Pursuant to § 37, § 67 and section 70 (3) of law No. 432 of 9. June 2004 on the keeping of animals as well as section 36, paragraph 1, article 37, paragraph 1, article 39, § 41, section 45, paragraph 2, article 49, § 50, section 51, section 52, paragraph 2, article 54, paragraph 4, article 60, paragraph 3, of law No. 526 of 24. June 2005 on food (food law), as amended by Act No. 1549 by 20. December 2006 and law No. 110 by 26. February 2008, fixed:

Chapter 1

Scope and definitions

§ 1. The Ordinance covers any kind of imports into Denmark in annex 1, part of the listed foods as well as berthing of vessels from third countries in Danish ports and landing of aircraft from third countries in Danish airports.

(2). The foods listed in annex 1, part II, are not covered by the Ordinance

§ 2. At the border veterinarian means a food the region employed by official veterinarian at a border inspection post without prejudice. Annex 2.

(2). By veterinary checks shall mean:





1) For food, which is received in the course of trade, food of the region





a) non-discriminatory random checks at the place of destination,

b) control including control during transport, suspicion or

c) stricter control.





2) For food, which is returned from partner countries, food the region's control of the company receive control.

3) For food imported from third countries, the border veterinarian





(a) the control of that party) is accompanied by the required documents, the information contained in the documents correspond to the information contained in the prior notification, as well as to the information in the documents is adequate (document control),

b) check that there is consistency between the party and the accompanying documents (identity checks), and

c) control of that food is fit for human consumption and comply with the provisions in force (physical checks), including simple investigations at the border inspection post and, where appropriate, taking samples for analysis in the laboratories of the veterinary and Food Administration.





4) For non-conformist foods from third countries, which must be stored or transported siteres for export to third countries, the documentary and identity checks as well as any physical checks referred to in point 1. 3.

5) For food, which is returned from third countries, the identity and physical checks, as referred to in point 1. 3 (b) and (c), as well as the documentary checks referred to in §§ 32-36.





(3). On importation means:





1) receipt of food in the course of trade,

2) imports from third countries of food products into free circulation as well as food for the treatment under the Customs inward processing ', ' scheme

3) introduction of non-compliant food from third countries of transit or warehousing,

4) introduction pursuant to chapters 5 and 8-10 of foods, which are not released for free circulation, and

5) berthing or stopover in accordance with Chapter 7 of the foods that are not released for free circulation.





(4). In the course of trade means reception in Denmark, see. (5) of the food which,





1) has been health or identification mark in accordance with the Community provisions in a company in another country or trade a factory ship, which is registered by another country, trade or

2) originating in third countries, and which, after the veterinary control is released and resold from receiving company to Denmark.





(5). By a trading country means a country of the European Union, Norway and Andorra, as well as for fish and fishery products and bivalve molluscs, echinoderms, tunicates and marine snails in addition, Faroe Islands and Iceland. These countries collectively termed the trade area. The following areas are not, however, included in the trade area:





1) Faroe Islands (fish and fishery products and bivalve molluscs, echinoderms, tunicates and marine snails are, however, trade) and Greenland in the Kingdom of Denmark,

2) Ceuta and Melilla in the Kingdom of Spain and

3) overseas territories and departments of the Republic of France.





(6). By third countries be understood outside the trading area, see. (5).

(7). For the purposes of transit by land transport from a border inspection post directly and without reloading through the trade area to another border inspection post by non-conformist foods originating in a third country and intended for export to a third country after border veterinarian acceptance.

(8). By non-conformist storage means temporary location in veterinary designated warehouse in a free zone, a customs warehouse or skibsprovianterings company of non-compliant food, see. paragraph 15, originating in a third country and intended for export to a third country after border veterinarian acceptance.

(9). By prescribed document means a health certificate, health certificate, veterinary document URf.eks. a veterinary supplementary attestation or any other document required under Community law or national law.

Paragraph 10. For foodstuffs imported from third countries for the purposes of a party an amount of an animal food of the same type and processing level, which is subject to the same statutory document, originating from the same sender, transported by the same means of transport, are presented at the same time for veterinary checks and are destined to the same consignee.

Paragraph 11. Destruction means disposal by incineration.

Paragraph 12. By importer means a person or company resident in Denmark, causing the importation of foods, and which has received confirmation that the activity to be registered with the food the region.

Paragraph 13. By the responsible party for the purposes of the importer or any person or entity resident in Denmark who, empowered by the importer, which give rise to the import of a specific party.

Paragraph 14. By conformist food means food that complies with applicable law for import for free circulation in the EUROPEAN UNION.

Paragraph 15. By non-conformist foods means food originating in the third country, and which do not comply with current legislation.

Paragraph 16. By non-harmonised food means food originating in the third country, and for which alone is established national import conditions.

Paragraph 17. By the recipient company shall mean a company which is physically receive food through trade or by return or make a splitting of a consignment of food, which is received in the course of trade.

Paragraph 18. By skibsprovianterings company means a customs warehouse with a special approval as victualling business from Tax for the storage of foods, which are intended for delivery to ships, and which must not be put into the EU.

Paragraph 19. By compound foods means food containing both processed foodstuffs of animal and plant foods, including foods, where processing of primary fødevaren is an integral part of the manufacturing process of the finished food.

Paragraph 20. By meat products means products as defined in point 7.1 of Annex i to Regulation (EC) No 1782/2003. 853/2004.

Paragraph 21. By processed products means products as indicated in point 7 of annex I to Regulation (EC) No 1782/2003. 853/2004.

Paragraph 22. By milk products means products as defined in point 7.2 of annex I to Regulation (EC) No 1782/2003. 853/2004.

Chapter 2

Trade

§ 3. Foods must be accompanied by a health certificate or specially crafted trading documents, if there for animal health reasons is adopted Community provisions to that effect.

(2). Foods for which the production and marketing rules have not been harmonised in the EUROPEAN UNION, should only be introduced after prior permission of the veterinary and Food Administration. Application must be forwarded via the food region, in the territory of which the importer is located.

§ 4. Receive business operators shall, on request, inform the food region of receipt or expected receipt of batches of food after food the region's specifications.
§ 5. Receive business operators must keep a register of received batches of food. The register shall contain information about the importer, date of receipt, product category, number of packages, weight, country of origin, country of origin business and exporting country. The register shall be kept by the receiving company for at least 5 years. Registered must on request be presented food region.

§ 6. The importer must, for each lot, which is received on the recipient undertaking which self-monitoring inspection of that the party complies with applicable law and inspect the lot. This control must be carried out before the party used or transferred, and it must be ensured that health checks and identification marks appearing on foodstuffs in accordance with the applicable legislation.

(2). The importer must immediately report any irregularities in the party for the food region, where operator is located.

§ 7. Food region shall carry out non-discriminatory spot checks of the received consignments of food.

(2). Suspected that the current legislation has not been complied with, the food the region make suspicion control, including control during transport and control of the means of transport.

