Report on veterinary checks by importing animal foods 1)

Chapter 1

Area and definitions

§ 1. The decision includes any form of import in Denmark of the food listed in Annex 1, Part I, as well as the circulation of ships from third countries in Danish ports and landing aircraft from third countries in Danish airports.

Substances. 2. The foods listed in Annex 1 are not covered by the notice

§ 2. In the field of border animals, one of the food region is employed by an inspection point in accordance with Annex 2.

Substances. 2. For veterinary checks, see:

1) For food received by trade, food region

a) non-discriminatory sampling on the provision site,

b) suspected control including control during transport, or

(c) sharpened control.

2) For food returned from trade countries, the food region’s control of the company’s receiving control.

3) 3) For food imported from third countries, the border veterinarian

a) checking that the party is accompanied by prescribed documents that the information in the documents correspond to the information shown in the advance review and that the information in the documents is adequate (document control),

b) control of compliance between the party and the accompanying documents (idential control), and

(c) control that the food is suitable for human food and complies with applicable provisions (physical control), including simple investigations on the border control and possibly sampling samples for analysis at the Danish Food Agency’s laboratories.

4) For non-conforming foods from third countries, which are stored or transited to export to third countries, the document and identity control, and any physical control referred to in No. 3.

5) For food returned from third countries, the identity and physical control referred to in no 3(b and c, as well as the document control referred to in §§ 32-36.

3. When import is understood:

1) reception of food at trade,

2) import from third countries of food to free circulation and food for processing under the customs scheme »active preparation«,

3) 3) introduction of non-conforming foods from third countries to transit or storage,

4) in accordance with Chapter 5 and 8-10 of food which is not free of turnover and

5) run or stop according to Chapter 7 of food which is not free of charge.

4. By trade, reception in Denmark is understood in accordance with paragraph 5, of food as,

1) has become the health or identification mark in accordance with the Community provisions of another trade country or a factory vessel registered by another trade country, or

2) originating in third countries and as after veterinary checks are released and resold from the receiving company to Denmark.

5. In a country of trade is understood an EU country, Norway and Andorra, as well as for fish and fish and fish, as well as two shelled soft animals, pigs, sacks and marine snails, also the Faroe Islands and Iceland. These countries together are the field of trade. However, the following areas are not in the field of trade:

1) Faroe Islands (fish and fish goods as well as two shelled soft animals, spikes and marine snails are traded) and Greenland in the Kingdom of Denmark,

2) Ceuta and Melilla in the Kingdom of Spain, and

3) 3) overseas territories and departments in the Republic of France.

6. By third countries, countries are understood outside the field of trade, as referred to in paragraph 5.

7. By transit, land transport is understood from a border control place directly and without the charge through the trade area to another border control location of non-conformed foods originating in a third country determined to a third country after the accession of the border.

8. In non-conforming storage, temporary placement is understood in the veterinary designated warehouse in a free zone, a customs deposit or ship-examination company of non-conformed foods, in accordance with paragraph 15, originating in a third country intended for a third country after the acceptance of the border pet.

(1) A health certificate, hygiene certificate, veterinary document, such as a veterinary supplementary station or other document required under EU legislation or national legislation.

10. For food imported from third countries is understood by a party a quantity of an animal food of the same type and processing rate, which is covered by the same prescribed document, derived from the same sender, is transported with the same means of transport, presented at the same time for veterinary checks and is determined to the same recipient.

11. By destruction, disposal is understood by combustion.

(1) In importers, a person or company is recognised in Denmark, who is in front of the import of food and has received confirmation that the activity is registered in the food region.

(1) By the responsible for the party, the importer or a person or company is recognised in Denmark, as notified by the importer, in front of the import of a specific party.

(1) In terms of food, food is understood that meet applicable legislation for imports to free revenue in the EU.

(1) In non-conformal foods, foods which originate from third countries are understood and which do not meet applicable legislation.

Substances. 16 In non-harmonious foods, foods originating in third countries are understood, and for which national import conditions are established.

(1) By receiving a company that physically receives food by trade or by return or makes a division of a party food received by trade.

(1) In the case of ship-provoking company, a customs declaration is understood with special approval as a Provisional company from Tax to the storage of foods which are determined to supply ships and which must not be translated in the EU.

(1) In composite foods, foods which contain both processed animal foods and vegetable foods, including foods where the processing of primary food is an integral part of the manufacturing of the finished food.

(1) By meat products, products are understood as defined in point 7.1 of Annex I to Regulation (EC) No 853/2004.

(1) For processed products, products are understood as listed under point 7 of Annex I to Regulation (EC) No 853/2004.

(1) For dairy products, products are understood as defined in Section 7.2 of Annex I to Regulation (EC) No 853/2004.

Chapter 2

Trading

§ 3. Food must be accompanied by a health certificate or specially designed commercial documents if there are animal health reasons adopted Community provisions.

Substances. 2. Food, for which the production and marketing rules are not harmonised in the EU, must only be introduced after the prior authorisation of the Food Authority. Application must be submitted via the food region in whose area the importer is located.

§ 4. Receiving companies must inform the food region of receipt or expected receipt of lots of food according to the specifications of the food region.

§ 5. Receive companies must regularly lead a register of received parties food. The register must contain information about importers, date of receipt, product category, number of colli, weight, country of origin, origin and shipping country. The register must be kept by the receiving company for at least 5 years. The registration must be shown on request for the food region.

§ 6. The importer shall, for each party, be received on the receiving company, which own control shall take control of the party to comply with applicable law and enforce the Party. This control must be made before the Party is used or transferred, and it must be ensured that health and identification marks are listed in the food in accordance with applicable legislation.

Substances. 2. The importer shall immediately report irregularities at the party to the food region where the receiving company is located.

§ 7. The food region does non-discriminatory sampling of the received parties food.

Substances. 2. In the event that applicable legislation is not complied with, the food region shall carry out suspected checks, including control during transport and control of transport.

3. If the inspection referred to in paragraph 1 or 2 referred to in paragraph 1 is repeatedly observed irregularity by parties food from the same source of origin, the food region shall take control of subsequent parties of food from this company.

