat, a school may either establish a special carriage of goods, possibly against a certain payment from the student, or in exceptional cases, an agreement with the parents that the parents should be taken to a certain degree, compensation shall itself provide for the carriage of passengers.

§ 14. Free-space grants can be given to students in language stimulus and kindergarten, as well as on 1 -10. class steps. Deposits to reduce parental payment for school-free time schemes may be given to students in kindergarten and 1. -3. Class. Content aid grants may be granted to students of 8 to 10. class steps. It is a prerequisite for the granting of grants and subsidises subsidy grants that the student is not full 18 years of the beginning of the school year. Elives, which is 18 years of age in a school year, can be subsiuned for the rest of the school year.

Paragraph 2. The grant aid, free-charge grants and subsidies for the reduction of parental allowance for school-free period shall be allocated to each school based on the basis of the parent ' s income basis, cf. paragraph 6, set up on the basis of the calendar year in advance of the calendar year in which the school year begins.

Paragraph 3. If the parents are married or have a common population address without being married to each other, the aid shall be calculated from the overall income basis of the parent.

Paragraph 4. If the parents are divorced, separated or not married without having common people's registration, the aid shall be calculated from the income basis of the parent ' s premises ;

I) that have the parental authority, or

2) on whose address the student is registered to the population if the parents have custody of the parent authorities.

Paragraph 5. The total income base of the parents, cf. paragraph 3, or one of the parent's income base, cf. paragraph Four may be reduced for each of the children's siblings that are under 18 years of the beginning of the school year.

Paragraph 6. The income base of parents is made of personal income with an addendum of positive capital income used for calculating income tax after the Danish income tax, however, before they mentioned bottom-deduction and deduction of the basic amount, as well as the addendum to the income tax and the addition of an amount of income that is taxed in accordance with Article 8 (a) of the person who is subject to the Danish national tax. 2.

Paragraph 7. Paragraph 8. The criteria for granting residency aid, free-deposit grants and subsidies to reduce parental payment for school-free time arrangements shall be set by the distribution secretariat.

§ 15. It is a condition for the receipt of grants under section 14, that further specified student groups, including children of the school board members and employees, are not wholly or partially exempt from lifts.

§ 16. The subsidy to the German minority schools must cover the special cost needs, which are necessary for the maintenance and securing of the German minority's school system by Deutscher Schul-und Sprachverein für Nordschleswig. In the expenditure requirement, hours to the dual mother tongue class (German, Danish) shall be a special operating grant to ensure the existence of the schools and other minority-specific schemes.

§ 17. Deposits to benefit from the distribution secretariat, cf. Act 11, paragraph 1. 1, no. 2, and section 17 (3). 1 and 2, and grants which Deutscher Schul-und Sprachverein für Nordschleswig has to distribute to German minority schools, cf. Act 11, paragraph 1. 1, no. 3, and section 14, shall be paid at the beginning of the financial year. Interest income, etc. in the period from payment of grants and for use is used for partial coverage of the distribution secretarial and Deutscher Schul-und Sprachverein für Nordschleswick's administration costs.

Chapter 7

Payment of subsidies, etc.

§ 18. Advance to individual schools will be paid monthly in advance. Deposits for general operating expenses, buildings grants and benefits for cowards shall be paid out by 1/12 of the calculated annual subsidy.

Paragraph 2. Deposits for the first seven months of the financial year shall be paid definitively. If the number of pupils per number 5. Paragraph 4. Paragraph 5. Deposits for special education, extra expenses for the teaching of disadvantaged pupils and support classes in Danish of two-language students shall be paid monthly by a proportionate share of the approved amounts. However, the expenses of aid shall be borne by the school and shall be refunded by the Board of Direction of the Documentation for the presentation of the documents. If the school is to repay grants, cf. § 12, paragraph 1. 6, the amount of the subsidy payments shall be deducted for the following month.

