Publication of approval, supervision and control of establishments and installations and penalties for infringements of the by-product Regulation 1)

In accordance with section 45, section 67 and section 70 (4), 3 and 5, in the Law No 432 of 9. In June 2004, on the crew of animals, as amended by law no. 105 of 20. In February 2006, the following shall be :

Approval, supervision and control

§ 1. For the purposes of this notice :

1) ' Biproduct Regulation ` shall mean the Regulation of the European Parliament and of the Council (EC) No 1774 of 3. October 2002 on health rules for animal by-products which are not intended for human consumption.

§ 2. Companies and plants covered by the by-product Regulation with subsequent amendments shall be approved by the food registration in which it is situated.

§ 3. Applications for the approval of establishments, installations or methods covered by the Regulations referred to in section 5-16 shall be sent to the food-based destination in which the plant or plant is located.

Paragraph 2. The birth records shall supervise and control the checks referred to in paragraph 1. 1 mentioned establishments and facilities.

§ 4. Applications for the approval of alternative methods for establishments and installations engaged in the activities covered by the regulations referred to in section 5 to 16 shall be sent to the food registration in which the plant or plant is located.

Punishment

§ 5. Unless higher penalties have been imposed on the other legislation, the penalty shall be punished by fine, which violates the following provisions of the by-product Regulation as last amended by Commission Regulation (EC) No 2020/20. 523 of 11. June 2008 :

1) Article 4 (1). 2-4,

2) Article 5 (5), 2-4,

3) Article 6 (1). 2-3,

4) Article 7 (2) ; 1-2 and 5,

5) Article 8 (2) ; 1-4

6) Article 9 (1). 1,

7) Article 22 (2) ; 1,

8) Article 25 stk.1-2, or

9) Article 29 (2). 1-6.

§ 6. Unless higher penalties have been imposed on the other legislation, the penalty shall be penalised by the penalty which infringes the following provisions of Commission Regulation (EC) No 2. 668 of 10. March 2004 amending certain Annexes to the by-product Regulation as regards the import of animal by-products from third countries :

1) Article 1.

§ 7. Unless higher penalties have been imposed on the other legislation, the penalty shall be penalised by the penalty which infringes the following provisions of Commission Regulation (EC) No 2. 878 of 29. April 2004, on the measures taken pursuant to the by-product Regulation for certain animal by-products classified as category 1 material or Category 2 material for technical use, as amended by the Commission (EC) No 1877 of 18. December 2006 :

1) Article 4, or

2) Article 5.

§ 8. Unless higher penalties have been imposed on the other legislation, the penalty shall be penalised by the penalty which infringes the following provisions of Commission Regulation (EC) No 2. 79 of 19. 1 January 2005 on the implementation of the by-product Regulation in the case of the use of milk, milk-based products and milk derived products, as category 3 material of that Regulation :

1) Article 2,

2) Article 3, or

3) in Article 4 (4), 1.

§ 9. Unless higher penalties have been imposed on the other legislation, the penalty shall be penalised by the penalty which infringes the following provisions of Commission Regulation (EC) No 2. 92 of 19. 1 January 2005 on the implementation of the by-product Regulation in respect of procedures for the disposal or use of animal by-products and amending Annex VI, as regards conversion to biogas and processing of rendered fats, which : Commission Regulation (EC) No, 2067 of 16. December 2005, Commission Regulation (EC) No, 1678 of 14. in November 2006 and Commission Regulation (EC) No 1422, 2006, 1576 of 21. December 2007 :

1) Article 4.

§ 10. Unless higher penalties have been imposed on the other legislation, the penalty shall be penalised by the penalty which infringes the following provisions of Commission Regulation (EC) No 2. 93 of 19. 1 January 2005 on the implementation of the by-product Regulation as regards the processing of animal by-products of fish and commercial documents intended to accompany animal by-products during transport :

1) Article 1.

§ 11. Unless higher penalties have been imposed on the other legislation, the penalty shall be penalised by the penalty which infringes the following provisions of Commission Regulation (EC) No 2. 208 of 7. February 2006 amending Annexes VI and VIII to the by-product Regulation as regards the processing standards for biogas and composting plants and requirements for manure :

1) Article 1.

§ 12. Unless higher penalties have been imposed on the other legislation, the penalty shall be penalised by the penalty which infringes the following provisions of Commission Regulation (EC) No 2. 2007 of 22. December 2006 on the implementation of the BiProduct Regulation as regards the import and transit of certain intermediate products obtained from Category 3 material for technical use in medical devices, in-vitro diagnoka and laboratory reaga and amending the the said Regulation :

1) Article 4 (1). 1, 2 and 4

2) Article 5, or

3) Article 6.

§ 13. Unless higher penalties have been imposed on the other legislation, the penalty shall be punished by fine, which contravenes the following provisions of Commission Regulation (EC) No 2. 829 of 28. June 2007 amending Annexes I, II, VII, VIII, X and XI to the by-product Regulation as regards the placing on the market of certain products of animal origin, as amended by Commission Regulation (EC) No 2. 1256 of 25. October 2007 as regards the transitional period relating to the use of commercial documents and animal by-products animal by-products :

1) Article 1.

§ 14. Unless higher penalties have been imposed on the other legislation, the penalty shall be penalised by the penalty which infringes the following provisions of Commission Regulation (EC) No 2. 1432 of 5. In December 2007, amending Annexes I, II and VI to the Biproduct Regulation concerning the labelling and transport of animal by-products :

1) Article 1.

§ 15. Unless higher penalties have been imposed on the other legislation, the penalty shall be penalised by the penalty which infringes the following provisions of Commission Regulation (EC) No 2. 437 of 21. May 2008 amending VII, X and XI to the by-product regulation as regards requirements for the processing of milk and milk products as defined as Category 3 material.

§ 16. Unless higher penalties have been imposed on the other legislation, the penalty shall be penalised by the penalty which infringes the following provisions of Commission Regulation (EC) No 2. 523 of 11. June 2008 amending Annexes VIII, X and XI to the by-product Regulation as regards the import of blood products for the production of technical products :

1) Article 1.

§ 17. Regardless of section 5 to 16, pet animals may be disposed of by degraving.

Paragraph 2. For the purposes of this notice, pet animals shall mean any animal belonging to species which are normally fed and kept by human beings, without prejudice to human or agricultural production, for example, dogs, cats, guinea pigs, reptiles or steerfish, and aquarium fish.

§ 18. With fine punishable by the penalty that violates § § 2-4.

Paragraph 2. The penalty for infringement of sections 2 to 16 may go to prison for two years, if by the act or omission, the offence has been committed with a set of or gross negligence, and the infringement is :

1) Posted damage to human or animal health or induced hazard to this, or

2) obtained or intended for the economic benefit of the person concerned itself or others, including in savings.

Paragraph 3. Legal undertakings may be subject to so on. (legal persons) punishable by the rules of the penal code 5. Chapter.

Entry into force

§ 19. The announcement shall enter into force on the 15th. July 2008.

Paragraph 2. At the same time, notice No 355 of 19. May 2003 on the disposal and processing of animal by-products.

1) The commotion shall contain provisions necessary for the application of Regulation (EC) No 2 of the European Parliament and of the Council. 1774/2002 of 3. October 2002 on health rules for animal by-products, which are not intended for human consumption (EU Official Journal 2002, L 273, p. 1ff).