(3). If in accordance with paragraph 1 or 2 shall control is found repeated irregularities in batches of food products from the same origin company, making food the region tighter control of subsequent batches of food products from this company.

(4). Parties subjected to suspicion of control or tighter controls, placed under the bracket of the food the region.

§ 8. If it is established that a party food does not comply with the provisions in force, seizes food region party, including any parts of the lot in downstream, and decides that the party does not need to be translated.

(2). If deficiencies are found under section 6, the food the region failing to seize the party.

(3). Food the region requiring the importer to





1) party returned within a prescribed time frame,

2) party rendered into pet food or fur animals, within a set time limit, or

3) the party must be destroyed within a prescribed time frame.





(4). Food region lays down the procedures for the return, reprocessing and disposal, including the documentation submitted by the importer to submit.

(5). Return is conditional on the food the region approves an authorization to return the party to which the importer has obtained from the competent authority of the country where trade establishment of origin is located. Authorisation from the competent authority of the country of trade shall contain a specific description of the of the importer reported rejection reason.

(6). If the return or reprocessing for pet food or fur animals is not possible, or if the food the region required time limit is exceeded, or if the importer gives his immediate consent, the lot must be destroyed.

(7). Destruction, as referred to in paragraph 3, no. 3, and (6) shall be done under the supervision of food region.

(8). Costs in connection with the seizure, revocation, return, reprocessing and the destruction of foodstuffs is the responsibility of the importer.

(9). There are udpantningsret for the amount referred to in paragraph 8.

§ 9. Food the region seize the party and shall decide on the destruction within a prescribed time frame, including any parts of the lot in downstream, where it is found that:





1) who in the party seems to substances, which can cause one of the diseases referred to in the notice on the lists of infectious diseases to the law on the keeping of animals, or a zoonosis or any other conditions which may pose a serious risk to human or animal health, or

2) party comes from an area where there is a suspicion or an outbreak of serious infectious diseases in humans or animals.





(2). Food the region may decide that paragraph 1, nr. 2, does not apply to foods that are heat treated in hermetically sealed container to an F0 value of 3.00 (preserved).

(3). Food region lays down the procedures for the destruction, including the documentation submitted by the importer to submit.

(4). Destruction, as referred to in paragraph 1 shall be carried out under the supervision of food region.

(5). Costs in connection with the seizure, withdrawal and destruction of food is the responsibility of the importer.

(6). There are udpantningsret for the amount referred to in paragraph 5.

Chapter 3

Imports from third countries

§ 10. Food arriving from third countries, should be introduced into Denmark in places where there is created a border inspection post without prejudice. Annex 2, which is approved for the food.

(2). Foods that arrives at a border inspection post, must be subjected to veterinary checks at the border inspection post, before this food can be brought into the EU without prejudice. However, section 23.

§ 11. Foods should not be introduced or reintroduced from third countries to Denmark, unless they have been subjected to veterinary control at a border inspection post by trade area's external border.

(2). Foods covered by paragraph 1, which have not been subjected to the veterinary checks at the EU's external border, seized by food region. The importer required to return or destroy the party, see. § 19.

(3). Food originating in the third countries, which in Denmark are received in the course of trade, are covered by the provisions referred to in Chapter 2.

§ 12. Food shall on importation be accompanied by the original of the required documents that must contain the prescribed public and animal health certificates of the food concerned.

(2). The original of the accompanying documents must be delivered to the border veterinarian, who shall keep the documents at the border inspection post. Border veterinarian shall provide a certified copy of the document to the importer of the batch.

(3). Non-conformist foods must, however, always be accompanied by the original of the required documents after the veterinary checks carried out.

§ 13. The importer must to the border inspection post to send a copy of the notification (advance review), which must be done in accordance with art. 2 of the basic regulation. Annex III of regulation 139/2004 on the arrival of food to veterinary control.

(2). The notification referred to in paragraph 1 shall be carried out in the English version.

(3). The notification must be properly completed and without corrections.

(4). Limit the veterinarian or the person responsible for the party sends CVED'et (veterinary certificate) to the Customs authorities at the border inspection post after finishing veterinary control, see. art. 3 (3) of Regulation No 136/2004. For consignments under customs control must be applied to the reference to the certificate of veterinary checks Customs document.

§ 14. Brokers, airlines, shipping companies, courier companies linieagenter m.v. must submit the cargo contents (cargomanifest) to the border inspection post of any aircraft or ship that lands in or visiting Denmark. This is true regardless of whether the cargo or any part thereof shall remain on board, trans-shipped, stored, imported or siteres. The message, which must be designed in such a way that the plane's respectively, the ship's identity and product categories is clear, the border inspection post must be received before the aircraft or the ship's estimated time of arrival.

(2). Foods in the cargo referred to in paragraph 1 shall be subject to prior notification, see. § 13, unless they will be aboard.

§ 15. Ports and airports, where there are established border inspection post shall forward lists of ships or aircraft estimated time of arrival at the border inspection post. The lists shall contain the names of vessels or aircraft, route numbers and information on what port or airport they arrive from.

§ 16. The food at the border inspection post must be subjected to veterinary checks referred to in article 6. the specified control frequencies in annex 3 or in accordance with the arrangements made by the veterinary and Food Administration.

§ 17. Foods that are in transport in international traffic arriving from third countries, and which is intended for consumption by the crew and passengers, must not be subjected to veterinary checks, if they are not brought into Denmark.

(2). Foods covered by paragraph 1 of its one-off packaging, which are removed from the means of transport referred to in paragraph 1, must be destroyed.

(3). Foods covered by paragraph 1, may, however, upon prior authorization by the border veterinarian, is transferred directly from a ship or aircraft in international traffic to another in the same port or airport on condition that the transfer is made under seal, and that such foods have origins either in partner countries or in third countries or parts of third countries, which are approved by the EU in animal health goal.

(4). Destruction, as referred to in paragraph 2 shall be carried out under the supervision of food region.

(5). Costs in connection with the seizure, withdrawal and destruction of foodstuffs referred to in paragraph 2 shall be the responsibility of the importer.

(6). There are udpantningsret for the amount referred to in paragraph 5.

§ 18. Suspected that the current legislation has not been complied with, the border veterinarian is to carry out checks, including verification of suspected means of transport.

(2). If the border veterinarian has sampled on the basis of suspicion, it comes under the bracket at the border inspection post or, if this is not possible, on a border veterinarian designated store, which is located in the same food region by the border inspection post.
(3). If veterinary checks is a health risk or serious or repeated error, can cross veterinarian is to carry out tighter controls of subsequent batches of food with the same origin. Border veterinarian puts such parties under the bracket. To cover inspection costs associated with tighter controls will be charged a deposit.

§ 19. If food in a party does not comply with applicable provisions or non-veterinary control, seizing grænsedyrlægenpartiet. Cross the vet decides that the party cannot be imported. Border veterinarian give the importer an injunction that





1) party returned within a period of not more than 60 days,

2) party rendered into pet food or fur animals, within a set time limit, or

3) the party must be destroyed within a prescribed time frame.