4. Parties that are subject to suspected control or sharpened control are placed under the bracket of the food region.

§ 8. If it is found that a party food does not comply with applicable provisions, the food region shall suspend the Party, including any parts of the Party on the later market, and shall decide that the Party shall not be translated.

Substances. 2. If the shortcomings have been found pursuant to section 6, the food region may not suspend the party.

3. The food region on the importer, that

1) the party is returned within a fixed period of time,

2) The party is processed for pet animals or fur animals within a fixed period of time, or

3) 3) The party is destroyed within a fixed period of time.

4. The food region lays down the detailed terms of return, processing and destruction, including the documentation that the importer must present.

5. Return is subject to the fact that the food region approves an authorisation to return the party which the importer has obtained from the competent authority of the trade country where the origin company is located. The authorisation from the competent authority of the trade country shall contain a specific description of the reason for the importer.

6. If returning or processing for pet animals or fur animals is not possible, or if the food region has agreed to be exceeded, or if the importer provides its immediate consent, the party must be destroyed.

7. The destruction referred to in paragraph 3 shall be carried out under the supervision of the food region.

8. Costs relating to seizure, withdrawal, return, processing and destruction of food are the importer.

(1) In paragraph 8 the amount referred to in paragraph 8.

Section 9. The food region shall appoint the Party and shall decide on destruction within a fixed period of time, including any part of the party on the later market joint if it is found that:

1) substances that may cause one of the diseases referred to in the order of lists of infectious diseases to be allowed to hold animals, or a zoonose or any other relationship that may pose a serious danger to human or animal health, or

2) The party comes from an area where there are suspected or detected eruptions of serious infectious diseases in humans or animals.

Substances. 2. The food region may decide that paragraph 1, no 2 does not apply to foods which are heat treated in Hermetic closed container for a F0- value of at least 3.00 (hounds).

3. The food region lays down the detailed terms of destruction, including the documentation to which the importer must present.

4. The destruction referred to in paragraph 1 shall be carried out under the supervision of the food region.

5. Costs related to seizure, recall and destruction of food are subject to the importer.

6. The amount referred to in paragraph 5 shall apply.

Chapter 3

Import from third countries

Section 10. Foods arriving from third countries must be entered into Denmark in places where there is a border control place in accordance with Annex 2 approved for that food.

Substances. 2. Foods arriving at a border control must be subject to veterinary checks at this border control before the food can be entered into the EU, cf. section 23

§ 11. Food must not be introduced or recovered from third countries to Denmark, unless they have been subject to veterinary checks on a border control at the external border of the trade area.

Substances. 2. Food covered by paragraph 1 which has not been subject to veterinary checks at the external border of the EU, is attached to the food region. The importer shall return or destroy the party in accordance with Section 19.

3. Food originating from third countries received by trade is covered by the provisions laid down in Chapter 2.

§ 12. Food must be accompanied by the original of the prescribed documents to include the prescribed folk and animal health stations for the food concerned.

Substances. 2. The original of the accompanying documents must be delivered to the border veterinarian, which stores the documents on the border control site. The threshold shall hand a confirmed copy of the document to the importer of the party.

3. However, non-conformal foods must always be accompanied by the original of the prescribed documents after the conduct of veterinary checks.

§ 13. The importer shall send a copy of the notification (referred on), which must be done in accordance with Article 2 of Annex III, in Regulation 136/2004 on the arrival of food for veterinary checks.

Substances. 2. The notification referred to in paragraph 1 shall be made on the Danish version.

3. The direction must be correctly completed and without corrections.

4. The border veterinarian or the responsible for the Party shall send the CVED (veterinary control certificate) to the customs authorities at the border control point after the veterinary checks referred to in Article 3(3) of Regulation 136/2004. For parties under customs control, the veterinary inspection certificate shall be applied to the customs document.

§ 14. Mægler, carriers, line agents, carriers, courier companies, courier companies, etc. must submit goods records (cargomanifest) to the border control site of any aircraft or ship, which land in or antag Danmark. This applies, regardless of whether the load or parts thereof remain on board, recharged, imported or transited. The message, which must be designed so that the identity of the aircraft and the product categories clearly appear, must be the border control place in the hedge before the expected arrival of the aircraft.

Substances. 2. Foods in paragraph 1 shall be pre-determined, cf. section 13, unless they become a table.

§ 15. The seas and airports where there is established border control place must be submitted lists of ships or aircraft expected arrival to the border control site. The lists must contain the names of the ships or the route numbers and information on which port or airport they arrive from.

§ 16 The food must be subject to veterinary checks in accordance with the inspection rates set by the Food Authority.

§ 17. Foods that are in transport in international traffic, which arrive from third countries, and which are intended for the preparation of crew and passengers shall not be subject to veterinary checks if they are not in Denmark.

Substances. 2. Food covered by paragraph 1 with the attached one-way packaging, which is emitted in paragraph 1 of that transport means shall be destroyed.

3. Food covered by paragraph 1 may, however, after the prior authorisation of the border animals, be transferred directly from a ship or aircraft in international traffic to another in the same port or airport on the condition that the transfer occurs under customs clearance, and that the food concerned originates either in trade countries or in third countries or parts of third countries approved by the EU in animal health conditions.

4. The destruction referred to in paragraph 2 shall be carried out under the supervision of the food region.

5. Costs relating to seizure, recall and destruction of food in paragraph 2 are the importer.

6. The amount referred to in paragraph 5 shall apply.

§ 18. In the event that applicable legislation is not complied with, the border veterinarian shall carry out suspected checks, including the control of the means of transport.

Substances. 2. If the border veterinarian has drawn samples on the basis of suspicions, the Party shall be placed under the bracket of the border control location or, if this is not possible, on one of the border animals specified stock, which is located in the same food region as the border control.

3. If the veterinary checks are identified a health risk or gross or repeated errors, the limit animal can take effect of subsequent parties of food with the same origin. The threshold lays such parties under bracket. For the coverage of control costs in relation to strict control, a deposit is required.

§ 19. If food in a party does not meet applicable provisions or does not consist of veterinary checks, the border veterinarian shall attach the party. The threshold shall decide that the Party cannot be introduced. The importer gives an invitation to the importer that

1) The party shall be returned within a fixed period of maximum 60 days;

2) The party is processed for pet animals or fur animals within a fixed period of time, or

3) 3) The party is destroyed within a fixed period of time.