Paragraph 6. Grants may not be paid to a newly created school before doing so in the case of the calculation of the subsidy calculation per 5. § 19. The Management Board shall be responsible for reporting in accordance with the provisions relating to the use of the subsidy calculation.

Paragraph 3. The Administrative Board shall notify the Ministry of Education at once the school has filed for bankruptcy or for payment, or when there is a danger that the school is to set up its business. If the notification does not provide a reasonable level of security for the school's continuation and will not be provided for such security within the time limit set by one of the Ministry of Education, additional charges may be made conditional on the guarantee of a financial institution.

Chapter 8

Municipal contributions

20. The municipality's contribution to the state of students in language stimulus, preschool class or 1. -10. class and to students incorporated in a school-free period at a free elementary school are calculated on the basis of the lifts ' statements per year. 5. September of the preceding financial year.

§ 21. The contribution shall be paid once a year 1. July of the current financial year by means of deduct payments made in July from the Customs and Tax Authority of the tax on income tax, state grants, etc.

§ 22. The obligation to make a student in a financial year is not affected by the fact that the student after 5. September of the preceding financial year has been transferred to another municipality or has been enrolled by that school or that the school does not receive grants during the school year.

Chapter 9

Special education, health education and supplementary education

-23. In the case of pupils whose development requires special consideration or support, special education or other specialized pedagogical assistance shall be given in accordance with the rules of the public school special education and other special pedagogical assistance with the other specialised teaching ; any modifications resulting from elementary school stylisation. It is a prerequisite that a student refers only to specialist training if there are problems which are not temporary in nature and cannot be resolved within the framework of the general education.

§ 24. Elives, due to illness or their health or wellbeing, cannot be taught in their school, are entitled to education according to the rules in the notification concerning the health education for students in primary schools and certain private schools.

§ 25. For students who need temporary aid, without the need for special education, additional training may be provided. For two-language trainees, special training may be provided in a manner that ensures that bilingual children permanently resident in Denmark are taught Danish corresponding to the requirements of the Danish School of People ' s classes.

Chapter 10

Different rules

SECTION 26. The school pays compensation to the person who is selected as a supervisor, cf. Section 9 (4) of the law. 2, with the following amounts per school years per year. school :

1) DKK 6,000. for schools with up to 55 students on 5. September of the school year.

2) $10,000. for schools with 55-109 students on the fifth. September of the school year.

3) $15,000. for schools with 110-219 students on 5. September of the school year.

4) $20,000. for schools with more than 219 students on 5. September of the school year.

Paragraph 2. In addition, the school may provide prudential transport compensation according to the rules of the State, cf. The Financial Ministry circular on the mission agreement.

Paragraph 3. No refund shall be paid under paragraph 1. 1 to Supervisor, if the supervision is carried out as part of their employment relations.

§ 27. Declarations of authority, cf. Section 9 (4) of the law. 7, must be written in Danish and include at least the following information :

1) School's name and school code.

2) Name of the supervisor or the supervisors.

3) Date of supervising visits, stating the classes and the subject of supervision has been the teaching of the classes.

4) In Danish, the opinion of the student body in Danish, regal / mathematics and English.

5) The assessment of whether the school ' s overall educational offer from a holistic assessment is the target of what is commonly required in primary school.

6) The appraisal of whether or not the school meets the requirement laid down in Article 1 (1) of the law. TWO, FOUR. a point, to prepare students to live in a society of freedom and the people's regime.

§ 28. The Schools are exempted from the provisions of the law on public payments and so on. sections 1 to 6 as regards the connection to the NemKonto System, section 7, as regards the receipt of electronic invoices and the obligation to enable electronic payment and Article 8, as regards the application of the State's Concern Payments (SKB).

Chapter 11

Entry into force

§ 29. The announcement shall enter into force on 1. August 2008.

Paragraph 2. Publication no. 1299 of 10. In December 2006, on subsidies and so on to free schools and private basic schools, etc. (free primary schools) are hereby repealed.