(2). If it referred to in paragraph 1, the party has left the border inspection post, seized the food region, in whose territory the party finds itself, the party and decides that the party does not need to be translated. Food region provides injunctive relief as referred to in paragraph 1.

(3). Border veterinarian respectively food region lays down the procedures for the return, reprocessing and disposal, including the documentation submitted by the importer to submit.

(4). Return is conditional on the border veterinarian respectively food region approves an authorization to return the party to which the importer has obtained from the competent authority of the third country to which the party wanted returned. Authorisation from the competent authority of the third country shall contain a specific description of the of the importer reported rejection reason.

(5). The return referred to in paragraph 1 shall come from the border inspection post where the food was presented for veterinary checks and with the same type of transport. The return in accordance with paragraph 2 shall come from the nearest border inspection post approved for the control of the food concerned.

(6). If the return or reprocessing for pet food or fur animals is not possible, or if the border veterinarian respectively food region required time limit is exceeded, or if the importer gives his immediate consent, the lot must be destroyed.

(7). Destruction, as referred to in paragraph 1, no. 3, and (6) shall be done under the supervision of the border veterinarian food region, respectively.

(8). Costs in connection with the seizure, revocation, return, reprocessing and the destruction of foodstuffs is the responsibility of the importer.

(9). There are udpantningsret for the amount referred to in paragraph 8.

§ 20. If a party food can pose a risk to human or animal health, seized by the border veterinarian party and shall decide on the destruction within a prescribed time frame.

(2). If it referred to in paragraph 1, the party has left the border inspection post, seized the food region, in whose territory the party finds itself, the party and decides that the party must be destroyed, including any parts of the lot in downstream.

(3). Border veterinarian respectively food region lays down the procedures for the destruction, including the documentation submitted by the importer to submit.

(4). Destruction, as referred to in paragraph 1 shall be carried out under the supervision of the border veterinarian food region, respectively.

(5). Costs in connection with the seizure, withdrawal and destruction of foodstuffs is the responsibility of the importer.

(6). There are udpantningsret for the amount referred to in paragraph 5.

(7). For foods which have been found to have a content of residues of certain substances whose use is prohibited or not authorised, of MRPL, see. Commission decision 2002/657/EC, as amended, should limit the veterinarian by derogation from paragraph 1, decide that the party can be returned or destroyed under section 19.

§ 21. A batch of food must first be imported or reimported from third countries, tran siteres, entering or leaving a warehouse as covered by section 39 when the importer has paid the costs in connection with veterinary checks in accordance with the applicable tariffs or made the necessary security for the payment of these.

Chapter 4

Import for free circulation of conformist foods originating in third countries

§ 22. Import for free circulation of foods originating in third countries shall be carried out in the conditions laid down in annex 4.

§ 23. Of foods covered by this chapter, as by plane or ship arrives at an airport or port at which created a border inspection post, the veterinary check could await the arrival of food to the final border inspection post, on condition that:





1) there is a border inspection post of destination port of destination, respectively, who are authorized to check the food concerned,

2) consignment transported by air respectively by sea directly to the place of destination, and

3) party are transported without reloading.





(2). The party, however, can be transshipped directly from one aircraft to another or directly from one vessel to another vessel within the same airport or port range, if the importer shall inform the border veterinarian of this fact prior to the operation.

(3). Border veterinarian can, if there can be danger to public or animal health, carry out documentary checks of parties that trans-shipped either directly or after being unloaded in no more than 12 hours for 7 days respectively for air freight shipping freight.

(4). Border veterinarian shall carry out documentary checks of parties, as in the case of trans-shipment is unloaded for a longer period of time than indicated in paragraph 3. If there can be danger to public or animal health, the border veterinarian is to carry out identity and physical checks of these parties.

(5). Border veterinarian must complete the veterinary control of parties, as in the case of trans-shipment has been unloaded in over 48 hours for air freight, respectively, 20 days for shipping freight.

(6). The importer must inform the border inspection post, when to be carried out in accordance with paragraphs 3, 4 or 5 of the basic regulation. § 13.

Chapter 5

Import of non-harmonised food originating in third countries

§ 24. Import of non-harmonised food originating in third countries shall be carried out in the conditions laid down in annex 5.

(2). Imports of other non-harmonised food than those listed in annex 5, shall take place only after prior permission of the veterinary and Food Administration. Application must be forwarded to the food region, where the importer is located.

Chapter 6

Transit and storage of non-conformist foods originating in third countries

§ 25. Non-compliant foods may not be imported for free circulation in Denmark.

section 26. Non-compliant foods may tran siteres to another third country or to the same third country if:





1) foodstuffs originating in and shipped from a third country or part of a third country, which has been approved by the EU in animal health goal. Meat products must, however, also be subject to the EU statutory minimum treatment provided for in respect of the third country in question, see. Annex 13.

2) food upon arrival in the EU is accompanied by it at any time by the EUROPEAN UNION provided for the certificate to be used for transit and storage.

3) prior permission has been obtained from the border veterinarian at the border inspection post at which the food is presented for veterinary inspection.





(2). A permission, see. (1) is subject to the condition that the person responsible for the transit of food writing to the border veterinarian declares that food leaves the trade area within 30 days, as well as to the food in the event of rejection is not returned to circulation in the trade area but searches returned to a third country. If return to a third country is not made within 60 days, foods are destroyed.

(3). Foods covered by paragraph 1 shall, notwithstanding section 16, only be subjected to documentary and identity checks at the border inspection post. If there can be danger to public or animal health, or if there is a suspicion of irregularities, the border veterinarian in addition submit food physical control.

(4). Transit must be carried in a means of transport, without intermediate reloading, or a container, which is waterproof, identified and sealed so that the seal is broken, as soon as the means of transport opens. Food should not be unloaded, split or be handled after the border veterinarian has sealed transport.

(5). Foods covered by paragraph 1 may only be placed out of the trading range in places where there is created a border inspection post, where they must be subjected to documentary and identity checks before export.

(6). Notwithstanding paragraph 5, the food is transferred directly to destruction after the prior consent of the border veterinarian at the border inspection post of entry. Destruction must take place under the supervision of food region.

(7). Costs in connection with the seizure, withdrawal and destruction of foodstuffs referred to in paragraph 6 shall be the responsibility of the importer.

(8). There are udpantningsret for the amount referred to in paragraph 7.

(9). Non-conformist food arriving at a border inspection post for export to a third country, must be accompanied by a veterinary certificate issued at the border inspection post of entry, as well as the original of the specified document.
Paragraph 10. The person responsible for transit must, prior to arrival, inform the border inspection post of food desired done, about the arrival of food to control.