Substances. 2. If in paragraph 1 that party has abandoned the border control site, the food region in whose territory the Party is located, the Party and decides that the Party must not be translated. The food region provides tenders as mentioned in paragraph. 1.

3. The food region shall lay down the detailed terms of return, processing and destruction, including the documentation to which the importer must present.

4. Return is subject to the fact that the border veterinarian approves an authorisation to return the party, which the importer has obtained from the competent authority of the third country, whereby the party is requested. The authorisation from the competent authority of the third country shall contain a specific description of the reason for the importer.

5. Return after paragraph 1 must be done from the control point where the food was presented for veterinary checks and with the same type of transport. Return after paragraph 2 must be done from the nearest border control location approved to the control of that food.

6. If returning or processing for pet animals or fur animals is not possible, or if it is determined by the food region, the time limit is exceeded, or if the importer provides its immediate consent, the party must be destroyed.

7. The destruction referred to in paragraph 1 shall be carried out under the supervision of the border animals, respectively.

8. Costs relating to seizures, recall, return, processing and destruction of food are the importer.

(1) In paragraph 8 the amount referred to in paragraph 8.

§ 20. If a party food can pose a danger to human or animal health, the border veterinarian attaches the Party and decides on the destruction of a fixed period.

Substances. 2. If in paragraph 1 that party has abandoned the border control site, the food region is placed in whose territory the Party is located, the Party and decides that the Party must be destroyed, including any parts of the Party in later the recurrent.

3. The threshold, respectively, shall lay down the detailed terms of destruction, including the evidence that the importer must present.

4. The destruction referred to in paragraph 1 shall be carried out under the supervision of the border animals, respectively.

5. Costs relating to seizures, recall and destruction of food are the importer.

6. The amount referred to in paragraph 5 shall apply.

7. For food where there is a content of residue concentrations of certain substances whose use is prohibited or not allowed, over the MRPL, cf. Commission Decision 2002/657/EC with subsequent changes, the border veterinarian shall notwithstanding paragraph 1 decide that the party may be returned or destroyed by section 19.

§ 21. A party food must first be imported or re-exported from third countries, transited, added or otherwise a warehouse covered by section 39 when the importer has paid the cost of veterinary checks after applicable tariffs or provided the appropriate safety for payment of these.

Chapter 4

Import to free circulation of conform foods originating in third countries

§ 22. Import to the free circulation of food originating in third countries must be made on the conditions set out in Annex 4.

§ 23 For food covered by this chapter, which with aircraft or ship arrives at an airport or port, where a border control is established, the veterinary checks may depending on the arrival of the food to the final border control point on the condition of:

1) there is a border control place in the provision airport, which is approved to check that food,

2) The party is transported by the respiratory tract directly to the destination, and

3) 3) The party is transported without charge.

Substances. 2. However, the party may be recharged directly from a plane to another aircraft or directly from a ship to another ship within the same airport or port area, if the importer informs the border veterinarian in advance of the discharge.

3. The border can, if there may be a danger to the public or animal health, make document control of parties, which are either directly or after having been unloaded for a maximum of 12 hours for aircraft freight respectively 7 days for shipping.

4. The threshold makes document control of parties, which in connection with the discharge is unloaded for longer than stated in paragraph. 3. If there may be a danger to the public or animal health, the border veterinarian can carry out identity and physical control of these parties.

5. The veterinary medicinal product performs complete veterinary checks of parties which have been unloaded over 48 hours for aircraft freight respectively 20 days for shipping.

6. In advance, the importer shall notify the border control at the time of inspection by paragraph 3, 4 or 5, cf. section 13.

Chapter 5

Import of non-harmonized foods originating in third countries

§ 24. Importing non-harmonized foods originating in third countries must be made on the conditions set out in Annex 5.

Substances. 2. Importing other non-harmonious foods than those listed in Annex 5, shall only take place after the prior authorisation from the Food Authority. Application must be submitted to the food region where the importer is located.

Chapter 6

Transit and storage of non-conformed foods originating from third countries

§ 25. Non-conforming foods may not be imported to free circulation in Denmark.

§ 26. Non-conformed foods may be transited to another third country or to the same third country if:

1) The food is derived from a third country or part of a third country approved by the EU in animal health conditions. However, meat products must be subject to the minimum processing set by the EU for that third country in accordance with Annex 13.

2) The food on arrival to the EU is accompanied by it at any time by the EU prescribed certificate to be used by transit and storage.

3) 3) In the event that the food is presented for veterinary checks.

Substances. 2. A permit, pursuant to paragraph 1, is subject to the responsibility for the transit of the food in writing to the border animals, declares that the food leaves the trade area within 30 days, and that the food in case of rejection is not returned to the turnover in the field of trade but is returned to third countries. If return to third countries has not happened within 60 days, the food must be destroyed.

3. Food covered by paragraph 1 shall, regardless of Section 16, be subject to document and identity control on the border control. If there may be danger to the public or animal health, or if there is suspected irregularity, the border veterinarian must also submit the food physical control.

4. The transfer must take place without charge in a means of transport or a container which is waterproof, identified and sealed, so that the sealed is broken as soon as the transport center is opened. The food must not be unloaded, divided or handled after the limit animal has sealed the transport.

5. Food covered by paragraph 1 shall only be carried out by the trade area in places where there is a border control place where they must be subject to document and identity control before the output.

6. No. 5 the food can be brought directly to destruction after the prior authorisation from the border veterinarian at the entrance limit control site. The destruction must be carried out under the supervision of the food region.

7. Costs related to seizures, recall and destruction of food in paragraph 6 shall be subject to the importer.

8. The amount referred to in paragraph 7 shall apply.

(1) Non-conformal foods which arrive at a border control site for imports to third countries must be accompanied by the veterinary control certificate issued on the entry limit control site and the original of the prescribed document.

10. The responsible for the transit must, prior to arrival, inform the border control place where the food is requested to arrive food to control.

§ 27 Non-conformed foods may be stored in a warehouse in a free zone, a customs warehouse or a ship-provoking company for the later residual release from the trade area, or transported directly from a border control place to prepare persons in ships in international speed outside the field of trade, if:

1) The food is derived from a third country or part of a third country approved by the EU in animal health conditions. However, meat products must be subject to the minimum processing set by the EU for that third country in accordance with Annex 13.

