Decree on subsidies for physical therapy with physical therapist in practice sector and unpaid physiotherapy with physiotherapist in practice sector and in the municipality

Pursuant to §§ 67, 72 and 140 (a) in health law, see. lovbekendtgørelse nr. 95 of 7. February 2008, as amended by Act No. 539 of 17. June 2008, fixed:

General provisions

§ 1. Group 1 and group 2-secured secured persons are entitled to reimbursement for physical therapy and non-physical therapy with physiotherapist after medical referral.

§ 2. Insured persons are not entitled to reimbursement for physical therapy in public hospitals or in private hospitals or clinics that receive patients for physical therapy in agreement with public hospitals.

§ 3. Regional Council does not provide reimbursement for the physiotherapist's services to himself, to the spouse or to children living at home.

(2). The local authority provides for unpaid physiotherapy with physiotherapist in practice sector does not grant to the physiotherapist's services to himself, to the spouse or to children living at home.

§ 4. The Regional Council provides grants with the same amount and for the same services to group 1 and group 2 – secured unsecured persons.

(2). The Municipal Council is providing free of physical therapy with the same services for Group 1 and group 2-insured persons.

(3). For Group 1-insured persons, it is a condition for receiving reimbursement for physiotherapy, that it be performed by a physiotherapist, who has endorsed the relevant agreement between the regions for wages and tariffs and Danish Physiotherapists.

(4). For Group 1-insured persons, it is a condition of receiving unpaid physical therapy that it is carried out by a physiotherapist, who either have signed up to the relevant agreement between the regions for wages and tariffs and Danish Physiotherapists, or providing similar services in municipal auspices, see. § 13.

(5). For Group 2-secured, there has been physical therapy with a physiotherapist who has not signed up to the agreement, the local municipality shall pay the grant on behalf of the Regional Council. In order to get the subsidy paid to the patient forward a receipted and itemized bill to the municipality. The grant may not exceed the amount of this account.

(6). Both group 1 and group 2-insured persons pay their own share of the fee directly to the physical therapist.

§ 5. Persons entitled to benefits pursuant to the Community legislation or international agreements, has during the stay here in this country the right to reimbursement for physical therapy and physical therapy with physiotherapist after unpaid medical reference on the same terms as Group 1-secured.

(2). By Community legislation or international agreements shall mean Council Regulation (EEC) No 2377/90. 1408/71 on the application of social security schemes to employed or self-employed persons and members of their families moving within the community, and the related regulation (EEC) No 2377/90. 574/72 on the implementation of Regulation No 40/94. 1408/71, the agreement on the European economic area (EEA Agreement), the Nordic Convention on Social Security and the agreement between the European Community, its Member States and Switzerland on the free movement of persons.

Reimbursement physical therapy

§ 6. The Regional Council provides grants for physical therapy with physiotherapist after doctor referral in practice sector.

§ 7. The terms and conditions for grants, including the performance descriptions, to physical therapy with physiotherapist after medical referral is demonstrated by the agreement between the regions for wages and tariffs and Danish Physiotherapists.

§ 8. The Regional Council is providing a grant of 39.3% of those in the agreement between the regions for wages and tariffs and fees charged for consultations provided for Danish Physiotherapists, including team training. By physical therapy in the patient's home is granted a subsidy of 40% of those in the same agreement, the distance allowance.

(2). If physical therapist at the same visit treats or coach several family members in the same home, providing the Regional Council only one grant. Treats or trainer physical therapist at the same visit multiple patients in nursing homes or similar, are calculated only one spacer Appendix, as Regional Council in this case pay fully.

§ 9. If the Regional Council decides to offer preventive and follow-up physiotherapy classes, provides the Regional Council grants to the services covered by the agreement provisions on group lessons.

(2). The Regional Council grants for preventive and follow-up physiotherapy classes see. (1) make up 2/5 of the fee provided for in the framework agreement, concluded between the regions for wages and tariffs and Danish Physiotherapists regarding the implementation of preventive and follow-up physiotherapy group lessons.

Eligible ridefysioterapi

§ 10. The Regional Council provides grants for physical therapy at ridefysioterapeut after medical referral.

§ 11. The terms and conditions for grants, including the performance descriptions, to physical therapy with ridefysioterapeut after medical referral is demonstrated by the agreement between the regions for wages and tariffs and Danish Physiotherapists.

(2). The Regional Council grants for ridefysioterapi, see. (1) make up 4/5 of the fees provided for in the agreement between the regions for wages and tariffs and Danish Physiotherapists.

Unpaid physiotherapy, including unpaid ridefysioterapi

§ 12. Councillor offers unpaid physiotherapy with physiotherapist and at ridefysioterapeut in practice sector after medical referral.

(2). The terms and conditions for unpaid physical therapy after medical referral with physiotherapist and at ridefysioterapeut in practice sector, including service descriptions set out in agreements between the regions for wages and tariffs and Danish Physiotherapists.

§ 13. The Municipal Council can offer unpaid physiotherapy with physiotherapist and at ridefysioterapeut after medical reference by establishing offer of royalty-free physiotherapy at own institutions or through the conclusion of agreements with other local governments or private institutions.

(2). The terms and conditions for unpaid physical therapy after medical referral with physiotherapist and at ridefysioterapeut, including performance descriptions shall be identical with the conditions laid down in the agreements between the regions for wages and tariffs and Danish Physiotherapists.

§ 14. Persons with a durable, hard physical disability as a result of a congenital or hereditary disorder, acquired neurological disorders, physical disabilities as a result of accident or reduction of joints or muscle function due to inflammatory rheumatic disorders are after medical referral right to a free of charge, offer physical therapy, if necessary. by ridefysioterapeut, from the local authority.

(2). Persons with disability as a result of progressive disease as a result of a congenital or hereditary disorder, acquired neurological disorders or impairment of part or muscle function due to inflammatory rheumatic disorders are after medical referral right to a free of charge offers of physiotherapy from the Municipal Council.

(3). The National Board of health shall prepare separate instructions governing the movement of persons access to unpaid physiotherapy in accordance with paragraphs 1 and 2.

§ 15. Persons who are referred to unpaid medical physical therapy, including unpaid ridefysioterapi, can choose between receiving unpaid physiotherapy with physiotherapist and at ridefysioterapeut in practice sector or in the offer, the Municipal Council has established at own institutions or concluded agreements with private institutions, and can also select offers on other municipalities institutions, see. However, paragraph 2.

(2). A municipality may, for capacity reasons refuse to receive persons domiciled in another municipality, for unpaid physiotherapy, including unpaid ridefysioterapi, URf.eks. If the institution has substantially longer waiting time for unpaid physiotherapy, including unpaid ridefysioterapi than other local institutions, and if essential terms to people from their own municipality would otherwise be infringed.

§ 16. The notice shall enter into force on the 1. August 2008.

(2). At the same time repealed Executive Order No. 1079 of the 2. November 2006 on reimbursement for treatment with a physiotherapist in practice sector.