§ 27. Non-conformist food must be stored in a warehouse in a free zone, a customs warehouse or a skibsprovianterings undertaking with a view to the subsequent restløs export from the trading area, or be transported directly from the border inspection post for consumption by people in ships engaged on international voyages outside of the trade area, if:





1) foodstuffs originating in and shipped from a third country or part of a third country, which has been approved by the EU in animal health goal. Meat products must, however, also be subject to the EU statutory minimum treatment provided for in respect of the third country in question, see. Annex 13.

2) food upon arrival in the EU is accompanied by it at any time by the EUROPEAN UNION provided for the certificate to be used for transit and storage.

3) prior permission has been obtained for storage transport respectively from the border veterinarian at the border inspection post at which the food is presented for veterinary inspection. Permission for storage are subject to the condition that the person responsible for the party opposite the border veterinarian furnishes proof that the food region, in whose territory the destination store is located, does not oppose that the foods stored.





(2). For food products covered by paragraph 1, which are due to arrive for storage in Denmark from another trading country, obtained the authorization referred to in paragraph 1 from the border veterinarian of the border inspection post referred to in article 6. Annex 2, which is located closest to the warehouse, where the food is to be stored.

(3). Food Agency sets out requirements for the certification of non-harmonised food products, for which import conditions are not listed in annex 5.

(4). Foods covered by paragraph 1, it shall, notwithstanding section 16, only be subjected to documentary and identity checks at the border inspection post at which the food is presented for veterinary inspection. If there can be danger to public or animal health shall limit the veterinarian also submit food physical control.

(5). For non-conforming foodstuffs which are to be transported to or from a warehouse, or to be transported directly from the border inspection post to a ship, see. (1) the following conditions apply in addition to the established in the given permission:





1) the transport of foodstuffs shall be carried in a means of transport, without intermediate reloading, or a container, which is waterproof, identified and sealed so that the seal is broken, as soon as the means of transport or container is opened.

2) foodstuffs must be accompanied by the original of the required documents or an authenticated copy thereof delivered for each part.

3) foodstuffs must only enter a warehouse where food region has undergone food documentary and identity checks. If there can be danger to public or animal health shall also submit the food food region physical control.

4) food shall be placed in the reserved rooms or lockable section, see. section 40 (2) and (3).

5) food shall not be subject to any other handling, than what is necessary for storage and for the Division of the party itself in less sublots without removal of packaging.





(6). The person responsible for the store in a customs warehouse or free zone, skibsprovianterings undertaking shall ensure that each unit of stored food products covered by paragraph 1 shall be clearly and legibly marked with the entry number of the veterinary certificate that accompanied the party to the repository, so the identification of every unit in the party is possible.

(7). If a consignment of foodstuffs covered by paragraph 1 during storage can be divided into two or more parties, the owner of the lot before removal fill in a prior notification, see. section 13, for each of the new parties for the purpose of issuing daughter-veterinary certificates. If the party to be kept out of the trade area, the owner of the Party shall indicate on the ex-ante notification, from which food leaves the EU border inspection post.

section 28. Non-conformist foods, which are stored in a warehouse in a free zone or a customs warehouse may be removed for the purpose of transferring to a skibsprovianterings company or export to a third country. Transfer to skibsprovianterings activities shall be carried out on the basis of a T1 transit procedure in accordance with the customs rules.

(2). Removal of non-compliant food from a warehouse in a free zone or a customs warehouse for storage in a skibsprovianterings company is subject to the condition that the owner of the lot of food the region presents evidence that the food region, in whose territory the undertaking is situated, skibsprovianterings does not oppose that the foods stored.

(3). Removal of non-compliant food from a warehouse in a free zone or a customs warehouse with a view to exports from the trade area must be made only after prior permission from food region at the store. Food may only be placed out of the trading range in places where there is created a border inspection post, where they must be subjected to documentary and identity checks before export.

(4). The responsible party must notify, in accordance with article 3. § 13, the border inspection post where the food is done, about the arrival of desired foods to control.

(5). Non-conformist foods, which are stored in a skibsprovianterings company, may only be removed for export for consumption by people in ships engaged on international voyages outside of the trade area possibly after temporary storage in specially approved victualling warehouses in the port where the ship is carried out as victualling supplies.

(6). Non-compliant foods may only be removed from a warehouse in a free zone, a customs warehouse or a skibsprovianterings undertaking whose food region has undergone food documentary and identity checks. If there can be a risk to public or animal health, or if there is a suspicion of irregularities, must also submit region food food physical control.

(7). Removal according to paragraphs 1 to 3 and 5 shall take place without transshipment in a means of transport or a container, which is waterproof, identified and sealed so that the seal is broken, as soon as the means of transport or container is opened. Foodstuffs must be accompanied by the original of the required documents or delivered for each part of an authenticated copy thereof.

(8). Notwithstanding paragraph 1 and 5 can decrease after prior denaturation happen for destruction. Destruction must take place under the supervision of Food region.

(9). Costs in connection with the destruction of foodstuffs in accordance with paragraph 3 and 8 is the responsibility of the importer.

section 29. Non-conformist foods shall at all times be accompanied by a veterinary certificate, see. However, paragraph 2. Veterinary certificate must refer to the Customs document.

(2). Non-conformist foods that are removed from a skibsprovianterings company for export for consumption by people in ships engaged on international voyages outside of the trade area, however, must be accompanied by a certificate, see victualling. the model in annex 6, which shall be issued by food region by the decrease. This is true even though the food is subsequently stored temporarily in a special approved victualling warehouse, see. section 28, paragraph 5.

(3). Non-conformist foods, which are transported directly from the border inspection post to a ship for the purpose of consumption by individuals in ships engaged on international voyages outside the trading area, shall be accompanied by a veterinary certificate as well as a victualling certificate. Both certificates are issued at the border inspection post.

(4). Immediately after that a consignment non-conforming foodstuffs have been delivered aboard a ship, the master or his representative date and countersign the victualling certificate, see. paragraphs 2 and 3, which accompany the consignment, and returning the certificate to the countersigned food region, which has issued the certificate. The master counter-sign is not necessary if the certificate is already countersigned by a representative of the competent authority of the port where as victualling supplies takes place.

section 30. Means of transport and containers, which have been used for the transport or storage of food, provided for in this chapter shall be thoroughly cleaned and disinfected before they can be used again for the transport or storage of foods.

Chapter 7

The transport of food products from third countries to third countries by means of transport as between lands in or visiting Denmark

section 31. Means of transport with food transported from third countries to third countries may only between countries in or enter Denmark, if:





1) There is created a border inspection post, which is approved to control food.
2) foodstuffs originating in and shipped from a third country or part of a third country, which has been approved by the EU in animal health goal. Meat products must, however, also be subject to the EU statutory minimum treatment provided for in respect of the third country in question, see. Annex 13.

3) food upon arrival in the EU is accompanied by it at any time by the EUROPEAN UNION provided for the certificate to be used for transit and storage.

4) prior permission has been obtained from the border veterinarian at the border inspection post where the means of transport between lands in or visiting Denmark.