2) The food on arrival to the EU is accompanied by it at any time by the EU prescribed certificate to be used by transit and storage.

3) 3) In the event that the food is presented for veterinary checks, the transport from the border veterinarian at the point of control where the food is presented for veterinary checks. The authorisation for storage is subject to the responsibility of the Party of the Border Veterinary medicinal product presents evidence that the food region, in whose area the provisional provision is located is not oppose that the food is stored.

Substances. 2. For food covered by paragraph 1, which arrives in Denmark from another trade country, it is obtained in paragraph 1 of that authorisation from the border veterinarian on the border control place, in accordance with Annex 2, which is located almost at the warehouse where the food is to be stored.

3. The Danish Food Agency lays down the requirements for non-harmonized foods, for which no import conditions are listed in Annex 5.

4. Food covered by paragraph 1 shall, irrespective of section 16, be subject to document and identity control of the border control place where the food is presented for veterinary checks. If there may be a danger to the public or animal health, the border animals must also submit to the food physically control.

5. For non-conformal foods to be transported to or from a warehouse, or which must be transported directly from a control point to a ship, in accordance with paragraph 1, the following conditions apply to the given authorisation:

1) The transport of the food must be carried out without charge in a means of transport or a container which is waterproof, identified and sealed, so that sealed is broken as soon as the transport agent or the container is opened.

2) The food must be accompanied by the original of the prescribed documents or for each part a confirmed copy thereof.

3) 3) The food region must only be kept in a warehouse, if the food region has been subject to the food document and identity control. If there may be danger to the public or animal health, the food region must also submit to the foods physical control.

4) The food must be placed in the reserved premises or lockable sections, cf. section 40(2) and 3.

5) The food must not be subject to any other handling than what is necessary for the actual edition and the division of the party in smaller sections without the removal of the packaging.

6. The responsible for the warehouse in a free zone, the customs division or the shipping company must ensure that each unit of stored food is subject to paragraph 1, is clearly and easily readable marked with the run number of the veterinary control certificate, which accompanied the party to the warehouse, so the identification of each unit in the Party is possible.

7. If a party food covered by paragraph 1 during the edition is divided into two or more parties, the owner of the party before the transfer must fill out a pre-purchase, cf. section 13, for each of the new parties for the issue of daughter-veterinary checks certificates. If the Party is to be brought out of the trade area, the owner of the Party must be submitted in advance from which the border control place the food leaves the EU.

§ 28 Non-conformed foods that are stored in a warehouse in a free zone or a customs warehouse must only be attributed to the transfer to a shipping company or export to a third country. The transfer to the shipping company shall take place on the basis of a T1 shipping procedure after the customs rules.

Substances. 2. The supply of non-conforming foods from a warehouse in a free zone or customs warehouse for storage in a shipping company is subject to the owner of the party of the food region, the evidence that the food region, in whose territory the ship-examination company is located, does not oppose that the food is stored.

3. The supply of non-conformal foods from a warehouse in a free zone or customs warehouse for the supply of the trade area must only be done after the prior authorisation of the food region in the warehouse. Such authorisation is subject to the fact that the owner of the party in writing to the food region declares that the food leaves the trade area within 30 days, and that the food in the event of rejection is not returned to the turnover of trade but is returned to third countries. If return to third countries has not happened within 60 days, the food must be destroyed. The food must only be carried out by the trade area in places where there is a border control place where they must be subject to document and identity control before the output.

4. The responsible for the Party shall notify, in accordance with Section 13, the border control place where the food is requested, that food will arrive at control.

5. Non-conformed foods that are stored in a ship-provoking business may only be emitted in order to export to persons in ships in international speed outside of the field of trade, possibly after temporary storage in specially approved prospections in the port where the prospect of the ship is carried out.

6. Non-conforming foods may only be subject to a warehouse in a free zone, customs warehouse or a ship-provoking company whose food region has been subject to the food document and identity control. If there may be a danger of folk– or animal health, or if there is suspected irregularity, the food region must also submit the food physical control.

7. The discharge according to paragraph 1 and 5 shall be carried out without the discharge in a means of transport or a container which is waterproof, identified and sealed, so that the sealed is broken as soon as the transport agent or the container is opened. The food must be accompanied by the original of the prescribed documents or for each part of a confirmed copy thereof.

8. No one and 5 can be discharged after the prior denaturation occurs for destruction. The destruction must be carried out under the supervision of the food region.

(1) Costs related to the destruction of food according to paragraph 3 and 8 shall be subject to the importer.

10. The amount referred to in paragraph 9 shall apply.

§ 29 Non-conformal foods must at any time be accompanied by an veterinary inspection certificate, in accordance with paragraph 2. 2. The veterinary inspection certificate must refer to the customs document.

Substances. 2. However, non-conformal foods that are emitted from a ship-provoking company for the supply of persons in ships in international speed outside of the field of trade shall be accompanied by a certificate of propagation, in accordance with the model issued by the food region. This also applies even if the food is subsequently stored temporarily in a special approved proviation warehouse, in accordance with Section 28, 5.

3. Non-conformal foods which are transported directly from a border control place to a ship in order to prepare people in ships in international speed outside of the trade area must be accompanied by as well as an veterinary control certificate as a propagation certificate. Both certificates are issued on the control site.

4. Immediately after a party non-conforming food is provided on a ship, the ship operator or its representative shall date and consign the proviant certificate, in accordance with paragraph 2 and 3, which accompanies the party, and return the consigned certificate to the food region issued by the certificate. The carrier’s consignment is not necessary if the certificate is already consigned by a representative of the competent authority of the port where the prospector takes place.

§ 30. Transport funds and containers used for transport or storage of the food referred to in this chapter must be thoroughly cleaned and disinfected before they can be used for transport or storage of food.

Chapter 7

Transport of food from third countries to third countries in transport means, which intermediaries in or undertakes Denmark

§ 31 Transport with food transported from third countries to third countries may only intermediaries in or inlet Denmark if:

1) There is a border control place approved to check that food.

2) The food is derived from a third country or part of a third country approved by the EU in animal health conditions. However, meat products must be subject to the minimum processing set by the EU for that third country in accordance with Annex 13.

