Publication of pesticide residues in certain foodstuffs (fish, baby food, etc.) 1)

In accordance with paragraph 5 (2), Paragraph 1, section 49, paragraph. Paragraph 1, section 50 and section 60 (2). Three and four, in the law. 526 of 24. June 2005 on foodstuffs shall be fixed as follows :

Scope and demarcation

§ 1. The notice setting maximum levels for the permissible levels of certain pesticide residues in food as referred to in the Annexes is set out in the Annex. Section 3, paragraph 3. 1, no. Two and three.

Paragraph 2. The announcement shall also apply to food referred to in paragraph 1. 1 after incorporixture into a compound foodstuff, cf. Section 3, paragraph 3. 2.

Paragraph 3. Food is referred to as products. The announcement shall also apply to products referred to in paragraph 1. 1 after drying or processing, cf. Section 3, paragraph 3. 2.

Paragraph 4. The commuting shall also include products referred to in paragraph 1. 1, 2 and 3, which are intended for export to non-European countries. However, the publication does not apply to plant products, if it is shown that :

1) the country of destination requires this special treatment in order to prevent the introduction of harmful organisms in its territory ; or

2) treatment is necessary for the protection of products against harmful organisms during transport to the country of destination and during storage in this country.

Definition of pesticides and pesticide residues

§ 2. Pesticides shall be understood in the publication of the active substances, which are intended to :

1) protect plants or plant products against all harmful organisms, or to prevent such attacks,

2) influence the life processes of plants in a different way other than nutrition (e.g. growth regulators),

3) retain plants or plant products in so far as there are no special provisions concerning the use of such substances as additives, etc.,

4) destroy undesirable plants ;

5) destroy parts of plants, or

6) brake or prevent undesirable growth of plants.

Paragraph 2. For the purpose of pesticide residues, the residues of the active substances covered by paragraph 1 shall be taken into the same vein. 1, as well as the degradation and reaction products of active substances.

§ 3. Whether the content originate from a treatment or contamination, it is prohibited to sell :

1) Products that contain pesticide residues if the content exceeds the maximum levels set out in Annexes 1 or 2.

2) Products covered by it at all times in the case of processed child foods for infants and small children if they contain residues of pesticides in quantities exceeding 0,01 mg/kg, but see. paragraph 3 and paragraph 1. 4, of the product in question in the form ;

a) which are available for consumption, or

b) which are prepared according to the instructions given by the manufacturer.

3) Products covered by it at any time in the case of breast-milk substitutes and forceps for infants and small children if they contain residues of pesticides in quantities exceeding 0,01 mg/kg, but see. paragraph 3 and paragraph 1. 4, of the product in question in the form ;

a) which are available for consumption, or

b) which are prepared according to the instructions given by the manufacturer.

Paragraph 2. Where a specific MRLs are not provided for a product in either dried or processed state or a compound foodstuff, the maximum value specified shall be the maximum value specified in respect of the concentration or dilution of the product, the levels of pesticide residues due on the part of the treatment, and the relative content of the raw materials.

Paragraph 3. Notwithstanding the general limit of paragraph 1. 1, no. 2 (2) and (3) the specific maximum limits applicable to baby food and processed foodstuffs based on cerealis and breast-milk substitutions for infants and small children shall be used in Annex 2.

Paragraph 4. Notwithstanding the general limit of paragraph 1. 1, no. Article 3 (2) and (3) prohibiting the use of the pesticides specified in Annex 3 in agricultural products intended for the manufacture of baby food and processed products based on cereases and the manufacture of formula formula ; mixtures for infants and small children.

Penalty and effective provisions

§ 4. The penalty will be penalised by the penalty which violates section 3. Paragraph 1 or paragraph 1. 4.

Paragraph 2. The sentence may rise to a maximum sentence for two years if it has been committed by the action or omission, by means of a set or serious negligence, and the infringement is :

1) damage to health or to the detriment of such risks ; or

2) obtained or intended to benefit from the economic advantage of the person concerned himself or others.

Paragraph 3. Companies can be imposed on companies, etc. (legal persons) punishable by the rules of the penal code 5. Chapter.

§ 5. The announcement shall enter into force on 1. September 2008.

Paragraph 2. At the same time, notice No 186 of 19. March 2008 on pesticide residues in food.

1) Pesticides listed in this Annex, Schema 1, shall be deemed not to have been used if the residue concentrations do not exceed 0,003 mg/kg. This value, which is considered to be the limit of determination of the analytical methods, shall be reviewed periodically on the basis of technical progress.

Pesticide residues listed in this Annex, Schema 2, shall be deemed not to have been used if the residue concentrations do not exceed 0,003 mg/kg. This value shall be reviewed periodically in the light of data on environmental pollution.