(2). A permission, see. (1) is subject to the condition that the person responsible for the transport of the party in writing to the border veterinarian declares that food leaves the trade area within 30 days, as well as to the food in the event of rejection is not returned to circulation in the trade area but searches returned to a third country. If return to a third country is not made within 60 days, foods are destroyed.

(3). If the lot is transferred directly from one aircraft to another or directly from one vessel to another vessel within the same airport or port area shall be the person responsible for the transport shall inform the border veterinarian of this fact prior to the operation.

(4). Border veterinarian can, if there can be danger to public or animal health, carry out documentary checks of parties that trans-shipped either directly or after being unloaded in no more than 12 hours for 7 days respectively for air freight shipping freight.

(5). Border veterinarian shall carry out documentary checks of parties, as in the case of trans-shipment is unloaded for a longer period of time than indicated in paragraph 4. If there can be danger to public or animal health, the border veterinarian is to carry out identity and physical checks of these parties.

(6). Border veterinarian must complete the veterinary control of parties, as in the case of trans-shipment has been unloaded in over 48 hours for air freight, respectively, 20 days for shipping freight.

(7). The responsible party must inform the border inspection post, when to be carried out in accordance with paragraphs 4, 5 or 6.

(8). Costs in connection with the destruction of foodstuffs in accordance with paragraph 2 shall be the responsibility of the importer.

(9). There are udpantningsret for the amount referred to in paragraph 8.

Paragraph 10. This chapter does not concern the non-conformist food imported from third countries with a view to exports to consumption by people in ships engaged on international voyages outside the trading area. Such foods are subject to the provisions of Chapter 6.

Chapter 8

Return

section 32. Application for permit to fly food to veterinary control with a view to re-import from third countries must be carried out on a form conforming to the model in annex 7. The responsible party must ensure that all boxes on the form is being filled out before it is forwarded to the border veterinarian at the border inspection post of food desired reintroduced.

(2). Authorisation in accordance with paragraph 1 shall be granted on the basis of





1) an assessment of the animal health situation in the countries where the food has been transported or stored,

2) original, one of the third country authority or a certified copy of the issuing food region certified copy of the export certificate, which accompanied the foodstuffs were exported,

3) a statement of the third country authority to guarantee that the conditions governing the storage and transportation have been complied with, and in which it is clarified that the rejected foods have not been handled, as well as for the Authority rejected the parties the reasons for the refusal, and

4) do not sealed containers, a certificate from the hjemtransport undertaking that the content has not been handled or unloaded.





(3). (2). 3, shall not apply to the repatriation during transport, where the content has not been handled or unloaded.

§ 34. Border veterinarian determines on the basis of the veterinary checks whether there can be given permission to return.

(2). Authorization is subject to the condition that the person responsible for the party opposite the border veterinarian furnishes proof that the food region where the destination is located does not oppose that the foods stored.

(3). Border veterinarian shall determine the terms and conditions of the permission including that the food be transported directly to destination without intermediate reloading in a means of transport or in a container, which is waterproof, identified and sealed by the border veterinarian in such a way that the seal is broken, as soon as the means of transport or container is opened.

section 35. sections 32-34 also applies to return to another trade country via Denmark. The in section 34 (2) of the aforementioned documentation must, however, be obtained from the competent authority of the country in which the party sought trade restored.

(2). Permission to return to another trade country via Denmark is conditional on the owner of the lot have been ordered, to receive the country's competent authority has notified the border veterinarian in writing consent to reimportation.

(3). Returning from a third country to Denmark via another trade country of a party food should be made only after the prior consent of the food region where receive plant is located.

(4). Application for authorisation in accordance with paragraph 3 shall be carried out on a form conforming to the model in annex 7. The application shall be supplemented by an indication of the border inspection post at which the party sought was introduced. The responsible party must ensure that all boxes on the form be filled in before this communicated.

§ 36. Returning from a trading country to Denmark by a party foods may be made only after the prior consent of the food region, in whose territory the undertaking which reintroduces the lot, is located.

(2). Application for permit to reinstate food must be on a form conforming to the model in annex 7. The responsible party must ensure that all boxes on the form be filled in before this communicated.

(3). Authorization is subject to the condition that the person responsible for the consignment of food the region presents evidence that the food region, in whose territory the recipient undertaking is located, does not oppose that the foods stored.

(4). Food, as food the region has allowed the reintroduction to prior notification of the food the region by the receiving company, the food is reintroduced to. Prior notification shall be food region later than one business day (Monday – Friday) before the party's estimated time of arrival and shall indicate the expected arrival date and time. Prior notification shall be attached to the copy of the authorisation granted in accordance with paragraph 1.

(5). The responsible party must ensure that submitted a report made to return control of foodstuffs on the recipient undertaking. The report shall be sent to the region, which receive food establishment.

(6). The food referred to in paragraph 1 may not be used or transferred before food the region has given permission to do so.

Chapter 9

Privates imports

section 37. Privates imports of food products from other partner countries or San Marino can, notwithstanding the fact that the recipient is not registered, take place without permission and without quantity limitation and is exempted from the provisions of Chapter 2, when the following conditions are met:





1) food imported into own baggage in connection with entry or in close association with entry or received as packages.

2) foodstuffs intended for their own use.





(2). Paragraph 1 shall not apply to partner countries which have imposed restrictions as a result of suspicion or certainty to exposures to public or animal health.

(3). Meat and meat products and milk and milk products imported to Denmark directly from a third country, without prejudice. the conditions laid down in Regulation No 40/94. 745/2004, art. 1, paragraphs 2-3, and therefore not exempt from the rules set out in Chapter 3, however not prior notification in accordance with the rules laid down in section 13. To be in place no later than the working day (Monday-Friday) before the expected arrival in writing upon request time for inspection at a border inspection post without prejudice. Annex 2.

(4). Privates food imports from third countries in accordance with Regulation No 2377/90. 136/2004, art. 8, are exempted from the provisions concerning prior notification and veterinary checks in sections 10-13 and 16 if the food imported into own baggage in connection with entry or in close association with entry or received as packets sent from a third country.

(5). Privates food imports from third countries must not be from third countries which have introduced restrictions because of suspicion or certainty to exposures to public or animal health.

(6). Import in accordance with paragraphs 3 and 4 from the Faroe Islands or Greenland might happen as simulcast to several people at one address is allowed, if





1) the consignment is accompanied by a list, of which the names and addresses of all the recipients of the shipment food clear

2) the shipment is divided into single packets on each a maximum of 5 kg,

(7). Import in accordance with paragraphs 3 and 4 from the Faroe Islands or Greenland can be made through an association, if





1) shipment is divided into single packets on each a maximum of 5 kg,

2) the Association shall supply intact single packages, see. Nr. 1, to registered members of the Association,

3) the Association does not receive payment for extradition after nr. 2,

4) processing after importation only happens with the final beneficiary,

5) the food is intended for their own use,

6) each Member receives a maximum of 5 kg of consignment,

7) Association reviewed the activity to the food region, where the Association is located,

8) the Association continuously detects the quantities for each imported consignment is conveyed to every Member,

9) Association on request present it in no. 8 referred to registration, and

10) the Association shall report for each quarter in accordance with the registration No. 8 for the food region, where the Association is located. Notification must be made within the 10. in the following month.