3) 3) The food on arrival to the EU is accompanied by it at any time by the EU prescribed certificate to be used by transit and storage.

4) In the event that the transport center is obtained from the border veterinarian at the point of control, where the transport agent betweenlander in or antag Denmark.

Substances. 2. A permit, pursuant to paragraph 1, is subject to the responsibility of the transport of the Party in writing to the border animals, declares that the food leaves the trade area within 30 days, and that the food in case of rejection is not returned to the market in the field of trade but the return to third countries. If return to third countries has not happened within 60 days, the food must be destroyed.

3. If the party is omitted directly from one plane to another aircraft or directly from a ship to another ship within the same airport or port area, the responsible for the transport must inform the border veterinarian accordingly prior to the discharge.

4. The border can, if there may be a danger to the public or animal health, make document control of parties, which are either directly or after having been unloaded for a maximum of 12 hours for aircraft freight respectively 7 days for shipping.

5. The threshold makes document control of parties, which in connection with the discharge is unloaded for longer than stated in paragraph. 4. If there may be a danger to the public or animal health, the border veterinarian can carry out identity and physical control of these parties.

6. The veterinary medicinal product performs complete veterinary checks of parties which have been unloaded over 48 hours for aircraft freight respectively 20 days for shipping.

7. The responsible for the Party must in advance notify the border control when checking after paragraph 4, 5 or 6.

8. Costs relating to the destruction of food according to paragraph 2 shall be subject to the importer.

(1) In paragraph 8 the amount referred to in paragraph 8.

10. This chapter does not concern non-conformed foods which are introduced from third countries in order to export to persons in ships in international speed outside the field of trade. Such food is covered by the provisions of Chapter 6.

Chapter 8

Return

§ 32. Application for authorisation to carry food for veterinary checks for re import from third countries must be made on a form as it in Annex 7 showed model. The responsible for the party must ensure that all rubriches on the form are filled before it is sent to the border veterinarian at the control point where the food is requested.

Substances. 2. Permission after paragraph 1 is given on the basis of

1) an assessment of the animal health conditions in countries where food has been transported or stored;

2) original copy, one of the authority of third countries confirmed copy or one of the issued food region confirmed copy of the export certificate accompanying the food by the output;

3) 3) a declaration of third-country authority guaranteeing that the conditions for the storage and transport of the products have been complied with, and in which it was specified that the deed foods have not been handled, and for the party of authority rejected a justification for the rejection, and

4) Do not know stacked containers, a certificate from the home transport company that the content has not been handled or unloaded.

3. 2. No. 3 does not apply to a return on transport where the content has not been handled or unloaded.

§ 33. Foods that the border animals have allowed to carry out veterinary checks after section 32 shall be pre-determined, cf. section 13.

§ 34. The veterinary medicinal product shall decide on the basis of the veterinary checks, whether it is permitted to return.

Substances. 2. Permission is subject to the responsibility for the Party of the Border Veterinary Clinic to provide documentation that the food region where the provision company is located does not oppose that the food is stored.

3. The threshold lays down the detailed conditions for the authorisation, including the food is transported directly to the provision company without the charge of a means of transport or in a container which is waterproof, identified and sealed by the border veterinarian so that the sealed is broken as soon as the transport center or container is opened.

§ 35. §§ 32-34 also applies to return to another trade country via Denmark. However, in section 34(2), the documentation referred to in Article 34(2) shall be obtained in the competent authority of the trade country whereby the party is requested.

Substances. 2. Permission to return to another trade country via Denmark is subject to the fact that the owner of the Party has in front of the receiving Member State’s competent authority in writing has notified the border veterinarian consent to the repurification.

3. Return from a third country to Denmark via another trade country of a party food must only be done after prior authorisation from the food region where the receiving company is located.

4. Application for authorisation after paragraph 3 shall be made on a form as it in Annex 7 shown model. The application must be supplemented with information on, at which the border control place the party is requested. The responsible for the party must ensure that all rubriches on the form are filled before this is sent.

§ 36. Return from a trade country to Denmark by a party food must only be done after the prior authorisation of the food region, in whose area the company, which revolves the party is located.

Substances. 2. Application for authorisation to re-enter food must be made on a form as it in Annex 7 shown model. The responsible for the party must ensure that all rubriches on the form are filled before this is sent.

3. Permission is subject to the responsibility for the Party over the food region to provide evidence that the food region in whose area the receiving company is located is not oppose that the food is stored.

4. The food region has allowed to reintroduction must be pre-determined to the food region by the receiving company, the food is reloaded. The review must be the food region in the event no later than a working day (day – Friday) before the expected arrival of the party and must contain information about the expected arrival date and time. The notice must be attached to the copy of the authorisation given after paragraph. 1.

5. The responsible for the party shall ensure that a report has been submitted to the return of the food on the receiving company. The report must be sent to the food region where the receiving company is located.

6. The foods referred to in paragraph 1 shall not be taken into use or transferred before the food region has permitted.

Chapter 9

Private import

§ 37. Private import of food from other trade countries or San Marino may, whether the recipient is not registered, take place without permission and without quantity restriction and is exempt from the provisions of Chapter 2 when the following conditions are met:

1) The food is inserted into your own baggage in connection with entry or in the immediate connection to the entry or received as packages.

2) The food is intended for your own use.

Substances. 2. (1) 1 does not apply to trade countries for which restrictions have been introduced, as a result of suspected or certainty for risks to public or animal health.

3. Meat and meat products as well as milk and dairy products imported to Denmark directly from a third country, in accordance with the conditions laid down in Regulation No 745/2004, Art. 1(2), and therefore not exempt from the rules of Chapter 3, shall not be pre-subscribed according to the rules of Section 13. Instead, no later than the working days (day Friday) must be ordered prior to arrival in writing at an inspection point, in accordance with Annex 2.

4. Private import of food from third countries after Regulation No 136/2004, art. 8, is exempt from the provisions of advance review and veterinary checks in 10 10-13 and 16, if the food is entered into own baggage in connection with entry or in immediate connection with entry or received as packages sent from third countries.

5. Private import of food from third countries shall not be made from third countries, for which restrictions have been introduced, as a result of suspected or certainty for risks to public or animal health.