(8). Imports into Denmark directly from a third country to private use of foods that cannot be imported after the other pieces in this article, may only be made after prior permission from food region. Paragraph 3 shall apply mutatis mutandis.

(9). Foods to be introduced in accordance with this article, can be taken for veterinary control.

Paragraph 10. Foods that must be destroyed in accordance with art. 4 of Regulation No 40/94. 745/2004, must be destroyed in accordance with § 9 section 20 respectively.

Paragraph 11. Costs in connection with the seizure and destruction of foodstuffs is the responsibility of the importing food.

Paragraph 12. There are udpantningsret for the amount referred to in paragraph 11.

Paragraph 13. Providers of international passenger services, as well as airports and ports to be on one for customers, respectively. passengers visible place hang the posters, which informs about the contents of this article, and which they will receive food region. Chapter 10

Samples, etc.

section 38. Imports of foods originating in the other partner countries, as a sample for analysis, use for viewing at exhibitions and use of embassies in Denmark may, notwithstanding that the recipient is not registered and the food not health or identification tagged, be done without permission and without quantity limitation.

(2). Paragraph 1 shall not apply to partner countries which have imposed restrictions as a result of suspicion or certainty to exposures to public or animal health.

(3). Imports of food products from third countries as a sample for analysis, use for viewing at exhibitions and use of embassies in Denmark may only occur after prior authorization by the food region, in whose territory the company which receives the item sample is located. The authorization is subject to the condition that the person responsible for the party can demonstrate that the food in question originate in third countries or parts of third countries, which are approved by the EU in animal health goal or originate in Greenland, the Faroe Islands or Iceland. Foods that have undergone a heat treatment in a hermetically sealed container to an F0 value of 3.00 (preserved), as well as honey, can be admitted from all third countries. Permission may be given notwithstanding that the recipient is not registered and the food not health or identification-labelled.

(4). Authorisation in accordance with paragraph 3 cannot be given for food from third countries, which have introduced restrictions because of suspicion or certainty to exposures to public or animal health.

(5). Authorisation in accordance with paragraph 3 shall be granted in accordance with no. 1-3, those conditions.





1) Product sample shall be used solely for the stated purpose and will not be put into circulation or dispensed, since the distribution of samples on the spot, however, is allowed.

2) Packaging and remnants of the trade test, except for the parts that are used in the analysis, must be destroyed or returned, without prejudice. § 19, paragraphs 3-4 and 6-9.

3) Objects, which have been in contact with the product sample, and their surroundings should be thoroughly cleaned and disinfected.





(6). In the case of an application in accordance with paragraph 3 on food imports not originating in third countries or parts of third countries, which are approved by the EU in animal health goal, or not originating in the Faroe Islands, Greenland, or Iceland is conditional permission of veterinary and Food Administration assessment of the animal health situation of the third country concerned.

(7). Imports into Denmark in accordance with paragraph 3 or paragraph 6 samples via another trade country may, however, happen after prior authorization by the food region, in whose territory the company which receives the item sample is located. The owner of the trade test, together with the application to food region in writing declare themselves responsible for the in paragraph 5, no. 1-3 listed conditions are complied with.

Chapter 11

Veterinary appointment of customs warehouses, etc.

§ 39. Companies, which are used as storage in a customs warehouse, free zone, skibsprovianterings company and specifically authorised victualling warehouses must be designated by the veterinary and Food Administration, before there must be stored non-conformist foods. The veterinary appointment includes only the foods covered by Customs authorization.

(2). Request for designation in accordance with paragraph 1 shall be sent to the region on a schema, see Food. the model set out in annex 8. The request must be accompanied by a copy of the authorization from the Customs and tax authorities.

(3). The request must be accompanied by evidence that there is a room of adequate size at the disposal of the staff responsible for carrying out veterinary checks. The room must be reserved for this staff.

§ 40. Owners of those in § 39, paragraph 1, companies must ensure that room, as stated in § 39, paragraph 3, as a minimum, contain:





1) a telephone,

2) a fax,

3) a computer for the reception and sending of the TRACES messages, and

4) other appropriate office facilities.





(2). Warehouses in free zones, customs warehouses and skibsprovianterings companies, who shall be appointed by the Food Agency for the storage of non-conformist foods must have separate storage rooms are reserved for non-conformist foods.

(3). Warehouses in free zones, customs warehouses and skibsprovianterings companies, as designated by the Food Agency before 1. January 2000, must as a minimum have lockable section for the storage of non-conformist foods. Stocks, which make significant architectural changes, must be appointed and must comply with the conditions laid down in paragraph 2.

(4). Owners of companies, who is appointed pursuant to section 39, paragraph 1 shall keep a daily register of food products to or removed from inventory. The register, which must be kept in the warehouse for at least 5 years, shall as a minimum contain the following information:





1) For food supplied to the store:





(a)) date of food supply to the store,

(b) the nature of the food),

(c) the quantity of the food) in kg/litre,

(d) the country of origin),

(e) the border inspection post of entry), and

f) serial number of the veterinary certificate that accompanied the food at the warehouse.





2) For foods that are removed from the repository:





(a)) date of removal from the warehouse, food

b) food art,

c) food quantity in kg/litre, and

d) serial number of the veterinary certificate or victualling certificate accompanying the food from the store.





3) For foods that are removed from the warehouse for export to a third country, also the name of the country of destination and border inspection post of exit.

4) For foods that are removed from the warehouse for the purpose of transferring to a skibsprovianterings company, moreover, the reference number and the name and address of the skibsprovianterings company.

5) For foods that are removed from the warehouse for export for consumption by persons on ships engaged on international voyages outside of the trade area, also the name of the destination vessel.

6) For foods that are removed from the warehouse for the purpose of destruction, as well as the name and address of the rendering or incineration facility.





§ 41. Food agency may amend or withdraw the designation of warehouses in free zones, customs warehouses, skibsprovianterings companies and specifically authorised victualling warehouses.

Chapter 12

Sealing

§ 42. Food of the region, including the border veterinarian, sealing of transport vehicles or batches of animal foods, may be broken only by food region or the competent authority of another trade country.

(2). Paragraph 1 shall also apply to the seals affixed in connection with veterinary checks carried out in the other partner countries, unless the food is released for free circulation.
(3). Paragraph 1 shall not apply to the parties, which, after the veterinary checks carried out by the trade sector, including for consumption by people in ships engaged on international voyages outside the trading area.