6. Import by paragraph 3 and 4 from Faroe Islands or Greenland can be made as a link to several people to one address is permitted if

1) The shipment is accompanied by an overview, the name and address of all recipients of the food of the shipment clearly stated,

2) The shipment is divided into single packages of each maximum 5 kg,

3) 3) The recipient shall deliver intact single packages as referred to in Article 2 to the final recipient, cf. 1,

4) effect after the input only occurs at the final recipient,

5) food is intended for own use and

6) each recipient receives a maximum 5 kg of the shipment.

7. Import by paragraph 3 and 4 from Faroe Islands or Greenland can be done via an association if

1) The shipment is divided into single packages of each maximum 5 kg,

2) The association shall deliver intact single packages, cf. no. 1 to registered members of the association,

3) 3) The association does not receive payment for delivery after no. 2,

4) effect after the input only occurs at the final recipient,

5) food is intended for own use,

6) each member receives maximum 5 kg of the shipment,

7) The association reports the activity to the food region where the association is located,

8) The association regularly records the quantities that for each set party are conveyed to each member;

9) The association on request lists it in no. 8 that registration, and

10) The association shall report for each quarter of the registration after 8 to the food region where the association is located. The report shall be made no later than 10th of the subsequent month.

8. Import to Denmark directly from a third country to private use of food that cannot be introduced after the other pieces of this paragraph shall only be done after the prior authorisation of the food region. 3 applies to similar use.

(1) Foods wished in accordance with this paragraph may be taken into account veterinary checks.

10. Food to be destroyed by Art. 4 of Regulation No 745/2004 shall be destroyed according to the rules laid down in section 9 respectively Section 20.

11. Costs related to seizures and destruction of food are the responsibility of importing the food.

(1) There is a discharged for those in paragraph. 11 the amount referred to.

(1) Providers of international passenger transport as well as airports and ports must be on one of the customers or passengers visibly place the posters that inform the content of this paragraph, and as they are sent by the food region. The food region may set conditions for the suspension, including during which time the posters must be suspended.

Chapter 10

Samples etc.

§ 38. The import of foods originating in other trade countries, which are tested for analysis, use for exhibitions and use in embassies in Denmark can, regardless of the recipient is not registered and the food is not a health or identification mark, be done without authorisation and without quantity restriction.

Substances. 2. (1) 1 does not apply to trade countries for which restrictions have been introduced, as a result of suspected or certainty for risks to public or animal health.

3. Importing of food from third countries as a test for analysis, use to display exhibitions and use in embassies in Denmark must only be done after the prior authorisation of the food region, in whose area the company receives the test is located. The authorisation is subject to the responsibility for the Party to document that the food concerned originates from third countries or parts of third countries approved by the EU in animal health or originating in Greenland, Faroe Islands or Iceland. Food that has undergone a heat treatment in hermetic closed containers for a F0 - value of at least 3.00 (all conserves) as well as honey, can be allowed introduced from all third countries. Permission can be given regardless that the recipient is not registered and the food is not a health or identification mark.

4. Permission may not be granted for food from third countries, for which restrictions have been introduced due to suspicions or certainty for risks to public or animal health.

5. License after paragraph 3 is given on the terms referred to in No 1-3.

1) The product must only be used for the specified purpose and not to be placed on the market or distributed, as the distribution of flavor samples on the site is permitted.

2) The packaging and residues of the product sample, except for the parts used by analysis, shall be destroyed or returned, cf. section 19(3) and 6-9.

3) 3) Claims that have been in touch with the test, as well as their surroundings must thoroughly be cleaned and disinfected.

6. When applying for 3 on imports of foods which have not originating in third countries or parts of third countries approved by the EU in animal health conditions, or have not originating in Greenland, Faroe Islands or Iceland is permitted by the Danish Food Agency’s assessment of the animal health situation in that third country.

7. However, import to Denmark of the samples referred to in paragraph 3 or six of the goods referred to in another trade country can be done after the prior authorisation of the food region in whose territory the company receives the product sample is located. The owner of the sample must, together with the application to the food region, in writing, be responsible for the conditions referred to in paragraph 5, No 1-3.

Chapter 11

Veterinary discharge of tariffs, etc.

§ 39. Companies used as warehouses in a free zone, customs warehouses, shipping company and special approved prospectuss, the veterinary must be identified by the Danish Food Agency prior to non-conforming food. The veterinary posting includes only the foods covered by the customs grant.

Substances. 2. Request for posting pursuant to paragraph 1 shall be sent to the Food region on a form, in accordance with Annex 8 shown model. The request must be accompanied by a copy of the grant from the customs and tax authorities.

3. The request must be subject to documentation that there is a local of appropriate size available to the personnel carrying out the veterinary checks. The room must be reserved for this staff.

§ 40. Owners of the companies referred to in section 39(3) of paragraph 39 shall ensure that the room referred to in section 39(3) which contains at least:

1) a phone,

2) a telefax,

3) 3) a computer for receiving and sending TRACES messages, and

4) other appropriate office facilities.

Substances. 2. Storage in free zones, customs layers and ship-provoking companies identified by the Food Agency for the storage of non-conformal foods must be advised against separate storage rooms which are reserved for non-conforming food.

3. Storage in free zones, customs layers and ship-provoking companies designated by the Danish Food Agency before 1 January 2000, must be advised at least by lockable sections for the storage of non-conforming food. Layers that make significant building changes must be identified in new and must in this regard meet the conditions set out in paragraph. 2.

4. Owners of companies designated according to section 39(1) must lead daily records of food, which is added to the warehouse. The register, which must be stored in the warehouse for at least 5 years, must include at least the following information:

1) For food that is added:

a) date of food import to the warehouse,

b) the nature of food,

(c) the amount of food in kg/liter,

d) country of origin,

e) entrance limit control location and

(f) The run number of the veterinary control certificate accompanying the food to the warehouse.

2) For food that is deducted :

a) date of the food import from the warehouse,

b) the nature of food,

(c) the amount of the food in kg/liter, and

d) The run number of the veterinary control certificate or the certificate of propagation accompanying the food from the warehouse.

3) 3) For food that is emitted in order to export to third countries, the name of the provisional country and the exit limit control site.