Chapter 13

Transition and derogations

section 43. Gelatin, which is made before the 1. June 2000, and which is not accompanied by the prescribed document, referred to in annex 4 shall be accompanied by a declaration signed by the competent authority of the country of origin, of which the origin and date of manufacture is evident.

(2). Collagen manufactured before 31 December 2001. December 2003, and which is not accompanied by the prescribed document, referred to in annex 4 shall be accompanied by a declaration signed by the competent authority of the country of origin, of which the origin and date of manufacture is evident.

§ 44. Food agency may exempt from the provisions of §§ 8-9, section 13, paragraphs 1-3, § 15, § § 19-20, § 32, §§ 34-36, section 38 and § 42.

(2). Food regions may grant derogations from the provisions of section 32, paragraph 2, no. 3.

Chapter 14

Criminal and commencement provisions, etc.

§ 45. With fine punished anyone who:





1) violates sections 3-6, § 8, paragraph 5-7, section 9, paragraph 4, article 10, article 11, paragraph 1, section 12, section 13, paragraphs 1-3, §§ 14-16, section 17, paragraph 2 or 4, article 19, paragraphs 4-7, section 20, paragraph 4, article 21, article 22, article 23, paragraph 2 or article 6, § 24, § 25, § 26 (1)-6 or 9-10, § 27, § 28, paragraphs 1 to 8, section 29, article 30, article 31, paragraphs 1 to 3 and 7, article 32, paragraph 1, article 33, article 34, paragraph 3 , § 35, § 36, § 37, paragraphs 1 to 8, 10 or 13, article 38, article 39, article 40, article 42, paragraphs 1-2, or section 43,

2) fails to comply with the injunction pursuant to section 7, paragraph 4, article 8, paragraphs 1 and 3, § 9, paragraph 1, article 11, paragraph 2, article 18, paragraphs 2-3, article 19, paragraphs 1 and 2, article 20, paragraphs 1-2 and 7, § 23, paragraphs 3-5, § 27, paragraph 4, section 31, paragraph 4-6, section 34 (1) or section 37, paragraph 13, or

3) overrides the terms laid down in pursuance of section 3: (2) section 7 (4), section 8 (1), 3-4 and 7, article 9, paragraphs 1 to 4, article 11, paragraph 2, article 17, paragraph 3, article 19, paragraphs 1 to 4, article 20, paragraphs 1 to 3 and 7, article 22, article 23, paragraphs 3-5, section 24, paragraph 2, section 26, paragraphs 1-2 or 6, § 27, paragraph 1, or 3-4, section 31, paragraph 1-2 or 4-6, article 32, paragraph 2 , article 34, paragraph 1 or 3, article 35, paragraph 3, article 36, paragraph 3 or 6, article 37, paragraph 13, article 38, paragraph 3, or 5-7, section 39 (1) or section 41.





(2). The penalty can rise to imprisonment for up to 2 years if the infringement was committed intentionally or with gross negligence, and if the infringement is





1) caused damage to the health or caused danger therefor, or

2) achieved or intentional obtained a financial benefit for the person himself or others, including savings.





(3). That can be imposed on companies, etc. (legal persons) criminal liability in accordance with the provisions of the criminal code 5. Chapter.

§ 46. Unless a higher penalty is inflicted upon the rest of the law is punishable by a fine anyone who violates the following rules of Commission Regulation (EC) no 1093/94 of 6. May 1994 laying down the conditions under which third-country fishing vessels can land their catches directly and allocate them in Community ports:





1) article 1,

2 article 3), or

3) article 4.





§ 47. Unless a higher penalty is inflicted upon the rest of the law is punishable by a fine anyone who violates the following rules of Commission Regulation (EC) No 999/2001 of 22. May 2001 laying down rules for the prevention, control and eradication of certain transmissible spongiform encephalopathies:





1) article 16, paragraph 2-3 and 5-6,

2 article 17), 2. subparagraph, or

3 article 18).





section 48. Unless a higher penalty is inflicted upon the rest of the law is punishable by a fine anyone who violates the following rules of Commission Regulation (EC) No 136/2004 of 22. January 2004 laying down procedures for the EC border inspection post of the veterinary checks on products from third countries:





1) article 1-5,

2) article 8, or

3) article 10.





§ 49. Unless a higher penalty is inflicted upon the rest of the law is punishable by a fine anyone who violates the following rules of Commission Regulation (EC) No 1782/2003. 745/2004 of 16. April 2004 on measures relating to imports of products of animal origin for personal consumption:





1) article 1, paragraph 2, and 3,

2 article 3), or

3) article 4.





§ 50. The notice shall enter into force on 16 September. August 2008.

(2). At the same time repealed Executive Order No. 771 of 15. July 2008 on veterinary checks on imports of food of animal origin.

Annex 4

Import conditions for harmonized food from third countries









GENERAL







This annex lays down the specific conditions, in addition to the General conditions in particular. art. 11 of Regulation 178/2002 shall apply to imports released for free circulation, of harmonised food from third countries.







Accompanying documents







Foods must be accompanied by the prescribed document at any time by the EUROPEAN UNION. In addition to the General requirements for accompanying document in Directive 2002/99, art. without prejudice to article 9. Annex IV and regulation 853/2004, art. 6 of the basic regulation. Regulation 854/2004, art. without prejudice to article 14. Annex VI, they must at all times by the EU provided specific requirements for accompanying documents, including health certificates, met.

Aquaculture animals and products thereof, shall also be accompanied by an animal health certificate in accordance with Directive 2006/88/EC.







Approved origin







Foods covered by this notice may only be imported from third countries, approved establishments referred to in article 6. Article 6 of regulation 853/2004. Approved third countries emerges from the third country lists in annex 9-20.

Gelatine and collagen must come from approved establishments in Malaysia, Pakistan, South Korea and Taiwan as well as third countries listed in annex 9. Dairy products included in the compound foods listed in annex 1, part II, nr. 2 and 3, must come from third countries appearing in annex 15 and from which imports are permitted.







General animal health rules







Food of animal origin may only be imported for free circulation, if they come from the production, processing and distribution, which comply with the following provisions, or if the equivalent animal health guarantees:







1)





Food business operators must ensure that there is no spread of diseases transmissible to animals in all stages of production, processing and distribution of food of animal origin.







2)





Food of animal origin must be obtained from animals which satisfy the animal health conditions laid down in the relevant Community rules.







3)





Food of animal origin must be obtained from animals:





 



(a))





coming from a farm, a business, an area or part of a territory, which are not subject to animal health restrictions for those animals and food, as determined in accordance with Annex i of Directive 2002/99/EC mentioned provisions.





 



(b))





that, as regards meat, and foods derived from it, does not come from animals which have been slaughtered in a slaughterhouse, where at the time of slaughter or during the production process were found animals infected with or suspected of being infected with one of the diseases covered in Annex i of Directive 2002/99/EC listed provisions, or carcasses or parts thereof of such animals unless this suspicion has been eliminated.





 



(c))





There, in the case of aquaculture animals and products, comply with the provisions of Directive 2006/88/EC.