4) For food that is deducted from the warehouse to transfer to a ship’s Lieutenant-chief sheriff Astronomical Subsequent Disorder, including the reference number as well as the name and address of the ship’s shipping officer’s throw-in quarantine imparteditional spherical.

5) For food that is deducted from the warehouse for the preparation of persons in ships sailing in international speed outside the field of trade, also the name of the provision vessel.

6) For food that is discharged to destruction, also name and address of the destruction or incineration measure.

§ 41. The Danish Food Agency may change or revoke the posting of warehouses, customs warehouses, ship-examination companies, and specially approved provianter.

Chapter 12

Sealing

§ 42. The food region, including the border animals, sealing of transport or parties of animal food, must only be broken by the food region or the competent authority of another trade country.

Substances. 2. Subsequently, in relation to veterinary checks in other trade countries, the food is released for free circulation.

3. (1) 1 shall not apply to parties, which, in accordance with the field of trade, shall be carried out by persons in ships in international speed outside the field of trade.

Chapter 13

Transition and exemption provisions

§ 43. Gelatine produced before 1 June 2000, and which is not accompanied by the prescribed document referred to in Annex 4 shall be accompanied by a declaration signed by the competent authority of the country of origin, the origin and the manufacturing date.

Substances. 2. The period produced before 31 December 2003 and which is not accompanied by the prescribed document referred to in Annex 4 shall be accompanied by a declaration signed by the competent authority of the country of origin, the origin and the manufacturing date.

§ 44. The Danish Food Agency may dispens from the provisions of 8-9, § 13(1), Paragraph 15, §§ 19-20, § 32, §§ 34-36, § 38 and § 42.

Substances. 2. The food regions can dispens from the provisions of section 32(2), no. 3.

Chapter 14

Criminal and entry into force rules, etc.

§ 45. With fine, it is punished:

Substances. 2. The punishment may rise to prison for until 2 years if the breach is committed intentionally or grossly negligent, and if there is a breach of infringement

1) cause harm to health or recalled danger; or

2) obtained or attracted an economic advantage for the individual or others, including savings.

3. Companies may apply (juridical persons) criminal liability after the rules of the 5th Chapter of the Criminal Code.

§ 46. Unless higher punishment is undermined by the other legislation, the fine which infringes the following provisions of the Commission Regulation (EC) # 1093/94 of 6 May 1994 fixing the conditions for third countries fishing vessels to land their catches directly and on them in Community ports:

1) Article 1,

2) Article 3, or

3) 3) Article 4.

§ 47. Unless higher punishment is dismissed by the other legislation, the fine which infringes the following provisions of the Commission Regulation (EC) 999/2001 of 22 May 2001 fixing rules on the prevention of, control and eradication of certain transmissible spongiforme encephalopatier:

1) Article 16(2) and 5-6,

2) Articles 17, 2, paragraph, or

3) 3) Article 18.

§ 48. Unless higher punishment is undermined by the other legislation, the fine which infringes the following provisions of the Commission Regulation (EC) # 136/2004 of 22 January 2004 on the procedures for the veterinary checks of third countries:

1) Article 1-5,

2) Article 8, or

3) 3) Article 10.

§ 49. Unless higher punishment is undermined by the other legislation, the fine which infringes the following provisions of Commission Regulation (EC) No 745/2004 of 16 April 2004 on measures relating to imports of animal products for its own consumption:

1) Article 1(2) and 3,

2) Article 3, or

3) 3) Article 4.

§ 50. The decision shall enter into force on 16 August 2008.

Annex 4

Import conditions for harmonised foods from third countries

GENERAL
This Annex lays down the specific conditions which, in addition to general conditions in e.g. 11 of Regulation 178/2002 applies to imports to free circulation of harmonised foods from third countries.
Cordage documents
Food must be accompanied by it at any time by the EU prescribed document. In addition to general requirements for accompanying document in Directive 2002/99, Art. 9, in accordance with Annex IV and Regulation 853/2004, Art. 6, in accordance with Regulation 854/2004, Art. 14, in accordance with Annex VI, they shall at any time of the EU prescribed specific requirements for accompanying documents, including health certificates, shall be fulfilled.
In addition, aquaculture animals and products must be accompanied by an animal health certificate in accordance with Directive 2006/88/EC.
Approved origin
Food covered by this notice shall only be introduced from approved companies in approved third countries, in accordance with Article 6 of Regulation 853/2004. Approved third countries appear in the third country lists of Annex 9-20.
Gelatine and collagen must be introduced from approved companies in Malaysia, Pakistan, South Korea and Taiwan as well as third countries listed in the list of Annex 9M ownership products included in the composite foods referred to in Annex 1, Part II, No 2 and 3 shall be derived from third countries listed in Annex 15 and where import is permitted.
General animal health provisions
Animal foods may only be imported to free circulation if they come from production, impact and distribution joints that meet the following provisions, or if appropriate animal health guarantees:
1)
Leaders of food companies must ensure that there is no spread of diseases that can be transferred to animals in all parts of production, impact and distribution of animal foods.
2)
Animal foods must be made of animals that meet the animal health conditions laid down in the relevant Community rules.
3) 3)
Animal foods must be made of animals:
a)
from a holding, a company, an area or part area which is not subject to animal health restrictions for the animals and foods laid down in accordance with Annex Directive 2002/99/EC referred to in Directive 2002/99/EC.
b)
in respect of meat, and food made thereof, not derived from animals that have been slaughtered at a butchery, where at the time of the slaughter or during the production process animals were infected with or suspected to be infected with one of the diseases covered by those in Annex In Directive 2002/99/EC the provisions referred to in Directive 2002/99/EC, or the slaughter bodies or parts thereof of such animals, unless this suspicion has been eliminated.
(c)
Whereas aquaculture animals and products comply with the provisions of Directive 2006/88/EC.
Import to the free turnover of aquaculture products that do not meet the conditions set out in No 1-3 is possible if they meet the conditions of Directive 2006/88/EC.
Human life
The flesh of cattle, pigs, sheep, goats, hoards and poultry kept as livestock as well as breeding rabbits and breeding wild, including the meat of breeding peacocks, must only be introduced if the accompanying health certificate is provided with a attestation that the meat originates from animals slaughtered under conditions which ensure at least the same human treatment as the specified in Directive 93/119/EC of 22 December 1993.
ENZYMER OF ANIMALSK ORIGINAL
Fully purified enzyme of animal origin must be introduced from all third countries. Enzymet must be accompanied by documentation, where the enzyme is fully cleaned.
AKVAKULTURDYR AND AKVAKULTURPRODUKTER
Special conditions for importing aquaculture fish products for consumption
In.
The processing of aquaculture fish products of species which are susceptible to EHN, ISA, VHS and IHN shall take place on approved import centers unless:
1)
The fish have been cleaned before they were shipped to the EU, or
2)
health status on the origin site of third countries with regard to EHN, ISA, VHS and IHN corresponds to health status in the place where they are to be processed.
II.
Partys of fish species received for ISA or EHN must in accordance with the provisions of section. In addition, we also satisfy the following conditions:
1)
The competent authority of the origin Member State shall have recognised the place of origin as free of those diseases under EU legislation or the relevant OIE standard;
2)
the fish must be cleaned before sending, or
3) 3)
The party must be sent directly to an approved import center where the fish are further processed.
III.
Partys of fish species that are susceptible to VHS or IHN, and imported to EU countries or zones in EU countries declared free of those diseases or are covered by a programme in order to acquire status judgment of disease-free, shall be beyond the ones referred to in section. In addition, we also satisfy the following conditions:
1)
The competent authority of the origin Member State shall have recognised the place of origin as free of those diseases under EU legislation or the relevant OIE standard;
2)
the fish must be cleaned before sending, or
3) 3)
The party must be sent directly to an approved import center where the fish are further processed.
Special conditions for imports of living toy soft animals and marine snails from aquaculture use to consumption
In.
Parties of soft animals received for one or more of the exotic diseases referred to in Annex IV, Part II of Directive 2006/88/EC shall comply with the following conditions:
1)
They shall come from a place where there is no abnormal mortality without explanation, and as the competent authority of the origin period has recognised as free of those diseases under EU legislation or the relevant OIE standard;
2)
they must be imported as processed or unprocessed products as defined in Article 2(1) of Regulation (EC) No 854/2004, or
3) 3)
they shall be sent directly to an approved import centre where the soft animals are further processed, in accordance with Section VII of Annex III of Regulation (EC) No 853/2004 and Article 6 of Regulation (EC) No 854/2004.
II.
Partis of soft animal species that are susceptible to infection with Bonamia ostrea or Marteilia Refringens, and imported to EU countries or zones in EU countries declared free of those diseases or are covered by a programme in order to acquire the status of disease-free under Directive 2006/88/EC, shall comply with the following conditions:
1)
The competent authority of the origin Member State shall have recognised the place of origin as free of those diseases under EU legislation or the relevant OIE standard;
2)
they must be imported as processed or unprocessed products as defined in Article 2(1) of Regulation (EC) No 854/2004, or
3) 3)
they shall be sent directly to an approved import centre where the soft animals are further processed, in accordance with Section VII of Annex III of Regulation (EC) No 853/2004 and Article 6 of Regulation (EC) No 854/2004.
The conditions in paragraph I and II shall not apply if the soft animals are emballed and the mark ready for sale to the final consumer in accordance with Regulation (EC) No 853/2004.
Special conditions for importing live aquaculture fish
1)
The fish must meet the guarantees, including the packing and labelling guarantees and the special supplementary conditions laid down in animal health certificate, in accordance with Annex II and III of Decision 2003/858/EC and must be accompanied by this animal health certificate,
2)
The fish must be transported under conditions that do not change their health status and
3) 3)
The fish must be sent directly from the border control where the fish were subject to veterinary checks, to an approved import center to be slaughtered and cleaned.

Annex 5

Import conditions for non-harmonized foods from third countries

GENERAL
If there is no import conditions for a food, import must only be done after the prior authorisation from the Food Authority. Application must be submitted via the food region in whose area the importer is located. Food must not be processed to other EU countries, Norway or Andorra.
KØD
Meat of marine mammals from Greenland
The meat of marine mammals from Greenland must only be introduced if the meat is derived from animals treated on one of the Danish Food Authority authorized gambling companies. The flesh must be accompanied by a certificate certified by the competent authority. The certificate must contain the information included in the health or identification label for the product, and for frozen meat a clear indication of the month and year of freezing. It must be certified in the certificate that the exporting company complies with the conditions of authorisation. The meat may not be processed to other EU countries, Norway or Andorra, unless the exporter submits a declaration for the food region from the veterinary authorities of the Member State concerned with an acceptance of the receipt.
Meat of crocodiles
Fersk, including chilled, frozen and deep-frozen meat of breeding crocodiles from third countries, can be entered on the following terms.
The meat must be subject to veterinary checks upon arrival to Denmark.
The meat may not be processed to other EU countries, Norway or Andorra, unless the exporter submits a declaration for the food region from the veterinary authorities in that Member State with an acceptance of the receipt.
The flesh must be accompanied by a health and hygiene certificate issued by the competent authorities of the country of origin and signed by an official, of which the following information is stated:
1)
The country of origin of the animals.
2)
One of the EU set totestation for human slaughter.
3) 3)
The meat comes from animals from breeding under official veterinary checks.
4)
The animals are slaughtered and treated on companies authorised by the competent authorities of the country and under their supervision.
5)
The animals have been subject to veterinary ante and post mortem control, so that the animals are found healthy and the meat suitable for consumption.
6)
The flesh has been examined and has been found free of trikines or has been frozen to ensure the killing of any trikines according to the conditions of Annex I, Chapter IX, point C, in Regulation 854/2004.
7)
The flesh has been frozen to ensure the killing of any kindworm (Spirometra erinacei) (min. -10C for 24 hours).
8)
The flesh has been examined and is found free from salmonella. The technique must be taken into account the possibility of detection of Salmonella Subgroup III with slow lactation by supplementing the use of Bismuth Sulfit Agar.

There is no minimum temperature or other treatment of animal health for meat products and treated stomachs, blisters and intestines. However, the flesh of such meat products and treated stomachs, blisters and intestines must have undergone such treatment that the cut surface shows that it no longer has fresh meat characteristics, and the fresh meat must also satisfy the animal health rules applicable to the export of fresh meat to the Community.
Specific treatment arrangements - in falling order by strictness