Import for free circulation of aquaculture products which do not comply with the conditions laid down in point 2. 1-3, is possible if they fulfil the conditions laid down in Directive 2006/88/EC.







Humane killing







Meat of bovine animals, swine, sheep, goats, equidae and poultry kept as livestock and farmed rabbits and farmed game meat, including meat of farmed ratites, may be imported only if the accompanying health certificate is provided with an attestation to the effect that the meat comes from animals that have been slaughtered under conditions ensuring at least the same humane treatment as that provided for in Directive 93/119/EC of 22. December 1993 on the protection of animals at the time of slaughter or killing.







ENZYMES OF ANIMAL ORIGIN







Fully purified enzyme of animal origin may be imported from third countries. The enzyme must be accompanied by documentation which shows that the enzyme is fully purified.







AQUACULTURE ANIMALS AND AQUACULTURE PRODUCTS







Special conditions for the importation of fish products of aquaculture origin for human consumption







In the.





Processing of fish products of aquaculture origin of species which are susceptible to EHN, ISA, VHS and IHN, must take place in approved import centres unless: 1)





The fish has been cleaned before they were shipped to the EUROPEAN UNION, or





 



2)





health status of the place of origin of third country with regard to ISA, EHN, VHS and IHN are similar to health status at the place where they are to be processed.







II.





Batches of fish species susceptible to ISA or EHN must, in addition to the conditions set out in section i. in addition comply with the following conditions:





 



1)





The competent authority of the third country of origin should have recognized the place of origin as being free of those diseases in accordance with Community legislation or the relevant OIE standard,





 



2)





the fish should be cleaned before dispatch, or





 



3)





the consignment must be sent directly to an approved import Centre where the fish are further processed.







III.





Batches of fish species susceptible to VHS or IHN, imported into EU countries or zones in EU countries declared free of the diseases in question or have been the subject of an application in order to acquire the status of dom disease free, in addition to the conditions set out in section i. in addition comply with the following conditions:





 



1)





The competent authority of the third country of origin should have recognized the place of origin as being free of those diseases in accordance with Community legislation or the relevant OIE standard,





 



2)





the fish should be cleaned before dispatch, or





 



3)





the consignment must be sent directly to an approved import Centre where the fish are further processed.







Special conditions for the import of live bivalve molluscs and marine snails from aquaculture for human consumption







In the.





Consignments of mollusc species susceptible to one or more of the exotic diseases referred to in annex IV, part II of Directive 2006/88/EC, shall satisfy the following conditions:





 



1)
They must come from a place where there are no abnormal mortality without explanation, and that the competent authority of the third country of origin recognised as free of those diseases in accordance with Community legislation or the relevant OIE standard,





 



2)





they must be imported as processed or unprocessed products as defined in article 2 (1) of Regulation (EC) No 1782/2003. 854/2004, or





 



3)





they must be sent directly to an approved import Centre where the molluscs are further processed without prejudice. However, section VII of annex III of Regulation (EC) No 1782/2003. 853/2004 and article 6 of Regulation (EC) No 1782/2003. 854/2004.







II.





Consignments of mollusc species susceptible to infection with Marteilia refringens or Bonamia ostrea, and imported into the EU-countries or zones in EU countries declared free of the diseases in question or have been the subject of an application for the purpose of acquiring the disease-free status in accordance with Directive 2006/88/EC, shall satisfy the following conditions:





 



1)





The competent authority of the third country of origin should have recognized the place of origin as being free of those diseases in accordance with Community legislation or the relevant OIE standard,





 



2)





they must be imported as processed or unprocessed products as defined in article 2 (1) of Regulation (EC) No 1782/2003. 854/2004, or





 



3)





they must be sent directly to an approved import Centre where the molluscs are further processed without prejudice. However, section VII of annex III of Regulation (EC) No 1782/2003. 853/2004 and article 6 of Regulation (EC) No 1782/2003. 854/2004.







The conditions laid down in paragraph i. and II. shall not apply if the molluscs are packed and labelled ready for sale to the final consumer in accordance with Regulation (EC) No 1782/2003. 853/2004.







Special conditions for the import of live fish of aquaculture origin







1)





The fish must comply with the guarantees, including those for packaging and labelling and the appropriate specific additional requirements, as laid down in the animal health certificate, see. annexes II and III to decision 2003/858/EC and shall on importation be accompanied by this animal health certificate







2)





the fish should be transported under conditions that do not alter their health status, and







3)





the fish must be sent directly from the border inspection post where the fish were subjected to veterinary control, to an approved import Centre to be slaughtered and eviscerated.







Annex 5

The import requirements applicable to non-harmonized food from third countries









GENERAL







If there is no specified import conditions for a food, may import only occur after prior permission of the veterinary and Food Administration. Application must be forwarded via the food region, in the territory of which the importer is located. The food must not samhandles to other EU-countries, Norway or Andorra.







MEAT







Meat of marine mammals from Greenland







Meat of marine mammals from Greenland may only be introduced if the meat comes from animals which have been treated at one of the food agency approved wild game processing houses. The meat must be accompanied by a certificate, certified by the competent authority. The certificate shall contain the information contained in the health or identification mark for the item, as well as for frozen meat, a clear indication of month and year for refrigeration. It must be certified in the certificate that the exporting company is in compliance with the conditions for authorisation. The meat must not samhandles to other EU-countries, Norway or Andorra, unless the exporter submits a statement on the food the region from the veterinary authorities in the Member State concerned with a confirmation of receipt.







Meat from crocodiles







Fresh, chilled, frozen and deep-frozen meat including farmed crocodiles from third countries may be imported under the following conditions.







The meat must undergo veterinary border control on arrival in Denmark.







The meat must not samhandles to other EU-countries, Norway or Andorra, unless the exporter submits a statement on the food the region from the veterinary authorities in the Member State concerned with a confirmation of receipt.







The flesh shall on importation be accompanied by a health certificate, issued by the competent authorities of the country of origin and signed by an official veterinarian, stating the following information appears:







1)





The country of origin of the animals.







2)





One of the EUROPEAN UNION provided certification for humane slaughter.







3)





The meat comes from animals from breeding under official veterinary control.







4)





The animals are slaughtered and processed in establishments, which are authorized by the competent authorities and under their supervision.







5)





The animals have been subjected to veterinary ante-and post-mortem inspection, whereby the animals healthy and meat has been found fit for human consumption.







6)





The meat has been inspected and found free from Trichinella or have been freezing treated to ensure killing of any trichinae in accordance with the conditions laid down in annex I, chapter IX, point (C) of regulation 854/2004.







7)





The meat has been freezing treated to ensure killing of any tapeworms (Spiro metra erinacei) (min.-10  C in 24 hours).







8)





The meat has been examined and found free of salmonella. To be in the technique takes into account the possibility of detection of Salmonella Subgroup III with slow lactose fermentation by complementary use of Bismuth Sulphite Agar.
